    "...instead of coming up with something ORIGINAL."
    That's a pipe dream. Originality doesn't exist. Someone will have always done something similar if not the same exact concept before. Don't try to be original. Try to be creative. There's a difference.

      It wasn't stealing, but it definitely was not an original piece regarding Lady D's clothing. Her face, mannerisms and physique are all original creations but her clothing is 1:1 copied. There was no altering of the clothing's look at all. The hat, gloves and dress were all copied.

    • @Pheonixess
      @Pheonixess 3 года назад +140

      @@floofzykitty5072 They weren't copied though, they were inspired. An old photograph is not a painted illustration, a complete reference design, or a 3D model. A lot of other research had to go into making it look similar, and reimagine what a similar white dress, hat, ect would look like digitally and in a 3D space. I'm sure the creators are glad people think it looks similar because it means they reached their goal, but on the other hand, when others say it's copied implies laziness and ignores everything that goes into design and development to create an inspiration.

    • @floofzykitty5072
      @floofzykitty5072 3 года назад +7

      @@Pheonixess Obviously the hat is more generic and there are probably hundreds of hats that look exactly like that created by different artists, but the dress is a different story.
      A dress is still intellectual property. If it was a more modern piece of clothing, the creator could definitely sue them for using their IP without their permission. The dress has no alterations to it at all.
      Reimagining it for a 3D space also doesn't hold much water because... Real life is a 3D space. The image still has depth and three dimensions. If you watch Micarah Tewers, she often works with an incomplete reference image where only part of the dress can be seen. When she recreates the dress she doesn't call it her own design or say it's anything other than a recreation, even if it differs in some ways *only because she didn't have the complete information*. If they *did* have the complete information of the dress, they would have used that information to copy it further.

      People who are ignorant in general, not even just about art. The originality thing applies to basically everything. There's even been instances of technologies being developed at the same time, by people or cultures who had no idea the other existed and had no idea the other was working on whatever it was they were inventing. Yet they came to the same thing, just perhaps in slightly different ways. If anyone ever thinks they have an original idea about anything, whether its art or science or philosophy or whatever, they should know that that's just their ego talking, and that idea was thought of many times over before they thought of it. And it will be thought of many times after. If anything they are tapping in to a collective consciousness, a sea where that idea already exists.
      If someone obsesses about the originality of anything, thats a red flag of an out of control ego. For them to place such high expectations of others to come up with completely original ideas, they would have to assume they are so creative and so genius that they can come up with an idea literally nobody could think of. You must be really special if you think none of the billions of people, everyone who ever lived and died over the millennia on planet earth, never thought of the idea you just had before you lol

    What happened to me there was a 'unknown person from Thailand' trying to censoring my art every single of my art ( I think this person probably hating on me so much by making like a ghost account to attack me). And this unknown person (ghost account) literally text every of my clients even since last year clients received a long message of this person trying to discredit me by blaming me that I'm copying a random character from Pinterest a 'basic pose' , "which I never seen it before".

      @@corruptedteka The thing is that's how concept art works. The art team most probably did dozens of sketches referencing different outfits, poses, etc. for the creative director to say "ok we'll take elements from outfits A and D, poses A and C and F have the feel we want for the character, now try adding this here and those elements here, see you in two days for the next batch".
      I mean is that hard to not see the final design deviates a lot from that photo and drawing in the end? It's pretty evident that's an early development sketch from the "get a general idea of the character's design" phase, one that was chosen (no wonder, it has great, well... character to start working with) from and with many others.
      And even then it's not just a copy, he adjusted the pose, added the characteristic black gloves and cigarette, etc. It's just that: Referencing, because concept artist's job is not to make beautiful marketing assets but quick and dirty graphic research to help designers decide what the end product shall look like.

