RUclips treating everyone like criminals. New Copyright Changes are hurting innocent people. Content ID flags are crippling Partner Channels. This isn't the way.
Joe I completely agree with and support what you're saying! RUclips's had a huge fall from grace ever since Google bought them out. They DON'T care about gaming, gamers, or Content Creators in general. Update after update they just seem to keep on throwing their creators to the side while they completely suck up to the bigger companies. I understand that Google is a business but the way they're treating the people that made the site what it is today is completely deplorable. :( Just know if you ever do have to bring them to court or anything like that, I'll be supporting you! Heck, I might even join you, there's power in numbers.
Although I agree with what you're saying, Google bought RUclips way back in 2006, not even 2 years after it was launched. The majority of RUclipss growth was under Google.

i just started a channel and i got content id claims on MY really MY stuff that I WORKED HARD on. Well, the first day i got angry like Joe. The second day i thought that i will find solutions and cooled down - lets play the game! Maybe its time to move on to another video platform if youtube is not interested to solve the problem. How bout they bring a few officials from companies to find people who are breaking copyright laws and uploading their content without permission? Now that wouldn't be hard would it? No it isn't that hard! RUclips's just lazy to do it!
What's sad is this likely got ignored entirely as well or very little was done to correct it, another RUclipsr by the name of Ace of Ocarina Maker had to deal with bullshit copyright claims on his channel as well, some of which were also old as fuck videos that barely got views anymore, and he and others at least in their area as they got dumped on in the video game department with them, was it was a bot that RUclips developed to kill off small channels like his in RUclips's eyes.
Full Time Content Creator here. I just hit the point that I've made the leap and started working on RUclips Content full time. I pay my bills, support my family off my ad revenue. I've been nailed with claims on the 3 channels that I work. ModDB, TGN, Now TheXpGamers. This is in a single word. Scary. Really Scary. So much work claimed by company's that don't even own the content. Hours of editing, writing, working. 50 hours a week. So someone else can click a button and walk away with the income.
***** Moving to another platform would mean to start from zero, all of their work of year would go to trash. The reason why they are successfull it's because of the hardwork and time. It's the same if i'm at a high position on one job and i need to change job starting from below.

Man, I saw a huge spike of copyright claims from RUclips to so many youtubers (except for big let's play videos) particularly when talking seriously (and humorously) about a movie or game and on a small youtuber. What the hell happened to RUclips? Is money the only think that matters to them now?

9 years later, the copyright system for youtube still hasn't changed anything one bit. It is so surreal that it's gotten to the point where bots are now using false claims for copyrighted material. But we also have to band together against the correct target, RUclips was correcting a problem created by the largest MCNs, now it's the MCNs screwing us by making us managed. I don't think Joe fully understands that yet.

A third of our videos got striked, most of the times not even by the publisher but from some weird unreachable Asian company. We actually got a copyright claim from a company called GONG that claims a fadeout... a BLACK SCREEN! They have nothing, absolutely nothing to do with Ubisoft. But i cannot fight it... Right now i'm working with Ubisoft Netherlands to revoke this claim.

RUclipsrs have the same right(at least they should) to use footage and content that news stations have. News stations don't have to pay for every clip that they use, nor should they have to. The same goes with RUclipsrs. There is NO DIFFERENCE between RUclips Reviewers and News Stations when it comes to how they use people's content. They're exercising their rights. Imagine if news stations weren't allowed to use images or footage without paying the creator, or if newspapers couldn't print photos without paying the photographer for printing it? I'd imagine it'd be pretty similar to vlogs. We'd never be able to see what's happening in the world.

The reason it doesn't happen is because: 1) cost. server space and what not 2) No one will visit it, because youtube is the juggernaut of video sharing on the internet. 3) Who's going to make videos on it?
aerochrise you gotta use strategy, maybe even kickstarter. Get some famous youtubers to agree to start uploading their videos there as well and over time make a full transition.

If you got 8 or 9 famous RUclipsrs to just tell their fan bases to check out/move to this new site you would get a few million people in the fan base of the site/traffic. That would be enough to make it start showing up in search results. It could work but then the other channels would have to boycott and stop uploading to RUclips to actually get people to move to a new site. But hell that could work, if you got PewdiePie to get his fan base alone to go over you would have millions of people, but at the same time who the hell wants that fan base on their site? lol
A little-known clause in copyright law is that you can legally sue someone making fraudulent copyright claims. A copyright law professor is currently suing RUclips for trying to take down one of his videos that was technically fair use. Band together with other big-wigs of RUclips, Joe, and sue RUclips's pants off. It'll make them think twice about trusting bots.
I am already avoiding all nintendo, sega, and capcom stuff because they pulled off shits like this. I am sure that im not the only one. So as long as they keep figthing this publicly and the words gets out there. These company will most likely suffer in the long run if we stand against this.

