Concerning Crimea, not only the prohibition of annexation is relevant in international law but also the right of self-determination. In Katchanovski's paper of 2022 on the Ukraine War there is no reference to Baud who had already published books and papers on that war at that time.

The ICJ is a more political body than the ICC, merely based on the simple fact that actual countries like South Africa are party to the ICJ petition process, whereas the ICC warrant process is strictly governed and initiated by actual lawyers. So when Karim Khan is excluding accusations of "genocide" from his warrant applications, it is probably because he is a less politicized and less activist actor than the South African government. The ICC also exists for the purpose of addressing crimes against humanity. Israeli settlements in Palestinian territories are crimes, but they are not crimes against humanity or acts of war; they are petty crimes. The ICC would therefore not in principle have the domain to issue arrest warrants in response to the settlements.
