      Incorrect! Ppl are allowed their own decisions and even change their minds. The interview I saw stated 3 were for life and one after hearing about his mental state changed her mind.

    He hunted down his victim which were children and executed them and he planned the whole thing and he gets life without parole! How many children must he execute to get the death penalty? I’m confused! Is their a number?

      The decision to recommend the D penalty is not just based on the crime, it’s got a lot to do with mitigating circumstances, etc. This is why the trial focused heavily on establishing his state of mind.

      I agree it had nothing to do with the number. He never should have even been placed into MSD school. He should have been in a care facility but no one department ever wants to accept responsibility for these types of brain damaged people. look what the state has spent now to prosecute this guy. They could have paid for him to have round the clock care for his entire life for less money I’d say… and that’s what he needed. No access to guns and the Internet and no one watching what he was doing.

      It was a death penalty case, but someone decided he deserved to rot. Nothing you can do about it. He will die in a box either way. You can’t force someone to choose to kill someone. He didn’t get what he wanted. We should be happy he’s probably miserable.

You know the death penalty usually takes decades to be a thing, then the families would have the wound reopened again when it comes to appeals and the countdown to the day. 🤨 What if he got a stay? No one had mercy on him. That wasn’t even an option. Your need for delayed vengeance is, though, and its honestly gross. I’d off him myself, happily, but justice doesn’t work that way, children.

    They’re asked when selected if they’re opposed to the death sentence. That person must have lied because there’s no reason he shouldn’t have got death

      Just because they are for the death penalty doesn’t mean they have to impose after hearing the aggravating and mitigating factors…it’s was the whole point of this for the jury to hear the evidence, and clearly 3 out of the 12 felt some of the mitigating factors felt it wasn’t warranted.

      Opposition to the death penalty doesn't mean they will definitely recommend it. If they only wanted jurors to do that then what would be the point of this penalty phase? They'd just give him death. No need for all of this.

    I just don't see what would call for a death penalty if this doesn't. My heart broke watching the family members hearing "no". The wife and son that walked out was my breaking point. We can't imagine being in their shoes, we can try, but would you really want to let someone that viciously killed your babies or husband life a long, easy life with a free bed and free meals, free health care? I just don't see how allowing these people to live, basically getting away scot-free, is going to set an example for others who think about doing these types of crimes.

      Hi - I do think that a person who did not have fetal alcohol syndrome and obvious brain damage who did this crime, or even way less than this crime, could be held to a death penalty, but I think in this horribly sad case, the person committing the crime should have never been put in the situation he was in. He should never have gone to that mainstream high school and he should never have been allowed to be alone, let alone purchase a weapon etc etc. He should have been in a home for mentally disabled people where he had someone watching him every day.

      Aside from everything presented in the case, aside from the wishes of the victims' families, it depends on how you view it. Some would say that having to rot in prison for the rest of your life knowing what you did, is the harsher punishment.
      Also, I would like to offer a different perspective: if someone is sui. cid. al, they may commit harsher crimes in hopes of either death by cop, or death by trial.
      There are cases when the families are angry and upset that the person got to get off scot-free by way of death.c"cc"":$⁷::⁷$$⁸8y::::⁷g7g%%%%%and

      Something else that would be sad for the parents is 20 years of appeals if he had been sentenced to death. More court appearances, dragging this out even longer for what? The possibility that maybe even Florida would get rid of the death penalty by the time he exhausted all of his appeals. Every single day is a sad day for these families, whether that guy gets life or death.

    This is just plain weird.... the jury only in deliberation for 7.5 hours with one juror against the death penalty? WTH?!! So just like that, with no discussion or persuasion from the other jurors, no re-evaluating any testimony or documents of the brutality of this horrific crime?!! In 7.5 hours?!! This is asinine!!!!

      One juror was a hard-core hold out with a 'no' for the DP. The jury decided to sleep on it. When the next day arrived and nothing had changed they gave up and submitted their illogical decision to the court.
      There is NO way that the aggravating factors didn't outweigh the so-called 'mitigating' factors.