Why are there zero repercussions for the companies who invoke fake Content ID Claims? Any company can spam content ID matches and not be punished no matter how wrong it is. The only people who get hurt are the content creators. Why is this the situation? There is no reimbursement either for the money lost during the content claiming. How does this sound fair at all? A company should be punished after giving out so many fake claims, they should be taken off the Content ID matching algorithm for a certain amount of time.. the same way content creators are punished for copyright claims. Completely one sided.
Monty Gonzales RUclips makes money from the ads that they place on peoples videos. Content creators make money for making content that gets lots of views because the more people that watch a video, the more people that see the ads that make RUclips money. Now, a couple companies are complaining, so RUclips has set up a system that auto flags content for companies, even if said companies don't want it flagged. When content is flagged, the company that it's flagged for starts making the money from it instead of the content creator, but RUclips still gets the money from the ads on it. So basically, a couple of greedy bastards complained, so RUclips said, "Well, we're making money either way, so fuck you guys. We'd rather have our money than give quality service." I've watched a few videos on the subject and this seems to be what they're all saying.

False copyright claims are illegal.. So I dont get how RUclips just allows this. I think what they need to do is have a penalty for false claims. $10,000 fine per company. That will stop them real fast.
that'd work too though i don't see a way they can uphold a fine they'd need legal power for that they have the right but i feel they should add in features to identify those that do false claim and when someone is found out remove their channel however since the system is gurenteed to have some bugs at the start maby change it to the strike system they already unfairly use on content creators but aimed at channels that issue false claims so that repeat offences get's the channel banned but it's just a slap for the first 2 problem there then is how would they possibly do that and also how long would they have to do so since a system like that is bound for abuse just like the false claim is so for now they just need a way to report a channel for acting in such a way and have there good for nothing lazy employees actually look into it and see if there is any merit to assuming the claims made by the channel are false and if there is ban the channel that will stop the system from easily being abused and get rid of these company's real fast cause they'd now have to make it through a firewall made up of people who don't want them there
They are technically not illegal, since RUclips's systems aren't legally binding. It only becomes illegal if you take it up to court and it's proven in court that the claim is false.

If you think that's bullshit, I've had Content ID matches in the past for music which I wrote/composed - completely original works. Then I had to jump through fraking hoops to prove I composed and own the rights to them. With this new mess of a system, I'm thinking that I may have to start looking elsewhere now.

Probably part of it, but even people who have something like 100 subscribers and 5 videos, all of their original content, are getting flagged for some reason.

Stick with Royalty free music. That, right there is 50% of the issue with copyright flags. Just Google the copyright info for RUclips. I can't remember who wrote it up but, it goes over a list of how to avoid copyright strikes.

I agree with Joe here, every time there are new people wanting to do something they love to do, it's like RUclips just cuts their channel by pulling the plug on them, and whatever happened to the "Freedom of Speech," RUclips is ignoring the freedom of speech and just do what they want, that is also not fair for those kind of people that have fun making Let's Plays, walkthrough's, guides, and anything relevant with Nintendo games and products. Plus, most people who have done their own video's on game's don't have a chance to retaliate on a situation like copyright can't fight back unless they have some help and I hope, US, the people of RUclips can make things right, NO more copyright claims, and NO more channel's being watched by every move by each company so everyone can be happy online about what they want to do with video games, even NINTENDO things.

For years I have told other RUclipsrs "Do not use music in your videos" All ignored me. They would say "Its allowed under law, Fair Use" or "Im promoting the game / product" Common sense told me that where $$$$ is involved, the fair use law would, in time, be ignored. I also expected the games companies to claim "Oh it's nothing to do with us" and point the finger at RUclips, as they are doing.
But with games becoming more movie-like there may well be a day when devs decide you know what, we don't WANT this guy to be able tot urn the music down, it's a part of the experience! (which is BS). There's plenty of, let's say, questionable game copies out there with the music and/or sound totally removed as well. So if pirate scene groups can do it, why can't devs? I personally hate how games are becoming more linear and that is also encroaching on transitive work, or, how you play a game and how I play a game is being eroded by games being more and more linear and cutscene heavy. Skyrim? You could make a Nord archer and I could make a Khajiit mage. MGS4? GTAV? We both g through exactly the same story with only tiny differences overall. The whole Hollywood-ization of games is a bad, bad thing. It's not only hurting RUclipsrs, it's hurting players. It's hurting games as well as what happens if you spend.....say.....$40 or $50 on a game with no replay value? (LA Noire for instance which is on sale on Steam the past few days, linear with little to no replay value) You're screwed then, you can't trade it in for a different game and you've already seen everything the game has to offer. Additionally, as games get more expensive in terms of money to make, the publishers (let's be real here, they call the shots not devs) will pretty much railroad players through the game showing off what they spent all that money on. TotalBiscuit touched on it in his content patch the other day and said the same thing as you, turn the music off when recording.

