      you cannot auto-renew tax, an MOT is required no current MOT means unroadworthy by default, ie you can not tax it.

      So let’s all just be a bit more Blaise about taxing our vehicles, when dvla turn up, run indoors tax it and job done. Moral of this story ! Justification: I’m a law abider !! Tell you something, minute the roads are in disrepair, you’s lot will be first to comment and make another video ! And before we go on to the other subject that tax does not entirely go on roads, yes we know it goes everywhere else inc. nhs

      He was held ransom on a private car park...legally mind you... The car park's owner could have charged him whatever he felt charging...legally... And hold his vehicle as collateral until full payment has been received... legally. This tantrum toddler should be glad he met a very nice and mellow guy and not me (for instance)...I would have had him pay up big time... possibly 5 years of road tax worth...and some fees to let him leave (open gates , taking time from the CEO and such like)

      Even though he had admitted not paying tax, under law clamping a car is classed as stealing, even if its by the DVLA... So good on the guy prison guy. Plus they bleed us white on the roads with taxes left right and centre. Its atrocious

      FYI. DVLA clampers are not a con, WILL tow your vehicle AND crush it if you don't pay.

      @77MrAH you normally get multiple letters and it'll be almost two months before they come looking to clamp it.
      This was either a spot check or this guy has the car registered to his place of business and the DVLA clamper has come a looking after the warning letters have been sent.

    Can tell you work in a prison, you are so chilled about the way this guy was behaving, but you've probably had to deal with much much worse. Well done for keeping it calm and dealing with it politely. And I'll be double checking my tax auto renews this year! Thanks for the heads up!

    I'd report him to DVLA, get a witness statement from your colleagues and the police officer to back up your report. That is completely unprofessional behaviour, he should not be in a public office position dealing with members of the public, with that kind of attitude! 😲🥺😎👍

      @hffp1 yep correct. I've seen it done on here "RUclips" and the police said pay to the clamping company or fuck off....he fucked right off. I guess a civil case would need to be brought and proof of ownership will be found.

    They do have a job to do. In this case though it was blindingly obvious there was an oversight. You immediately sorted it. Probably just has a massive chip for prison staff. Total respect for you, both for the job you do and the calm manner you dealt with this person.

    Mr Clamper ain't getting no commission today. DVLA tax enforcement is run under tender by a private company called NSL who do pay their operatives by commission 😃🤣😂

    How can the DVLA clamp a car for not being taxed, if it's parked on private ground, off of Her Majesty's highway?
    The police were called because they would not let Dom out until he paid the car parking charge, so why did the police attend, as this was a civil matter, not a criminal matter?

      Rog5446 Becauae by law the car needs to be taxed or SORNed, when not taxed you need to register the car as being parked up of road and where. If the car had a SORN showing the address of this private car park, then he'd be legal.

      Not so, I have a car that was not insured and kept off road in my court yard.
      I had a letter from the DVLA saying that according to their information, it was not insured and they instructed me, that if the car was not being used I should SORN it, which I could do online.
      When I registered it SORN, they did not enquire as to where it was being kept and I duly received a cheque from the DVLA for the residual of the tax.

      Listen to anybody explain a tussle and they always seem to be the calm one, with the other guy very unreasonable. This is something I learned about life. You need to have been there and seen it to know. Not saying this guy is embellishing it, but he could have been.

