For many businesses it depends on the offense but I def agree with you. You wouldn't hire a bank robber to be a cashier. Sheetz has a no tolerance policy about backgrounds and that's okay because it's their business but background checks are not a skin color.

Both the company and the injured person should sue the government, for negligence. The government is guilty of negligently forcing the company into failing to cause due diligence in hiring.