I took it as good advice and stayed clear of using material that was created by others. I can see the point from both sides. It should never have been allowed from the start and this guy wouldnt be in this predicament now. If it's suddenly outlawed you can wave goodbye to guys like TotalBiscuit, Jessie Cox and PweDiePie who make millions combined off of RUclips.....and who do have agreements with said publishers. Also there have been devs (Surgeon Sim 2013) comes to mind where the devs state you can use that game footage and monetize it in your videos. On a larger scale guys in TGS, Curse etc do reach agreements with.....say.....Blizzard to get the okay to use Hearthstone videos or SC2 vids or Riot to post LoL videos. For how easily the system could be abused, even before this shitstorm..... Day One Garry's Incident Devs gave TotalBiscuit a review code. Devs ALSO said the general public were allowed to make RUclips videos with the game in it (Permission trumps copyright law yes?). So Biscuit makes the video, the game is, well, a shitty mess, and the devs go after his video with a false DMCA request solely based on the fact it's negative and lie and BS to him about it. He saved the emails and proved in his video that the devs were flat out lying. Also, it is far, far far too easy to flag a video. I could go to one of your videos (let's say your most viewed one) and hit flag, fill in the forms and do that without actually legally being able to do so. I could do that to scoutthedoggie and his videos too, I could do it to Joe's. The penalty for it isn't enforced at all and it only takes a few clicks (though admittedly issue with the DMCA in general)

What's eerily foreshadowing about this video is that Joe predicted AND warned us about the false copyright claims that have been going across RUclips lately. This video was just a precursor of what was to come. Nostalgia Critic, IHE, TB, Hikock45, and tons of others had this happen to them in the past three months alone and everyone's voicing their opinions and little to nothing is being done. RUclips should've seen this video and learned that if just one person had this much passion about this, then maybe they should look into the system, instead they didn't and the content ID system has only gotten worse. #MakeRUclipsGradeAgain

Copyright law is law and sadly RUclips have to follow the law. Personally I believe people using music in videos can only help the artist. If someone wants to download music they won't be doing that over RUclips!
The thing is, content ID doesn't follow the law. Content ID allows ANYONE to claim ANYTHING. There's also this thing called fair use, under which reviews (and Let's play's for that matter) fall under. Like Joe said: If fair use didn't exist, reviews would not exist, which is a VERY bad thing.
There is no law saying that you can only moneytize 5 seconds of a copyrighted video or song.. There is no law saying that you are guilty until proven otherwise.. This Content ID is what we get instead of SOPA, big companies want to remove bad reviews and controll 100% of their work. If that was the case with video games, we would still be playing tetris now as many hours as we play League of Legends. The other video sites are not having this Content ID bullsh*t and they are running a perfectly legal business.

I didn't make my point well. If RUclips didn't make clear steps to show they are not aiding copyright infringement. They could be found guilty of it (tho the user agreement should get them out of it) How can they make a system that can work out if the person has the right to use content they are using. It can't be done by people there is just too many videos being uploaded all the time. Hence the flagging system but I do agree if you give everyone the option some will miss use it. After he censors the 12th or 13th f-bomb, I imagine the intern would say, "screw it, I'm not getting paid enough for this."
I keep asking RUclipsrs about this: Why don't you try to move off of RUclips, and start hosting your own content with your own, relevant sponsors? Never trust a corporation to have your best interest at heart. They're in business to make money, and so are you. I don't think anybody would want to open up a new website only for joe, unless that person is a crazy fan that watches all of his videos. in the other case, who would open a lot of different websites of all youtubers? what's the point of doing that? He just needs to go to another site like Vimeo or Daily Motion. He can make ad revenue of both sites. The thing that keeps uploaders of the sites is the is the low potential for views and the thing keeping viewers of the sites is lack of good content so it's a bad, unnecessary, circle. But all what people like Angry Joe needs to do is to make trailers for his videos on RUclips with links for other sites with less copyright etc.. That way it's possible to drag people slowly and hopefully completely away from RUclips.
RUclips was the bomb dot com when I started my channel. But ever since this Google+ shit took over it's become very frustrating and unattractive to me. To see people like you and Markiplier having their videos flagged and their fucking means of survival jeopardized is enraging. Hopefully this stuff will blow over.

