I like this judge very much. She’s kind and respectful and super patient.
I agree
I agree.
To be fair, the trial was televised to millions of people. Of course she'll be this way.
She allowed more hearsay from amber.
too patient
I remember the Jury that ruled Casey Anthony not guilty and then later some them came out and said they regretted that decision and wish they could go back and change it. Hope we don’t get a situation like that again.
The most competent jury probably found a way out of jury duty.
It's crazy that truly innocent people can have their guilty status changed, but true criminals found to be not guilty can't be testified against a second time, unless they commit another crime.
In that case the jury instructions literally made it impossible for them to convict.
Kind of a different kind of court case, don't you think? Casey was accused of murdering her 2 yr old daughter. Slightly different outcome.
There were plenty of evidence against Casey, but it has to be beyond reasonable doubt, and the jury bought Jose Baes ridiculous tale of her father was the one, and it was an accident. We knew and she is guilty, but the court has to prove it. Another thing, the prosecutor went for death penalty, there were no other option, no life in prison, no man slaughtered, so the jury had they hands tight.
This judge was one of the best I’ve seen. She was so patient easy going and a really good disposition.
Very cool 😎
I really like this judge. I googled her (Penney Azcarate) and she was active duty in the Marines, was a captain and then after several years went to reserves so she could go to law school. She also runs a court for veterans with nonviolent crimes.
Thank you
👍👍👍👍👍💕
Explains her discipline and patience. 👏👏👏

The fact that the jury already takes this long to make a decision blows my mind. Even a blind man could see during this trial who was lying and who wasn‘t…
They want some more time off of work
They are more than likely trying to sway 1 person on the jury to agree. They need to all be for Johnny
There are probably some who need to be convinced..
They have to go through six weeks of evidence. I think it‘s normal.
They were both lying at different times, neither of them were 100% truthful
I remember Amber saying on the stand that the OP'ED was NOT WRITTEN about Johnny its about his ego (or words to the affect) then last week she admitted on the stand it was about him to fight against his power in the industry.
I heard her say that as well.
Yes! It was one of the first questions Camile asked her "Ms. Heard why are you here" and she replied that she was there because her ex husband Johnny was suing her "for an Op Ed I WROTE..."
Ah, she's trying to use a technicality, because she explicitly said, "I wrote that because of powerful men LIKE HIM."
@@rupertperiwinkle4477 TECHNICALITY just like PLEDGE and DONATE
@@rupertperiwinkle4477 Yes, but the fact is, at least to the jury's decision process, she NEVER said his name within her op ed.
For those that are saying the jury shouldn't be taking this long... From my experience in a jury... You'd be quite surprised at how long it would take for something that seems so simple. We literally had 1 video to go through and only 6 jurors and we had to go to a second day simply because 1 guy wasn't on board with us. We had to explain why his statements didn't make any sense in order to convince him. So with the amount of material they have to go through and the amount of jurors with all different backgrounds and ideologies, I can imagine this taking quite awhile
I come from a different country and we have no jury, who participates in a jury? normal people or persons with a some juristic background?

I actually friggin love this judge. She’s been about as impartial as anyone could have hoped.
People!! Have you ever been on a jury before??? They have to look at all the evidence from the last 6 weeks, answer forty plus questions on the jury form, debate them, get a unanimous decision and THEN decide monetary damages. This does NOT take 5 minutes!! lol
Not only that, but every jury member needs to 'interpret' every question correctly, and the same. Ambiguity/misinterpretation has no place here.
Amber is guilty of deffatmation. 50M$ that she needs to pays to JD.

Exactly
It did take 5 minutes (4 hours to be exact) in the OJ SIMPSON trial.
The verdict can’t be based on who the jury likes the most.
Imagine being a juror that believed her BS and then after hearing the 30 minute audio from Australia they couldn’t play in court where she’s manically screaming she didn’t mean to hurt him and they’re trying to keep her away from him and even gave her psych meds.. Really is a huge injustice they weren’t able to play that audio. Would’ve been open and shut. He’d win 100%
do you know why they weren’t allowed to play it?
Right!!!
How come they weren’t allowed? So bizarre

