  • @chrisjenkins203

    As wild as this trial has been, I can see this trial being used for case study and scrutinization for law students. It contains so many examples of proper testimony vs improper/inappropriate testimony. Examples of how to relate with a jury and come across as reliable vs testifying with a combative and defensive tone, which typically results in a jury dismissing your “professional opinions” and damaging your ability to win your case. It just has so many good vs poor examples to study and learn from. It certainly has been an entertaining one to watch.

    • @victrola2007
      @victrola2007 2 года назад +18

      It will be absolutely be studied in part of, possibly, a full seminar or a course on the trial as a whole. Certainly, proper and wrong way to interpret and apply 'The Goldwater Rule'!

    • @chrisjenkins203
      @chrisjenkins203 2 года назад +15

      @@victrola2007 Exactly! I would’ve never imagined this trial was going to be the rollercoaster ride it turned into. Yes, I expected some inconsistencies vs what’s seen in everyday trials. But for a deformation trial, the fireworks were vast and delightful.
      The “expert witnesses” (and I use that term lightly) for the defendants side and “Miss Heards” testimony of her own were just a complete train wreck to watch and hear.
      Also, Depps behavior, composure and overall mannerisms were so intriguing and satisfying to watch. For a guy who openly admitted to so many unflattering attributes and habits, he still managed to come across likable and more importantly, sincere and honest. Unlike Miss Heard, who came across extremely unlikeable, unreliable, dishonest and borderline fraudulent.
      It was such a genius move for Depp to start off by owning all of his flaws and that way, the defense couldn’t use them against him later on.
      But those are just a couple observations of what will make this such an intriguing and productive case study for future law students. And you’re correct! It contains so many rarities that I can already see places like Princeton and HLS including this trial in case method classes/workshops.
      This particular case is unquestionably worthy of in depth dissection and scrutinization. IMO, It certainly commands the attention of law schools and students. It will undoubtedly encourage productive, informative and beneficial ethical exploration and study. I can only imagine the discussions and knowledge it will provide future law students with.
      I’m actually reveling just thinking about how dynamic, rewarding and gratifying it would be to participate in such a class that includes this in its curriculum. It definitely resulted in being one for the books.

I am dismayed that Dr. Spiegel is treating patients and providing “expert testimony”, especially in a area of practice where many individuals struggle to be heard and overcome stigma related to mental illness, self harm and substance abuse disorders. His testimony showed bias and a total lack or empathy, as well as “traits” of projection of his own perceived shortcomings.

Spiegel used “snippets” of the UK trial, some deposition material, and (arguably between his own deposition and testimony yesterday) also some of Depp’s acting. Last day of testimony tomorrow and I 100% believe that Johnny is innocent of everything with the exception of being caught up with addiction.
      Addiction was his downfall….. and Amber used it against him as a way to record him she manipulated him and regardless of the verdict Thursday
      This whole trial has amplified global awareness of the possibility of men Being victims in our society and beyond. Amber has made a complete mockery of a movement for women in the industry to stand up against powerful men using their money and power against women for leverage to get what they want. The truth is, Amber and her entire defense and her testimony is a collaboration of a projected perception of what she did to Johnny. She did every single thing to him that she has testified he did to her. She is THE ABUSER! She is calculating, she is cunning and now she is CANCELED!
      And I still stand with Johnny Depp

      so does the definition of psychopath, The most important testimony of the day was David A. Kulber, Johnny's hand specialist. Johnny's lawyer established Johnny could not punch with his right hand, and he also could not grab with his right hand. Amber's sister claimed Johnny grabbed Amber by the hair and punched her. If he had hit her with his injured finger, he would have had to get his cast fixed, which the doctor said he could not do. That would mean he had to have grabbed her by the hair with a hand that could not grab. Any way you look at her testimony it could not happen. Additionally, if he had been able to punch with his pinned finger, the bruise on Ambers face would have been on the other side of her face.

    • @robertsavage8270

      A psychopath is defined as an individual as having a lack of empathy for others, but uses charm and charisma to manipulate people they encounter. Psychopaths are not recognized as an official mental health disorder, but psychopath traits include using people to gain power, money, and more without any regret or remorse.

To bring a witness to the stand to not simply support/disparage Heard or Depp, but to educate the jury on why the activities of one of the expert witnesses is wholly counter to what is expected of an "expert" of that profession. She presented herself as his soulmate by mirroring him in only ways a narcissist could do (since she clearly isn't his soulmate). That's why it took him time to see the real her. She was slowly boiling him like a frog in a pot of water. It wasn't from the beginning. She thought she could abuse him, use him, demean him, and then be him... she thought she thought she thought. She was wrong. And now the world is watching. She will forever be ruined. And he has made history with this trial. This is what attracts psychopaths like Amber Heard and her friends who mooched off of Depp just like Amber Heard did. Because many of them have received lots of therapy over their lives like Amber Heard did they have learned tactics from their therapists which they then use on their victims. We know this because one of her friends who was a witness for her said they bonded over their interest in reading and psychology and this same mooch then moved in with Johnny Depp after he and Amber Heard bonded over how to practice psychology on victims.

      People attract people they recognize their own values in. Heard doesn't come across as a person who necessarily values intellect or truth-seeking, but more so status, charisma, and dominance. She herself emphasizes dominance in most of her stories (e.g. repetitively challenging Depp's manliness). It isn't surprising that her witnesses and lawyers portray similar characteristics.
      I'm more surprised that everyone in these comments is so positive about Depp's witnesses, given that all of Heard's experts portray the exact levels of populism that have been extremely successful in (American) politics the past few terms.

      I'm not an expert and English is not my native language, but I assume the differences are the same between "ciúmes" (jealousy) and "inveja" (envy).
      Envy is wanting to have a quality someone else has. It's not necessarily bad if the reaction is constructive. It's destructive and negative envy if you try to harm the person that is better than you. It's constructive and positive envy if you try to better yourself using someone better than you as a role model or reference. For instance, you may envy someone because that person is better looking, or stronger, or knows how to do better drawings, etc.
      Jealousy is a negative feeling about the supposed relationship (real or imaginary) between two people. You're jealous of X if you believe there's something (R) between X and Y, and you also want R, don't want R between X and Y, and you're hostile against X because of that. It's like the feeling of betrayal. For instance, you may believe your partner has secret affairs. Or that your parents love more a sibling.
      Did I describe the differences correctly?