    Literally even memory is reference. You can't draw something you've never seen before. Even monster designs/things that don't exist were based off real world concepts or a mish-mosh of various creature anatomy irl. I agree with everything you said. Especially considering the piece was a concept design and not a fully rendered work for selling, the artist did nothing wrong. Most companies want their artists to work as fast as possible. Using already established poses etc and changing elements is the easiest way to do this. The purpose is just for deciding on design before it goes through a painstaking modelling process and to give the 3d designers an idea of what they're doing. I would think all of this would just be common sense.

    this happened to me many years ago, someone gave me a photo (they told me it was them, and apparently it was some guy in a band I had never heard of) and asked me to draw it in pixel art for use on a game, where you can upload your own images as profile. Some group of rude girls put me on a forum claiming I traced it and I stole this mans photo to sell and did like an overlay thing, which even showed it wasn't EXACTLY the same, it was a pixel art based on reference (which they couldn't seem to wrap their heads around what a reference was, and that the image wasn't exactly matching, just similar). I even said, I used the reference image provided to do what my customer asked, I did not trace or draw on top of this image. Since this, in like 2007, it has been near impossible for me to get commissions because they still bother me with this I trace thing to this day. I make stuffed animals as well and one of the group of girls recognized a link to one of my examples I posted (on fb) and messaged my commission, told her I steal art and the girl said..oh actually I don't want to hire you anymore cause you steal. I have never traced art in my life and I even did livestreams of both drawing digital and making plush toys to prove this to people, but once they claim something and get enough following it doesn't matter...
    I used to be able to pay all my bills with my art and then had to get a full time job in retail (which is draining my soul) because of the harm these people did to my image.

Our teachers would actually get on our case for _not_ using references... like shame us in front of the class for not using enough references lol. It was probably the biggest thing they drilled into our heads: reference, reference, reference. It’s pretty much the most important thing to do when creating art. Even the most experienced and talented artists in the world still need to use references, it’s not something you should ever outgrow, because it’s impossible to know how to draw/paint every single thing in the world off the top of your head!

    I think people in those tweets were confused a bit on both sides, as there was this weird mix of things that apply to illustration, but not to concept art, lack of knowledge about copyright, lack of knowledge about references and general confusion about the grey line of how transformative is transformative enough.
    Reference usage, especially, but not limited to commercial work, depending on how does one use it can make a difference between c&d and being fine.

    I stan this video. As a perfectionist it's hard to feel ok with my art, so when I hear stupid stuff like "referencing is stealing", or something other nonsense, I then overthink about if I'm being original enough or not. Even when I'm just practicing tracing or copying I feel bad about it, even though there's nothing wrong doing it. I hate my perfectionism. It just kills my love for art, but it's hard not to think about if I'm drawing good or not.

    The people who try to dismiss referencing by saying it's "cheating" are so dumb. Like 90% of the time if you went to an American public school you have cheated and you likely didn't see that as bad. I was one of the few who didn't like cheating, but I still did it when I was desperate (mostly in Spanish) but like cheating is what you explain to little kids and you tell them it's wrong so they grow up honest and reliable. It's not what you tell adults who are far past elementary school.

    It isn't just on Twitter. A few years ago I had this same argument on Imgur with some twit who couldn't tell the difference between art theft and reference, and kept insisting that reference wasn't okay to use. So wtf are you supposed to use for a particular pose? Just pull it out of your ass, and then later on wonder why your drawing isn't looking right? Even my own art teachers back when I was in school said reference was fine; everyone uses them. And the same argument-from students-was present then. Students arguing with the professionals, *whiny nasally voice* "Isn't that CHEATING?!" Here's me sitting on the other side of the room rolling her eyes and saying "Shuddup ya nit" under her breath. Ugh, and that BS predated Twitter.
    I think people get hung on the concept of originality, and don't realize that in the creative world, nothing is original. Case-in-point: the story of Lord of the Rings. The One Ring is basically The Ring of Gyges. Both stories could be said to be an example of how absolute power corrupts absolutely. History, mythology, and folk tales are often a great source of inspiration (heck, it worked for TYPE MOON with the Fate franchise).
    Anywho, that's enough of my long-winded spiel. As for Imgur, I deleted my account-completely different reasons. Imgur turned into nothing but plague and politics over the last year, and that's really a drain on anyone's creativity.

    I believe in using reference, and do often in my own art, but I don't think much was changed in the final art piece. It looks more like a study than it does your own art. Whilst I love her design, I think a little more changes from the original reference would have been best. I don't think this is enough for Twitter to go off this much, though. The artist is fine.

