The store is working in direct contact with Break Through Towing to allow their customers to be towed without warning, in less than the time frame allotted, when there are ample parking spaces still available for other potential customers.
My car was towed on September 5, 2018 without any warning from McDonald's. We went and picked up my rental car 45 minutes later from Break Through Towing and were charged a whopping $445!
While picking up our car there was another man there picking up his car complaining about the fact that his car was towed while he was inside eating McDonald's.
When Break Through delivered our rental car they did so on the other side of the road facing traffic and told me I HAD to drive the car off of the tow truck.
Incredulous at everything that occurred we decided to go back the next day on September 6, 2018 to see what signage existed. We made sure to go through the drive thru so we would be a McDonald's customer so we wouldn't be in violation of their parking rules.
We paid for lunch at the drive thru at 12:07pm. We received our food around 12:15pm. We sat in the parking lot and ate our food for a little less than 15 minutes before I got out of the vehicle to record video and take pics with my phone of the signage related to parking at McDonald's.
The signage indicates there is a 30 minute time limit before you will be towed by Break Through Towing. While recording this footage (we'd only been there 15 minutes at this point), a tow truck shows up (same driver as the day before) and immediately attempts to tow a car belonging to a lady with a disabled placard and her baby.
When the lady comes hurrying out of the McDonald's to see what's happening we inform her that they are trying to tow her car. According to her they were just in there for 10 minutes. When the tow truck driver is unsuccessful in towing her he turns his attention back to us and attempts to tow us, driving recklessly in the parking lot.
I had to literally stand behind my truck to not be towed again.
There is a man that appears to work for McDonald's who kept coming in and out of the restaurant flagging cars for towing.
After the tow truck was unsuccessful in towing the car of the disabled woman and our car, he left due to us recording the entire event.
We then went and visited the office of Break Through Towing to ask them questions about their towing policies. They even charge people separate fees for not having their registration and insurance information on their person, even if it's located IN THEIR CAR THAT WAS TOWED.
This practice is shameful, it's predatory, and the fact that McDonald's allows their customers to be towed away is disgraceful. Upon checking online Break Through Towing has a horrible reputation and it's appalling that a company like McDonald's would partner with them for this predatory behavior.
We thank you for taking the time to watch this video and encourage you to lodge your complaints against the store and the towing company.
    Thank you for watching.

This company was investigated and found guilty of breaking laws at towing peoples cars when they did not break any tow zone laws. This company is shut down permanently, the owner did pay a few people to go to this mcdonalds, and a couple other locations and call their tow trucks to tow away vehicles in which the owners left just minutes before. This was aired on many mainstream media news channels...Many thousands of people did get scammed out of hundreds of dollars each from this scumbag towing company(which the owner did open another towing company I think called Magic towing shortly after breakthrough towing was forced to shutdown, Magic towing was also forced to shut down)

All tow charges returned with in interest from both companies and McDonald's throws in another $1000 to all cases proven for every customer, patron, or unfortunately anyone that parks and goes into get food. Doesn't a person get at least 30-60 minutes for lunch right. To set up 2 tow truck companies to rip people off takes all kinds of scum. Take down the snakes involved in this crime syndicate. Michigan needs to pass new legislation to protect drivers from unlawful tows. Bring the freaking hammer down y'all. Stand by your cars and tell the tow driver's to get the hell out of there. They are not ordering, they are blocking. Get real. Don't take it anymore. Everyone in that area of Michigan or the whole state, should boycott McDonald's. Stop the stupid practice and customers MIGHT return. Send them a big 0 profit.

i had the same experience at another mc Donalds in the south bronx(new york city). I walked into an adjacent empty parking lot of a recently-out-of-business diner to smoke while my buddies who rode with me in my car, were inside the McD's eating the food they had ordered. I walked barely 40 feet - out of courtesy - so I don't blow cigarette smoke in the McD's parking lot into the faces of drive thru customers !!!! Less than 2 minutes later, this tow truck guy comes in and tries to take my car !!! I warned him and he wont listen ! Then I walked in to the restaurant and complained to the manager and pointed to my friends sitting at the table, eating what we ordered, and my sandwich and drink !! then the manager calls the tow company and asks the guy to bring the car back. It all made me so angry. Then I called the corporate HQ of McDonalds. I got feedback from them 3 weeks later that they fired 3 employees, and the manager (all spotters working for the tow company) and also got a restraining order against that tow company. They now have another tow company working there that follows certain rules before towing cars ! The rules they mentioned are : 1. ensure that a car is actually parked illegally - a person parks, and is gone from the lot for more than 40 minutes, and then, if the person does show up while the vehicle is being hooked up or towed, but hasn't left the parking lot, then release the vehicle with no charge. They also said this new towing company charges a reasonable $40 a day lot fee for towed vehicles in their possession.

