After deciding to claim workers compensation for a work injury, the Workers Comp manager at the Company was fired, then after undergoing surgery myself to fix the problem I was also terminated while rehabilitating...how shocking is this?
Workers comp is corruption shareholders for profit in a system that is supposed to support injured workers financially and medically in a proper time frame is a oxymoron, I can say they do neither my chosen workers comp Dr said you most likely knee a Knee replacement but workers comp don't want to replace total knee till your at least 55 years old they don't want to have to do it twice.SMFH ,So your at the Mercy of the shareholders😢
Thank for answer my question but I never had any issues with my knee or back and they said I have pre-existing severe osteoporosis and I have a facet injury to my lower lumbar it's been 10 years on workman's comp but they saying it's pre-existing???????!!
I've reached MMI, my doctor says he wants FCE before giving WC the numbers. Is this a good thing? And what if the FCE test was a disaster, I knew I couldn't do some things that were asked of me to do. I didn't want to hurt myself, so I attempted, but the PT was getting angry and said he'd just add in his report that I had an attitude. He often asked me if I was even going to try, he wasn't happy with what I did and wanted me to hurt myself.....HELP ASAP
Is this your doctor or the IME? Your relationship with your doctor is just as important as with your lawyer. If you are not seeing eye-to-eye, perhaps you need to have a discussion. Let the doctor know your concerns.
I got hurt on the job in 2016 i you been receiving 1:01:43 long-term disability insurance up until Aug 2023. I filed for workmans comp years ago. My hearing paperwork was filed in 2022. How long does the process take
Hello Sir I Been on Comp since 2021 , I'm getting tired of my lawyer I dont think he has my best interest at heart . Would you be willing to take the case ?
If the prior injury is to the same body part or has permanent effects then yes it might impact the overall settlement. But a good lawyer can help mitigate the negative impact and maximize your settlement.
Great video. Question…Are insurance companies easier to give you a higher settlement, when they know the accident was due to a 3rd Party & they are getting a % back thru subrogation?? Will they be easier negotiating a higher settlement with that being the case? Thx
In NY State the statute of limitations is 2 years from the date of accident and 30 days to give proper notice. Call me if you have any questions! Good luck and feel better.
I'm an officer and last year on march doing an execercise I tore my ACL and meniscus it took 3 months to get my surgery going and another 3 months to start therapy I had a doctors evaluation a couple of days ago and it sounds like I'm approaching the deadline to be released to full duty even though I can't squat or run/jog my case manager told me I was going to receive some money once the doctor clears me out on my next evaluation on May 20. My question is should I contact an attorney and see If I could get a settlement or am I too late. I'm from AZ

I have had 2 surgeries for a hand injury does that increase my workers comp settlement?
You should teach Law in Harvard. Smart Attorney.
Does a pre-existing injury hurt a settlement?

No the insurance company works for them not your best interest. Get an attorney.
Time limit on all cases, even though I’m still in the hospital?
