My name is Charlie and I am disabled. I live with chronic illness, I have a severe form of Psoriatic Arthritis and its crap! I am in pain all the time and always battling fatigue. BUT, I will not let it win. I love to learn and to laugh (even though it hurts my arthritic rib cage LOL). You will often see Ollie (she) my black Labrador. She is currently my trainee assistance dog! We are together, literally ALL the time.

have you been following over the past 5 years how many illegal immigrants are coming to this country?
And over the past 3 years since Home Office started using hotels, their goal was to put as many people on benefits as possible.
They give them refugees status cos they feel pressure to cut down the number of hotels.
The benefit system then get too expensive and they then start killing people by failing their assessm and then taking them to the tribunal.
all that stress there is for a reason.
It is the survival of the fittest.
Only people like refugees with no english single or with many children will survive as they get more sympathy from PIP people.

My son had a telephone PIP: I insisted beforehand that I wanted audio recording. They tried every which way to deter this, saying it would be problematic, cause delays, etc. Even on the day of the assessment, the assessor suggested that audio recording wasn't needed! This audio guarantees the answers CANNOT be twisted to reduce points. They have to send you a copy of the recording on a CD via a courier.

i WAS allowed the recording which i did BUT everything i said was twisted and changed and the total opposite of what i said! i don't agree with "lying" BUT when you are living with pain on a minute by minute basis and your gp won't see you you HAVE to do some thing which will end up with you taking more medication than necessary AND putting you in bed for the next day! i just don't see how a phone call assessment gives capit the ability to see you! now got legal advice because the mental and emotional stress this has caused me is off the charts. if you're feeling low and you have to go through this basis with a clown company then their objection to dismiss and ignore you takes you to a very dark place. so depressed i can't even function!

I was with my adult son when he had his assessment by an ATOS 'nurse'.
We were not allowed to record anything.
The assessment went well, but when we read the results of what she had written, it was all lies, lies, lies.
Nearly two years later, a tribunal in our local court trashed her assessment and the decision by the DWP, made a full award with no end date, and ordered the DWP to backdate the whole award to the date of the original application. These assessors and the DWP are liars, cheats, have no empathy, pity or sympathy and like their Tory order givers, corrupt to the level of criminality.

I was in exactly the same boat with lying assessor and ended up in court. The judge even silenced the DWP doctor’s attempts to twist everything in the department’s favour. The relief wasn’t at getting backdated payments, just putting right the attempted lies and deception. These people are pure evil.

Hi Charlie,I wanted to take a moment to express my deepest gratitude for the incredible support and guidance you've provided to individuals with disabilities and their families, especially as they navigate the complexities of the Personal Independence Payment (PIP). Following my brother's stroke, your support videos became a beacon of hope and information for us. Inspired by your insights, I was able to complete his PIP form accurately, leading to a successful outcome where he was granted the enhanced rate for both daily living and mobility components. This has provided him with the essential financial support he desperately needed.I am fully aware that without your invaluable advice and the compassionate effort you put into every piece of content, we would have found the process daunting, and the positive outcome might not have been possible. Your work truly makes a difference in people's lives, and for that, we are forever thankful. With love and best wishes,❤

Great advice here. You need to swallow any pride you have and no matter how much they dance around the question, don't give in to the pressure. I dont go to the shops, I never leave the house unless I'm with someone. And if nobody can come with me then I would have to rearrange the appointment. Same with can you make food, keep clean by showering etc. It sounds horrible and you don't want to come across as lazy or think this person must think I'm dirty. But at the end of the day no matter how bad it makes you feel stick to your truth! They are looking for anything to take points off you

This is so true. I had an assessment for arthritis. They started asking me if I had a dog. They try and trick you to see if you are more able than you actually are. I was waiting for him to then ask how do I walk it. Think he was disappointed that I told him I have a cat 😂, which I did. He then started asking me how far can I walk. He literally told me and gave me distances in metres. I do not know, I don’t measure the ground. He literally made me agree with him. Watch out for there indirect questions. They are horrible 😢.