Exactly....They are actually violating the Racketeer Influenced and Corrupt Organizations Act (RICO)...as well as conspiracy and any other number of violations to defraud customers, The McDonald's and it's franchise owner, management and staff have entered into a conspiracy with the tow company and it's owner, management and staff as well as those spotting for them. They could all end up spending the rest of their lives in Federal prison. These are the same laws that brought down the mafia in this country. If McDonald's corporate will not do anything to stop this after they have been made known of it then they also will become explicit in the crimes. Why the victims have not done anything is a mystery to me. Either this shit is a scam or they are the biggest lazy asses I've seen. Even Fox news who has covered it a number of times has shown no evidence that they have notified corporate or the state authorities. If local prosecutors won't do shit then contact the state Attorney General or even the Unites States Department of Justice. This McDonalds however seems to be working with a different Tow Company now. Inside Edition just did a report on this McDonalds and they 100% have a spotter who works for the MD's.

This indicates that space is not a valid parking space, because of the layout of the lot, they keep that space open for larger vehicles to make the turn around in the drive thru lane. So actually if they get towed for parking there it's perfectly legal. The fact that they got towed for being their for only 15 minutes might be immoral but not illegal.

I was a tow truck driver for three years before becoming an OTR trucker. When we towed abandon vehicles off of business property we had to have a permission release form filled out and signed by the owner or the manager of the property or we could not touch the vehicle legally! We also had to legally present a copy of that form to the owner of the car when they came to pick it up! That may vary from state to state but I can't see it being much different.

This towing scam is common all over the united states. Especially in apartments. I was a victim of this years ago. Cost me 350 to get my car back. The lady at the tow company was behind bullet proof glass. What does that tell you. My neighbor told me it was 100% OK to park in his parking spot, mine was full with another car. Then i come back the next day to see my car gone. Keep in mind we do not have badges or car numbers or anything to verify what car goes where. I then find out it was towed and the tow company told me that they do not give info of who called in to tow my car. My neighbor said he never called anyone. My guess, the security guard for the apartment complex gets a certain percentage for each tow he calls in. This has been going on for years. Many tow companies are doing this scam "legally" and screwing people over. Which means thousands of people employed for these security/ tow companies know exactly what they are doing. They are straight scamming people out of their hard earned money. These people are pieces of you know what and do not deserve to be employed.
If i knew where to report this higher up i would. And i mean above the police which will do NOTHING like usual because the tow companies have the law on their side. Anyway this is a serious issue that needs to be investigated.

In Victoria (A state of Australia) it is illegal to tow a vehicle off private property, or from a public car park. Without the consent of the owner of the vehicle. We had huge problems with private car parks doing a simular thing. This amounted to extortion. In some cases Car park owners were using wheel clamps to hold people to ransom. The State Government Outlawed this type of behaviour. We have had Tow Trucks for over 20 Years, and there is no way we would be involved in this sort of stuff. Great Video.

Funny story about the same scenario. A good friend of mine's uncle works for the state dept that licenses these trucks. Its not Michigan. I was over one time when his uncle dropped by and he told me him and a coworker went to Burger King and he comes out and the car was on the tow truck. It was a state owned car by the same dept that licenses the tow trucks. His uncle basically told the tow truck driver that he wasn't going to say who he was but if he doesn't unhook and drop the car, the business will regret it deeply. The tow truck driver told my friend's uncle to f*ck off and drive off with the car. So he tells me the next day, he shows up to the towing yard with his boss, an investigator with the dept of revenue, and the state police. They walked right in, informed them they were pulling their state license to operate, seized all the tow trucks and put them on tow trucks, arrested the owner for tax evasion and fraud, and arrested the tow truck driver for auto theft and theft of state property. Then they locked the placed up and called it a day.
Michigan tow truck drivers must not have a lot of oversight from whoever licenses them. Some states don't play around with this type of stuff.