    I had an old Mazda which wasn't taxed but I had it parked outside my house.
    Now, I must be honest I did know full-well that this was illegal and that the vehicle should be taxed if it is parked on the public road.
    But I had taken a relaxed approach to it - I reasoned that I was not driving the vehicle about and it wasn't in anybody's way parked right outside my own house, so I left it there.
    So one day, the Wife and I are coming out the front door to go out for a meal (it was actually my birthday) and I see that this fella has taken a photo of my car and disappeared behind a tree into a van.
    It's a DVLA van.
    I go to speak to the guy and right away he is confrontational. Right off the bat.
    Now, I know he probably has a lot of arguments with angry people who are having their car clamped, but I had not been confrontational with him at all and I must admit I did feel a bit intimidated by his behaviour. He wasn't just confrontational, he was aggressive with it too.
    I tried to reason with him but he wasn't having any of it. He'd got my back up with his attitude so I thought, fine - I'm moving the Mazda onto my drive before he puts the clamp on and then I won't let him on my property.
    That plan went down like a lead balloon as the bloody battery was flat, lol.
    So I was screwed and I had to pay the fine to have the clamp removed. But here's the real kicker:
    The guy explained to me that if I paid the fine that day the clamp would be removed and as long as I also taxed it, or moved it onto my drive immediately, that would be the end of it and there would be nothing more to pay.
    So I paid it, clamp was removed, and I taxed it. I thought everything was done and I forgot about the incident.
    Months later I get called into the office at work. We've received an attachment of earnings, they tell me. £900. It'll come out of your pay in monthly installments.
    I couldn't believe it. They weren't told what it was for either, just that it had come from the courts. I phoned the court and found out that I was also supposed to pay an additional fine to the DVLA and that I'd been prosecuted for non-payment. I'd had no idea any of this was going on!
    I then had to explain to my employer that it was due to non-payment of car tax but it was a very embarrassing situation and I could not believe how much the fine had ramped up.
    Anyway there were no installments. They took the full whack the very next month, straight out of my pay :(
    All in all I got done for more than £1000.
    I understand it's my fault but I do feel hard done by. I always tax, insure and MOT the vehicles I drive about. The *only* reason this particular one wasn't taxed is because I had it parked right outside my house and I never drove it anywhere. It's still against the rules but the penalty didn't really match the crime in my view.
    Won't get caught like that again.
    But yeah, the attitude on these DVLA enforcement staff can be very bad.

      Not at all sure why you feel hard done by. You knew the vehicle should be off the road, but didn't bother. With road tax around £300 I think the cost of evasion (£1000) is about right, otherwise it would be worth taking the risk of non-payment. I bet everybody you told will be sure to SORN, or pay.
      Yes, some enforcement staff can be lacking, but just imagine being in their shoes. Hearing the same stupid excuses (like yours), day upon day upon day. Not to mention the verbal abuse they inevitably receive from people pissed off they've been caught.

    I used to park behind my flat, It was in a car park for the shops loading in and other flats in the run of above the shops. 1 day I woke up to find a clamp on my car. they had just 'privatised' the car park. there was a guy clamping other cars too. No warning had been given that the car park was going to start charging. I explained this to the clamper, had no idea the car park was going to be charging. So i got out my hack saw and started sawing thru the clamp. Clamper called the police, one arrived, very quickly, and said to the clamper it's not criminal damage until I had cut right thru the clamp. Spluttering clamper removed the damaged clamp. I told him I would just cut it off if I was ever clamped again. I parked there for free for the next 6 months.

    If it should have automatically renewed (didn't know that was an option), but didn't, the failure was in the control system, not with you. If so, you didn't get lucky, you were switched on. People are swindled out of so much over a life time. Calm rebellion, nice one.

      @@the90sfattyfromtakethat Nonsense, of course automatic renewal isn't the default action. To auto-renew you need to select that option, then ensure the funds and card are in place to pay when its due. He didn't do this, didn't read the warning emails and so was clamped at the registered address he'd given, which incidentally they're permitted to do.

      No, wrong. He failed to ensure his direct debit was valid, so he's just as guilty as anyone else who hasn't paid. The failure was with him, and he was lucky to get off.

    Your car does not need to be taxed to be parked on private land, he was trespassing, your car was clamped illegally. Doesn't matter whether you taxed it before his clamp or not, he can only clamp your car if it's on a public highway. Nice of him to give you heads up though that your tax hadn't renewed ;-)

      Not true. It can be clamped in carparks, and at the registered address- which is where it was, and is how the clamper found it.