When "someone" asks you a question about breathlessness, angina, worries, etc. Tell them how you are on your worst day, no need to make things up or say that sometimes I feel better and can do something that on a bad day you can't.

Massively. I have my video assessment in 2 weeks. I'm struggling. This is my 4th attempt. I had it. They took it away. My GP tells me I shdnt work and be in pip, my previous psychologist tells me the same, my OT tells me the same. I really believed them when they said I can do all these things. I thought it was me being lazy, depressed and just needed to get on with it. I go out, get a job, am off sick loads and within a year have another heart attack. I've never had the mental strength to appeal and like I said just believed it was me. I had another heart attack this Dec, I'm 46 now and have been having heart attacks since I was 33 with a cardiac arrest at 34 which I was dead for 9 mins. Left me with brain damage which no one told me for another 9 years. I suffer agoraphobia, social anxiety, memory issues, panic attacks, chronic pain, on top of brain injury. All noted. I miss appointments, don't attend. Have still to do my cardiac rehab as have not left my home since Dec. I'm a tad worried I may loose my temper or it may cause a panic attack as they are a trigger to me. Oooooof even just typing this makes me shaky so going to stop and take 5 and ground myself. Sorry I'm babbling and can't seem to stop.

Just follow Charlie's advice and teachings, and you will likely be OK ... put it into your mind from the outset that the whole process is 1. Apply 2. Mandatory Reconsideration 3. Tribunal.... if you get the right points awarded sooner ... so be it.... you got a shortcut ... woohoo.. you join the club of the very few...
If you expect the rejections, the lies, and the trickery.... if you put it into your mindset that it WILL happen.... then it doesn't hurt so much when they do it... the application / review is only step 1.
      Good Luck

If it's people causing your agoraphobia (wouldn't blame you) then getting up earlier to go out and about when few are up may help. By the sound of your plight you need more than just a bit of assistance and I hope you're assessment is viewed by someone with compassion. Be Lucky 👍

And no I felt demoralised hurt and vowed I’d never ever put myself through such a degrading experience !! Hi Charlie, I was on High Mobility low Care when I was on D. L. A. when the time came to change to Pip I filled the form in, when I got to the MOBILITY section, as you say, there's 2 questions, 1 how far can you walk, 2 can you plan and follow a journey. Being of SOUND MIND, I can read a map and I can input details into a Sat Nav, I can follow those directions, so I answered YES. As you know, I was awarded STANDARD care AND standard Mobility. I asked for the decision to be looked at again, the letter came saying the decision was the same. I had absolutely no idea why the mobility was Standard until I went to see the Citizens Advice, it was explained to me that, it doesn't mean PLAN AND FOLLOW A JOURNEY as in getting from one place to another, it ACTUALLY means COULD YOU KNOW WHERE YOU ARE GOING, then ACTUALLY MAKE THAT JOURNEY, get on a bus or in a taxi, to make your way to that place. I was actually gobsmacked, it has NOTHING at all to do with MOBILITY, which, in my mind, THAT part of the question is a TRICK question, in a MOBILITY section. My question to you Charlie is, can I do anything about it, I often wonder how many more people FELL for the same trick question and lost their High Mobility.

But why do you lose points for that scenario??? The scenario shows that its not consistent that the person can go on his or her own? Shouldn’t the applicant be able to do this consistently??? If I’m bed bound 3 weeks and don’t go out at all, and then 2 weeks after that I can manage to come out and drive to my appointments, or pop into a local shop couple of times a week walking only very short distance, and only because I have no one else to take me, if I had I’d not drive myself. That doesn’t mean I can do it consistently and every and any time I need or have to.

