- I was in Brea Ca. on Father's Day Sunday (6/19), documenting (gathering phots & video) from the public sidewalk. Within 5 minutes of my arrival , I was quickly approached by two individuals from this congregation ( one who later in the video identifies himself as a pastor) , expressing their discomfort of my presence with my cameras. I tried explaining I have to them that I have the same right to be there as they do , under the first Amendment (Freedom of religion & press) they then placed a call & moments later the larger individual named Dno started to engage me by deliberately bumping into me on the sidewalk, He claimed later to Police that he felt I bumped into him . Police were dispatched & ultimately Dno apologized for his behavior in under the assumption I would not pursue further legal action, I never accepted his apology & have since spoken to several lawyers. Unfortunately none of them felt I had a case to move further. I placed a request for Brea Police body camera footage from their interaction with Dno in hopes of seeing what information of mine was given to him by police since he knew my legal name when he initiated his so called apology. The request for body camera footage was also denied. One can only guess what Brea P.D has to hide with denying the request for footage.

This is a teaching moment for the two gentlemen even though they felt that the filming of their service was amiss. First of all camera man is legally in the right. In this day and age of technology one of them could’ve just googled the first amendment instead of playing police and all of this could’ve been avoided. Secondly it’s been my personal experience that when you start to share the Gospel of Jesus Christ a lot of these guys will bolt. And if not, you’ve just planted a seed. Win-win. p.s. apology was in sincere “what may have taken place” when it actually took place.
Funny how that little girl was the only one so friendly to you and even waved at you there and said hi smiling. If only those ignorant rude grown men could learn something from that little girl.

The reason they selected could literally apply to every single police officer body cam given all of these incidents are "investigatory in nature". My guess is that the officer said some things to the church members that were in violation of policy or law and they want to cover it up.

My only guess is that the officer knows the guy and they were talking like buddies and the officer shared information that he shouldn't have,
so now the department is covering the illegal actions of that cop.

How can people in my country be so ignorant of this? But what i would do is place my elbow at kidney level. rest my fist on my hipbone and place my oopsite foot in like a t-position. this way when he backs up into me he'll be backing up into a brick wall with a pointy protrusion aimed at a veeeery sensitive area of the torso. The cop immediately began excusing the guy's behavior by saying he "stumbled into you". He didn't stumble; it was deliberate.

If you saw a video of friendly and welcoming church members wouldn't you consider going to that church? Also people would comment on social media reviews about how friendly the members were then guess what? More people would hear the message of Christ. Someone seeking help like for food or something, would be inclined to go to a church were the members are friendly.

I believe a Tom Bane Act violation might achieve more than an assault charge. Since DNO admitted guilt on camera, and since he used violence to violate your civil rights, a nice 25K civil settlement might help support the future work of "First Amendment Audit. Ignorance plus violence is a bad combination for DNO's personal pocketbook. Maybe the church could finance a go-fund-me for the big guy.

The perfect time to share Christ would have been at that moment they approached the auditor. Why would a believer want to hide their faith, the gospel? They missed a perfect opportunity. The irony, of course, is religion being steeped in freedom of speech. By denying the auditor his rights to freedom of speech, they're essentially shacking their own rights to freedom of religion.

I think you are right. At the same time churches have been shot up and members killed in recent years. This fact has folks more aggressive and cautious on security. It's understandable. They went to far. They represented the congregation poorly and themselves. We all learn everyday and usually the most from mistakes. I do wonder what would have been the outcome had they invited him over? To join them? Been friendly and cautious from a distance but if declined just let him be?

I didn't find his apology to be insincere. He just seemed ignorant of the law. The point of these videos is to educate, at least I'd like to think. Now he knows. That “apology” was not really taking any ownership. It was what I call a “non-apology apology” (or the “gutless weasel apology”). Clearly he was backing in to you and stepping on you on purpose. If his church does not condone that kind of behavior, I’d hope their pastor would reach out to you. There are some key elements of an apology (that vary based on your sources), but one key element is always explicitly taking ownership for the behavior/words/action. That was not present in what he said. California Penal Code 242 defines the crime of battery as “any willful and unlawful use of force or violence upon the person of another.” You were assaulted and battered. He never acknowledged that. Even if he claims the initial battery was accidental, after that initial time he continued to batter you even more - That would indicate a clear and willful intent to batter you in an attempt to stop you from exercising your civil rights.

“I apologize for whatever I did” you should have asked him “and what specifically are you apologizing about? What specifically did you do?” Once it’s on camera then you have the full admission. His apology was like a little kid being forced to apologize to another adult or kid - just going through the motions. He will do this again to someone else.

An apology is an admission of guilt. By the way, there is nothing a lawyer can do on your behalf that you cannot do for yourself. Initiate a lawsuit, and the church has to hire an attorney, that's when you start to win.
The only difference between our hero photographer and the lout who physically manhandled him is that our hero photographer is much more sophisticated in his planning and execution when he wants to go bully people and try to sucker them into pushing him than the dull-witted guy was who pushed him. And, of course, our hero photographer is very clever in his way of harassing people without breaking the law whereas the other guy isn't very clever about his responses.
But our hero photographer is not higher in the moral hierarchy. For me he's much lower down. He uses his intelligence to sucker people into performing in his videos so he can sell them for money, whereas the other guy was just reacting to what our hero photographer did to sucker him in.
