- This audit takes place outside this Bank of America location, as I was documenting what I could see from the public sidewalk. It was a fairly large location with a drive thru ATM lane around the opposite from where I was doing the majority of my recording. When I went around the other side of the building to check out the Drive thru ATM lane, on my way back , I noticed bank security had briefly followed me around the corner. As I made my way back to my original position, a 2nd security guard came outside to have a conversation with his colleague before both of them retuned inside the front doors. Soon after an employee of the bank approached me , asking why I was recording the bank. When she didn't get the answers she wanted, she turned to go back inside, but not before I asked her if she could reassure their customers that their money was safe with BofA during this current banking crisis taking place . After a while , a customer exiting the building took notice of me recording & began saying she was going to sue me , because I didn't get her permission to record her. I offered her information regarding public photography, but she proceeded to call police. A short time later, a patrol car pulled into the parking lot to do a drive through of the area. As I made my way around the parking lot perimeter, the patrol car had already exited the lot.

Ignorance of the law, false accusations, wasting public resources and a threat of violence is always such a great combination.
Notice how security did the proper thing by doing nothing because they knew better.

Some peoples sheer dedication to remaining ignorant is almost commendable. If they were to put this much effort into their daily lives, just think how much more they could accomplish.
Yea - I think people are allergic to learning or admitting they were wrong. Many people seem to see it as a sign of extreme unacceptability to be ignorant of anything. This is exactly the best place to be in order to stay ignorant. My theory is that too many parents ingraine in their kids that admitting mistakes or ignorance is a sign of weakness and totally unacceptable.

I don't know maybe it's me because I've been watching these now for a couple years but I would think that many people would be informed about being audited and yet they come up to your camera and still say that you don't have permission to record them. And it cracks me up each time I see them say that...
They still think its worth a shot to try to intimidate you. Threaten to call the police. Because yes, every bank manager in the country has training on all kinds of security scenarios. Including this exact thing.

It's actually half true.... and this is where the problem is.... people never really seem to go deep enough in their understanding of public photography usage and WHEN consent is required vs when it isn't. So most people just assume it's required in all circumstances. As a commercial architectural photographer I have to carry model release forms for anyone in one of my shots thats recognizable. Often if they are small enough in the shot I can edit them to make them NOT recognizable and therefore sidestep the need for the release. But editorial, news gathering, press photographers, releases aren't necessary.

@@debbiemcdermott3172 California is one of those states, and I'm pretty sure the two-party consent covers the audio part only, not video. However, if an individual approaches you while you are recording then they consented.
A simple PSA in California for a month would stop these idiots for saying "you don't have my conscent"

Back around 1980, I was doing computer work at one of the banks that eventually became Bank of America. I was given a tour of the item processing department, back when banks returned your physical checks to you with your statement. The woman running the department had been there a long time and had seen everything. She explained to us new employees that only stupid people try to rob a bank by going in with a gun. There are so many more easy safe ways to steal the bank's money.
I don't know how you can deal with all these idiot Karen's and Darren's at times, you certainly have a lot of patience, and reserve, to do this. 👍 Standing up for your rights.

3:09 I've notice several auditors when confronted by an ignorant person claiming they "don't consent to being recorded" never respond by telling them they don't have the expectation of privacy in public. This guy just says "Well, I'm going to anyway". It doesn't teach these people a thing with that kind of response.

Most banks are federally Insured so why do employees put themselves in potential danger ? If bank was robbed the criminal wouldn't get but a few blocks away before getting caught

The California law has several requirements for the crime of stalking. One of them is that the accused made a threat of physical harm. Repetition is another.
It just amazes me that management needs to get involved in anything outside there inner responsibilities, other than their drive throughs.
What language were you speaking around the 7:10 mark in the video? It sounds like it could be French. Whatever language it was, or wasn't, I'm glad that you educated "Miss Karen" about the right to practice photography in a public space. But I have a feeling she won't retain that free education. I just couldn't imagine feeling bold enough to harass someone at my bank. I would walk in, do my business, walk out and be on to the next thing.
How does standing on a sidewalk and behaving like a tourist harass anybody? Serious question. I see comments like yours constantly, but nobody will ever explain this to me. 38 security cameras were simultaneously recording everybody inside and outside of that bank, so why would somebody holding one more camera constitute harassment? I'd really like to know why anybody would say anything like that.
