    As a graphic designer, in simple terms, what he’s saying is that Amber’s team never provided the actual photos. And the photos that they did provide were screenshots and were altered/copied so that the original data could not be read. So when the lawyer is asking him, “You didn’t find any alterations, correct?” He’s asking a question that doesn’t make sense. It’s not the original photo. But the lawyer is saying, “Did you find evidence of alteration?” But he couldn’t either way because they gave them screenshots and copies. The actual photos that were presented were altered, either way. Because they were screenshots.

      agreed, forensic security researcher here, that's exactly what the witness was saying. It's not a yes or no question per se, because of what @sin city quinn said, but what I would have said is "that's incorrect, I *DID* find evidence of alteration as I was not given original photos and that in and of itself is an alteration, so yes there was evidence of material alteration of the photo"

    I've been a photo retoucher for 15 years and this man is SPOT ON. When an image is photographed in its RAW FORM which is the most accurate and the most largest form, you get ALL THE INFORMATION IT COMES WITH LIKE , time, what aperture/fstop you used, what lens you used, what camera your using, etc. Once you put it into a editing software like I use Photoshop and you start changing the photos sizing the information starts to get compressed, lose data, lose its rawness (its authentic realness) especially when you convert it from raw to jpeg which makes the image a COPY and not the REAL THING. RAW shows the real deal and anything else can distort the image.

    I'm completing a degree in Cyber Intelligence and just took a Digital Forensics course last Fall, to me it's blatantly obvious that Amber's team is trying to misrepresent EVERYTHING about this topic to an uninformed jury. I know enough to complete his sentences when they interrupt him - every single time they do so it's because what he's about to say will either provide VERY important context, or show the absolute criminal degree to which they're trying to get the jury to adopt a fallacy. It doesn't matter if the photos he was given look 1:1 identical to the original, they are completely different files and all he can do is speak to the ones he was given. FFS, the picture at 6:08 is literally a picture of a computer screen, showing a picture that's on a piece of paper, and Amber's team is trying to make the jury just think it's the exact same as the original. She's happy to provide that BS as evidence, but not the source file of the picture on that paper. I can guarantee if he was provided the actual device used to take the pictures, it would be complete game over for Amber Heard. This is absolutely disgusting conduct by all of Amber's team and I can't express that enough to those uninformed on this topic - they're obstructing the truth at every single corner in this testimony.

    Interestingly enough Mr. Nuemeister was a very neutral witness. He walked a balanced road initially by trying to explain that getting a hold of Amber’s phone is the best way of determining the authenticity of the evidence presented. Unfortunately, AH’s team didn’t want that answer. They wanted a definitive “no, the images weren’t altered”. Here is where I tipped my hat to Bryan:- He KNEW that the photos were screen grabs from the get-go and could have categorically stated that the images presented were doctored. Instead, he gave AH’s attorney not one, not two, not three, not four, but some 5 to 6 times to restate the question instead of immediately spitting a plot line in favor of Johnny. It was at 20:02 when he became visibly fed up that he stated that AH’s team actually altered the photos by the very nature of how they presented it. An obvious luminary in his field and an upstanding individual for not stooping to skullduggery.

      @@neliaferreira9983 no, Nuemeister refrained from giving a narrative to Johnny:- recall Nuemeister was Johnny’s witness. If he gave in and said “yes, I have found evidence that the photos were edited”, and left it at that without an explanation, that would have been a tainted response misleading the jury as it could be interpreted as some intent to manipulate the photo on AH’s part.
      However, he was trying to explain that may not necessarily be the case as the photos presented are either screen-grabs or backups of backups (3rd generation photos) and to that point, what is presented in evidence wouldn’t stand to scrutiny, which could just be an honest/rookie mistake:-
      that’s why the original phone is important. To put it simply, Mr. Nuemeister did not seek to offer a conclusive opinion on the authenticity of the photos, even after demonstrations that showed noticeably different visible versions of the same photo. He was simply saying, we have no way of knowing which wouldn’t be an outright win for Johnny nor an outright loss for Amber.
      Compare that AH’s witness who shot his own credibility in the foot by stating with a degree of scientific certainty that he found the “source” and “originals” and therefore, the photos not edited…albeit being found on IPhones/IPads made months after the relationship. And the sad thing is, I’m willing to bet that not even Amber’s own expert was given the original phone. Note also that Nuemeister was able to trace some photos to an IPhone 6…a device which matches the timeline of events…should tell you who the real expert is.

      That wasn't what he did. The judge sustained the objection Depp's lawyers had to him trying to not let the answer the expert wanted to give. This means the expert was told he could answer. However because he asked the question again, the lawyer decided the best thing to do was to say "I can't remember too, don't worry let's move on"". But Depps's lawyers jumped and got the court to read the question from the transcript so that he could answer it. It was never a tantrum, it was a tactic to try and fix his inability to get the witness to say something that discredited his previous evidence.

