I strongly believe that unless a student has committed a very serious offence, then he parents just be the first port of call. There's been too many instances of schools using police as "Discipline Officers" instead of Police Officers. They've totally blurred the lines between the two roles.
You scare them straight , so that they learn a lesson while they're still young and impressionable and so, avoid going down a path that could result in much more serious crimes when they're adults. I didn't see the parents being notified to be present and aware of the charges. I saw two of these and in both cases the school made a decision without parental involvement. In the first story an autistic child was being bullied. The bully got off scott free and the victim was arrested. I've also seen in actual schools where I have lived that their no tolerance policy punished the victim with the oppressor! I'm outraged by this. If I still had small children I would homeschool. Not all children are innocent, but not all are guilty.
There was only one time in my 6 years working with special needs and at risk youth that we had to call the cops and i agreed with it 10 fold. First let me set the premise, this was no first encounter with this kid and to call him a kid is a stretch. Im 6'4 250lb and this kid could give me a run for my money when i was working with him at 22. He was probably 5'10 and pushing 200lb. He just had abnormal strength. Well on this day he punched a kid and when told to stop and they tried to restrain him (a few of the teachers are trained in take downs and special holds to prevent the child from harming themselves or someone elese (that is the ONLY time they can use it) , well when he saw the restraining people around he grabbed a pair of scissors and was trying to STAB THE TEACHERS. It was unreal. Ultimately they had to have me watch him till the cops came cause im the only one these kids dont want to murder cause im a young guy who doesnt treat them like children. Honestly i expected more out of them and they gave it. You treat them like kids theyll act like kids, yes they were still children but when i say that i mean we had 5 n 6th graders acting like 1st graders.. Throwing fits about recess and the like. The parents knew that the kid was going to be taken to juvie for the night before they called the cops, in fact the parents are the ones who said to call them before he hurt a teacher as the staff originally wanted them to come and just take the kid home for suspension and avoid involving police etc. Its a tricky situation, some of those kids really couldnt give less of a shit about you, the police, their parents, or anyone. Ive seen one spit at a cop and hit their parents. Some of these kids i really think would be better off getting scared straight in a way now, and realizing that isnt the life they want before its too late

I noticed in this demonstration that the child wasn't read his Miranda rights or charges by the police when he was arrested. Honestly, that's accurate because when children are arrested in school, due process is sometimes ignored, as if they don't have rights. I've heard of children being arrested for behavior that isn't even against the law, such as yelling in class or disrespecting teachers. It baffles me that schools would choose to get the police involved and traumatize a child for life, possibly ruin their future, instead of calling a guardian.
The law concerning interrogation of children is a little different than with adults. Generally speaking a parent or guardian needs to be present. Miranda rights are only read after somebody has been arrested and is being formally questioned, anyway.
@traci holmer This country has an issue with understanding Miranda rights. As the comment above me said, it’s a little different for minors anyways, but police do NOT read you Miranda rights unless they are planning to formally question you.
Miranda rights a heavily misunderstood. They are only ever required to be read when questioning is planned to be ensued. Children do not have rights (hence they cannot legally sign contracts, etc.). Children can be arrested for behavior not exactly violating the law but rules that the parents/guardians have signed into agreement within a school setting, basically signing on the fact that SRO's can in fact "arrest" minors for petty "offenses". But when it comes to actual law violations, it doesn't matter the age of the person when "needing" to read Miranda rights when not required, as stated above.

You don't have to Mirandize him if you aren't going to question him because they have to have a parent present because he's a minor. No parent, no questions, no Miranda warning needed.

Mid 2000’s a local middle school made a huge error in judgement and had a couple 12yo kids arrested for literal horseplay. Those kids were scarred and traumatized far more out of proportion to the “assault” they had done. They spent a week in jail until bail was set and made. They were stripped-searched daily and any time even their attorneys visited them. The Ass. Dist. Attorney wanted to make an example out of them. Thank god when the case came to a head, the judge had sense enough to all but dismiss the case. Our assistant district attorney said if she had it to do again, she’d prosecute it the same. She’s lucky she retired and moved far away. Many in the community vowed to slap her into next week if seen in public, consequences be damned. None of this should ever happen to children.

I got arrested out of my junior high school back in 2001, for defending a new kid while he was being jumped by multiple other students , one of the kids parents wanted charges pressed . It definitely did not go like this, happened in front of the whole school at lunch being thrown to the ground .

