    Since the tragic shooting death of Trayvon Martin, Florida's Stand Your Ground law has come under intense scrutiny. Florida governor Rick Scott is presently forming a task force to reexamine that state's law. Critics argue that such laws have led to shootouts over petty disputes and have hampered police investigations with a sweeping grant of legal immunity. Supporters of the Stand Your Ground law say it does not apply to the Martin case and that such laws merely protect those who use a firearm in self-defense from prosecution and financially ruinous litigation. Massad Ayoob is a firearms trainer and author of "In the Gravest Extreme." He spoke at the Cato Institute April 23, 2012.

      Common sense doesn't exist. What Massad possesses is superior reasoning and experience in firearms and associated legal matters than the layman.
      To call it "common sense" is an insult to the effort Massad put in, and the natural gift that Massad possesses like millions of people.

      That's a very accurate brief description of Mr. Ayoob. I've read him in gun magazines and heard him speak to audiences a few times as well. An Officer working on the Fort Wayne Police Department homicide detective division told me he studied under Mr. Massad Ayoob, also.

    It should never require massive amounts of money for any citizen to defend themselves against legitimate self defense. Laws are needed to restore a person to their pre-event status. This has all the earmarks of malicious prosecution.

      We should be forcing change by crowdfunding funds for legal defense for any citizen that obviously defended themselves, i.e. Kyle Rittenhouse. After we do this enough times, politicians will be forced to do their job.

    I'm an autonomous person and have fundamental issues with laws but I could listen to Mas talk about right-action under varying circumstances for hours - as law intends to apply to reason and good on a fundamental level and good people understand that regardless of that entrenched bureaucratic corruption that majorly has laws favoring criminals over good people trying to do the right thing

      An ounce of prevention is worth a pound of cure. Unless you are being robbed, it takes two to tango. Once you realize the guy or gal is an idiot, before things get heated, become part of the solution by stop talking and put distance between yourself and the person. I am in my sixties and I typically do not go where I feel I need a gun to protect myself. I carry one just for general security for me and mine; much like I carry aspirins, to get ahead of the headache before it becomes a problem..

    Here in Colorado, there is no "Duty To Retreat" in a self defense situation. There is also the "Make My Day Law" which authorizes the use of deadly force on any intruder within your dwelling. "Reasonable" is a legal term, open to interpretation.

      In our country (Italy) if you get arrested and then all charges get dropped, once you'll be released they pay you back the damage based on the days you had to pass in jail plus moral damages 'cause your image is literally ruined by TVs.
      TV shows then start to fight each other for having an exclusive interview which is well paid.
      Said so, 90% of the time even if you get back the freedom, your image is kinda fucked up, your job is gone, family is ruined... Money can't erese the past nor will give back your old life.

    Read your state's legal use of force statute. Basically memorize what it means. It usually means reasonable force and that is defined as the least amount of force required to get out of the situation.

    It would be nice to hear from those never charged by defending w/deadly force, those charged and acquitted, those prosecuted. To hear what went through their minds. Obviously, there would be human error in stories through memory or falsehood, but it could prove beneficial to hear of someone who survived.

    You need to update the lecture in these "dynamic" times. Here in the EU, I was ambushed by no less than 20 drunken and maybe coked up idiots while talking on the phone with the police, mind you. The first sucker punch cracked my phone and got me knocked down, but I was able to stagger back and then I rolled with the punches - so they could not land something strong enough to get me down again. When I saw that they had me cornered and running away was not feasible, I warned them that I am armed, but that did not impress anyone and they kept swinging from all sides. I lifted my shirt and grabbed the handle. This is when most of them started getting red lights in their intoxicated heads, but one lunged forward to get my gun. I turned with him and pulled the gun out, so as to keep it under control. I did not point the gun and I did not even chamber a round, because the sight of the big black pistol cooled them down. That's when the police arrived and arrested... me, since I was the one with the gun, apparently. The fact that I was also the one with the bruises on the face seemed irrelevant. Anyway, the next day I got apraised by the forensic doctors, they listened to their recording of me talking to the police when I got smacked and generally they got it right this time - I was the vicitm and not the perpetrator. One would say that things got sorted out, except they haven't returned my gun, awaiting deliberation by the prosecutor whether to bring the attackers to trial or drop the case on the grounds of "boys will be boys". Time goes by, I have my CCP, but not my CCW - first world problems, I guess.

    I have an implanted cardiac defibrillator that can be activated by a blow to the chest, sending lethal or incapacitating electric shocks into my heart. I certainly hope that I am not expected to defend myself with mere fists or grappling when confronted by someone that wants to physically strike me with fists and kicks. I hope that the concept of Disparity of Force applies to my situation, as I consider myself to be at a grave disadvantage in hand-to-hand combat.

