    Jones lawyer - we have google analytics but we don't use them. Seriously? The judge is going to believe that? Alex's defense might be off to a rocky start.

      It was very clumsy wording. What that very likely meant is that they opt-in to Google tracking clicks on their site, but they do not actually exercise their access rights to the data google makes available to them. You'd have to reference google's log information to know whether that is truthful.
      The data is all tracked by google *AGAINST* their site.
      This order was quite comparable to a defendant being compelled to produce closed circuit video footage of themselves in a certain building that is completely operated by a third party. Plaintiff would have to produce the video footage by contacting the owner of the recording system. In this case, plaintiff was rightfully required to seek this information from google.

When you do harm to someone by telling lies intended to enrich yourself, you aren't covered by a right to freedom of expression. The right to freedom of expression exists to prevent the government from making specific speech illegal.     There actually *is* proof that they used Google Analytics post installation on the domain, since a reverse search of their UA ID reveals they added it to other related domains in 2018, 2020 and 2021. It was definitely being checked and expanded.

    In order to use Google analytics, you have to have code inserted on each page of the website. The defendant lawyer's argument about a book in the library as an example is not even close.

The number of times alex Jones is being made to bend over and do things no other defense would ever have to provide. They have handed over much more in discovery than any other media company being sued ever. It's outrageous. They have his emails.. His texts... All the companies documents. Yet the plaintiff still claim they have basically nothing.... And have been given nothing. And the media keeps spreading the lies. It's nuts. On top of Alex not being able to even defend himself as the court issued a default judgment. What's the problem with a defense being able to defend themselves.... They want him to not be allowed to say they did not profit off this tragedy. What's the Issue? If you have all the proof then why are you scared about letting a defense argue a point. Oh they have no proof... And know it's not there... So they want a biased judge to help them.... And this judge does just that. It's insane. Sad to watch
      No matter how you feel about Alex Jones. This should not happen in America

    Note to litigants: Courts (i.e. judges) do not like to be played
    Using the library book analogy, if a court orders you to produce a certain book that is alleged to be in your library, you are required to go to the shelf and produce that book, regardless of whether you know of the existence of that book.

      Or If you don’t know it’s there then how do you know it’s there or not? Let’s ask him to bring his 10th grade report card in… I think it’s a little much but I guess that’s why his attorney needs to ask the right questions to prove in front of the jury that he didn’t use it. But I think there should be something to say you can’t bring in evidence that can clearly be proven never was used. Aka it’s a waste of time if it’s clear that it’s irrelevant.

      Rules for sanctions are found in the court rules of every jurisdiction in the US, state and federal. Non-compliance -- and we have seen this from Jones in every one of the tort cases -- has consequences.

      You clearly don't know what you are talking about. They clearly have the Google Analytics page tags in their website pages and likely have always had them there. That doesn't mean that they request the reports from Googles data servers. There would be no change history on any of the InfoWars websites as they likely have had those lines of code there for years. All those lines of code do is send data to Google. Google stores that data and offers tools to analyze it, but in order to take advantage of this service, you have to actually request the data back from Google. If you never requested this data from Google, then you don't have it. That is the argument made by the Defense here. The Plaintiffs are arguing that simply having these lines of code on your web pages means that you regularly request reports from Google, which is pure nonsense.

      Personal conjecture is conjecture, so here goes ...
      What the Google analytics pertinent towards Alex Jones is a) how much traffic both his RUclips channel (thus tracks with likely earnings from his channel, especially from Patreon, and other paid subscriptions/donations) plus the InfoWars website (so donations to the latter) both got/get; and b) how much traffic I think his online store, plus Amazon sales (if Google tracks that ...) for his supplements etc was/is getting.
      Bottom line, depending on what those analytics show, is, by default, likely not only show his _actual_ gross income across everything he does as CEO of his companies, but that then places a likely nett personal worth, of him the individual, without having to argue to get him to produce his actual tax returns, accounting, etc ...
      Given he's already been adjudicated guilty, in a _Civil Court_ over defamation, slander, and libel, a default judgement made after two - three years of foot dragging on his, and his lawyers part (whom may face sanctions of their own, due to their conduct ...), again, this may well be part of another penalty phase of the one - two other civil proceedings that were also ongoing.
      The reason why the Google analytics is key, is, most likely, he, and his legal team, trying to prove both the company Alex owns, and operates, and himself personally, has barely two nickels to rub together ...
      However, as analytics tend to be pretty precise, as above, my conjecture for that being used, is to prove, likely with Forensic Accounting/Analysis of those analytics, that with all the traffic, and thus likely gross, and nett profits, plus his own, personal, nett worth, he isn't exactly penniless ...
      Depending on the outcome on _all_ the damages awarded, the total, in all three cases, may 'only' amount to $50 - $60 million ... which maybe his lawyers could argue down to $45 million over all three, but who knows what the limits are, in terms of punitive damages, exist in Texas ...
      ... either way, he certainly is likely to face having to pay out a minimum of $30 million ... which I personally think is only fair, given what the families of the victims of Sandy Hook, many whose children were barely 10, or 11, when they were shot dead by a man whom should've been in in-patient psychiatric care ...