Top marks.... you're correct.... if you can not do the task reliably safely and as often as reasonably required... the DWP criteria stipulates that you SHOULD be regarded as not able to do the task at all and awarded maximum points for the task.
BUT... here's the thing .... that is not how they will award points... they will give you zero points or 2 points because they badgered you with hypothetical situations and tricked you into giving a hypothetical answer, and THAT is what they will base the award on.
They do this and then send you the report with the statement ... "You told us you can plan and follow a joined unaided, so I have awarded zero points."... and you will think to yourself, 'I did say that' and give up.
They put all their eggs into one very fragile basket... they ignore their own guidelines and policies and award redecuded or zero points on the understanding that YOU, the applicant, does not know or understand the criteria, you will see this explanation on paper and not challenge it.
Charlie IS absolutely spot on by saying it is infinitely better not to let yourself get tricked in the first place... if you can't do a task, then you can't do it, don't answer hypothetical questions... if the answer is no, the answer is no... BUT they have had a lot more practice at this than you have, and if you do fall prey to this tactic, IT IS NOT the be-all and end all.. you can challenge the decision at Mandatory Reconsideration, pointing out that you cannot do the task safely, reliably, and as often as is reasonably required ... once they realise you understand the criteria, their basket of eggs falls apart, and they have no choice other than to award points fairly and accurately.

    • @Mrskess
      @Mrskess Месяц назад +6

@@Garuthius in this case, Is it worth showing to them that you are aware of the criteria and tell the assessor that when you do drive yourself to the appointment on rare occasions as you have to and nobody to take you, that this is not consistent, reliable and as reasonable required??
if I say I can’t do it at all, then this will be regarded as fraud, no? Because let’s say they decide to investigate and spy on me, on the rare occasion I will go to an appointment myself as I have nobody to take me there, and it does cause me a lot of distress which effects my nervous system which then means I’m again bed bound at the least for several days, and worse for 2/3 weeks.
Should the applicant during the interview always state that what they manage to do occasionally isn’t consistent and reliable?

It's not clear cut if you have severe anxiety or arthritis. People like us just don't fit the questions. I've not been able to with for a year now and prior to that was doing a job I loved that paid me way more than I will ever get with pip so obviously I should be getting support but it's very very very difficult to answer these questions when you live with a variable condition. ❤❤

I just wanted to let you and everyone else going through this nightmare process I think I might have just been awarded full enhanced daily living and mobility,
The reason I say think I have just had an amount of money hit my bank account with my national insurance number as its reference , no letter , no message, so I roughly calculated what it should be back dated to when I began the claim!
So PLEASE LISTEN TO EVERY WORD CHARLIE SAYS !!
I would not have come close if I hadn't watched and re watched all of the videos and made notes etc, I was really prepared for my video assessment, Charlie is exactly right in the above video the assessors come across as lovely but very sneaky, so you have to try and stay focused and don't let them confuse and trick you , my video assessment was only 13 days ago !
Just know where you are in the points and stick to it, but watch every single video that Charlie has made it is definitely worth it

      @Garuthius Месяц назад

@@Brit-jr-1988 I honestly wish I could say there is an easy answer here... Unfortunately with your given circumstances it would not be a straightforward road.
OK so, according to DWP's own criteria, from what you have described in your comment, It would appear at surface level you would be entitled to at least some degree of PIP. To get a full understanding of exactly what you are entitled to, you would need to seek a full evaluation (with someone like Charlie) (I'm not currently taking on any new cases other than emergencies). It really does come down to how limited and restricted you are by your symptoms and how much your lifestyle deviates away from a median lifestyle (we used to call it 'normal' but nobody likes to use the word normal any more.
The reason it becomes more complex is that, DWP / Central Government are on a drive at the moment to get as many people as possible off from long term benefits so you would have to fight tooth and nail to get anything out of them. They would tie you up in knots asking you questions about what you can and cannot do and use every aspect of your work, travel, lifestyle to try to refute your claim. It's not a 'personal' thing, they do this to everybody but they have more to argue with in your circumstances. If you are willing to put in the time and effort to watch all of Charlies videos and seek out as much help and advice as you can get from people who know the system, it is entirely possible that you could be awarded all that you are entitled to but it would most likely turn out to be a very long battle (as it does for most applicants to be honest). But your partner is right, you more than likely have some level of entitlement to PIP, so there is no point in 'not' applying, the only benefit your are GUARANTEED NOT to get, is the one that you do not apply for.
Again I don't know your circumstances, and if you have already looked into it or already in receipt. Again, from what you say in your comment it would also appear that you should be eligible for some level of Universal Credit with the LCW addition. That may also be something else for you to enquire into as you may be entitled to it and not receiving it because you have never asked to be evaluated for it.
Hope some of this helps and Good Luck.

