    Great use of window and camera. And you your rights, well done.
    The plod was polite at times but was also rather rude too - the classic exercising your rights is judged as “being obstructive”. Highly childish & pompous Plod speak. Further, because you didn’t comply with his “unlawful requests” and phantom traffic laws you’re “making the stop longer” etc So what. It’s your time and your rights - not his.
    LEGALS
    - you have a legal right to pull over and stop when it’s safe. The hard shoulder is not safe in your view. Legal behaviour. (NB. best to slow down and acknowledge the request).
    - you don’t have to wind the window down or talk. Legal.
    - he can try the door so always keep it locked. Legal of him BUT that’s why you look all doors and windows.
    - setting up the camera. There’s no section of the RTA that says you can’t record the outcome, and it’s reasonable to wait to do this. No sections says “you must answer Police questions within 60 seconds of being stopped!
    - Plod said “we have a right to examine the licence …check it’s not fake” An outright Lie, an unlawful statement, rather outrageous from a motorway traffic cop. The RTA 88 would say “surrender” your driving licence. It doesn’t. It doesn’t for various reasons. Besides, if the licence is fake it doesn’t matter, the system will tell the officer if the driver has a licence. He actually needs to be confident it’s you. If he’s unsure, issue a producer …don’t invent new laws that don’t exist …that”a licence must be surrendered”.
    - breath test fine, legal. BUT don’t take their mouthpiece rubbish, they always ask the driver to take it. Refuse.
    - speed accusation. Legally interesting as he stated your speed was 86, you said it was 75 and could prove it via multiple devices. Can he change the accusation from 86 to 75 lat a later date? (Leaving aside the fact it’s within Force tolerances). I’m unsure tbh. You’re suggesting his equipment or use of it is broken/wrong. It put a huge doubt in his mind. Nor did he want the hassle.
    My judgement is that he was unsure about the use of his equipment (as it’s calibrated and has a certificate) OR more likely he just guessed. I say this because he never explained exact WHAT speed device he was using. Maybe he was using inboard radar that may have picked up another car. Either way, he was rumbled and wanted to avoid a court case suggesting, even conforming, that he was incapable.
    I suspect any Magistrate would question the officer about his equipment and why this driver was pulled over. Not once did he say “I say you pull ahead of all the other cars doing c86mph”. Or “you were weaving at speed”. Or “my device tracked you from x to y as you sped away” etc. It was all very general, very vague. I reckon he guessed the speed and was caught off guard when you challenged him.
    Personally I would defend you as follows:
    “Two, independent, highly reliable devices BOTH tracked your speed at c75mph at the time of said offence. They are recording devices. My client was at the maximum motorway speed limit (70mph) in heavy traffic and was observing other cars more than the Speedo given the dangerous nature of the motorway and close distances between cars. However, with confidence, he can say when he occasionally glanced down at the Speedo he was doing c70mph. He also kept up with the flow of the traffic, reinforcing his genuine belief he was travelling legally. These comments were all recorded in his phone, and also important is what was not said …my client did not discuss he Speedo readings. He may well have been travelling at 70 mph at the moment of officer “speed assessment”. My client blew zero on a breath test. My client politely fully complied with all legal commands. He vigorously states he was not driving anywhere near 86mph, instead hovering around 70mph, us using he cruise control set to c75, well within the accuracy readings of this vehicle ie 75 on the Speedo could be 68mph.
    Meanwhile the officer has produced no evidence, didn’t mention any evidence at the time, nor mention any bad driving, and worst of all has changed his accusation from 86 to 75 mph because he now has no confidence in his speed device or how to use it. If he had, he’d produce evidence and charge my client at 86mph.
    It appears he’s making up the Charge at will, indeed based on hearsay ie what my client admitted to at the time based on his view of multiple devices - and even that is based on GPS trackers not a calibrated speedometer.
    Sir, why on earth are we here? The real answer is my client exercised all his legal rights, ignored all the illegal commands and untrue Police statements, so this officer now wants to penalise him - without any of the required evidence, instead using hearsay, because he has no independent evidence, and the belief of two officers is required in Law or, a speed device reading. He’s produced nothing. The truth is he has no idea what speed my client was driving at that time. I say “that time” because we don’t actually know when he was supposed to be speeding - that hasn’t been mentioned nor produced via a device.
    Now then RUclipsrs - what do you think any reasonable magistrate would do … ?

      I’ve seen it for myself, the magistrate refused to see my evidence. So it was my word against that of a police officer. In my view that’s a stalemate, the magistrate didn’t agree.