ANY non city tow company can not legally keep your vehicle. Call the police (yes it takes time) to have them meet you at the tow Yard to get your vehicle. A report is made and the tow company then can sue you. Meanwhile look up your counties maximum toe charge.
This also applies to mechanics. ONLY state and federal can "impound" your vehicle. No personal or corporate entity can hold your personal property.

They can only legally tow from property if the car is on a property but the owner is not doing business with the place of business. In this case you are doing business with McDonald's and it is an unlawful tow. However they will keep it up if unchecked. I would take this video to corporate of the company involved.

Does this make this companies practices legal?? I doubt it very highly, but it is certainly not fair especially after the car had only been in the lot for no more than 10 minutes. Being on a fixed and very limited income and for them to be carelessly towing disabled people’s cars and charging $450 is outrageous. Got towed at a Ross in Los Angeles. Asked the manager about it. He said they didn't call but a guy sits out front in a tow truck and watches the parking lot for people leaving to other businesses to.
I looked up the local towing laws and learned what he was doing was ILLEGAL! Tow companies are NOT allowed to generate their own tow! A business has to CALL THEM and ask to have someone towed!
We called and threatened to sue them and they released our car and we avoided paying almost 700 dollars in fees!

There's a guy in Austin who stands at the convenience store and boots the cars of people who go into the stores next door on the same property, as there is little to no parking at those storefronts, making it often necessary for parking to overflow to the convenience store. Yes there's a sign with vague language about leaving the property. They claim the next door stores, which are all part of the same building, are a separate property. There is nothing delineating the stores and no indication to the public that the property owner, (who owns all the stores) considers each store to be a separate property. The police won't do anything because they say it's legal and at best, a civil matter. So you have to pay $100 to get the boot off. He will also take property worth $100 in lieu of cash. I watched him take a guys electronics and subwoofers and put them in his own truck!!! That crosses the line into just straight up robbery, in my book.
Yes it's illegal. And sanctioned AND LICENSED by the city. I watched this guy boot ten cars and make $1000 in one morning last Saturday. The United States is in a downward spiral. Expect ALOT more of this criminal nonsense to pop up in the future. Just about everywhere. And Austin, in particular, is a nasty little garbage hole of this type of extortion.

Steve AAA doesn't have anything to do with them. They are a contractor for AAA. All AAA does is feed them tow and service calls. AAA is totally worth it for a member. I used to drive tow truck in a remote region, and had to charge $400-$900 for breakdowns fairly regularly. We charged $100 to hook up and $2.60/km plus fuel surcharge, plus tax (canada) it adds up fast. If they had AAA/CAA and bought the better coverage one tow could buy years of membership. 1. No longer around.

Your rental car agreement is A LEGAL SUBSTITUTE for a registration and most people opt in for insurance on it as well, a little gotcha in most states if the rental wasn't insured a. they shouldn't release b. a company representative must show up with insurance to release car. But being in a parking lot less than an hour SHOULD NOT RESULT IN A TOW anywhere in the U.S. I had a hard time coming up with instances where a vehicle could get towed that fast and there isn't many but blocking driveway, vehicle left in the middle of road and such.

Therefore, you can surely bet that the McD's owner it probably getting 1/3rd of that towing charge even though the towing company and the McD's owner will never admit it. I'd file a complaint with McD's headquarters. They'll probably say that the owner is an independent franchisee and is free to do what the want.

A client came in to get his haircut and the stylist was not ready for him so he walked across the street to get a drink. The boot guy saw him and booted his car. The stylist noticed it and ran out back. The boot guy said that he was not park illegally and she told him that the guy had an appointment and she was running about 10 minutes late. He still charged him $300 to take the boot off his car. That’s why I rarely go into Nashville anymore. It’s not worth dealing with those people. I have to go to an oncologist and he’s in downtown Nashville. I would be highly upset if I came out of my car had a boot on it. I do park in patient parking but that doesn’t mean anything to them.

