Also in practice these trademarks mean almost nothing. Mass effect has a patent on a dialogue wheel yet other games have dialog wheels. The thing that really stunted the FTC argument was its insistence on explaining the effects on SONY not the CONSUMER. If your going to argue its bad for consumers you actually need mention the damn consumers in your argument. They looked like Sony lackies the entire time and it really harmed what could have been a good argument.

One it was relatively unprofitable land, two France was a bit strapped for cash and preoccupied 1v1ing the planet post French Revolution and three the position in North America was untenable, they either sold it, or someone else would take it. By giving it to the Americans they kept it away from the British at least and ensured a better transition for the citizens & companies active in those territories. Also calling the PC a direct competitor to Microsoft is crazy, considering they’re almost always benefiting from most peoples PC purchase in some way. If anything PC is becoming more an extension to Xbox then anything considering they’ve been trying to make Xbox more of a home computer for a while now and they’ve been merging all of their services as well, with speculation that they’re trying to do away with their consoles completely in favor or cloud gaming and subscription services.

Hard to say, because most PC release sales happen through third party companies like with Steam currently being the main go to for any PC release, instead of the Microsoft store. They don't benefit from that, aside from maybe whatever Valve gives them to keep Steam on Windows.

Tbh i don't really consider pc to be a competitor for Microsoft because they're still basically the biggest company that has a hand in the pc hardware and software pie, so although you could play a pc available game on a non-microsoft hardware it's way more likely that you will use at least some of it, so basically it's the same as saying that "a company i only own 50% is as much a competitor as one that I own 0% of"
Even though they have to use Windows they won’t make as much money because Valve is the owner of steam, not Microsoft. While it does technically help Microsoft overall, it really is a competitor for them and i feel like if they had a choice between everyone using xbox or everyone using pc, they would choose xbox in a heartbeat.

It’s crazy that no one realises that this is going to change everything. Microsoft showing that this is the way the games industry is heading means Sony have to follow suit. Now it’s a race to swallow up relevant developers. Ultimately reducing the amount of variety in gaming even more than it’s already been reduced.

FTC has successfully blocked like 3 mergers and broken up a total of 1 monopoly (cell phone carriers) in my lifetime. It would have been more surprising if they Actually won the suit.

Well I would feel bad for the FTC just trying to do their jobs, but there were three major acquisitions across America and there are still more being looked into right now by massive conglomerates, one of which stands to control roughly 40% to 50% of American grocery purchases. The FTC decided to go after this instead. And I can't really sympathize with them after that. They just picked a fight they thought they could win, they brought their c game at best, and to no one's real surprised they shit the bed again.

None of Bethesdas management has changed, especially if you believe that Microsoft is "hands off" as they claim. Also what about Xbox Game Studios has inspired confidence recently? You could make the argument they haven't released a great game since Halo Reach.

That's a reason even ActBlizz employees kinda want this deal to go through. Currently, Actblizz is anti-union, and Microsoft is pro-union. Ntm a requirement of the merger was that Kotick get the boot, but he walks away with a fuckton of cash so he's on record of saying that he's totally fine with it because he gets money out of it. Also, iirc, Microsoft had said that post-merger, they will let the Activision studios working the COD Mines to make games again. We might see a new Spyro from Toys for Bob down the line, or another Crash Bandicoot. Old, dormant Activision games could come back. There's a lot of potential for good here because Microsoft wants games out of these guys, and Activision had put a bulk majority of their game studios on Warzone duty.