    My car tax too was supposed to auto renew, got a letter last week from the DVLA saying it wasn’t taxed. Did it immediately online and then called DVLA because there was back tax to pay and asked why it hadn’t auto renewed, they said because the MOT was ‘due’ to run out (not had run out) and they wouldn’t tax a car without a MOT. My MOT was carried out on time, however the DVLA said they don’t check this afterwards but should have written to me, I didn’t receive any letter so could easily have found myself in the same situation.

      FL34747 I knew it was going to work because I checked the payment for my internet had come out of my bank account. Should always check you’ve paid for services you’ve used otherwise you could get a situation like the guy in the video did.

    This is a victim of a system which I believe is a money making revenue. THEFT. Fair play to him as he acted with complete calmness and politeness. He went out of his way to reason and problem solving this situation. I however would of acted somewhat different. However I myself had my car clamped recently by a private contractor.As my car is a soft top convert able they were unable to impound my car,which is what they normally do in my area.I can only guess they need a bigger and a different vehicle to have my car lifted because lifting by the two sides would actually rip the soft material roof? I have to be completely honest my car was not taxed and over sight by myself.The car is exempt from tax under Disability,but I have to still fill in the forms each renewal.The following day I taxed it then phoned the company to remove the umbilical cord but they were not accepting my credit card or a friends. Which we were both could not understand as there was sufficient funds? Anyway I was not putting up with the inconvenience and letting them incur even more charges.So we removed the car from the road after it took 4hrs getting it onto a small lifting vechile. Very difficult with a clamp round the front wheel. Was not going to break the clamp and break any law concerning DVLA man law of theirs.It threatens and warns DO NOT ATTEMPT TO REMOVE THE CLAMP AS IT WILL LEAD TO PROSECUTION DVLA. It does not say you cannot remove car with clamp intact.Was not prepared to leave my property on a road 20 minutes away from my house.It was after 5 days and nobody contacted me or was visited by the heavys. So I learnt to pick the lock and removed the clamp with any damage.The clamp is in my garage if DVLA wish to have their umbilical cord back. Further more when I taxed the car I had to start the tax from the 1st day of the month which the clampers had placed the clamp after the car in theory was legally taxed.My advice is don't give in to theft threats ect made by the DVLA but find a way to beat them legally. I did and looks like I have.

      You say he is a victim, but how ?,
      The way I see it is, he had no tax prior to being clamped and had been using it on the road illegally, also automatic renewal of tax is by direct debit and if a payment fails then the DVLA will send an email on that day informing you they will try again within 4 days of it happening, if it fails again another email is sent permanently cancelling the direct debit, Vehicle clamping for non payment of vehicle tax usually happens after a fine of £80 has been sent to your address and it has not been paid so he must of been aware , unless of course he doesn't check his emails and post, in this day and age I think the majority of us check emails daily on our smart phones and have post delivered daily.

      A message to BB which I think I must answer for everybody. First BB are you a Clamper or even worst DVLA? Would you like your clamp back? My suggestion is to play and watch the whole video and listen to what this VICTIM actually says. Lets not forget this man is too busy looking after real CRIMNALS. Furthermore your information is incorrect. DVLA send out a SORN letter before tax runs out. As for e.mails from DVLA are you having a laugh. Try contacting DVLA is an impossibilitiy. They have no time to be personal with anyone.Myself renew my car tax through the POST OFFICE simply because I don't have a bank account. DD is a choice.I find it more difficult to remember when my tax is due since they abolished the tax disc. How convenient is that for DVLA. Further more the clamper trespassed on PRIVATE PROPERTY. He has not been given permission to act illegally on someone's PRIVATE LAND. Where do you come up with a statement saying the car has been illegally driven on the roads. The car was parked on PRIVATE PROPERTY therefore was not on the Public Highway.This gentleman actually was so gentle and tried everything to solve the situation. He actually behaved professionally unlike the clamper who works in the public eye. He is certainly a VICTIM of verbal abuse. As the Policeman stated would you like to press charges against the clamper. To which he replied no. Verbal Abuse is a criminal offence, the highway taxation does not come under criminal law. AMEN