As of September 25, 2018, from the Metrotimes News:
A Detroit towing company that has come under fire for its aggressive tactics and $400-plus cash-only towing fees is now facing a class action lawsuit that alleges it routinely engages in "illegal, predatory, and rogue practices." The suit filed Friday by attorneys with the Truth2Power Civil Justice Fund alleges that Breakthrough Towing violated state towing laws by hauling vehicles from private lots without proper permission, refusing to release vehicles to owners who showed up before their vehicle was towed, and failing to notify police before removing vehicles. Breakthrough Towing was recently the subject of a viral RUclips video that purported to show the company trying to tow McDonald's customers legally parked outside the restaurant's location on Woodward in Midtown.
The allegations detailed in the suit plus a handful of additional horror stories shared by Breakthrough victims with Metro Times together paint a picture of an operation so aggressive that it easily catches people parked legally, taking their cars regardless of circumstance. As one of the plaintiffs in the case says she was told by a driver - "once he was dispatched, no matter if the car was hooked up or not, he had to take it." Once caught, vehicle owners can be robbed of a week's paycheck almost instantaneously, forced to pay cash for tows starting around $400 with additional fees tacked on for inevitabilities, like having to retrieve their vehicle registration from inside the car. The company appears to rely on "spotters" for alerts when a car has been parked too long (it denies this, but we've seen people stationed for hours at a time outside at least one of the lots from which it tows) and keeps its trucks idling throughout Midtown

This is called racketeering, in case there is any question of it. This activity is very rampant in South Florida, especially around the Miami area. This is very profitable, as these companies are often "all in the family" operations with collusion and shadow ownership going even up to the highest of politicians and other "government" officials, active or retired. Municipal contracts are often awarded through no-scrutiy, no- bid contracts using obfuscation to hide the true structure. It would appear to only be getting worse over time, as well.

Since as far as I know you have to file a report with the police before towing, yeah that is a legit strategy. I knew a guy who ran one of these. He said he had to wait for slips to be planted on the cars for 24 hours. Most of the people who never picked up their cars had them crushed.

The whole process he is doing is wrong wrong wrong! I'm a AAA driver myself and I worked at a company that did illegal parking tows. First off, you need to get pictures of the car parked illegally with a time stamp then you have to leave for at least 10 minutes to give them a chance to leave. After the 10 minutes, you have to come back take another set of pictures with time stamps and then you can pick up the vehicle and have the property manager sign a paper authorizing the tow.

    • @yetithehabib2114
      @yetithehabib2114 5 лет назад +1

@@MajBoothroyd from what I know, that's how the process is done legally and fairly. Someone had replied to my comment mentioning that someone was getting kick backed for picking up the cars and needless to say but hes more than likely 100% right! When you're a PPI tow truck driver, you do get commissions for getting cars but the manager who was flagging cars down is more than likely getting kick backs too, causing this whole conundrum

    • @yetithehabib2114
      @yetithehabib2114 5 лет назад

@ReallyNotBob Tech the truck driver is just a driver if anything. If he was the property manager, he knows what hes doing is extremely illegal, especially considering the amount of signs on the property and the rules set on those signs. Nonetheless, the driver is making alot of money, as well as the company and from my best judgement, the manager of that McDonald's is getting kickbacks too for flagging the cars down.

Astounding, imagine how many victims had already fell through their scams and paid the fees without voicing their concern and fight for injustice, until just one person decides enough is enough. People really need to be more vigilant and aware in their daily lives, and really need to start noticing things so the society as a whole can start improving, get rid of bad actors, etc. The tow company could have been shutdown a long time ago, if just someone else would fight for injustice. This is the difference between living as a human vs a zombie.

Hey Jason and Em! My family and I are tow truck operator's and owners. What happened in this video is ILLEGAL!! I don't know what your follow up had been, but you need to peruse it. AAA is a separate entity from this towing company and if they haven't already been informed you need to let them know. They'd be furious over the way this company is conducting itself. AAA has a rating system of who they give calls to. Our company is in the top 20 in California. We worked hard for that endorsement. If you would've been parked in the McDonald's parking lot for over six to eight hours? Then yeah, maybe you could've been towed. Key word, emphasis on Could Have. I'm implore you to see this through. The behavior of this company gives us honest tow truck driver's a bad name. I apologize for what both you and Em had to go through. Be safe in your future endeavors. If your ever in Cali and need road assistance hopefully we'll be the one's to come to your rescue. Take care!😎

Bob Cat : Thanks Bob! Your correct. No system is perfect. I can guarantee you AAA was not to happy with this business practice at all. I just wanted to make sure they followed through. I'm sure they weren't the only ones to fall victim to this tow company. Hopefully more will see this video and report them. We definitely put our two cents in and sent the video to the powers that be. This is so wrong on so many levels and it gives those of us who work in the tow business a bad name. Seriously! Who trolls McDonald's parking lots for business? This tow company needs to be out of business as far as I'm concerned.