Have to say my experience with PIP is both good and bad. I Have a large tumour on my spine which causes a lot of mobility issues. After my initial telephone conversation I received the lowest rate of PIP. I was told to contest this so got another telephone call. I told her my back had deteriorated because the treatment had caused a vertebrae to be crushed. I was informed she could only deal with the original case and could not take this new development into account. Anyway, she took me over the original claim and suggested some changes such as how far I can walk. Anyway, at the end, she informed me that I would be receiving approx. £40 extra a week plus she backdated it so I got another £800 plus with in 3 days. This only happened because of her obvious kindness and desire to help. Left to me I would still be on the lowest rate.

My uncle asked the assessor if the Pip lady wanted a cup of tea. Meanwhile my aunt was asked about her coordination. My uncle put the assessor cup of tea on a table and a few minutes later she said I better have my tea before it goes cold. Assessor is sat one side next to my aunt, uncle the other side further down. He removes the tea from the table and gestures towards the pip lady. My aunt then briefly takes the cup and passes it on a few inches to the assessor. That got her points lost as it showed she could hold and handle a hot drink.

It's easy to sit here and pick things to bits but the person being interviewed in this mock video should just say, "I usually go with my best friend but if they're not available I don't go to my appointment unless I have someone with me. The hospitals will probably accept that a lot more than some uneducated Capita muppet wearing a DWP badge. I get the lower amount of pip because I can’t go to unfamiliar places by myself at all. They didn’t give me any points for not being able to go to familiar places by myself because I am able to sometimes. Is that correct according to the pip rules? I thought they had to take into account how often you can do something and how much stress it causes you. I go out one day a week to do my shopping. I can stand the anxiety of going out that much, but I wouldn’t be able to handle going out by myself more often. I know that the DWP won’t give me any points because I can go out occasionally, but would that decision be overturned if I went to tribunal?

It's horrible they try to trick you. I'm trying to claim for mental health (ADHD, Autism, Anxiety, Depression). The entire system is geared against people like me. I live alone with no friends or family to help and no support services so I struggle so much. The frustrating thing is I "can" do some of the things they ask, but not consistently, they're really hard. Doing those things has consequences. My Anxiety shoots up, I get easily frustrated & emotional, I get very tired (but still struggle with sleep), I become more impulsive, masking my traits becomes difficult (adds to anxiety) and I'm overwhelmed by senses and emotions. Even maintaining my flat is hard (pots in sink for months, floors not hoovered, weeks of washing pile up). I had to take a day off work for my assessment because it took that much out of me, and still took a few days to recover. That was only a 2 hour phone call. But if I have to go to an appointment, I do because I don't have a choice. I just have to accept I'll have consequences after. Being autistic, I don't always understand what they're trying to ask so if they ask "can" or "if you have to", it's yes. I feel my disability is used against me and taken advantage of.

Thank you for saying this because this is my exact same scenario too! I don’t have family, friends or support so I have no choice but to do things. But it takes me forever to do them. I also have physical conditions and it’s very hard to navigate all of this, because I don’t understand. Also this scenario is also a good opportunity in the mandatory reconsideration to say that doing it once shows that I am unable to do it consistently! We have to use their words against them also!