    I really just want to know if this same dress was common to wear. If it was just the lady in the photo’s dress and was unique or something, I feel like it would be too heavily referenced to the point of copying. But, if it was something normal that a lot of people wore then it’s just referencing a real life outfit, like overalls and it’s fine.
    There’s also a point where you’re not completely copying, but it’s too heavily referenced and I feel like a lot of the arguments don’t consider that. I’m not saying that that’s what happened here, just that people are overusing that argument and it makes me worry that’s what’ll happen if a video game or other character is copied.

      I think there's also not much you can do when it comes to clothes either because they're not technically "owned" by anyone. You can't really copyright clothes.
      So when it comes to that you can give the creators credit but most of the time in fashion and sewing everything is useable by everyone. It's just frowned upon to take the outfit and sell it.
      Clothes are deemed as functional items so they don't get the same protection as other art forms. Otherwise you'd probably see people suing people for t shirts and any pants, skirts, dresses and socks you wear right now.

      @@whoahanant Yeah, that’s what I’m trying to say, the problem would be if it was like one of those crazy intricate one-of-a-kind outfits that you see on a runway but no one actually wears it. It doesn’t seem like that in this case, but it could be when taking reference from real life. Sorry if I’m not explaining this well.

    • @whoahanant
      @whoahanant 3 года назад +13

      @@tunamuffiin.I.Donatello no it's fine. When I was getting into sewing I ran into the same issues and questions about copyright and protection of clothes/outfits. Because as someone who does art I assumed all the social and legal rules would be the same as in the art community.
      Although there's no copyright laws to protect your outfit the community will call out people who claim that the outfit is theirs and businesses that copy and sell it immediately. But outfits are going to always be wanted by other people, this is how it works with clothes after all, so eventually your outfit will become public property at one point or another. This is how all our fashion trends start, someone makes and wears something and then we see everyone else wearing it afterwards. You will only get so much credit before the mass who isn't a part of fashion, get their hands on it. Also recreating outfits is a business and it's not really shunned. I'm not into full fashion, I just like cosplay and costumes but, I make myself clothes too sometimes and this is my current understanding of a chunk of the world of fashion/sewing.
      When it comes to a dress from (I forgot the date but it's old) it's not really protected and at this point we all can use and reference it. If it was a NEW outfit then it would be a much bigger issue but it's out of date, there's no way anyone should be counting it as stealing at this point.

      "There’s also a point where you’re not completely copying, but it’s too heavily referenced and I feel like a lot of the arguments don’t consider that" There is no such thing if you're a concept artist working in a tightly scheduled production pipeline. I feel people just don't know what concept art is or what function it serves. It is not a commissioned painting for a client, it's a preproduction step. In this phase of the production, paint-overs and photobashing is king. The production artist is iterating on a concept that the Art Director is going for and people are delusional if they think they're gonna give artists time to do fully original pieces. You need to be ready to iterate at least 3 times a day (at least that's my experience in the small studio I worked for working on mobile games; can't imagine how much more hectic it is for actual AAA)
      "...video game or other character is copied." This is why it's almost never done. Concept artists always reference from life.

      @@submarinecatdraws1079 I’m not really talking about that concept art if that’s what you mean, the finished product is still the same dress and hat just with things added on top and on a different person. Still, if it isn’t a one-of-a-kind outfit with a million details I think it was more of a common thing to wear so it’s not really a problem in this case.

    I wonder if the art nerds realize that the basic superhero costume: a skintight bodysuit with trunks on the outside and boots is based on outfits worn by wrestlers and acrobats at the turn of the 20th century? Many of these performers even wore a cape, which they would drape around themselves as they took the stage, hiding their physiques until they would do the big reveal and start their show.

    This mentality is what kept me from using reference when I was a young artist. I literally had no idea that all my favorite artists were looking at pictures or several pictures to make their beautiful pieces. Idk why I thought this. I guess I thought if someone is a good artist, heshe doesn’t need reference.

  • @joannelee5574

    The concept art pic that started this all looks more like a study IMO, the pose, lighting, and folds are identical to the photograph, but was painted by someone with a good understanding of lighting/proportion, so I feel like it was honestly a study of the image. Considering it was concept art, not an individual piece for sale, that’s understandable. I would consider it plagiarism if someone tried to sell the individual piece for profit tho (if they didn’t own the photo’s copyright)
