      Can we look at his records? He's a public servant so I would think there are records of complaints and lawsuit filed against him. 20 years ago police records are kept for almost the police officer entire career but recently, Union are pushing for department to remove the records after 3-5 years.

      No is called the blue flue. Meaning all cops will delay all open cases, making the court over crowded. Take a typical 6 month case to get everything in. Now you're looking at year minimum, three tops for the same case. This is the system that's been created, and why judges throw away this types cases against cops.The needs of few doesn't beat the many.

      "Courage is not as wide spread as most people are led to believe it is". Poor judge will be painted in living color of a man being located years from now at a county landfill, odd thing the guy found will have a striking resemblance to the judge.

      Any Time a System holds certain individuals on a higher scale than other individuals and seem to more times than not find no wrong doings in their own people than understand they are human who can and do make mistakes is already flawed. Most Cops aren't Lawyer's Yet seemed to more often than not be perfect in understanding and serving the law. It's never been about Justice as much as it is about Control.

    That also happened here in the Philippines. Four police officers beat one soldier, so the soldier went to their camp, and when he returned, he was accompanied by two military trucks and a humvee with a 50 caliber machine gun pointed at the police station. As a result, all cops who assaulted a soldier were apprehended, loaded onto a truck, beaten, and thrown back to their police station.

    This is a textbook example of a cop who, after realizing that he'd gone too far, tried to intimidate the victim into not pushing further with the incident, under the threat of prosecution. That cop was justifiably fired. It's people like him that actually make policing more difficult.

      Make it 10 for a good cause. The military officer never disrespect nor argued. Both police officers had no reason to stop the car, also, the comment about the dog's name was not just inappropriate but disrespectful as there are no rules to give a name to a dog.

      Improper display and evading are both crimes... Barricading yourself in your vehicle and refusing to comply during a felony stop are crimes...
      Resisting arrest is a crime...
      This idiot wanted to be a martyr so he could profit... Watch his own camera as he turns it on and smiles at the camera as he pretends to be street lawyer when the cops have guns pulled on him... He wasnt scared... He wasnt nervous... He was perfectly calm and capable of reason... He made a willful choice to fail to pull over... He made a willful choice not to inform the officer he would delay pulling over by using blinkers, hazards, calling 911, etc... There are many ways to inform law enforcement you are delaying pulling over...

      Thats in no way what happened. They offered to charge him, which they didn't have to do, if the man felt he had been mistreated and wanted to take it to court. They extended a professional courtesy that that dickhead did not deserve, by not charging him, knowing it would probably get him dishonorably discharged.

The dickhead drove for 6 min with flashing lights behind him with out making any attempt to pull over or notify the cops of what he was trying to do. When the first officer asked him to get out of the car he acts like he has no idea what's going on. He refuses to show them his hands after repeated requests to do so. Refuses to follow any of the lawful orders he's been given. Doesn't notify the cops that he has a firearm right by his hip. Before the cop even gets put of his cruiser he's already getting his phone ready to record, more concerned about turning the stop in to a spectacle than in following commands and making sure everyone is safe. When I saw the first video I thought the cops did him dirty too, but the full video shows what actually happened. You tard asses just can't be bothered to be informed.

      This is possibly the worst example possible.... Dude did this intentionally... Officers conducted a felony stop because he failed to acknowledge lights.... He traveled with cops behind him and didnt so much as use a blinker or hazards to let the cop know hes hesitating to pull over...
      Felony stop initiated... Barricaded subject refusing to comply.. Pepper spray deployed... The only reason this is such a big deal is the media took hold of it and pulled their classic race baiting bullshit... Keep in mind the entire reason they pulled him over was no plate (improperly displayed but still a crime) so they had no idea who he was...

      @@12gaugeCharlee Pulling over in a safe location is valid. However he failed to acknowledge lights and sirens. When you delay pulling over for OVER A MILE you have to inform the officers that you're hesitating to pull over... The law has given several examples of how you can do so, including slowing down to 15-20mph (varies by state) with hazard lights or blinkers, dialing 911 and informing the operator of what you're doing, or flagging down the officer...
      When he failed to acknowledge, officers conducted a felony stop.... I assume you know what a felony stop is? If you do, then you'll know this was a classic barricaded suspect...

    The fact that lawyers and police chiefs can consistently say, "There was nothing wrong" to these, is exactly why nobody has faith in them anymore. If all of that is perfectly ok, then we need to rethink how to protect ourselves against the police. Even just pulling forward to a well-lit area is enough to justify "escalating" the situation.

      First you can see him struggling with his fellow officer's actions and kind of sort of thinking about stopping this incident and preventing his partner from doing the wrong thing. But the thin blue line, and probably a seniority of the other policeman kick in, and his humanity and morals are wiped out when he joins in tackling the innocent black guy. There was a moment when he could have come out of this encounter as a freaking hero who would show the general public that all policemen are not the same and that there are some bad apples that make them all look bad. But he missed that opportunity and will too suffer the concequences of his actions.