Ok?
If this end up being ruled not defamation over a technicality like "it didn't cause damages", I'm gonna be really sad. Sure, Johnny has won in the eyes of the public but he really deserves a home run.
1000%
Didn't he lose roles because of these allegations ?? It definitely caused damages to his reputation until recently
I thought it was damages per se anyway - not damages per quod - because he is a public figure.
That isn’t a technicality. That is literally what defamation is. The requirement is to prove you suffered monetary harm because of the published statement. That is an element of the law. I would like Johnny to win but they haven’t done well to show that her Op-Ed directly lost him roles to the level of harm in damages they seek. Unfortunately for him Hollywood was backing off prior.
Lmao that you think it's a "technicality" that no defamation found should lead to a ruling of no defamation. It's the entire case.
Omg!! Judge Penny has HAD IT with Elaine😂😂😂😂😂😂
That's for sure.🤣
I know it's so obvious her patience has run out! I'm out of patience with Elaine myself
The Judge is so patient. This trial has been a circus, and any self respecting judge despise these kinds of trials and for the most part it has been Ambers team that has ridden her patience to near zero.
noticed that both sides like her also.
@KS Donald I thought everyone was both a judge AND lawyer in the last six weeks? Same people who were parenting and gorilla experts with Harambe
Love the judge. So polite and genuine.
But so many of her rulings were wrong. She impeded the natural flow of the trial with repeated erroneous rulings on objections. It was frustrating to watch.
@@jx14aby are you a lawyer?
She is a rockstar!
@@jx14aby I've watched many lawyers react to this judge and none would agree with you, this is one of the very best judges this trial could have had. She is also the site judge.
BTW why the coart room was empty?
This judge probably wants this case to be done and over with.
Unlikely? This is a court of law. The Judge welcomes questions being asked about the complications of the deliberation.
Given her very calm attitude, I'm not sure how properly DONE she is with this case but I think she knows Amber is 100% lying that's for sure, the way she sustained many objections when Amber was on the stand performing. It's notable one time Amber said she has scar tissues in her nose with a 'broken nose' and she was kinda laughing it off because she was a marine she most likely knows what a real broken nose is like.
I’ve already said it. That woman is a saint and has the patience of Job. She needs a vacation after ruling over this trial.
I’m sure the judge neither wants the case to be over quickly, nor for it to be unnecessarily prolonged. She has a job to do which she seems to be doing fairly and professionally.
Even so, not only the judge but everyone in the court room wants this case to be over with, the lawyer's and Johnny etc
I think a lot of people on here needs to do some jury service for experience.
If she hadn't gone for his career, they wouldn't be in court.
For those who don’t know:
Defamation isn’t just about truth and falsehood. It’s also about damages. You have to check several boxes here.
1: was the statement true or false.
2: was it written or uttered by the defendant
3: did the statement cause damages
4: did the defendant willing lie or speak recklessly
They have to do this for EACH STATEMENT. It’s not a lump sum. You have to take them individually. Also they have to meet all the above conditions. If even one element is lacking, it could be ruled as not defamation as per the law.
They reached Number 3 here, so does that mean they all agreed with 1 and 2? Cause if so number 4 is a no brainer and should they get past 3 it should be a very instant 'Guilty' for AH
Thank you for Sharing 👍
Both the evidence and her lies check all those boxes
These are just examples, there are 7 statements per action (not calling out original comment but comments thinking the jury has only 4 statements). Each statement is more complex than it seems, especially the “malice” statement is really complicated and would take a while and there’s one of those per statement as well as the Waldmen (sp?) statements
I think Ben went through all these in his closing comments and told them what to put. They just need to play it back and do as he says.
if I had a dollar for every time Amber Heard lied in court, I’d have enough money to fulfil her charity pledge.
Lol for real
"pledge" 😂
You mean donation right? 😛😉
@@Fear2570 Hey don't forget that "pledge" and "donate" have the exact same meaning!
You, meanwhile have never lied!
The judge is this trial has been a class act all the way through. I've sat through several cases over the years and never experienced a judge like her. She's brilliant 👍🏻👏🏼
Listening to lawyers commenting on the case last night and doesn't look good for Johnny , guess they weren't watching the whole trial ...JUSTICE FOR JOHNNY !!!
It may be obvious to us viewers who should prevail, but the reason it’s taking so long is that the jury has nearly 40 pages of jury instructions they must abide by, and there are a total of six claims/statements (between JD’s claim and AH’s counterclaim) that they must reach a finding on; each statement has seven elements to it. They have hours of depositions, exhibits, and testimony they must consider; it’s not a matter of just taking a single vote as to whose side they believe more.
This exactly. The judge’s instructions even cautioned against making a decision without reviewing the evidence. I think they are just doing their job as jurors and being sure that they apply the laws appropriately.
They will be there for a week, in my humble opinion.
@@missyyy- And the last thing either side wants is a mistrial for jury misconduct, or solid appellate issues that will drag them all back into court! Regardless of who prevails - if either side even does - they’re both spending a fortune on legal fees, so no one wants to spend another day in court. she's literally on tape admitting she assaulted him. How is she not under criminal investigation?
This is a good sign for Johnny, it shows that there was disagreement among the jury as to whether the content of the op-ed reflects a defamatory statement, on the other hand the title itself can easily be seen as defamatory that's why Johnny's team is happy about it.
Haha. I hadn't thought about that.
There isn’t a disagreement. In order to get to that particular question the jury had to agree that JD was defamed. The instructions are if they answer yes to question 1a they go to question 1b (which they did) then they were brought to question 1/c….This should be breaking news! 1a specifically asks if they feel JD was defamed.
But the title is part of the op ed. I dont understand why they needed this clarity.
Hopefully the jury isn't taking the question in isolation and literally. If so, reading that statement by itself, you couldn't attribute it to her referring to Johnny even tho during the trial she did say that she was writing it about Johnny. I hope I am wrong.
This judge has the patience of a saint.... but even that saintly patience is drawing thin with Amber's ridiculous representation
will Johnny win? I dont know how the U.S. jurisdiction works with jurys and so on :D