Either way though, I'd argue Microsoft winning was the 2nd best scenario because Sony winning and being given a chance to acquire Acti-Blizz instead would theoretically be worse for both general consumers and the competition due to Sony's insistence upon exclusivity deals, which are disruptive to the entire games industry (i.e. only reason I haven't played Bloodborne and Demon Souls is spending a few hundred dollars on a Playstation just for 2 games is a waste of money). And as we saw with the Epic Games Store, relying on exclusivity deals to make your product "appealing" is less effective than trying to use paper as body armor against a bullet. Best case scenario would've been Microsoft losing and Sony being hit with something to prevent them from buying something like Square or Acti-Blizz either just so the consolidation of the industry doesn't get worse.
I still remember first hearing about this case, and the literal next day after hearing the argument that "Microsoft wouldn't make CoD exclusive" or something to that effect, they scrapped all progress on the PS version of Redfall, making it an Xbox/PC exclusive (Though honestly that turned out to be a blessing in disguise). Edit to add: What do you mean rival company? Microsoft owns Windows. That's their own platform, just a separate division.
I think it entirely depends on the IP. A major IP like CoD theyd probably stand to make more money keeping it on multiple platforms as opposed to making it an exclusive
@@artybrandt yeah except they've already made it clear they're willing to lose money in the short term to gain control of the market. They are currently taking a loss on game pass because they want to force every subscription gaming service competitor out of the market. Microsoft has enough money to lose some now as long as they make more down the line. The goal isn't to just make money off COD, it's to force people to use their services to play popular games so they can price gouge when no one has a choice but to use their services. This is why they've stated that their games will only be made available to PS and Nintendo users if Sony and Nintendo allow GP on their platform. It's an underhanded way of extending an "olive branch" so it looks like they're trying to make games more accessible when in reality they're trying to gain more control.

Microsoft owns windows, not PC. Windows isn't the only OS and the OS isn't the thing that really profits from games. Importantly they sell through third party resellers like steam, and they don't own the hardware companies that profit most from games. Basically you can play a microsoft game from day 1 without giving them any more money than the cut they get from the sale of the game, so it's not a closed ecosystem like when Sony make something PS exclusive, meaning you need to use their hardware, OS, storefront and paid online services.

Ideally, Activision Blizzard would stay it's own company, would release on all platforms, and ideally the same would happen with all companies. But if miscrosoft owns all the companies. Who gets to choose where those titles go? Who gets all the revenue from all those big titles? Who is now able to snuff out competing game companies by not only owning the hardware, but also the software, and every aspect of manufacturing, the definition of a monopoly.
I think the biggest benefit of the acquisition is the possibility of Activision bringing back dormant franchises. Many of their other studios have been repurposed as COD support studios so it would be nice if they went back to work on separate projects.

Granted, PC is a separate platform from Microsoft, but the problem is, the most accessible OS is a Microsoft product. So while you may not be directly supporting Microsoft when choosing pc to play COD, Microsoft will still benefit greatly by running COD on Windows, and them taking every step to have you link your microsoft account to cod
There's always been things like WINE that let you run Windows executables in Linux, and now Steam themselves have Proton which lets just about any Steam game run on Linux even if it was only intended for Windows. Linux isn't very popular outside a specific demographic though, which is nice in it's own way since there ends up not being a lot of malware targeting it unlike with Windows and MacOS, but it's actually probably the most accessible OS since most versions of it are free and handle no differently from Windows and MacOS.

We really need to see change in the gaming industry. I’ve always hated how the big rivalry between consoles was more so about which exclusives each console had rather than one console actually running better and having better features than the other. Hopefully this is a step in the right direction

Less companies is almost universally a bad thing for consumers. More companies, by definition, means more competition. The more companies merge together the more power is in the hands of the leaders of each controlling company to be anti-competitive. If companies cared about increasing consumer access to games they could literally make agreements and/or contracts with each other to formalise a way to do so- literally nothing is stopping them. With very few exceptions almost any time a merger between large companies happens it is bad for the consumer, if not at first then a few years down the line.
You forget the fact that both Microsoft and Activision Blizzard are kinda struggling hard. Microsoft cannot make a good game to save its life, and Blizzard seems addicted to holding a gun to their IP's heads. My hope is that not only the deal goes through, but also it results in the produces games not being soulless, stunted cash grabs and they begin learning from their collective mistakes.