    Safe on hard shoulder, that's why we are told that if we break down on motorway we should leave the vehicle step over the rail and go up the embankment to wait recovery as its very dangerous

    To be fair the officers were fairly decent about it and only wanted to chat re your speed rather than give you a speeding ticket, even though you did admit to doing 76mph in a 70mph zone.
    I'd have just said I was keeping up with the traffic flow and my speedo indicated 70mph.

    I worked as an AA patrol on the motorways & believe me, the hard shoulder is the last place you want to be stopping on. I have lost a mate who was working on the hard shoulder, even though every light on his breakdown vehicle was flashing away. The motorway hard shoulder is an extremely dangerous place to be stopped, even for a short while. Any copper who wants you stopped on the hard shoulder of a motorway is a total idiot & needs to be reported. Not as though that would do much good, as none of them are too bright....

      Hard shoulder is a bad place to be. A truck nearly hit the tow truck I sitting in for five minutes. I was freezing. The tow guy told me the truck was half way on the shoulder and woke up just in time. 5 minutes of my life on the shoulder and I nearly lost it.

      @@julianchamberlain5399 you have been brought up well like i was , we are good old honest people , it just seems that 2021 the younger generation havent been brought up that way, its get what you can in anyway you can, and sadly its spread to police, i think the deceit that a lot of police show these days is to try and get easy arrests, nicking criminals is made harder because CPS dont want to know, so its pointless working hard to catch criminals so to keep up arrests on paper they now lie to the public about what they are doing, lie about their legal powers and more often than not escalate things so people lose their temper, then they arrest them, its easy work for them, plus their training is appalling none of them know the law, and on top of that their equipment is so bad they are a year out of date with their insurance checks

    A hard shoulder is a place to stop in an emergency.
    Allegedly driving at 86mph does not constitute
    an emergency.

    Interesting quote that should be ignored...always.
    In 2018 Darren Stokes was killed on the hard shoulder
    while working for the RAC.
    In 2019 Jason Mercer was killed on the hard shoulder when
    his car was struck by a truck.
    In 2020 a 26year old was killed after his car ran into
    the back of a vehicle parked on the hard shoulder.
    So irrespective of how "safe" this officer thinks it is
    the ultimate proof of proving him wrong isn't much
    use to the deceased.

      It really is policy to breath test everyone. The law requires them to have probable cause, meaning they can only test you if you've been in a collision or there's evidence of a potential offence.
      He was wrong(ish) about the driving licence. You're not required to carry it, so you can't be required to show it, there & then- but he did & it's not your property, it belongs to the DVSA who have authorised him to check it.

    Definitely a mistake to confess to speeding. He may have had nothing until you did that.

    I just uploaded dash cam footage of the minuets before where he said I where he said I was traveling at 86mph and it was safe to stop. Edit: I deleted it now in case they try and use it as evidence against me.

      They can try and use it against you, but in reality it would show that they got everything wrong and it would harm their case as the little bit of speeding is out of step with everything else and making a case out of you is disproportionate and not in the public interest.

      @@t5jerry I've seen the dashcam video and it doesn't show Julian doing anything wrong. He is doing exactly what I would do in the same circumstances, driving safely. As for the deleting, it's only been removed from public view - a standard technique in legal cases to not show your hand to the other side ahead of time.

    Since when was the hard shoulder a safe place to stop? Never admit that you exceeded the posted speed limit as that is admissible in court and ensures that you will be found guilty. If you had got fined you could always pay with the commemorative coins.

    The scary thing is how out of date their insurance database is , im shocked its a year out of date , how many people are being done for no insurance because of their database.
    There is no problem of pulling off the motorway for a safe place, I hope he isn't going ahead with evading.
    In this instance I would say its 50/50 , he wasn't an arsehole cop imo , I dont like the fact he has the last say on 86mph though so I would take it to the tribunal and get it overturned.
    75 is a fair speed for a 70mph road, I thought they had a 6 or 7mph difference and only pulled for well over 80.
    Banged to rights on the driving test question though , its one you can't argue.
    I thought he was a decent copper , I hate the boring "advice" they give though, that's just to feel important,.
    Overall I have no concerns over this stop, and I hate police, they are corrupt and sanctimonious, he was OK though.

      The Police system relies on the Insurers updating it, so the officer advising Julian to check with his insurers was good.

Luckily I'm not a total copper hater but do resent those who abuse their power. At what point did that copper abuse his powers and make Julian suffer any injustice.       7/He also took issues with the driver setting up his camera.. um.. I’m surprised the driver doesn’t have a dashcam.. However, the police are pathological liars.. In a he say/she say without a footage.. you going to loose in court.. police will loose their BWV if it exonerates you.

    You have a red flag on the PNC on your vehicle. Tell them to remove it or its harrassment. From my POV he lied about the speed and had no reason to breath test you either.