Can you tell me, specifically, what the judge has said or done to indicate her patience is drawing thin with Amber's representation? I watched this entire clip and couldn't find anything.
She has patience because she got already paid, Amber is going to win and she know it.
This Jury is going to mess this case up And then regret it when they see all the videos of her lying.
It's worrying
They have done that in other cases Casey Anthony
Don´t forget that Amber won the case in the UK.
@@mochilero-fe6hv She did not win anything. The Sun (newspaper) did and the question posed to the Judge was not, "did Amber lie?" I watched 3/4 of this trial, I never really followed Johnny Depp, but watched some of his movies. Which I have to say, he is an exceptional actor!!! He has stole my heart and it did not take but an instant hearing him speak, to be a fan of this sincere, loving, caring, & down to earth man!!
It broke my heart to hear the horrendous things AH accused JD of. How do you do that to someone you supposedly loved so deeply the way she talked! JD could not have said it any better when he said “she took nothing less than everything”, that said it all!!!! You felt his hurt just listening to him, you want to hug him tight and say it will pass one day : (
JD was totally spent, drained & empty you can just hear it in his voice, & see it in his eyes!!! Thank the lord above you got out with your life, that’s how bad it had to be.

Yep but thank God for juries. Think of the movie '12 Angry Men' - common sense prevailed. I speak as an ex juror where I had to be convinced of the offender's guilt by another jury member. His argument was irrefutable, Another juror never agreed with this so it was a hung jury. I strongly believe that trial by jury is the fairest system we have here in the UK. I cannot speak for any other country.
@@gemmag.2988 Luckily that was a movie. So we won't always get the happy ending. Also this is a civil case, you shouldn't be trying to decide whose guilty by irrefutable proof. Its what is more likely.