Speaking from personal experience I have seen it happen to my ex's mom when I was a teen. They dragged court out over two years and did not have a shred of evidence so instead the state tried to outlast her financially, resulting in her losing all of her assets to afford lawyers and her reputation had been tarnished from the outset. During that time my ex and her siblings had to visit their mom under conditional settings as though she was already a criminal and this continued until my ex's mom was finally found not guilty on all counts.
    Should free speech mean that libel, slander or defamation falls under protected speech if it can destroy people's lives. Clearly not.
    The trial for defamation concerning Alex Jones never happened. The defendent did not comply for 2 or 3 years (can't remember) with supplying court ordered documents. This resulted in Alex recieving a default ruling. This means that his freedom of speech was never put to the test because he ceded his right to a trial. The Texas court proceedings were to determine the damages caused by the liable party since Alex was found liable by default. Regardless of what you think, the court should not change how it works in his favor or anyone's. The fact that it doesn't does not mean Alex didn't get a fair trial. That is all.

      The most crucial point about freedom of speech is people think it covers all speech. The constitution addresses government suppression of speech. It has nothing to do with what we say about each other. Or more to the point, anything Jones said about Sandy Hooks victims and their families.

      @@johnraiti9867 broadcasted/recorded civil trials usually don't turn off cameras for sidebars (probably would be a state law, but I've watched civil trials from many different states and never seen a video feed turned off for sidebar). It's all on the record anyways. The point of a sidebar is for the jury not to hear, which they obviously can't since none of us can. There's no issue with the sidebar being video recorded.

    My sibling works for an attorney and lots of processes are left up to the para-legals or legal secretaries to do. You can really f-up if you don't file something or send out letters timely etc. I bet someone's going to get chewed out after this. Feel bad for them because a para-legal/legal secretary's job is full of attention to detail. My ADD couldn't hack that type of job. I would have been fired early on! 🤣

      If I might add one small point - it's everybody's job to assure things are filed in a timely manner. An attorney that can't cut it will always dump his responsibility on his paralegals. Most of the people I went through law school with weren't analytical enough to be lawyers and wasted a lot of time chasing side issues. One way you can tell is if they spend too long on cross and don't understand the value of making three points or less. Juries only remember so much. Use your time for better things.

      That makes me extremely skilled at fast level differentiations in Machine code. And are faster at solving programming codes that create a problem in Software.
      I’m maybe 3 times faster than my colleagues.
      But then there are something basic at keeping my apartment clean and tidy is something I Can’t even comprehend or do.
      So yes we have obstacles very big obstacles that seems so basic for other normal people.
      But they can’t do what I do. So I have had to just hire a Cleaner that comes 2 times a week.

      I'm a paralegal at a civil defense firm. We do not have doctorates, attorneys do. They are the ones that have to answer to the Bar Association, not paralegals. It is the attorneys responsibility to make sure the rules of civil procedure are followed. Paralegals do not practice law, we cannot ultimately be held responsible for these kinds of mistakes.
      Also, I find my ADHD to be an asset when it comes to my career. You have to be able to juggle 10 different things at once and switch tasks/focus at the drop of a hat.

    My first impression, from these moments about the sanctions and Google Analytics and the failure to file something is that the Court is bending over backward, but the Defendant and his counsel are trying to play "hide and seek" with the required disclosures, and the Court is on top of what's real--which appears to be, like in the previous case, that the failure to provide discovery about profits is intentional and violates the rules. The Defense counsel is cool, and I don't know what kind of community is hearing this case, but his repeated weakly stated excuse that he is "relying on what he's been told by his client" is like forfeiting and winking to the Court that his client is fully aware of what he's doing and doesn't care what he's supposed to do. And if that's all they can say on these issues, that portends we might be in for another big win against Jones. This strategy of letting a default happen by not giving discovery sounds like its coming from Jones, who believes he knows what jurors, like his listeners, think. He thinks he's better of pretending he can't fight, so he lets the default happen. He's surely relying on the publicity that will keep the faith amongst his most ardent followers. And clearly, he's believing bankruptcy will also help him. He should fear the bankruptcy court. They can simply say they are going to look back in time before he filed. This Plaintiff's lawyer is very aggressive and, most times and in most places, smart and very aggressive trial lawyers are appreciated by jurors.

      As a former paralegal, if he filed anything, he would be able to present a file-marked copy. When we file documents with the court, we take multiple copies and get them file-marked and send a file-marked copy to every lawyer and keep one in our file.
      Any lawyer worth their salt would absolutely have a file-marked copy ready to present to the Judge, if it had just been filed the day before.

The woman they put on the stand the other day admitted that Jones doesn't research anything, he just hears something somewhere, he likes it, so he repeats it on air. She admitted that he did it all for money. Jones is presumably paying these people to NOT put on a proper defense.
      In your professional experience have you ever seen anything like this? Lawyers NOT actually defending their clients, but willingly laying it all out there for the public to see?
      Maybe I'm just not seeing how impossible it would be to defend Jones, maybe they really have no options. Craziness...

      @@johnsmithe4656 I have never seen anything like this and I was a paralegal for 20 years. But a lot of it is the client and the attorneys I worked for would not have tolerated Alex Jones’s BS and would have fired him as a client. I’m not sure how competent his attorneys are.

    It's relevant when your client hides it for years claims he doesn't have this information and then his other attorney accidentally lets it loose now the information is out there and we have it we're going to use it I mean honestly he hid this information he was supposed to hand over and then lied about it again and again and again and again this man needs to go to jail for perjury I like can't take anymore of him.
