    The parents of the 9-year-old who was arrested in August after fighting another student and striking a teacher are speaking out. Cops were called after fourth grader Devin Shepherd got into a fight with a classmate during recess at Needham Elementary School in Franklin, Ind. When a teacher intervened, Devin hit the teacher. The boy's father recorded the heartbreaking scene. “Just chill out buddy. You're leaving with me. I promise you,” the father told his son as he was being arrested. #InsideEdition

      Well he did punch her/him in the face.
      Edit: I’m not defending what they arrested him for, and I think it was definitely to far. However, correct me if I’m wrong, I believe he punched the teacher, not the kid who was bullying him. I wouldn’t consider it self defense. They definitely should have gotten the child bullying him in trouble, which I hope they did.
      All I’m saying is he did punch a teacher in the face, while they were supposedly just interfering between the kid and the bully.

      @@DMalltheway My nephew is visibly autistic and he still behaves himself and doesn't get into fights. Having a condition like that is no excuse for bad behaviour.
      When I was younger they sometimes got the police into school when we were really bad and it worked because it basically scared us and got us to take things more seriously. I'm glad they did it

Imagine yourself in this situation. You get bullied. You stood up. The teacher tried to stop the fight and you Accidentally hit her. She calls the cops. The bully doesn't get arrested. You get a permanent criminal record. You graduate college. But for what? Just to get rejected on 90% of your job application just because you have Battery and mischief on your criminal record. You go homeless. You get tormented by passerbys. Then you die. And you go to hell. Cause god saw your criminal record.

      @@K-ZY a 'criminal record' shouldn't determine whether we'll be saved or not, though.. I mean:
      1. Having a criminal record for something we did, isn't what makes our wrongdoings wrong. If what the boy did wasn't wrong, then it's not wrong - the 'criminal record' can't just make it wrong if it's not. God is just: if what the boy did isn't wrong, surely it wouldn't make him punished.
      2. Even if what he did was wrong, there's still a chance that he won't be condemned; because God is merciful enough to forgive sins.

    I am an autistic adult, and I could not have held myself back. Knowing my own experiences with situations like these, and how this type of thing happened to myself a lot, I would be way to enraged to ever be as calm and collected as that father was. What a great and astounding father.

    As someone with autism and ADHD who is still in their childhood (I’m 14) I’ve suffered bullying in school since I was around 8. I don’t really remember because I didn’t understand I was being bullied until I was about 11. People with autism can react without thinking and I think that happened to this boy. He was provoked. People with autism can have higher emotional responses, especially children. I live in the UK and children under 10 can’t be placed with criminal charges. I hope, 5 years later things have changed and this won’t happen again.

      I know this comment is a few months old but I just wanna say that I'm sorry you've gone through that. I'm autistic and was bullied at that age too, it always breaks my heart a little to see kids go through the same thing, but as an adult I can say that things do get better. Once I got out of high school things improved immensely, you just gotta hold on until then.

    I was in 8th grade, saw a half deaf girl getting bullied, she slapped the guy and she was suspended, while the dude walked free. She committed suicide, no happy ending to this.

    I am autistic and this sickens me to my core. I have had similar problems like this but not getting arrested and I did get punished like every other kid would. I was throwing chairs at people in 2 grade and I just got ISS. He was just fighting back and defending himself. The most likely reason (Due to my experience) is probably that is mistook the teacher for another bully so he hit them. This is just awful and sickening.

      I defended myself several times when I was in elementary school; but because I was bigger, and a girl, I got suspended multiple times! I would have boys in my class call me fat, everything you could think of, and when I stood up for myself, the boys that bullied me got to go on their marry way, and I got suspended.

    As someone who was heavily bullied in elementary school and also suffers from autism, I completely felt this kid’s pain of having the humiliating feeling of consequences being thrown on you for defending yourself from bullies. I couldn’t even IMAGINE what I would be like if I were arrested in elementary school like that at such a young age.
    Shame on that school honestly. I genuinely hope he’s doing much better now.

      @@vxenb7091 based on another comment (and I did some digging myself) is that from my understanding was that although I can’t find anything regarding to the bully getting any punishment (from the source I did find was that the whole incident started over an argument over a butterfly or something) but the charges were dropped on the boy.

