He still has parental rights, and if OP is attempting to move back to France that will make it more difficult for her to get custody since she is removing the child from her original home and potentially the father's family. Unmarried people still have to follow rules of custody, especially if paternity was established.

Yeah most Muslim countries banned paternity tests in early 2000s without court orders (which are virtually impossible to get) but they are fixated on France. We are a catholic country after all and we still hold traditional views too.

For people who've never dealt with international custody agreements, home turf is the advantage. She will be advised to never allow her daughter to leave France again as the father could hold her and force it into the American court system where he would prevail. The UK court system in similar battles (as an example) has actually cancelled passports of children so they can't be taken out of the UK as long as they are minors.
Most likely the father is on the birth certificate and most jurisdictions will accept that as proof of paternity. There would be no advantage in forcing the man to take a test if the father wants custody and the mother knows she has no other viable candidates.
Maybe but I believe the child has double citizenship since most European-American couples realize that any major EU country passport is more powerful than the US one. Also most of the time it's pretty automatic that the child will have double citizenship

I’ve already seen the second story, so I’m gonna pretend I didn’t and irrespective of where the story will go, I will say this: Even if he didn’t cheat on her, I still think OP should divorce him, because it’s not some simple crush, it was this guy who apparently was so heavily moved by this woman’s confession of love that he took an extended period of time to seriously consider throwing his marriage away and destroying this poor woman’s heart. Regardless of cheating, or hell, even if he didn’t contact her, divorce him because he apparently loved this woman so much he had to think about leaving his wife. OP should take this as the dealbreaker it is and end the marriage. Tbh, if there was a step between emotional affair and physical affair, it would be this.
If the woman did not marry her husband, she has full custody of the child. This is the most common rule across jurisdictions. It would be more complicated if they were married, or divorced.

That is simply not true. This is misinformation. It’s just what most people falsely believe. Custody is determined by the court, if the father wanted to take that child and there is no custody order set in place, he *legally* could do so.

I'm French and I can say that cheating is not viewed as normal here. It is taboo BUT I once saw a enormous advertisement poster in the parisian subway about an infidelity dating app (I was young and shocked, still shocked tbh) so I can't say that everyone is against it I guess.
There are movies about cheating viewing it as a fantasy (I don't really watch these). In the late 70s and the 80s was the sexual liberation of women (and just everybody in general). I don't know if it happened all over the world but back then the youth was encouraged to try everything with everyone, it was chaotic. A lot of movies from back then had cheating. And most of the movies about cheating from this century are made by old guys (you know..).

The story about the mom and the nasty nanny. When they set up the custody agreement, she can put that in the custody agreement that if this woman comes near her child, he loses all visitation.
Except there are no custody rights and that could easily be argued as parental alienation and attempting to run the father’s life by threat of preventing him from seeing his daughter. He actually holds all the cards because the mother is attempting to gain custody of the child in a nation the child is not a citizen of, dad could make her life hell and easily get the child because the baby was born in the US.

Story 1, yes, if someone cheats they still have a right to be in the child’s life. Personal experience here, my oldest daughter’s father cheated but he still sees her every weekend and talks to him almost daily. I moved to Alabama from Tennessee and we still make it work out. He hurt me but I can’t hurt her bc of his actions.
He was letting his delulu affair partner watch his infant. So many things could have gone wrong. Nanny's mental health was obviously not it. She has no business being around children. So frankly, I don't trust the father's judgment at all. Like she was literally talking about getting rid of his wife. What if she started to see the daughter as an obstacle as well?? Scary stuff!

21:25 Im not a lawyer or anything, but I've heard that you can add certain clauses into the custody agreement that bars certain people from being around the child. Ive heard of people adding in that they're not allowed to introduce a partner before a certain amount of time or before the other partner has met them. OP absolutely has the right to protect her child and keep a toxic person away even if that means cutting off the other parent.