    *The Lt. Clearly stated he drove until he went to a public, well lit area, preferably a gas station so that they wouldn't be tempted in pretending he has a weapon and opening fire, he clearly asked why he was being pulled over, he clearly said he was scared and didn't feel safe right now, he clearly got pepper sprayed more than four times unnecessarily, he clearly was heavily disorientated from said spray, not knowing what escalated things so quickly and started to get orders barked at him. After it was all said and done, the officer CLEARLY knew he was screwed because they didn't find anything, mistreated an Army Lieutenant and was choking his poor dog in spray and tried to bribe him into keeping his mouth shut like it never happened or they'll arrest him for no reason. If this isn't a huge violation of laws and protocol, then I'm moving to Iceland.*

    I have said this many times. The police recruitment will take these thugs that have been in minor trouble and bullied from the time they were kids in elementary school and then give them night sticks, guns, tasers , and spray. They are thugs and should be held accountable to the full extent of the law.

Which is why the police did what's known as a felony stop, surround the vehicle guns drawn, demand the suspect out of the vehicle and lay on the ground so the officers can place them in cuffs.
      Although his intent was simply to hesitate, the officers did have reasonable suspicion due to his failure to inform the officer he is waiting to pull over.

      @@teddy5004 driving at a slow speed with his flashers on, to a well lit area before stopping is not a felony, it is not evading and is recommended by many law enforcement agencies. Also the reason of having a paper plate is not a reasonable excuse to pull over a vehicle in the first place. Like in my original statement, with this officers attitude, the driver was more than justified to drive to a well lit area, rather than take the chance of what may happen in a dark secluded spot with no witnesses.

      They lost qualified immunity as soon as they violate someone’s civil rights. This is what both allows the suit, and why the defense is attempting to fight it on the grounds that his rights were not violated. Never talk to cops - EVER!       Edit - in this case I mean to say. You can always sue the department (the people) if it is the policy that's at fault. In a case like this though they lose it. There is a reason for the use of the term qualified.
      I can agree that sometimes officers will be given immunity when they shouldn't but the problem there isn't the tool but it's the use of the tool.

    As of 2/11/22 the officer's appeal to dismiss this case was denied. However, in MAY/22 all 4 judges on the 5th Judicial Circuit recused themselves from hearing the case. Even after he stopped, he REFUSED to obey lawful orders for about 10 minutes, all while having a loaded gun near him, that he didn't tell the officer about.       With that said, the Floyd trial was a travesty with the BLM bullshit, which tainted the trial from top to bottom.

      @@alanguages If you look up felony stops you'll see what these officers did was completely textbook.
      This was caused by the citizens own lack of communication by failing to acknowledge that he was going to pull over and ended up leading the officers on a mile and a half chase. If he turned his hazards on or called the police to notify dispatch, he would be fine.. But he just continued driving and ignoring the officer until he decided to pull over... Additionally you also have the misconception that people are allowed to pull over in a "well lit area"... The law doesnt say anything about a lit area... It says when it's safe to do so... When getting pulled over you litterally have a giant seizure warning on wheels with flood lights and alternating flashing lights that can be seen for miles.... You'll be just fine on the side of the road...

      Didn’t watch the whole video did you? He was told countless times before hand to get out of the car long before pepper spray even came into the picture, and wouldn’t of even been told to get out of the car had he not drove well over a mile before pulling over even if it was to get to a highly lit up area. Then he kept arguing with the cops about getting out of the car.
      Just because he was in uniform doesn’t mean argue with commands.

    Firing the cop wasn't enough. He should be charged with a crime.
    One of the most damning statements from the cop, in my opinion, is when the driver says "I'm afraid of cops" and the cop says "You should be."
    It's just too stupid to believe.

Your “facts” are irrelevant to this argument you’re attempting to mount. This was absolutely a Fourth amendment violation. And the First Amendment violation really isn’t debatable. He was offered a literal quit pro quo trade for his silence and agreement not to report what occurred. Of course I’m just one little federal judge who happens to be licensed in Virginia sharing my opinion; what could I possibly know?

      The reason the suit is for $1 million, is because that’s how much police are bonded for by professional insurance. The officer won’t pay anything out of pocket.

    I hope Caron gets 2 million for himself, above and beyond the 50% the lawyers keep. He demonstrated more fortitude, strength of character and presence of mind throughout the entire horrific ordeal as a young soldier in his 20s, than most adults. What a terrific and truly noble young man. He deserves all our support.

      @Damien Montero The Windsor cop tried to stop Nazario’s lawsuit, while the state attorney general launched a month long investigation.
      Attorney General Mark Herring uncovered a pattern of _discriminatory, unconstitutional policing._
      At the end of December 2021, beginning of January 2022, Herring, made history by suing the Windsor PD for civil rights violations as his probe concerning quote *_the egregious treatment against Lieutenant Caron Nazario was indicative of a much larger issue within the department._*
      Police officer, Joe Gutierrez, was fired from the Windsor PD in July 2021, I’m not sure where he’s at today. The other cop was never fired.
      Since I can’t find anything else, I assume Nazario’s case is still pending. In my opinion the settlement should be substantial and forthcoming.
      That’s all I’m going to dig up for now.

      Officers should have charged him for either eluding or for refusing lawful orders at the stop. Instead they saw he was just doing a dumb stunt for a video and offered to let it go. Should have just arrested him instead of trying to be cool about it.

      @@gbart7857 None of this would hold up in court. He wasn't eluding, he drove to a safe area before stopping (iirc, this is allowed during traffic stops). The 'offer to let it go' was a desperate attempt to extort the victim after realizing they had no real charges and needlessly escalated the situation. Threatening, holding him at gunpoint, pepper spraying (4 times?), and assaulting him is hardly 'being cool' about it. The officers were the ones playing stupid games that night.
