      It depends, they have got the cars keeper details and that's who would get prosecuted specially as there are so many street cams around, then if the car is causing an obstructions it would just get towed or bumped out of the way.

    I see the problem with the car, there is a chain stuck in the suspension and it needs to be removed otherwise an accident can happen.

    I like the little old man, who obviously wanders from the nursing home so often, they thoughtfully put a hi-vis on him so they can find him again. Quite heartwarming really. Oh and nice anti clamping vid as well ! We don't really have that in Australia, but if we did, I am sure we would see an upturn in clamp to rectum injuries.

      Indeed, there's no legal grounds to stop you touching anything that's placed on your vehicle.
      If that were the case, it would be illegal for clampers to TOUCH your vehicle when putting their leeches on it.

      In Australia, if your vehicle has been wheel clamped there is little known law that states that anything that is attached to you car / motor bike, becomes the property of the owner of the vehicle. You then have the legal right to remove said attachment , put it inside your vehicle and drive off.

      In law you may touch their clamp as much as you wish. However if you damage the clamp that is criminal damage. Of course, if the damage your vehicle while fitting the clamp you can take proceedings against the clamping firm for criminal damage. And don't let anyone try to dissuade you, I have done that 4 times now and each time I was successful

    They clamped my car on my driveway a few years back. They wanted £550 for unpaid parking ticket. :( Wish I thought of removing the wheel. Great job!! thumbs up my man.

    there was a clamper in our area who used to let 3 people park up in the 3 spaces there then after they went he would put his signs up and clamp the cars. and he would charge them £150 release fee and say Hes already called the toe trucks and charge them another £350 on top. until i took videos off him doing it and put them on dvd and sent them to the council and the local paper. i had my 4 tyres slashed for doing it but he ended up in high coart.

    If a clamp is fitted to your car it then becomes an accessory.
    It doesn't matter who owns the clamp it now belongs to you the same as fitting spot lights.
    Because it's now a car accessory you can take it off how ever you feel fit but you must take it with you to avoid being charged for littering.
    You can't be arrested for theft because it was put onto your vehicle by a third party as a gift.
    Way 2 is to carry a clamp and clamp the clamper...

    TS 410 still saw has them off in less than 30 seconds. Just make sure there is no CCTV and take the clamp with you, that way they cannot prove you have damaged it. You just tell them you had it lockpicked and you left it on the road, not your problem someone stole it.Used to remove loads, it is illegal to clamp nowadays . I focus on DVLA clamps now. Cut 3 off last week .

    I keep a small dremmel and a cut off wheel. It takes longer, but they will cut through in less than a minute. Next is to find the guy that put it on, and throw it through his front window.

    Conceptually depending on the facts in a civil case (and sometimes even criminal), if someone puts something on my property without my permission and it restricts me from being able to move my personal property like putting on a wheel clamp on my car, then there is legal cause of action to sue for trespass on to my property. The law shows that this indeed can be a form of trespass and unless otherwise expressed in a valid contract.

    Just to let you Know, that this happened to me. The Police were called. The clamping Company, said that unless I paid the fine, within a certain period, (Two hours or so) they would tow my Vehicle to their pound, which would incur, a further cost. But, in law, they can only tow your vehicle, to the nearest public highway, any further, (eg, to their pound) and it would be deemed, "Theft". Now, the important bit. It is not the "Company", that would be charged with theft, but the actual driver of the towing truck, so "He, or She", would get a criminal record, this, will stop them, from impounding, your Vehicle! You may still, however, have to pay the clamping fine! I didn't, the company released my Van, without charge!

    I remember I whipped one of them off with a Stihl saw during rush hour just outside Edinburgh city centre once. It took less than 10 seconds and it was off! When I first kindled the saw up there was heads popping up all over the place to see what the noise was. I got a standing ovation from everyone present, the bus stop across the road erupted! It was hilarious!
    I also took another one off the exact same way just down from Anderson bus station in Glasgow years ago! Exact same response from everyone present!
    The moral of the story... Everyone likes to see a clamp coming off!! E V E R Y O N E!! 🤪

    in new zealand it is illegal to issue tickets on private property(carparks) but they can clamp or tow.
    I have a friend that cuts clamp and keeps it

    By the way - the police officer is totally wrong about it being an offence. It is not making off without payment. He is either being deliberately misleading (most likely) or his grasp of the law is very tenuous. To elide this with leaving a restaurant without paying is completely wrong. You should have taken his number and complained.

      The officer is saying that when entering a car park where you have to pay you are entering a contract and are required to pay (...and display, I assume, in this case). There should be a sign saying that if you don't pay and display then you could be clamped and subsequently subject to a release fee ...blah blah. Therefore the guy has parked his car, entered the contract and it's terms and conditions with the car park owner. He got clamped and they can make him pay the consequential fine.

    I don't see why the driver gave him his name and address. I would have said if you want that info, then put it through the system. Same sort of thing if a security guy wants your info or a community service person, etc, no one has the right to demand your details and this even applies to the police. You have to be arrested first before giving those details.

    As long as you don't damage the clamp, you can remove it. Just jack up your vehicle, let some air out to the tyre and slide off the clamp. If you damage the clamp or cut the the lock it is criminal damage. and don't take the clamp, just leave it and drive off their property and put air back in the tyre.

    As a side note, if You have a Blue disability Badge they cannot legally clamp your car. Always display it even when not parked in a disabled space. A lot of people don’t know, including clampers, if your not sure about wher you parked take a photo of your car with the badge displayed BEFORE you leave it. Then if it does get clamped the police will make them remove it for you 😉👍

      tasmedic the policeman is wrong. This is a civil matter, as long as he doesn't damage the clamp it is not an arrestable offence. He is still liable to the fine though. None of this matters anymore, this practise has been illigal for years in the UK, this is a very old video.