As long as it's worked out between the parents and both consent to those terms, they can file the agreement and the court will uphold it. But if one contests, the court will look to do whatever is in the child's "best interests", and that can mean anything. Liv isn't a minor, so to the court, she's just the woman he stepped out with. And since seeing her father and having a relationship with him is in Cassie's best interests, and since Liv is with the ex (forgot his moniker), they may see the request as petty and not uphold it.
That's why OP intentionally misled him in his thought process in order to get him to agree to her terms. It's not easy for a mother to lose custody, but one thing that is heavily frowned upon and can cause a court to strip a mother of custody is withholding the child and creating undue hardship (such as distance) between the father and child. Had he contested OP's terms and even lawyered up, she would still be living in the same city as the ex. She still needs to be careful with what she posts. If he cared enough, he could use her reddit post as proof of deception and manipulation.
Fortunately for OP, but unfortunately for Cassie, he doesn't give a damn about his child.
It's almost irrelevant if a clause is added or not. OP can use the texts as examples of dangerous behavior from the nanny in court, so if the ex is still seeing her she could have his visitation limited, supervised, or removed altogether for it being an unsafe environment for the baby.

It might be state based rather than applying to all of the US but here if you are not legally married, dad has no custody rights. He has to go to the court to get those rights. The child’s custody and care falls automatically on birth mom. So, even if dad had not agreed to mom taking baby to France, she’s not kidnapping her. If the courts granted custody to dad and mom didn’t give baby to dad at his turn or if full custody, by set date, THEN she’d be kidnapping.

Things kind of similar have happened to me. Not with pictures but inappropriate messages or actions. What I did was talk to my husband about it and handed him my phone so he could respond to the person. Another time he just told me a young man was going through something and just do my best to be supportive. Not all situations are the same. It is best to talk things over with your partner.
There is no reason for him not to say anything after the nanny sent him supposedly unsolicited nudes. If he didn't want to answer the texts, then he should have told his wife. But the worst thing was the gaslightning, making her feel like she was making a big deal about nothing. When they do that, it's because there is more to it than justs texts or pictures

So here's where custody issues and international laws get really complicated. If OP retained French citizenship (I doubt they relinquished it) and got her daughter dual citizenship (which most couples who have different citizenships do) then if OP took her daughter to France and simply stopped communication with her ex, there is very little that can be done. OP's husband could try to get legal action taken by US courts, but the legal nightmare of dealing with foreign authorities on custody issues would make it nearly impossible for OP's ex partner to effectively do anything about it. It is easy to have the courts in either country disagreeing on the custody ruling, as well, as a French court is almost certainly going to find in favor of the French mother living on French soil and the US court could easily go either way (famously favoring mothers already). While, at best, morally grey, it would not be difficult for OP to simply ice out her ex partner and preventing him from contacting the child at all.
That's not morally grey, that's just plain wrong. Unless there is specific evidence of the father not being fit then taking him away from the daughter as revenge would make OP the AH. The father certainly did some things that were not great, but nothing to outright suggest he is an unfit parent. OP also said she was only going back to visit family for a few weeks(but she has been dishonest throughout her story so it wouldn't surprise me if this was also a lie).
Since they weren’t married when baby was born, paternity has not been established legally, and thus no legal rights. But the baby was born in US, if he lawyered up, she couldn’t leave the US w baby forever, as the baby belongs on the district/state where they were born. She better leave immediately before he starts legal battle or she will be forced to stay in US, and May be forced to return to the states with an American citizen

For the nanny story it depends on where they live but I know in South Carolina the mother automatically gets sole custody of the child if the parents were never married - atleast until the father fights for visitation.

She can get full custody and make arrangement HOWEVER (depending on state) if he should choose to apply through the courts for visitation and it gets granted and something happens that mom doesn’t like. She can’t restrict visa it because it would be in violation of the visit agreement set by the court. Most courts won’t allow mom to say “oh he can see his child if so and so isn’t around” and grant that. If so and so doesn’t pose a threat to the child the court will see it as mom’s jealousy and that won’t matter. Also some states, you can’t move without getting court permission to move state otherwise if dad is smart enough he could go to court and file for kidnapping.
I know all this because I went through something like this with my son’s father a couple years ago. So, OP needs to weigh all her options and go over the state guidelines she lives in currently with fiancé. The last thing she needs is him to hear that he can file for kidnapping and suddenly she’s back home getting pulled over and arrested for international kidnapping of her own child. It’s stupid as hell but it is a thing.