      Yeah it really has been one of the longest trials over something that was very straightforward. Many strange things happening over the trial as well. Very disappointing for those poor parents and families. 💔

    Why was a juror that did not believe in the death penalty allowed to sit on this jury. She should have been honest from the get go and recused herself because of her beliefs. These crime were so hanous that he should have gotten the death penalty. He plead guilty, there is no debate, he deserves death. What about the parents that will never see their children grow up and never have families, She should have never been allowed to sit on this jury.

      Everybody's calling it a Mistrial forcing the judge to reverse her decision because 1 juror has not only lied but was influenced and the rules stipulate your not allowed to have any person juror,judge or lawyer or anybody influence your decision so.... Mistrial

    The problem is in part the fault of Florida Law. There should be no circumstance whereby ONE juror can decide the fate of a defendant that is in opposition to the other 11 jurors. This is a flawed system.

    When they polled the jury "is this your decision"? ONE (or all 11) of them should have said "NO" & hung it right there! Eleven did NOT agree.

      @Melissa Jayne I don't know of a case where this has ever happened. But I do know they would have either had to start over OR it would be a "Hung jury" & they would have to begin the trail again with a new jury? This verdict was BS!! I have been on a murder trial in Texas & I can guarantee you that I would have said "NO" when polled in this case! Almost all juries get polled after their decision!

      @Melissa Jayne I'm not 100% positive, but I think because the jury has to be unanimous for death they probably would have been sent back into deliberations, and if the jury was still unable to make up their minds they might have had to do a retrial. Either way a hung jury would not get him the death penalty because they all have to agree to it.

    This is a slam dunk death penalty case. He did it. Tons of witnesses saw him do it. The physical evidence prove that he did it. This act of terrorism was carefully planned out and he had no remorse after the act was done. He willingly surrendered to police instead of taking himself out which means that at the very least, he wanted to live. He didn't bother giving the victims a chance to live so his life should be forfeited.

      @valcaron I agree. I just mean in terms of impacting the jury's decision. Threats are not okay, but the kind of threat does matter for legal purposes here I think. Either way no need to threaten someone if you think they are lying, just report to the bailiff.

      @@dracofalconis7865 it’ll cost tax payers around $1.26 million to put him to death. That’s counting the years he’s in prison for all of his appeals and then the cost of putting to death and burial. It’ll cost around $740.000 to keep him in prison.

    Just highlights the weakness in our society it seems. If you think killing 17 kids and adults in a school doesn't warrant instant death, regardless of any mental health issues, seems as crazy as he is. If a dog is rabid and bit 17 kids in a school, you don't not put it down because it's not his fault he's rabid. He planned this. It was calculated and executed, he went room to room, murdering children on valentines day. Imagine looking those grieving parents in the eye, after burying their children and suffering the facts of this case for all this time, and making them suffer the fact that they will now be paying for this animal to have three meals and a bed to sleep in. Sad

    No one knows what that juror's reasoning was, nor who that juror is. Just go by actual facts. The families wanted the death penalty, but the juror decided against it for some reason. The juror decided against family wishes.

    Florida actually had majority jury rule and/or judge imposed death sentence until 2016 when the Supreme Court of United States struck down that statute with the Hurst v. Florida decision. That lead to death sentences being unanimous and removed judge imposed death sentences. You are seeing that decision play out today.

      Actually what you’re saying is not entirely correct. Hurst v. Florida applied the rule of Ring v. Arizona to the Florida capital sentencing scheme, holding that the Sixth Amendment requires a jury to find the aggravating factors necessary for imposing the death penalty. In Florida, under a 2013 statute, the jury made recommendations but the judge decided the facts.
      The decision in Hurst only removed the judges power to ultimately decide on advice from the jury. It made clear that only a jury could sentence someone to death. This ruling did not change Florida’s juror supermajority rule. It was actually the Florida Supreme Court that ruled against the supermajority rule.
      After Hurst, the Florida legislature passed a new statute to comply with the judgement in March 2016, changing the sentencing method to require a 10-juror supermajority for a sentence of death with a life sentence as the alternative.
      This new sentencing scheme was struck down by the Florida Supreme Court in a 5-2 ruling in October 2016. The court held that a death sentence must be issued by a unanimous jury.