    I got my illegal clamp off within 3 or 4 mins...it was SO easy...i threw the clamp in the river Thames..and apart from a letter asking for money and their clamp back...i heard nothing from them again.

    I heard an interesting account of Total-revenge regarding a wheel clamper knt, he was followed home quietly, and a few days later after harrassing people he came "home" to a TOTALLY stripped empty house, no furniture, no tv no computer, washing machine OR even any carpets. The result was the b/s was paid, selling ALL the clampers stuff paid for this plus enough over for a weekend trip woth all meals out ALL paid for from the proceeds of the sale. Justice can work in many ways 🤔😜🤣

      +canturgan actually fella it has been quite a while far more than 2 years id say at least 10 because I was clamped and it still had the clamp on after it was made illegal and contacted the police on what to do the police told me to cut it off because there not allowed to clamp it had been sat in the car park for 3 weeks with the clamp on and police said that they wont be coming eny time soon so you cant be prosecuted and that was around 10 years ago

      no before then I was taxing 1999 2001 and it was around that time the reason being it was illegal but red tape kept it from being enforced by the police it only came enforceable by the police in 2012 when the law on clamping was changed to criminal from civil but was well illegal before then its just the police didn't have the powers at that time, but you couldn't be prosecuted for criminal damage for removel of the clamp but when the laws changed it then became illegal to damage a clamp upon removel and this is when dvla started to use this method knowing that you could be prosecuted, wich in turn made them to start clamping vehcles on the drive too, but because then people were removing them, they then came up with the sorn rule because clamping was not a legal methord although enough to make them able to collect the vehcle so they could get revenue from you collecting your car from the pound

    It is not illegal to remove a wheel-clamp when parked on private property and the vehicle is parked on private land. The land owner will be forced to sue for any damages.

    Just like to say I used your method of clamp removal today and I was surprised at how easy it was, wheel off remove two bolts a few whacks with a hammer and job done no laws broken and no parasites funded :D

    Am a welder, everytime they clamp my van. I cut the chain and recycle the clamp.

    Can't understand how they get away with it. The clamp was nearly as well integrated with his car as his engine is (OK slight exaggeration). It wasn't a stolen part and it was willingly incorporated to a private car. How can legal title to the clamp remain with anyone other than the car owner?

      does remind me of a story I heard at work over a decade ago. Which ended in a Dutch truck driver looking at the smug cowboys in a clamping van, he flipped them the bird, they held their hands out like waiters expecting a tip, he got out and outstretched his arms trying to reach from corner to corner of his 500litre diesel tank, before going around the other side to draw attention to the other one. As he walked back around the front he saw them twirling their fingers around their temples followed by the return of their smug grins. He turned to his drivers door, dropped his pants and showed them his arse, climbed in, lifted up the clamped axle and drove off back to the docks with the idiot van following him.

    pretty labor intensive to disconnect the ball joint, or strut. Couldnt you just wire it up to the undercarriage and let the chain drag on the street.....eventually one of the links will be ground off by the road (not you) and it will fall off.

    Police officer was wrong to get involved in a civil matter and threaten arrest. It was NOT "making off without payment" and the clamping firm already had the registration number of the vehicle anyway, it was a civil matter. If it were "making off without payment" then any parking company could ask for the arrest of any person who hadn't bought a parking sticker, which obviously they can't. You should put in a complaint about the police officer, he needs some training. The clampers always say "you can't touch the clamp" but of course you can touch and even remove the clamp by any means you want. You simply cannot damage the clamp as that's criminal damage. Picking the lock is best if you know a good locksmith, but this way works well too. :) Good work though, and good to show people how it's done.
    Can only do this with private firms clamps, not DVLA or police.

      Unbolting the strut would only knock alignment out on a vehicle with camber adjustment pretty much, which that van doesn't have to my knowledge. The hub can only fit the strut one way.

    Surely it all depends on the wording of the contract. If payment is to remove the clamp then it would not be making off without payment because he did not require it's removal, so there is no service to pay for. If the penalty is for parking on the land or not complying with conditions then it becomes a civil matter, having no intention of paying would make it theft. Clamping for private companies has become illegal because it can be abused and it's requirement is redundant anyway because money can be recovered in court. Changing the subject, one thing that used to annoy me when I worked in a petrol station is that if a driver fills their car up with fuel, as long as the customer goes in the shop and says "I've got no money" and provides their address they can fill their car up with fuel and not pay for it, again this can be easily recovered with costs but my employer and one silly sausage work colleague wanted to put liability on me or other cashiers for "letting them do it", the other flaw is police refusal to do anything when the driver blatantly left false details.

    Also to everyone moaning about being clamped: I've never been clamped and do you know why? I can read signs and always pay attention to where I park. If nuggets like people who get clamped smartened up and stopped parking where they shouldn't clamping companies would dissappear within a month as they'd have no revenue. Problem solved.

    Such a waste of time!! If I was the Clamper, I would have just waited until just before he had finished and put another one on the other side!! And If I was the Driver, I would have just not done whatever it was he done to get clamped in the first place (and if I had got caught doing something 'Clamp-worthy'. I would pay what is due!!) Both parties are as dumb as each other!!!

    The police man is wrong, it's a civil contravention if the clamp is undamaged. It would never be an offence as that infers that criminal act has been committed. In fact it's none off the policeman's business if the removal is being carried out without damage or a breach of the peace.