      @@garrettromer8499 the problem in this case is the fact that the kid couldn’t think properly. First of all he is autistic. Now that it self is already a big problem when it comes to logic and thinking straight. Another reason is the fact that the kid was bullied prior to the fight at recess. Now anybody knows its 10x harder for a kid with autism to just stop listening to bullies. Plus the fact that the teacher took the side of the bullies shows us that she didn’t care. That also must have triggered something in the kid’s head causing him to punch the teacher.

    Calmly and with compassion? My hefty hindside. Part of ASD is impulse control. Part of being a teacher? Is knowing this, watching for subtle antecedant behaviours, offering breaks, time out, eye & ear covers. I do not see any eye covers anywhere. A kid with ASD has just been bullied into fighting. Why is he not given time and coaching for calming down?
    I cannot believe that 36 years after I was on a popular TV talk show where they addressed bullying for the first time, teachers Still haven't taken responsibility to learn how to prevent and respond to Bullying.

I was screamed at and even grabbed by the teacher... Considering my previous teacher knew nothing about Autism in girls, she was toxic, and verbally abusive. Now she's a reading therapist for those with dyslexia... SHE'S NOT EVEN TRAINED FOR THAT STUFF!!!!! It took years to build up my self confidence.....     I am 15 with autism. This video hits my heart very hard. I feel the same way like this boy. I’m in high school with kids who just don’t treat me very well and bully me just because of who I am. This world is filled with teenagers who treat people with NO RESPECT and always cause trouble. I feel like I don’t belong in this world.     I am autistic, and I stand with the school and law enforcement on this one. The boy became physical over a verbal altercation about a butterfly, and the bully never got physical, at least from my understanding. They may have gone a bit overboard with the boy; however, he still deserves punishment. He is not a victim. Both he and the bully deserve at least discipline from the school district, not law enforcement especially at that age. This is just reinforcing that you can get away with anything cause your autistic.

    I mean even if he punched the teacher...How much damage can a 9 year old boy do...Something is fishy here. Either the boy was defending himself against the teachers son or the teacher just hates the boy.

      I’ve worked as a 1:1 teacher for kiddos with behavioral struggles. A majority of my kids would occasionally lash out/have episodes of hitting, kicking biting, etc. I’m concerned and disappointed about the way the school handled this.

      i know, how much damage can a kid do in that setting with no weapons? its like people who ruin other people's lives by filing a lawsuit against them for assault, or battery. but really they only touched them with a finger.

      I think it's less about the kid defending himself and the teacher just using her rights to the fullest extent of the law. People will sue anyone if they can. That's just how the culture is.

      Protocol shmotocall! You do not, absolutely DO NOT traumatize a young child like that. Those officers and every person, from the individual who procured the order to the teacher, should lose their jobs, and be forced to step down if they’re in elected or appointed or hired office.
      This was by far the stupidest thing I’ve ever seen police do.
      Schools in The 70’s would’ve made sure the fight was fair, and probably moved it to the boxing ring and gloves with supervision.
      Duh!

    The problem with most schools is that their “zero-tolerance” is more like “if I didn’t see it it didn’t happen.” They need to get to know their students better to realize the difference from a bully and a bullied student standing up for themself.

    Was there any discipline for the kids who were bullying this child??? That's what needed to happen, what the SCHOOL should have done. The wimps. Back when I was a kid 50 years ago if something like that happened to me my dad would be paying a visit to the other kids parents. And it might get ugly but it would certainly put a stop to any future incidents. Love my dad, my hero, RIP ❤

    I was expelled for my school for standing up for myself. I've been being bullied for over 2 years and for the previous two weeks before I'd been expelled I had been being violently harassed and having death threats sent to me daily. So I ended up punching the kid who was mainly doing it, I had not intended on doing this but she had instigated it. Either way though none of the teachers, principal, or counselor did anything to help me when I had continuously came to them asking for them to move me to different classes and or to deal with the situation. I even asked the school officer to help me and he told me that my situation was not high priority. He basically told me my life didn't mean s***.
    And people question why I have trust issues. They tell us to stand up for ourselves, and defend ourselves, but we get in trouble when we do just that.