Something people overlooked in the ftc deal is the fact Activision owns alot of IPs that sony used as their mascots during the ps1 era, like crash bandicoot and spyro the dragon. Someone had too of atleast wanted too block that deal because imagine your old mascot releasing a game soley on xbox.

also Minecraft was a great example of why they wouldn't want this big of an IP to be exclusive, Minecraft basically prints money on whatever platform its on it would have been a bad financial decision to remove Minecraft from Sony's platforms and I feel like this is exactly the case with COD, it makes too much money for it to make sense for them to remove it from PlayStation and I doubt that Microsoft will actually do that as they can make a ton of money by having it stay on that platform just like Minecraft

The thing that really stunted the FTC argument was its insistence on explaining the effects on SONY not the CONSUMER. The sale was a bargain for three reasons. One it was relatively unprofitable land, two France was a bit strapped for cash and preoccupied 1v1ing the planet post French Revolution and three the position in North America was untenable, they either sold it, or someone else would take it. By giving it to the Americans they kept it away from the British at least and ensured a better transition for the citizens & companies active in those territories. So yea it was cheap back then too, easy to judge in hindsight, but at the time it was reasonable for France and even a bit controversial for the u.s.

Also calling the PC a direct competitor to Microsoft is crazy, considering they’re almost always benefiting from most peoples PC purchase in some way. If anything PC is becoming more an extension to Xbox then anything considering they’ve been trying to make Xbox more of a home computer for a while now and they’ve been merging all of their services as well, with speculation that they’re trying to do away with their consoles completely in favor or cloud gaming and subscription services.

Hard to say, because most PC release sales happen through third party companies like with Steam currently being the main go to for any PC release, instead of the Microsoft store. They don't benefit from that, aside from maybe whatever Valve gives them to keep Steam on Windows.

Tbh i don't really consider pc to be a competitor for Microsoft because they're still basically the biggest company that has a hand in the pc hardware and software pie, so although you could play a pc available game on a non-microsoft hardware it's way more likely that you will use at least some of it, so basically it's the same as saying that "a company i only own 50% is as much a competitor as one that I own 0% of"

Also, iirc, Microsoft had said that post-merger, they will let the Activision studios working the COD Mines to make games again. We might see a new Spyro from Toys for Bob down the line, or another Crash Bandicoot. Old, dormant Activision games could come back. There's a lot of potential for good here because Microsoft wants games out of these guys, and Activision had put a bulk majority of their game studios on Warzone duty.
But this is exactly what Bobby Kotick wanted, and he already filled Activision-Blizzard-King with his political friends.

Either way though, I'd argue Microsoft winning was the 2nd best scenario because Sony winning and being given a chance to acquire Acti-Blizz instead would theoretically be worse for both general consumers and the competition due to Sony's insistence upon exclusivity deals, which are disruptive to the entire games industry (i.e. only reason I haven't played Bloodborne and Demon Souls is spending a few hundred dollars on a Playstation just for 2 games is a waste of money). And as we saw with the Epic Games Store, relying on exclusivity deals to make your product "appealing" is less effective than trying to use paper as body armor against a bullet.
Best case scenario would've been Microsoft losing and Sony being hit with something to prevent them from buying something like Square or Acti-Blizz either just so the consolidation of the industry doesn't get worse.
This reminds me of the Disney/Fox Merger from a couple years ago.

I still remember first hearing about this case, and the literal next day after hearing the argument that "Microsoft wouldn't make CoD exclusive" or something to that effect, they scrapped all progress on the PS version of Redfall, making it an Xbox/PC exclusive (Though honestly that turned out to be a blessing in disguise).
Edit to add: What do you mean rival company? Microsoft owns Windows. That's their own platform, just a separate division.
I think it entirely depends on the IP. A major IP like CoD theyd probably stand to make more money keeping it on multiple platforms as opposed to making it an exclusive
@@artybrandt yeah except they've already made it clear they're willing to lose money in the short term to gain control of the market. They are currently taking a loss on game pass because they want to force every subscription gaming service competitor out of the market.
Microsoft has enough money to lose some now as long as they make more down the line. The goal isn't to just make money off COD, it's to force people to use their services to play popular games so they can price gouge when no one has a choice but to use their services. This is why they've stated that their games will only be made available to PS and Nintendo users if Sony and Nintendo allow GP on their platform. It's an underhanded way of extending an "olive branch" so it looks like they're trying to make games more accessible when in reality they're trying to gain more control.