This is a good sign and shows that The Jury is viewing the situation in the eyes of the law and not being swayed by the status of either party. People should want this, because otherwise there could be possible grounds for prejudice and that could lead to a mistrial. This shows that The Jury are taking this seriously and viewing each member as general members of society which is what people should *WANT* to see because otherwise it would’ve been a waste if the entire six weeks were thrown out due to any form of mistrial factors.
Today’s society want everything instantly and they have to be mature enough to understand that not all things work that way.
I don't even think it's a bad sign for people who want Depp to win.
They just wanted to clarify if they have to find the title or the whole article false.
People might want them to steamroll over everything just to get to the verdict they want, but that's a terrible way to reach a verdict!
It’s fine, just know this case is a wash, no one is going to win anything
Well said!
I agree
its just a jury question for clarification. these kinds of legal questions from the jury are very common. most jurors have little to no knowledge of the law and these questions come up all the time in jury deliberations.
You're telling me they sat through six weeks of the trial. And THAT is what they needed clarification on? 🙈
Maybe one juror desperate to find a loophole for Ms Heard.
that is just the first of forty some questions. Im sure they will ask about more. This could take weeks!!
If it included the whole op-Ed then JD would lose as op-Ed states SA prior to college. If just the headline then it could have been about JD so better for JD
Whichever way the verdict goes, I feel JD cleared his name already
They are most likely leaning with Jonny but trying to determine how much damage was caused. Why they asked the question
I honestly think that the judge is tired of Amber Heard lawyers
I think the reason that the jury is taking this long pertains to the convoluted series of questions that need to be answered.
They haven't taken long, they started on Friday afternoon and didn't start deliberating again until this morning. Hardly a long time to determine a 6 week, multi million dollar case
Almost every case is like that.
That’s right.
Plus they have to then all come to an agreement on damages if they find in favour of either case
They need to be sure! This is not like choosing a flavor of ice cream!
Elaine is so incompetent
For real. Shes scatterbrained
Well, you have to look at her client who keeps running the trial.
I honestly can't believe this has went on so long.
Even if Johnny loses he’s still WON with the public OPINION!
I believe the jury is just making sure that all the i's are dotted and all the t's are crossed so that the ruling cannot be overturned in the long run. I have been on a jury there's a lot involved in it it's not that simple and not everybody always agrees. Many times it's the amount of people who say yay or nay makes the final judgement
Yes, I was an alternate on an s.a. case and the jurors who were deliberating asked several questions, same scenario as in this clip. I wasn't privy to the deliberations but had to stay and was called back for the verdict as part of the jury (tho' an alternate). Afterwards we all said goodbye to each other but not without the jury going over the decision and even my own questions. It was an amazing experience to see how important they held every word!! So, it could be and likely is precisely as you said- they are simply and importantly, going through each item and making sure all in the jury are clear.
Honestly really appreciate this perspective

@@karenl1180 what?

Sadly, the decision isn't "Who's lying?", but "Did Amber Heard's retweet of the Op Ed meet the legal definition of defamation or not?" There's not much question who's lying in the courtroom, but Amber Heard was careful in the Op Ed *not* to name Johnny. She may be able to scrape by on a technicality.
Myself, I think the tweet was definitely bringing the article to the attention of a new audience, because why else would she bother to tweet it? That's what social media is primarily for. But it only takes one stubborn jury member to mess things up.