    Recently I had a situation where while driving a guy behind me was in road rage fit and because I tapped my brakes to ask him to back off my rear bumper, then this guy in a big truck raced around me and we caught the red light , he jumps out and heads back to my car . (I happen to have a CCW permit here in Florida and my Glock 26 is in its kydex holster with a round in the chamber and always ready ) as he approaches I’m faced with the reality that if this guy was to bust my window and try to get at me I may actually have to do the unthinkable. As he approached I put my finger up and shook my head to signal do not do it Mr !!! And thankfully he turned around and got back in his truck . I was committed to doing whatever is necessary to defend my life as I could not move my vehicle without hitting other cars and I had to also think ahead as to all innocent people that may be in line of fire should it come to that . This event was a reality check for me and it’s mentally sobering that a great responsibility comes with carrying a firearm. I carry a GoPro everywhere I go while in my car and it will start recording with one quick push of the button also has a clip on it where I can quickly clip it to the collar of my shirt. While I was in this situation I had to constantly remind myself how will a jury see this situation and act accordingly. It sure is a lot to process but I believe this kind of entanglement is a part of modern thinking training . I thank GOD I did not have to engage this clown ! ….. after all maybe he was just having a really bad day .

    @ 7:25 , Ayoob's other videos perpetuate this scenario as well, that an attack is not necessarily justification for using deadly force, and not until you can PROVE that your attacker has overpowered you -- "got you on the ground or against the wall" (his words), and already RENDERED you defenseless, even possibly beat you to your weapon --
    But an attack can be a one and done punch, at which point it's too late THEN to use deadly force, because you're already dead, or incapacitated and unable to, and soon WILL be dead. Something is missing here, which seems to me to be a contradiction of his rule of, Ability, opportunity, and jeopardy.
    "Ability meaning your attacker has the power to inflict deadly force". It's probably too late as you're trying to determine "disparity of force" … "in the course of the fight " to determine ability. So, you have to first FIGHT with the guy and not until he has "the position of advantage" are you justified in using your weapon. That's the most ridiculous thing I've ever heard. It's the old adage (ass)ume makes an ass out of you and (me), in this case, a dead ass. Hell, he will likely have his OWN weapon which he will inevitably be using on YOU while YOU'RE trying to determine if he has said "ability" if you let him make contact before you use yours.

    I would like to answer your question. This is a true situation I was in at a gas station. I had parked by car in a crazy matter near a gas pump because a man took up two parking places near the gas pumps in order to rush into the store to get some coffee and things. He was in a big hurry I guess. I was filling my car when he came out and was mad at me because I sort of closed off one of the ways for him to exit the station. I said he parked so I could not get gas because of way he had parked. He was mad and started to come towards me and said I am going to kick your ass. I said nothing and went towards the front of my car away from him. I did not want to escalate this issue too anything where I had to defend myself. I guess I could have stood my ground because in Michigan we have that law. However, him seeing me back away caused him to stop, but still swearing at me and drives away. I did right the thing because I was willing to take a few insults and threats from someone having a bad day.

    The fact is the fact, to protect yourself from harmful people, people who are attempting to harm you in some form and possible death you must realize that it is your right to protect yourself.
    Here's a fact about myself, for years I have denie myself the right to carry or even own a weapon.
    I am a veteran of Vietnam and after the war and I returned home i had no desire to own nor ever kill another person even in self defense.
    But now I see all that is going on in my country i believe that every person should own a weapon for self defense and for hunting only.
    The right to carry much be a judgment by you as person of whether or not the person who is attempting to harm you is violent enough to kill you are do such bodily harm enough to make you use your weapon.

    Stand your ground did not apply to Trayvon Martin's death. His killer should be in jail.

      It was not used as a defense, As Zimmerman claimed he was on the ground getting beaten when he shot Trayvon. He did have injuries on his head that matched the testimony, but I don't know if it's true.

    Look at the court decisions or stautes in all the states and you will see that a justification defense needs be supported by some evidence that a reasonble doubt can be drawn from assuming its truth. Once it is known this will happen the government has to show the testimony not to be true or show it's not justified in fact.

    I wish that he would have addressed the concept of sexual assault in regards to the use of deadly force. I can only speak for my own state where I have researched the relevant deadly force laws, and the law is very similar to what he described in his speech: deadly force is acceptable in the face of death or serious bodily harm. However, my state law also specifically includes sexual assault in the definition of serious bodily harm. I have no idea how common this is throughout the country, but I think it is an important element that should be explored.

    The court and prosecutor doesn't care if you are innocent most of the time,they only care if they can convince a jury that you are guilty by any means at their disposal and that is the way it is most of the time in my experience

      Explain what you mean. He was arrested and his bond was six figures. He was attacked by two men. Zimmerman was not even arrested until mass public pressure and national media became involved.

    Even that Sheriff in FL gets it wrong. They present SYG as the rationale for using deadly force. SYG has nothing to do with fear of imminent death or great bodily harm.

    Our justice system is not perfect by any means, I have seen this first hand. I went to Court 14 times because of a charge my ex-wife made against me, it cost me over 60 thousand dollars (money I didn't have, I had to take out loans) and after two years of going to court the lying bastard prosecutor dropped the case the same day we were to go to trial. After they dropped the case against me my attorney asked me "Are you happy you beat the case?" , I said sure, I lost two years of my life and now I'm in debt up to my elbows, yeah I'm happy I'm actually happy happy, (in a pig's ass). After 30 some years I still have emotional (bad emotional thoughts) about this. Oh! by the way did I mention our justice system is not perfect??????.

    In the USA you do not have to prove your innocence. It is up to the courts to prove your guilt. Well, that is how it is supposed to be anyway.