      @@builderboyish email should not be relied upon. Email is (was) my job for many years, I've been developing messaging and mailing systems since before most of you had heard of the internet. Email is not a reliable form of communication, there are too many ways for it to go wrong, there's no end-to-end verification, messages get eaten by spam filters (because 99% of mail admins can't run a spam filter right), or get lost in mountains of spam in the user's spambox. I could make email as reliable as they wish it was, many mail admins know how, but that would require every mail admin in the world to change to a new system in lockstep with each other, so it'll never happen.
      secondly, the government can't send postal mail right to save their lives, I've had appointments sent by government departments where the date on the postmark was 3 weeks after the date on the letter, 2 weeks after the appointment, and I've had that same cock-up 5 times in a row until I had to ask my member of parliament to sort out the ensuing mess for me.
      I'd agree with you if the chosen methods of communication were a little more reliable. They should use SMS, and use return receipts or whatever the SMS world calls them to verify that a message has been delivered to a set of eyeballs not just delivered to a phone. If they can afford to employ someone to stick clamps on why can't they employ someone to hand-deliver a printed version of the message to the home address of anyone who fails to open the SMS version of the message?
      The facts are that the objective isn't to ensure you pay in the first place, it's to extort you when you don't pay, and anything which helps you to not pay is a good thing from their viewpoint because then they get to demand large amounts of money with menaces.

    nothing to feel guilty for re not paying your tax. a similar thing happened to me 3 years ago, taxed it on-line with the promise of auto-renew every year. 13 months later got a letter from DVLA saying i had been fined £60 for neither renewing or declaring a sorn. i checked back and found that indeed my tax had not been taken from my account the previous month. i re-taxed it straight away, it had been parked on the road and driven over the course of the untaxed period so i guess i was lucky. wrote back disputing the fine as i had complied with all of their conditions and it was therefore their fault for not collecting the tax as stated they would. two weeks later got a letter back saying that " under the circumstances, no further action will be taken"

      Wrong. If a car is not taxed or declared SORN, the DVLA will have it clamped as they are a government department.

      In Scotland it is, as it's classed as demanding money with menaces, or something like that.
      One of my ex students got clamped and said that 5 large guys and 2 trucks turned up and were quite intimidating. He and his partner were trying to get to their work in a hospital (he works in A & E), but had to find £300 to get unclamped.
      They should have taken photos of the guys, and if they ever come into A & E, delay treatment for the same amount of time that they've delayed you (hopefully the fuckers will need it at some point).

    I moved house and didn't change where my car was registered so didn't get the reminder. I got clamped n it cost me over 400 in total. The DVLA charged me for a couple of different things and I had to pay to get the clamp off. I'm surprised if u don't get a fine for not having tax on ur car.

      @@markplenty2631 There's not much of a way to help a person with a chip on their shoulder ... it's been with them for years and will likely remain for good ... hence his seeking out such a job along with acting in the way he did in this situation.
      We need parking enforcement officers for example ... we need people who ensure that the purchase of road tax is made every year and I'm sure there are many people in these unpopular but necessary positions who are fair. This bloke seemed to want to "win" at all costs. His crude reaction as he drove away said everything about him.
      He needs to be fired and perhaps get a job where he doesn't interact with the public. Surely, if his employers watch this video they'll do the right thing and get rid of him.

    You think... he doesn't earn commission from it, however I would not be sure about that. It is known fact that debt collectors, bailiffs and HCEOs earns commission, it is fact that parking wardens have quotas to meet. So I would not be surprised that DVLA has hired private contractors working either on commission or quotas basis. Yes he has no share of your road tax (some people would say VED is not road tax, but it is), but he certainly gets some share in some way from the release charge - either directly by taking the charge to himself, or indirectly where contract says somethign along the lines of "you have to clamp 500 cars a month to earn agreed bonus" etc.