what's next ? we will need permission from every engineer, game developer, janitor , recording software developer, ISP, keyboards and mice manufacturer,... to upload a single freakin' gameplay with no music or gun sounds cause the designers of those in-game weapons could complain about using sounds of their guns.
Joe I completely agree with and support what you're saying! RUclips's had a huge fall from grace ever since Google bought them out. They DON'T care about gaming, gamers, or Content Creators in general. Update after update they just seem to keep on throwing their creators to the side while they completely suck up to the bigger companies. Full Time Content Creator here. I just hit the point that I've made the leap and started working on RUclips Content full time. I pay my bills, support my family off my ad revenue. I've been nailed with claims on the 3 channels that I work. ModDB, TGN, Now TheXpGamers. This is in a single word. Scary. Really Scary. So much work claimed by company's that don't even own the content. Hours of editing, writing, working. 50 hours a week. So someone else can click a button and walk away with the income.
It's really fucked up, you guys must unite and show this to everyone.

A third of our videos got striked, most of the times not even by the publisher but from some weird unreachable Asian company. We actually got a copyright claim from a company called GONG that claims a fadeout... a BLACK SCREEN! They have nothing, absolutely nothing to do with Ubisoft. But i cannot fight it... Right now i'm working with Ubisoft Netherlands to revoke this claim.

RUclipsrs have the same right(at least they should) to use footage and content that news stations have. News stations don't have to pay for every clip that they use, nor should they have to. The same goes with RUclipsrs. There is NO DIFFERENCE between RUclips Reviewers and News Stations when it comes to how they use people's content. They're exercising their rights. Imagine if news stations weren't allowed to use images or footage without paying the creator, or if newspapers couldn't print photos without paying the photographer for printing it? I'd imagine it'd be pretty similar to vlogs. We'd never be able to see what's happening in the world.

1) cost. server space and what not
2) No one will visit it, because youtube is the juggernaut of video sharing on the internet.

A little-known clause in copyright law is that you can legally sue someone making fraudulent copyright claims. A copyright law professor is currently suing RUclips for trying to take down one of his videos that was technically fair use.
Band together with other big-wigs of RUclips, Joe, and sue RUclips's pants off. It'll make them think twice about trusting bots.

Why are there zero repercussions for the companies who invoke fake Content ID Claims? Any company can spam content ID matches and not be punished no matter how wrong it is. The only people who get hurt are the content creators. Why is this the situation? There is no reimbursement either for the money lost during the content claiming. How does this sound fair at all? A company should be punished after giving out so many fake claims, they should be taken off the Content ID matching algorithm for a certain amount of time.. the same way content creators are punished for copyright claims. Completely one sided.

Content creators make money for making content that gets lots of views because the more people that watch a video, the more people that see the ads that make RUclips money.
Now, a couple companies are complaining, so RUclips has set up a system that auto flags content for companies, even if said companies don't want it flagged.
When content is flagged, the company that it's flagged for starts making the money from it instead of the content creator, but RUclips still gets the money from the ads on it.
So basically, a couple of greedy bastards complained, so RUclips said, "Well, we're making money either way, so fuck you guys. We'd rather have our money than give quality service."
I've watched a few videos on the subject and this seems to be what they're all saying.

False copyright claims are illegal.. So I dont get how RUclips just allows this.
I think what they need to do is have a penalty for false claims. $10,000 fine per company. That will stop them real fast.

They are technically not illegal, since RUclips's systems aren't legally binding. It only becomes illegal if you take it up to court and it's proven in court that the claim is false.

If you think that's bullshit, I've had Content ID matches in the past for music which I wrote/composed - completely original works. Then I had to jump through fraking hoops to prove I composed and own the rights to them. With this new mess of a system, I'm thinking that I may have to start looking elsewhere now.