It would be interesting to know what Chew's motion was.
@@edelweiss2.076 His motion was to strike Rottenborn's closing statements of "if you find against Amber you send a message to all domestic violence victims in the world"
@@bunnyduncan
Shouldn't he have known that ?
“A defamation of character claim must be specific enough that it refers to the plaintiff. The statement does not have to refer to the plaintiff by name but it could be defamatory if the plaintiff is reasonably identifiable.” - I found this on defamation laws. I wish JDepp’s team had made this more clear to the jury, that it did NOT have to mention him by name. He just has to be “reasonably identifiable “. And I wish they reminded the jury in closing arguments that the ACLU exec testified that they advised Amber to edit Johnny’s name out.
Yes 😒, I've got a bad feeling about this
Surely at least 1 person in this jury would remember that portion of the ACLU testimony though, as well as her actually admitting to writing it about johnny on the stand. 🤞
Absolutely, you hit it on the head. Had they argued those two specific points, it would be a slam dunk.
What you're referring to is "defamation by implication", and I believe it's mentioned in the jury instructions
not to mention the headline was wife-beater Amber had never been married before technically an in the article she's referencing a man not another woman I guess I'm confused because everything has to go past Amber and her team the title (which I'm sure she came up with) the article is what makes you read the article that she clearly wrote about Johnny. I mean at this point we can tell that she was going out of her way and she was vengeful to Hurt Johnny Depp I mean TMZ come on now the only good thing I could see coming out of this is is it was the Washington Post that did all of this and Johnny Sue's them and then Washington Post Sue's her Amber for falsely giving them information
The judge opened that pen like a boss
AH is a cruel, evil woman. what she's doing to JD is really evil...Justice for Johnny
Depp will lose this case because cooler (and more intelligent, hopefully) heads prevail.
The Judge is fed up with Ambers lawyers 😂💀
Wow I hope he wins that will be so unfair
I believe they have chosen who's side they're on it's the money amount that takes time
They did discuss the article in court so why did they do that no wonder the jury are confused
I see a lot of people talking about this video thinking it's about the overall trial. The jury has been provided a questionnaire. They are just asking about what Question 3 refers to. Whether the question is referring to the title or the overall article. That's it.
Johnny, if you read this… you got this & the world knows the truth! Stay strong 💖
you think he spends time reading youtube comments on random videos?
@@MrJPort10 you mean amber?
I don't understand how the heading of the op-ed & the content should be considered separate. They are as one . AH would not have written the heading. It's only common sense that the publishers would title the article. The content of the article should be the determining factor as to defamation. The heading only has no merit without the content.
AHs lawyer made it confusing for the Jury. so annoying!
If JD doesn’t win. I wont give a 💩 about this system anymore.
I guess you never went through the OJ Simpson trial.
So after 6 weeks of testimony it comes down to the title of the op-ed? Are you serious, Jury?
ummmm. no it is just one of FORTY questions thet have to consider! could take weeks
Could take months...😋
Ben Chew has to be one of the most respectful person I have seen. This is the kind of person you wanna learn from, the kind of person who would very easily convince be to pursue law or take an interest in it (lol tho i would prolly fail).
I have never seen a judge so nice and patient before
The fact that this represents, a confusing question, after hours of deliberations is quite worrying..
The Judge 👩⚖️ is clearly NOT happy with the Amber’s team and their keeping her waiting like that, bunch of amateurs!! 🙄
The judge is so nice I love her so much
When a judge is righteous and fair it can clearly be seen. This woman is an exemplary judge, no bias just followed the law exactly as written. So much respect for her.
Lock her up
Hope the Jury doesn't think - "she didn't write the headline, there was testimony that publisher wrote the headline." That is irrelevant. The statement was owned by her when she testified that she wrote the op ed. She also owned it when she republished the article via a link on her twitter .
Or that the headline is ambiguous even though the article isn't :)
There is no way any sane person would say that the title of the op ed is not a statement of Amber Heard. Her defense there is abysmal, "I didn't write the title, and I didn't read the title before posting it on twitter"... Yea sure, like that's gonna work. As you say, the statement is owned by her in enough of a capacity to win Johnny the case.
People retweet articles on Twitter all the time. That doesn't make them personally responsible for the online headline chosen by an editor at WAPO.
@@edelweiss2.076 it does if they say "I wrote this op ed"
Don’t speculate on what the jurors are thinking just because of what the public opinion is
Humanity today is NOT the brightest in this NOW time linear. Dumbed down for years. Im deeply concerned about this jury. For obvious reasons. They shouldnt need to question anything.
they should because this is a very very hard case for johnny to win, you just dont know how law works
For those who are saying it only takes 2/3 of the jury to agree ~ I did a little research. According to people who actually study law, the verdict needs to be unanimous in this case.
The judge literally said that in the closing statements
They said it had to be unanimous when they instructed the jury. So maybe ppl just didn't listen.
as the judge stated while handing the case over to the jury, some of you people really fail to watch a simple video and listen huh
People not listening as usual.
The judge told them that with her instructions.
that sounds like they are going against johnny dang it not another Casey Anthony Trial. why on earth was it ever heard up there in the first place? Johnnys team do not look happy at all
Actually some lawyers who have followed this trial like The DUI guy who was on many days at the trial in person, or Emily D Baker, said the opposite, and said it was a very good sign for Johnny. Lets hope its true!
AH wrote the article and denied having fine so over an over. Then admitted It. By retweeting the article She now owns the responibility of both the content and the title and the defamatory intention
the fact they are asking questions is a good sign for Johnny