      You can’t overturn a verdict when it benefits the defendant unfortunately. The State isn’t allow appeal a conviction because of the 6th Amendment.

    That father was right yesterday when he said peoples’ feelings or religion should be out of the equation when considering a punishment, an eye for an eye is the only REAL justice, & no one but the criminal decides what the punishment will be since it would be what they did to the poor victim, let them have a trial, let the jury decide guilty or innocent, give punishment immediately, that’s a deterrent, & the focus is placed on the victim & the crime WHERE IT OUGHT TO BE, this system is not justice, this system we have now is a JOKE.

    The law must be changed to majority rule so that a juror that lies about being able to give the death penalty when warranted is nullified. It's insane that 1 juror can nullify what everyone else deems appropriate. Why is 1 person's opinion more important than the majority?

      That was the law until 2016. The Supreme Court of the United States struck down majority rule and Judge imposed death sentences with the Hurst v. Florida decision. Florida had to conform to the Supreme Court decision.

    The juror who refused to vote for the death penalty told the judge during Voir Dire that they could vote for the death penalty if they felt the evidence would show that the death penalty was appropriate. All potential jurors must answer that question. Many opponents of the death penalty lie about their true beliefs during this process. I’m sure in their minds they see themselves as champions of a great cause to save lives. The problem is, in my opinion, some people deserve the death penalty for their evil murders.

      How do you know any of those who voted in favor of the DP did not vote their personal opinion?
      All this talk about how the juror(s) who voted for LWOP must have lied during the selection process and were never ever going to vote for the DP no matter what, but somehow those who voted the other way are immune to lying during jury selection and were absolutely truthful, objective, and free of any error the whole way through.
      The rampant mindset in the comments of “I don’t like the verdict, so those responsible for it are wrong/problematic/corrupt and deserve to be punished” is so indicative of a primitive nature and outrageous sense of entitlement.
      And if judicial sphere in regards to the death penalty continues moving in the direction it has for the past couple decades, you can expect capital punishment at the state-level to become virtually nonexistent.

    Despite the fact that there appears to be Jury tampering, State Prosecutors are NOT looking to set aside the verdict. Why not?? State declared this to be a "safety issue" & nothing more. Apparently 2 Jurors were in fact threatened or intimidated during Deliberations. Apparently, during the reading of the Verdict, 1 Juror was trying to get the attention of Judge Scherer but she didn't see this person doing so. Today, the State asked & received permission from Judge Scherer, to have the Sheriff's Department to conduct an investigation into this matter. Was it this lone Juror who had said she NEVER planned to vote for the Death Penalty who committed this possible crime? This is absolute craziness.
    My heart goes out to the Families who now have more anguish to go through because of these new allegations. God be with them as they sort through today's new declarations.

    I sincerely doubt this is going to change the sentence. The only thing that could come out of this is charges against a juror or a contempt of court. Any official declaration of a mistral would cause a delay and would cause this to work its way up to SCOTUS.

    This juror may have decided at last minute they believe he indeed deserves Death but feels they can't be part of deciding that..even if that's the case that is what alternate jurors are for so how about contact the Judge DURING deliberations and ask to be replaced-NOT after the verdict has been handed down.Most likely scenario is this juror never intended to vote for death regardless of evidence and in that case this juror has indeed caused a mess and should be charged with something.These families do not deserve to have a repeat of the last several months.

    The flipside to the same coin is that if a juror is not allowed to vote for LWOP instead of the death penalty, then the trial is pointless, they may as well just sentence him to death as soon as he pled guilty and save a shed load of time and legal fees.

    And there it is, a juror wanted attention and said no to the Death Penalty. Now she is claiming jurors threatened her. Good job picking this juror!