If you and more than 60% at least of all the users all over youtube stop coming to the site, then yes. Ask yourself, how likely is that to happen?
For years I have told other RUclipsrs "Do not use music in your videos" All ignored me. They would say "Its allowed under law, Fair Use" or "Im promoting the game / product" Common sense told me that where $$$$ is involved, the fair use law would, in time, be ignored. I also expected the games companies to claim "Oh it's nothing to do with us" and point the finger at RUclips, as they are doing.
But with games becoming more movie-like there may well be a day when devs decide you know what, we don't WANT this guy to be able tot urn the music down, it's a part of the experience! (which is BS). There's plenty of, let's say, questionable game copies out there with the music and/or sound totally removed as well. So if pirate scene groups can do it, why can't devs?
I personally hate how games are becoming more linear and that is also encroaching on transitive work, or, how you play a game and how I play a game is being eroded by games being more and more linear and cutscene heavy.
Skyrim? You could make a Nord archer and I could make a Khajiit mage. MGS4? GTAV? We both g through exactly the same story with only tiny differences overall.
The whole Hollywood-ization of games is a bad, bad thing. It's not only hurting RUclipsrs, it's hurting players. It's hurting games as well as what happens if you spend.....say.....$40 or $50 on a game with no replay value? (LA Noire for instance which is on sale on Steam the past few days, linear with little to no replay value) You're screwed then, you can't trade it in for a different game and you've already seen everything the game has to offer.
Additionally, as games get more expensive in terms of money to make, the publishers (let's be real here, they call the shots not devs) will pretty much railroad players through the game showing off what they spent all that money on.
TotalBiscuit touched on it in his content patch the other day and said the same thing as you, turn the music off when recording.

Also there have been devs (Surgeon Sim 2013) comes to mind where the devs state you can use that game footage and monetize it in your videos. On a larger scale guys in TGS, Curse etc do reach agreements with.....say.....Blizzard to get the okay to use Hearthstone videos or SC2 vids or Riot to post LoL videos.
For how easily the system could be abused, even before this shitstorm.....

Devs gave TotalBiscuit a review code. Devs ALSO said the general public were allowed to make RUclips videos with the game in it (Permission trumps copyright law yes?). So Biscuit makes the video, the game is, well, a shitty mess, and the devs go after his video with a false DMCA request solely based on the fact it's negative and lie and BS to him about it. He saved the emails and proved in his video that the devs were flat out lying.
Also, it is far, far far too easy to flag a video. I could go to one of your videos (let's say your most viewed one) and hit flag, fill in the forms and do that without actually legally being able to do so. I could do that to scoutthedoggie and his videos too, I could do it to Joe's. The penalty for it isn't enforced at all and it only takes a few clicks (though admittedly issue with the DMCA in general)
It seems people is getting angry because they might have to start creating content for their channels.

What's eerily foreshadowing about this video is that Joe predicted AND warned us about the false copyright claims that have been going across RUclips lately. This video was just a precursor of what was to come.
Nostalgia Critic, IHE, TB, Hikock45, and tons of others had this happen to them in the past three months alone and everyone's voicing their opinions and little to nothing is being done. Copyright law is law and sadly RUclips have to follow the law. Personally I believe people using music in videos can only help the artist. If someone wants to download music they won't be doing that over RUclips!
The thing is, content ID doesn't follow the law. Content ID allows ANYONE to claim ANYTHING.
There's also this thing called fair use, under which reviews (and Let's play's for that matter) fall under. Like Joe said: If fair use didn't exist, reviews would not exist, which is a VERY bad thing.
Yeah, copyright law is indeed copyright law, but youtube's latest policy is allowing people to more easily violate copyright law. Pretty damn ironic.

I didn't make my point well. If RUclips didn't make clear steps to show they are not aiding copyright infringement. They could be found guilty of it (tho the user agreement should get them out of it) How can they make a system that can work out if the person has the right to use content they are using. Totally agree with everything he's saying; I feel like I just got yelled at though.
He just needs to go to another site like Vimeo or Daily Motion. He can make ad revenue of both sites. The thing that keeps uploaders of the sites is the is the low potential for views and the thing keeping viewers of the sites is lack of good content so it's a bad, unnecessary, circle.
But all what people like Angry Joe needs to do is to make trailers for his videos on RUclips with links for other sites with less copyright etc.. That way it's possible to drag people slowly and hopefully completely away from RUclips.
RUclips was the bomb dot com when I started my channel. But ever since this Google+ shit took over it's become very frustrating and unattractive to me. To see people like you and Markiplier having their videos flagged and their fucking means of survival jeopardized is enraging. Hopefully this stuff will blow over.

David Way Have you tried to ask whoever started the copyright strike to retract it? Some will do that and it will erase your strike.

David Way it's really things like that, that really make me want to stop uploading walkthroughs. i play video games that people never heard of or really really struggle playing, as soon as it gets enough views...bam! copyright claim! ah well, when my time's up, i'll never upload again and i hope the company will still profit w/o any images or videos.
what's next ? we will need permission from every engineer, game developer, janitor , recording software developer, ISP, keyboards and mice manufacturer,... to upload a single freakin' gameplay with no music or gun sounds cause the designers of those in-game weapons could complain about using sounds of their guns.