      But the speed limit is 70mph so you were speeding whether you want to or like to admit it. After that admission combined with your obstructive attitude, you were actually very lucky you didn’t get a ticket.

      so 78 is still under the 79mph 👍

    cops in the Netherlands stopped pulling people on the motorway over 20 years ago.
    they always take you to an exit/safe spot to talk.

      I remember being flashed to stop on a dual carriageway with no lane to stop on. I knew the road well so signalled to go onto the exit which was already visible where I knew there was a pullover place. Police weren't happy. I explained like, DUH, this is a really safe place....

    I thought the hard shoulder was for emergencies. My cruise control is 74mph when my dashcam and to Tom tom shows 69mph.

    It would be interesting to hear John Scotts analysis of this video. Are your required to stop in a dangerous place? If he is lying about 86mph? I can prove that I did not go anywhere near that speed. Is his GPS equipment faulty or is it an abuse of powers to knowingly lie as a reason to stop someone? Trying my doors and do I have to give him the licence to see if its fake?

      If he had evidence, i would have asked to view it. Not all police cars have speed radar detectors on them, and as you know police are allowed to lie in the course of investigation

    GPS and sat nav are not to be used for speed! They won't stand up in court. You've admitted that you were speeding at speeds upto 76mph! The maximum speed limit as we all know is70! Not like everyone seems to think is speed limit plus 10% plus 2mph! You can be done for just 1mph over the limit.

    Honestly, traffic coppers are the best of the bunch in my opinion. I've been stopped a few times in my years and I definitely could of had a fine, and they used that discretion and humanity to give me a break. We've all had a break, and should consider that before we discriminate the entire profession when we've all likely had a good one at some point.

    A hard shoulder is most definitely not a safe place to stop on a live motorway. Dear God is he for real? The rest, door opening attempt, trying to escalate, non acceptance that a 3rd party database "could" be out of date, is purely a control thing based on perceived authority. Poor poor policing.

    Normally I would say see you in court, but we know magistrates hang on off every word a copper says so would find you guilty what ever the evidence that you have that proves you were not speeding, magistrates dont care and will still find you guilty

    Police officer is correct about speed limit - However, as you rightfully said other drivers ignore the national speed limit and for those that have followed the speed limit many have died or been seriously injured by the carelessness of other drivers - Most drivers have no other option than to go with the flow on the motorway to stay safe - Perhaps the police should take this into consideration when stopping drivers that drive with the flow to stay alive

      Speed is not a danger. Inappropriate speed is the danger. Driving at 30mph on a 30mph when it's icy, dark and a residential road is very dangerous. Driving at 75mph on a lightly loaded motorway in daylight with no rain is not dangerous.

    Weird this insurance in the UK. Here in The Netherlands the car is insured and insurance is collected automatically, so you're always insured unless you don't have any money in the bank. Cops overhere will never stop you on the highway, but direct you off the highway first.

      Insurance works the same in the UK. It's just that the police use a central computer system which is supposed to collect the info from all the insurance companies. Supposed to, but it regularly doesn't because of crap computer systems or crap office staff. It was designed to save having to have a piece of paper which could easily be forged and was supposed to be more accurate. But GIGO principle still applies.

      They are reading glasses. Yer it was a mistake to admit going 76 or whatever. Turns out to be no more than 75. Everyone exceeds 70 mph and its tolerated on the motorway. Right or wrong its a fact. To prosecute me for going 75 mph on the motorway would just be malice.

      How do I know this glasses issue.. years ago my friend was giving a producer was told to confirm the details on it.. he said he can’t read it because he doesn’t have his glasses.. promptly, the police seized his car, license and reported him to DVLA they required him to do an eye test to get his license back also charged him to court for good measure!!!🤦‍♂️

    Hard shoulder is for emergencies only as its not a safe space to stop. Safe place is to take the first exit whether that's a junction or services. No point arguing with him about speeding, just ask for the evidence as he's on his own, so he's relying on you either admitting speeding or he has actual video footage. If he then has no evidence he can't give you a ticket as he's on his own. Also I was told in court that you can't be found guilty on forensic evidence alone when a speeding motorist killed one of my family and he walked away. Don't engage with them at the side of the road ever, name address, insurance and mot only and then see them in court if they do give you a ticket and never admit to what speed you were doing or any offence as they use that against you.
    Hasn't proved you were committing an offence, so has not right to ask for a breath test until the point you admitted to speeding. They have to have justification just like they can't just search you when out in public.

    He lied about the evidence, if he had it he would have used it. They never use discretion at 15 miles over the limit....... He clearly said it hoping that you would say something in agreement that would incriminate yourself. This is how they are trained to catch people.