I don’t know what this kid did to get arrested, but there are kids out there who are really bad and sometimes a situation like this is necessary to teach them a lesson about their bad behavior.
One time when I was in high school when I was fourteen, a teacher threatened to call the police on me for something I did with a straw. (it was nine years ago, so I don’t really remember what I’d done). And when she was done threatening me she said, “All over a straw.” And I said, “This isn’t _my_ choice.” Was she stupid? She really thought to call authorities over a straw! That’s just crazy.
Very sad. Unfortunately having been at a high school where the principal would often call the police rather than handle it herself I can understand what this boy must be thinking. If this is being used for educational use, they should of showed how they make you sit in booking for 8-12 hours before even processing your fingerprints, your mugshot, and they don’t even let you make a phone call for 5-6 hours either. If I remember correctly the parents are notified After the police have the juvenile and the reason for that is some parents become irate and cause issues at either the school or the police department. This procedure allows police to do what they need to do with little to no interruptions HOWEVER family is notified fairly quickly. Add to fact this is a training video not an actual arrest.

That's because Corporal Punishment was LEGAL at the time. We didn't have near the issues with out of control students we have now when Corporal Punishment was in effect. Then the courts went soft on the students & all hell broke loose. Parents/teachers/school administrators can't discipline out of control children/students these days since doing so oftentimes results in their arrest &/or CPS being called. I grew up on the tail end of the Corporal Punishment era & I can tell you that things were much smoother in school before the courts stepped in. Kids knew if they acted out at home or in school they had a paddling coming. They would settle their grievances/disputes off school grounds via the old fashioned fist fight instead of shooting a school up like they do nowadays...

This is just a skit, of course a parent would be called and brought to the police station in real life circumstances. The parents of this kid were probably working and couldn't come to act in the skit because it is clearly mid-day when they were filming this.
They do not have to call & notify parents before having the police talk to your child. The principal, vice principal & counselor have the right & are viewed as stand in/ temporary guardians of your child when enrolled in the school. I know this because I dealt with that very issue at my son's middle school.
There is a very eye opening & informative documentary titled, Zero Tolerance. This very issue is discussed in it. I highly recommend it to all parents.
Back in the day, teachers at my high school solved student issues verbally and hands on. Never saw a police officer at the school in four years. Times have changed. Nowadays, teachers are not allowed to do anything to students, so they have to call the police to avoid accusations and lawsuits.

He jacked me up the wall,pointed his big finger to my face until it hurt and my face had a red mark that lasted for awhile. He was a big man and I was very small - not even in puberty. Someone said that I could have gotten my teacher into trouble for what he did. No way man!!!!! My Sixth Grade Teacher taught me a valuable lesson!!!! I NEVER EVER behaved in such a disrespectful manner ever again!!!! He was fair in treated me in such a harsh way!!! I have PTSD from being sexually assaulted as a minor, this kid who sat behind me out of grabbed my chest and squeezed my chest. My fight or flight instincts kicked in along with my self defense training, I elbowed him in the face breaking his nose and right orbital socket I then grabbed his head and smashed it into the desk causing a gash across his forehead, the teacher rushed over to me and somehow by the grace of God got me off him. I was taken to the principal's office to calm down because my ptsd fits can last a few minutes or a few hours depending on what happened, my dad and police were called and ten minutes late he arrived at the school only to see me in handcuffs, he lost his shit and asked why I was in handcuffs and the principal said "because she attacked another student for no reason" that pissed my dad off even more because he knew better do he asked ME and the teacher who brought me in what happened. Me and the teacher said the same thing, a student grabbed and squeezed my chest causing me to go into fight or flight and I chose fight. The cop left me go, the other kids was arrested for sexual harassment and assault, was taken to the hospital and then expelled from the school. Principal had no choice, he was gonna let the kid come back but my dad threatened to sue the school for every penny they had. Even though the kid was expelled my dad pulled me from the school and him and my brothers homeschooled me.

The parents knew that the kid was going to be taken to juvie for the night before they called the cops, in fact the parents are the ones who said to call them before he hurt a teacher as the staff originally wanted them to come and just take the kid home for suspension and avoid involving police etc. Its a tricky situation, some of those kids really couldnt give less of a shit about you, the police, their parents, or anyone. Ive seen one spit at a cop and hit their parents. Some of these kids i really think would be better off getting scared straight in a way now, and realizing that isnt the life they want before its too late

I noticed in this demonstration that the child wasn't read his Miranda rights or charges by the police when he was arrested. Honestly, that's accurate because when children are arrested in school, due process is sometimes ignored, as if they don't have rights. I've heard of children being arrested for behavior that isn't even against the law, such as yelling in class or disrespecting teachers. It baffles me that schools would choose to get the police involved and traumatize a child for life, possibly ruin their future, instead of calling a guardian.

The law concerning interrogation of children is a little different than with adults. Generally speaking a parent or guardian needs to be present. Miranda rights are only read after somebody has been arrested and is being formally questioned, anyway.

Miranda rights a heavily misunderstood. They are only ever required to be read when questioning is planned to be ensued. Children do not have rights (hence they cannot legally sign contracts, etc.). Children can be arrested for behavior not exactly violating the law but rules that the parents/guardians have signed into agreement within a school setting, basically signing on the fact that SRO's can in fact "arrest" minors for petty "offenses". But when it comes to actual law violations, it doesn't matter the age of the person when "needing" to read Miranda rights when not required, as stated above.