Microsoft owns windows, not PC. Windows isn't the only OS and the OS isn't the thing that really profits from games. Importantly they sell through third party resellers like steam, and they don't own the hardware companies that profit most from games. Basically you can play a microsoft game from day 1 without giving them any more money than the cut they get from the sale of the game, so it's not a closed ecosystem like when Sony make something PS exclusive, meaning you need to use their hardware, OS, storefront and paid online services.

MS gets their money 5x over if you own a PC with Windows, it doesn't matter to them that you buy via Steam. Why do you think they are a Multi Trillion Dollar Company, 20x bigger then Sony? Also, every XBox Game is bound to MS tech and completely exclusive as well, so that argument ain't cutting it. And if you actually compare Sony to MS, theny ou would see why Sony isn't that big, because they reinvest and build up Studios and create new NaughtyDogs, Insomniacs and SantaMonicas, actual quality products compared to MS who runs everything into the shitter.

Yeah, I'm pretty fed up with the Sony and others have been doing this part at this point to be honest, I've been saying for years exclusives are bad (especially because I had to buy a PS console just to be able to play some games I liked), but people, even Dunkey said they were good because "it keeps the market fresh", Xbox then go ahead and do it for ONCE, and suddenly everyone is "mad" at exclusives and how this is "bad for market", when its been happening for years.

Who gets to choose where those titles go? Who gets all the revenue from all those big titles? Who is now able to snuff out competing game companies by not only owning the hardware, but also the software, and every aspect of manufacturing, the definition of a monopoly.

I think the biggest benefit of the acquisition is the possibility of Activision bringing back dormant franchises. Many of their other studios have been repurposed as COD support studios so it would be nice if they went back to work on separate projects.

Granted, PC is a separate platform from Microsoft, but the problem is, the most accessible OS is a Microsoft product. So while you may not be directly supporting Microsoft when choosing pc to play COD, Microsoft will still benefit greatly by running COD on Windows, and them taking every step to have you link your microsoft account to cod
There's always been things like WINE that let you run Windows executables in Linux, and now Steam themselves have Proton which lets just about any Steam game run on Linux even if it was only intended for Windows. Linux isn't very popular outside a specific demographic though, which is nice in it's own way since there ends up not being a lot of malware targeting it unlike with Windows and MacOS, but it's actually probably the most accessible OS since most versions of it are free and handle no differently from Windows and MacOS.

Less companies is almost universally a bad thing for consumers. More companies, by definition, means more competition. The more companies merge together the more power is in the hands of the leaders of each controlling company to be anti-competitive. If companies cared about increasing consumer access to games they could literally make agreements and/or contracts with each other to formalise a way to do so- literally nothing is stopping them. With very few exceptions almost any time a merger between large companies happens it is bad for the consumer, if not at first then a few years down the line.
You forget the fact that both Microsoft and Activision Blizzard are kinda struggling hard.
Microsoft cannot make a good game to save its life, and Blizzard seems addicted to holding a gun to their IP's heads.
My hope is that not only the deal goes through, but also it results in the produces games not being soulless, stunted cash grabs and they begin learning from their collective mistakes.

While that is true, it's not like many people would buy their games off the Windows store. Steam will take a percent, the same way Sony will on their own store. You don't even need to pay and activate Windows to be able to play PC games
Something people overlooked in the ftc deal is the fact Activision owns alot of IPs that sony used as their mascots during the ps1 era, like crash bandicoot and spyro the dragon. Someone had too of atleast wanted too block that deal because imagine your old mascot releasing a game soley on xbox.

also Minecraft was a great example of why they wouldn't want this big of an IP to be exclusive, Minecraft basically prints money on whatever platform its on it would have been a bad financial decision to remove Minecraft from Sony's platforms and I feel like this is exactly the case with COD, it makes too much money for it to make sense for them to remove it from PlayStation and I doubt that Microsoft will actually do that as they can make a ton of money by having it stay on that platform just like Minecraft
