      Yeah I agree. RUclips needs to take some of the blame for this. It keeps happening under their watch and they are not doing anything about.. ya know why? It's probably because they are gonna have to hire actual people to work in the copyright department which means less revenue for investors. So they rely on algorithms cuz it's cheap. Obviously.

      It’s insane. We had an old song get claimed by someone because 2 seconds of it sounded like a couple notes from their own song _that was uploaded several years after ours_ 😂 Fortunately it was one we hadn’t cared about for years & it’s not like we ever got big views, so it didn’t matter much.
      We did try to contest it at the time for the hell of it though, and exactly what you said happens...is what happened.
      “Oh well whatever” & all, but when it happens to a relatively popular artist/band/creator I can only imagine how frustrating it is

      RUclips is the primary profiteer as they get a percentage regardless of who wins the claim. This is clear selective enforcement. If the DA hasnt prosecuted anyone else (namely youtube), they are selectively choosing who and when to prosecute which is unenforceable. This guy needs to appeal.     RUclips needs to add an option where you can fight a claim due to lack of standing or fraud. It is so archaic that the CLAIMER gets to decided whether to drop the claim, which they absolutely never do. I talked to a RUclips rep about this once and the only real advice they gave was "seek legal counsel". So for small creators like me, we are basically screwed.

      Well, if you are a smaller creator then you could always take RUclips to small claims court. It doesn't cost much and usually lawyers aren't allowed. It's basically like Judge Judy. If RUclips doesn't send someone to show up then you automatically win.

      I still do not encourage or endorse committing any sort of grand larceny or theft on the internet just because you know there is a light sentence for stealing music money from other users. 5 years and 10 months in prison will feel even longer when you actually experience that prison time for yourself. I wish I knew enough about RUclips to know how false copyright strikes will eventually harm the bottom line of the higher-ups, and not just the bottom line of individual users.

      @@adampkalb They don't actually. RUclips themselves take a portion of advertising revenue from each video. The part you steal with false copyright is the creators portion, completely separate from RUclips's portion, so it cost them nothing so they aren't in a rush to fix it.

    As a musician I cannot tell you how frustrating it is how easily some random person can just claim your music. There are processes you have to go through to get the copy right back to it's original owner, but it's so much hassle when the original person that stole it basically just said "yeah that's mine."

      Idk man. People all over the video are commenting on the "weak" sentence that he got. But he got 2 years. 2 years is probably enough for rehabilitation. The guy didn't commit any murder. And I am quite sure all his stolen money will be seized. Getting even 2 years of jail time will also hinder the guy's ability to get employment, so yes, there is a permanent punishment he will be facing for the rest of his life

    The important question is whether the $20 million were seized from the scammers or not. 5 years is getting off easy and last thing you'd want is for them to still have even a cent of that money when they return.

      @Lightn0x the date for the restitution hearing hasn’t been set yet. They mentioned $1.4 million in the article but they are still looking for other victims. The final amount won’t be decided until the restitution hearing is complete. That article also said that the $23 million that was scammed was split between at least 5 other co conspirators

      All you have to do as scammer is to gift that money to family or invest it outside of country you live, preferably in country with no extradition laws like Argentina and you will never have to return anything. I don't think there was single person in history of USA to actually pay what court ordered. It's almost always settled outside courtroom at much much lower sum as most scammers will have very little if any money that can be connected to them. I worked in European IRS for years then as accountant, trust me they will not pay anything, they will return to same scam in matter of days, we even got some people continue to do scamms from within prisons by proxies... It's YT that needs to change it's policy or nothing will change

      Legally speaking what youtube does is the safest route. They involve themselves as little as possible so in case something goes wrong the 2 parties are supposed to duke it out in court and not be able to involve youtube. On the other hand if youtube reviewed the claims then they would be an active participant, meaning every time a fake claim comes up they would be included in the lawsuits.

    One of the things I find to be super irritating is when you pay to license sound packs in perpetuity and mix some audio for a video from it, and then some a**hole copyrights your video because they licensed the same audio pack and used it for some song they made. It’s just so irritating that RUclips allows this to happen. I’m glad this guy got fried for it, but it need to happen more. There’s a ton of this bullsh!t going around. It’s infuriating.

    The biggest take away is just how broken RUclips copyright system still is even after over a decade.
    I remember when PewDiePie just mentioned Despacito in a video title, didn't even play the song (half attempted a couple chords on a guitar) and the video was claimed 27 times for a song _that wasn't played in the video._
    So 27 people, individuals or parasitic legal firms, claimed the video saying they represented the copyright holder, and RUclips said 'oh, yeah, seems legit'.

Chest pain that begins when I start working on physically demanding or cognitively challenging tasks and gets worse if I try pushing through it, persistent vertigo that'll randomly appear and last for hours, headaches, mental fogginess/confusion that randomly pops up, and a bad cough. I'll be contacting my grad school's (master's program, unpaid) student emergency fund, so there's at least possible help, but I'm unsure how much they can help. It is what it is.

    Ill say the same thing I say about short sentencing for paedophilia.
    If the justice system cracks down on these kind of people, they'll be damaging their employer.
    It only makes sense to give minimal sentences to crimes which politicians and their buddies are expected to commit.

    I doubt RUclips will do anything about this, this has been going on for more than a decade, to a lot of people. I had some of my music claimed back in 2012- 2013 by the same kind of fake society with "media" in the name. I don't even run adds on any of my stuff, but these assholes did. It stopped a few years later (they probably didn't make enough from it). But it shows that they're doing this on a large scale, and even on small creators, at least at the time, before the ad-pocalypse. I'm sure that they have programs that do it automatically.

      Yeah, had the same at around 2011-2012 and it was kind of a big deal amongst music producers. There were topics about it on various forums.
      Fact that YT didn't look into it makes me wonder... Is it because they get a piece of the pie?

    Well the way the judicial system works, as far as I think this went is that he actually made a plea deal and had a pretty badass lawyer backing him up. Ive seen these things happen all the time. People who should be getting some serious time dont because of that. Now his initial charge probaby was like 20 years, but a plea bargain and his lawyer talking to the district attorney could have made an agreement to just 5

      Or just the fact that non-violent offenses aren't punished as harshly as offenses where the person threatens murder to get what they want. Five years is a pretty long time, and it is funny how any sentiments of rehabilitation and not doing over-harsh sentences go away as soon as the presenter was the one wronged.

      I'll point this out in a couple of replies; If you bother reading the sentencing, his gains were $6m, minus restitution with is starting at $1.45m but they're looking for more victims.
      And no, your time is precious, if 5 years is worth it you're wasting your life.