    When you apply for a passport, driver's license etc you have to submit the original documents such as birth certificate, marriage certificate in order go through a process to come up with an acceptable document legally recognised.

      literally every detail in that photo is the same.
      The angle, the background noise, her stray hairs, her eyelids, reflections, everything.
      Even if she somehow managed to take 2 consecutive photos with different lighting, the slightest shaking of her hand, the slightest movement of her head and even blinking would've changed all of these details to a substantial degree. I do camera motion tracking so i can say it's factually impossible that those are 2 separate photos.
      You can prove this easily by tracking 3-4 features in those 2 photos to get a 2D motion path estimate. I imagine the error/difference will be less than 0.1 pixels aka non existent.
      The only way those would be 2 separate photos is if she and the camera were frozen in time.

    • @KrisBarns

      It's literally impossible for the simple fact that she said the vanity lights go around the mirror. The fact that even the shadows are the same make her claim actually impossible.

    This is the problem with court cases like this when scientific or very technical arguments are presented. Lawyers do not understand them but want to control the narrative. At the end of the day, it's not about truth and justice. It's about impressing the jury with fallacious arguments.

    • @Torch82
      @Torch82 2 года назад +26

      In this case, I believe the lawyer had only 2 options: try to control the narrative, or not ask any questions at all. In hindsight, he probably should've went with option 2, but I'm assuming he's being paid top ask questions, so he had to do something if he wanted to earn his paycheck. I'm also glad he did, because he opened the door that allowed the expert to explain he was never given the actual photos. He was given screenshots of back-ups, and raised the question, if she has nothing to hide, why haven't they given him the actual photos, like the vast majority of people do in these situations?

    • @andrealaforgia7699
      @andrealaforgia7699 2 года назад +21

      @@Torch82 The problem is the impact of some questions on the jury. Not all questions have "yes" or "no" answers. I don't think the judge did a great job there, by forcing the witness to answer that way. The lawyer asked his question in a way that is very misleading. He implied that a technical operation was possible but there is no evidence that it was actually performed by Heard. The witness was trying to explain that nobody can perform that operation so, whilst it's technically correct to say that there was no evidence that Heard performed that operation, it would be relevant for the jury to know that this wasn't a situation where Heard was unwilling to perform that operation; she was unable to because everybody is unable to. Those are two different concepts: "I want but I can't" is very different from "I can't but I want".

    If there isn’t a scientifically correct answer then i don’t see the point of answering it with yes or no. Just by giving out an answer of yes or no he’ll be providing false information, something he can’t do under oath, because just as he stated it’s impossible for anyone to find it, including himself.
    Amber’s team wants to focus on having him admit that he can’t find it and they won’t accept anything other than yes or no because anything beyond that could damage their case. If he says “no, I didn’t find anything” then it just proves that the photo is authentic and they’re gonna leave it there. But his “No” is just because it’s impossible for anyone to confirm or deny it.
    It’s very clear they’re trying to direct the narrative in a way to benefit themselves and I’m glad he pointed that out.

    I love the judge for most of what she's done so far in this trial to be fair, but this is one particular bias that sticks out when you have a lack of technical knowledge in a field.
    AH's lawyer should not be allowed to force an answer they want and JD's lawyer should have argued more for their expert witness's right to answer with clarification .
    And the judge should not instruct the witness to checkbox tick something he's clearly found to be unanswerable, as an expert.

    • @zoesolomon7773
      @zoesolomon7773 2 года назад

      it is outside of the judge’s duty. in cross examination, you ask leading questions which are questions that demand a yes or no answer. it was on depp’s team to object to the question correctly. if there is no way to object to the question, the witness must answer it yes or no. court proceedings are also very technical, and all of the lawyers are aware of the way testimonies work. the purpose of redirect is for clarification, where they can ask an open-ended question and the witness can give a more nuanced answer. you can’t cross examine after redirect, which is beneficial and lends to the idea that most issues of testimony are more nuanced than yes or no answers. this is why you saw the lawyer during redirect ask a question that allowed the expert to clarify his answer to the specific question he didn’t want to answer yes or no to, and then nothing further.

    • @Jade-om7ie
      @Jade-om7ie 2 года назад

      @@zoesolomon7773 I understand- then the witness can clarify on redirect ...but there are questions that just cannot be answered via 'yes' or 'no'. If the witness answers 'yes' or 'no' to one of those questions the answer is recorded in the transcript and can be used against the witness later/forever. So, it's a very vulnerable position - the witness is obliged to lie. The redirect maybe won't save the witness in a later cross in a future trial because they will show and read the transcript and they will ask: 'On date Y did you testify X under oath?' and again 'yes' or 'no'? Then on the redirect, the lawyer can forget to ask 'In a previous testimony why did you reply X?' (because he/she doesn't know by heart that the witness clarified that answer in a previous redirect) and the witness is then potentially seen as a liar. I don't understand of law but shouldn't be the witness protected on these questions?