Thank you, charlie. My claim forms have landed for PIP renewal. That is exactly what they did to me and said I could plan a journey and walk more than 20 meters. I can't walk that far at all. So, I lost the higher rate of mobility. I was devastated because it is not true what they said. I put in for mandatory reconsideration and was refused. I could have taken it further, but because of what I have heard, what people have to go through and you're on trial, so to speak that I could not face it. So that is where it was left. So now it is up for renewal. I hope I can get it back. What are the chances that I can get it back? I hope you can reply but know how busy you are. Thanks Wendy x

I was warned about one question and they did ask it. Asking about what I do to stay entertained. Why not do some volunteering, say in a shop, that would be good wouldn't it? As soon as you say yes then they say so if you can do voluntary work then you can work full stop

Tricky! That's an understatement. During mine I was asked about washing my hair? I can't do it in the shower as I need to hold on due to hip pain and dizziness and shoulder pain. I was then asked if I was sat down, could I reach my head.....That WERE THE EXACT WORDS.......of course I can. I eat and drink but can't possibly hold my arms up to wash my hair due to the shoulder pain. That's not trickery this is blatant gaslighting!!

I've just had an awful assessment and complained that he wouldn't let me answer properly. Fearing the worst and cannot work due to a broken back and mental health. They aren't even doctors who assess they're just members of the public who know nothing about certain illnesses. I shall probably have to go tribunal. Stressed out so much having panic attacks.

My pip got cancelled without my notice, no letter, no phone call, I have cronic arthritis a pacemaker, and have to use a catheter bag (I'm 43) I was on the phone to them for 6 hours yesterday being passed from piller to post, hung up on me twice, and because my pip was cancelled, my premium ESA went down by £150, they gave me £300 a month to live on. That's not even possible in this day and age. (My PIP was transferred to the Scottish Disability company), but it'll take months for the transfer. We don't deserve this!!!!! ❤❤

@@neildobbs7278 I'm so with you. Could we start something? Because this isn't right at all, I have worked since I was 14, paying into the tax man's pockets and for what?? I'm a qualified chef, IT technician, web/graphics designer - you name it, I've done it, and I'm now no longer able to complete these tasks due to poor physical health, I've played female football, boxing, not lazy in the slightest, and this is how life is now and we HAVE to conform!!! NO!! I'm sick of it.... and I don't hate illegal immigration, but it's very clear who is being treated better... what can we possibly do to change this?? 🤔❤️

A friend of mine, despite all my advice and that from others, answered a question, second assessment, with: I feel better these days... He wanted to be honest, as though they were his friends - people he could trust - he lost all his points in the blink of an eye, and has been without pip ever since... He didn't even keep a copy of his original application form three years prior. Answer every question with the worst case scenario, also, if you can't go to a hospital appointment because your friend or family member can't go there with you, you simply don't go.

This went on with me doing squat thrusts etc etc the "nurse" took great delight in telling me I scored nill points and can't claim transport costs the look on her face when I informed her I had been back at work for 2weeks so they owed me a full days pay costs compensation for wasting my time it was delightful

If I don't know where somewhere is even local I just don't go.
But in another scenario I have two friends who both had strokes and one was awarded enhanced rates of PIP and the other declined for PIP after telephone assessments, even though they both spent 3 months in hospital and both could hardly walk when they came out of hospital, each using a wheeled frames to get about. They get everything delivered. The friend who was refused PIP doesn't want to go any further with the claim as she is well off but the other friend only gets PIP as he has over £16,000 in savings but will be due a state pension in 3 years.

As I keep saying, they will fail a certain number of people, unsure how it’s decided, flip a coin.DWP can they say, “we are helping people”, while getting rid of lots & if people die, take their own life, result for them & they (the Vultures who do the assessments, still get paid)

The thing is there are plenty of scammers claiming pip..
So I would say there are some over the top assessors and some really lenient assessors.
I know of 2 brothers who claim pip plus other benefits who ride motocross bikes at weekends who have access to vehicles and are totally able to do literally anything
It makes me sick that these people cheat the system live lives of fun and freedom and honest people get stitched up

I’ve just found your post. I get pip and can vouch for you with this. They ask the same question multiple times in deferent ways to catch you out. They try and coax you into saying you can manage. I had this last time and I ended up calling after they took my mobility component away from me. I was lucky I spoke to a decent man and explained that they didn’t even listen to what I’d said. He looked at my claim again and changed it. You DO need support as they are trained to catch you out.