No one was charged at the school but it haunted me for years and still does . The police and schools that allow this are promoting future mental issues and should be charged. Mid 2000’s a local middle school made a huge error in judgement and had a couple 12yo kids arrested for literal horseplay. Those kids were scarred and traumatized far more out of proportion to the “assault” they had done. They spent a week in jail until bail was set and made. They were stripped-searched daily and any time even their attorneys visited them. The Ass. Dist. Attorney wanted to make an example out of them.
Thank god when the case came to a head, the judge had sense enough to all but dismiss the case.
Our assistant district attorney said if she had it to do again, she’d prosecute it the same. She’s lucky she retired and moved far away. Many in the community vowed to slap her into next week if seen in public, consequences be damned. None of this should ever happen to children.

That's because Corporal Punishment was LEGAL at the time. We didn't have near the issues with out of control students we have now when Corporal Punishment was in effect. Then the courts went soft on the students & all hell broke loose. Parents/teachers/school administrators can't discipline out of control children/students these days since doing so oftentimes results in their arrest &/or CPS being called. I grew up on the tail end of the Corporal Punishment era & I can tell you that things were much smoother in school before the courts stepped in. Kids knew if they acted out at home or in school they had a paddling coming. They would settle their grievances/disputes off school grounds via the old fashioned fist fight instead of shooting a school up like they do nowadays...

Cops don't have to read you your rights unless they're questioning you. Which they also can't do until either a parent or guardian is present.

This is just a skit, of course a parent would be called and brought to the police station in real life circumstances. The parents of this kid were probably working and couldn't come to act in the skit because it is clearly mid-day when they were filming this.
They do not have to call & notify parents before having the police talk to your child. The principal, vice principal & counselor have the right & are viewed as stand in/ temporary guardians of your child when enrolled in the school. I know this because I dealt with that very issue at my son's middle school.
There is a very eye opening & informative documentary titled, Zero Tolerance. This very issue is discussed in it. I highly recommend it to all parents.

Back in the day, teachers at my high school solved student issues verbally and hands on. Never saw a police officer at the school in four years. Times have changed. Nowadays, teachers are not allowed to do anything to students, so they have to call the police to avoid accusations and lawsuits.

Parents should always be called first. However if the child continues to act up then the police are the best team to call. They are some kids who seek attention because of problems at home. But there are also kids who are just bad and really need to be taught a lesson.
This is very disturbing, when I was young living in beloved Levittown, Long Island, I have never seen a child get arrested by police, teachers had full control and did it in a very fair way!!
I agree!!! When I was in 6th grade 1976, I did something that was not correct. My teacher dragged me outside to the hallway by my ear. He jacked me up the wall,pointed his big finger to my face until it hurt and my face had a red mark that lasted for awhile. He was a big man and I was very small - not even in puberty.
Someone said that I could have gotten my teacher into trouble for what he did. No way man!!!!! My Sixth Grade Teacher taught me a valuable lesson!!!! I NEVER EVER behaved in such a disrespectful manner ever again!!!! He was fair in treated me in such a harsh way!!! I was a very disturbed kids and who knows what my Future could have been if he had not did that Act. I learned to respect Authority!!!!!

If this video is supposed to show children what happens when they have problems, this video has missed its educational purpose. Certainly, the laws in America are different than here in Germany. But every normal person should know that children, especially younger ones, are easy to influence, but also too traumatized.
We also had a boy in our school here in germany who was actually supposed to be arrested but the police didn't until he sent death threats to some girls.

I have PTSD from being sexually assaulted as a minor, this kid who sat behind me out of grabbed my chest and squeezed my chest. My fight or flight instincts kicked in along with my self defense training, I elbowed him in the face breaking his nose and right orbital socket I then grabbed his head and smashed it into the desk causing a gash across his forehead, the teacher rushed over to me and somehow by the grace of God got me off him. I was taken to the principal's office to calm down because my ptsd fits can last a few minutes or a few hours depending on what happened, my dad and police were called and ten minutes late he arrived at the school only to see me in handcuffs, he lost his shit and asked why I was in handcuffs and the principal said "because she attacked another student for no reason" that pissed my dad off even more because he knew better do he asked ME and the teacher who brought me in what happened. Me and the teacher said the same thing, a student grabbed and squeezed my chest causing me to go into fight or flight and I chose fight. The cop left me go, the other kids was arrested for sexual harassment and assault, was taken to the hospital and then expelled from the school. Principal had no choice, he was gonna let the kid come back but my dad threatened to sue the school for every penny they had. Even though the kid was expelled my dad pulled me from the school and him and my brothers homeschooled me.

It seems sometimes administrators can be quite lazy. They don’t want to waste their time doing investigations into stuff and are quick to suspend. You’re lucky you were not suspended.
