    "it's funny how treating doctors find it higher and carrier doctors find it a little lower... meaning work comp is cohoots with the doctors they assign so they'll have to pay less out

    My ortho surgeon is very arrogant and a horrible listener, I fell at work in January 2024 and the medical folks misdiagnosed me, saying no fracture, after walking in my hip 4 months and pt the hip was destroyed ( u should had been non weight bearing) anyways I have a physical job and there is no way I can do the job, it he feels his work is so good all his patients can get back to work within 2 months ( I run a kitchen ) he is unapproachable, I fear getting re injured if I go back to soon, not sure what to do

      Your rapport with your doctor is just as important as that with your lawyer. You should feel comfortable and confidant with both. Perhaps a chat with the doctor’s physician assistant or office manager might help. Good luck!

    Great video. Have a question. If I’m out on Worker’s Comp due to an injured shoulder that needed surgery and I injured the opposite shoulder from overuse… Can that be a new Worker’s Comp claim? Thx

      YES- this is a textbook "consequential injury." Have you discussed this with your lawyer and doctor?

    I have been on workers comp for over a year. Just got a 7% impairment rating for cervical raduicpathy whole person impairment. What does that mean . I was told I can't do the work I do anymore which is maintenance technician. Because of my work restrictions. And all I got is a 7% doesn't seem fair considering I can't do the work I have always done. Not sure what to do my lawyer doesn't tell me anything can't even get her to return a text

    hearing on sunday im report dr says not to go back to my old job uber i only make money in the summer,, acdf surgery is what the nuro out in for i don't have enough money to survive to stay out this long will going back to uber before my haring will it affect my case ..getting comp to pay for the surgery? my future pay when im out 6 months after the surgery tough spot..uber drivers write of there earnings not out fault like a bartender only getting 300 a week will get cut ime dr has me at 75 % need money till surgury

    Is 3% a good impairment rating for my TBI..?
    MRI with contrast= on first Gliosis and T2/Flair on 2nd MRI with no contrast.

      Doesn't look good only a 3% . I got a 7%for cervical raduicpathy and I can do my job anymore. We are just a number to them and not a big one either

    I was out 20 weeks with a partially torn biceps in both arms and my weekly payment it said was 2084 how much should I expect to get in my settlement

    Hello Rex, is there any relation between impairment rating and settlement? If I get high impairment rating mean I will have automatically high settlement amount ? Thanks

      There is a relationship but there are other factors such as work status and AWW that must also be considered.

    Can i reapply permanent partial disability again once the weeks they give me for the rating is done and my injury is not healed?

      Yes! you must do so before the CAP weeks expire. If your level of disability is over 75% you must apply for hardship within the last year of the cap. Otherwise, if you injury has worsened you could potentially apply for reclassification. Good luck

      They will likely consider the nature of the pre-existing condition and its impact on your overall level of disability. Its an apportionment issue, but your lawyer should be able to rebut it to some degree, depending on what your own doctor has to say.
