- Santa Monica Code Enforcement Officers, with backup from Santa Monica Police Officers, try unsuccessfully to remove unpermitted food vendors from the Santa Monica Pier on Sunday, November 28, 2021. The Officers were unsuccessful in removing the unpermitted food vendors. The vendors were able to continue to sell on the pier.
The unpermitted vendors were able to get on the Pier earlier this morning before Allied Private Security Guards started their shift around noon.
Former California Governor Jerry Brown decriminalized street vending in 2019 with Senate Bill 946 (“SB 946” - the “Safe Sidewalk Vending Act”).
The Santa Monica Pier has a worldwide identity. The City wants to preserve our decades old wooden Pier so it can be enjoyed for years to come. Because each unpermitted butane/propane cook-cart is a potential fire hazard for the Pier, the City’s Code Enforcement, the County Health Department, and the City’s Police Department periodically conduct educational and enforcement campaigns to help keep the Pier safe. This safety focus calls to eliminate all unpermitted carts, while addressing improper hot grease and trash disposal, and unsanitary food service conditions on and immediately adjacent to the Pier.
A new emergency ordinance passed on August 24, 2021, which prohibits dumping of commercial trash in public receptacles, disposing of liquid waste in public spaces and in storm drains or on any street, sidewalk, bike path, public parking lot, public park, the beach, the Santa Monica Pier, or any public receptacle citywide, and the use of unpermitted combustible fuels on and around the Santa Monica Pier.
Street vending is restricted on the Santa Monica Pier.
All vendors need a City of Santa Monica business license and vending permit to sell any items in the City, and vendors selling food must also obtain and display a Los Angeles County Department of Public Health permit.
As part of the City’s program, sidewalk vending is restricted in certain congested, high-traffic areas to protect public safety. This includes on and around the Pier, where all vending is prohibited except the City’s existing licensed vendor cart program, and the beach, Third Street Promenade, and Palisades Park, where stationary vending is not permitted.
A new ordinance passed on August 24, 2021, prohibits any person from using any combustible fuel (including propane, butane, any other liquid gas, kerosene, steno, charcoal or wood) on the Pier (including the Pier Bridge) or within 25 feet of the Pier, for any purpose involving the fuel’s combustion including heating, lighting, or cooking without a permit from the Fire Marshal.
Violations of the new ordinance may be handled as infractions, misdemeanors, or through issuance of administrative citations, in addition, combustible fuels used in violation of the new ordinance will be subject to impound by the Fire Marshal.ed as infractions, misdemeanors, or through issuance of administrative citations, in addition, combustible fuels used in violation of the new ordinance will be subject to impound by the Fire Marshal.

In California you can walk into stores and take what you want without paying, you can sell food without a permit. If you don’t want to leave the pier after being told to you don’t have to leave. Why have laws and law enforcers if the law enforcers don’t enforce the laws. Taxes in California pay for this. The inmates have taken over the asylum.

Thats the tactics gangs use to storm stores to steal right now because of the law as it is written. Prop 47 is the name of this law which defines this.
Police are instructd to escourt the illegal vendors off property. Their is no provision in the law (as written) to physically remove vendors nor confiscate their merchandise or carts as of this moment.
So the police just let them stay. Wow. Big waste of city money on those cops just standing around and watching these vendors.

The food isn’t even kept at proper temperatures. They don’t wear gloves. Where do they wash their hands? There’s no sink with running water. How can you sell food if it’s not up to temp nor store food at a proper temp without refrigeration? They touch money…then touch food. They don’t clean their tongs or utensils. All you need to do is touch one bad hotdog and everything else after that will be cross contaminated. No permit, no business license… who does any inspection? The dept. of health dont know if they’re not registered which is why it’s important to get these permits. Eat at your own risk.

How hard is it to just not allow them on the pier, why don't they have security at all the entrances and just don't let them enter. Instead of this on going game. And these carts are blocking the limited walking space.
Private security doesn't arrive until noon. Easy solution, vendors just get there earlier. Even when confronted with guards in the past, they just bum-rush past them. A dozen of those metal carts coming at you pushed by this disrespectful group is not worth your life. Especially since the city, fire and health department don't enforce the laws already on the books.

@@1garyhicks1 it was really easy the one and only time I have seen health inspection officers on the pier. They confiscated all the food items. Vendors left real quick when they had nothing to sell... Go figure.

As annoying as the fat guy singing is and he is truly annoying, Hare Krishna has been a part of Santa Monica and Venice Beach for as long as I can remember. I was born in 1965 and grew up a few blocks from the pier. They were there before me...

Made a nice photo-op for about a week. Sheriff's don't patrol that area. That's LAPD and LAFD's jurisdiction. You call 911 for assistance in Venice, no one from the Sheriff's Dept is showing up. The cameras are gone so residents and business owners are left to deal with the same B.S. as before.
whatever, if it wasn't for the Sheriff taking the initiative, LAPD would be still doing what SMPD is doing ... LAPD Pacific Division and Los Angeles City Councilman Mike Bonin pride was challenged by an elected LA County Sheriff that has jurisdiction in ALL of LA County cities , making them finally get their act together.

Nothing confiscated, no citations. Can't keep them from getting on the pier. Can't get them off the pier anymore. Now it's worse because the officers push them back to the half way point. The vendors refuse to move and just start setting up shop on one of the most congested spots. All while Code Enforcement Officers ( Code FYI Officers would be more accurate) and worse, SMPD stand around and watch.
So we wait until next weekends episodes with the same cast of characters.

utilize the 5 security/police(not sarge or his driver) , 1 police stands at back close to vendor the other where customers go. the 1st security goes to front of line also standing where customers stand and uses her skills to get that vendor moving and 2nd security guard is at station 2 where customers stand ready to move them.
and other guards if available to also stand where customers approach the trolleys so they all move like a "catapiller"

I'm glad I don't have a legal business on the boardwalk, they have to pay tons of money for permits, rent, taxes, etc, but these illegal freeloaders come in and undercut them and take business away. Maybe the legal business people should get together and do a little "rough justice".
