      I don't know the laws there but here mere possession a weapon while intoxicated is not a crime. Here, it's a crime if:
      1. Intoxicated,
      2. In the persons hand and loaded,
      3. The person is not engaged in legitimate self defense.
      So even if you are drunk and someone attacks you or someone else , you could defend yourself or defend the victim of the attack. It would be unlawful to be hunting or target shooting while drunk.

    You are not allowed to carry a firearm when you are drinking. It is a felony. He should have charged both of them for that and her with the OVI also. Again cops are treated differently than the rest of us.

      Melissa Mccarty the night wasn’t over, they both may have been charged or may be charged at a later date which would effectively end their law enforcement careers. I guarantee that this will be pleaded down or the firearms won’t come into play, she’ll get the OVI and hopefully she wasn’t more than twice the limit which would make her “super drunk”. In this day and age of Uber and Lyft, it was hubris that let them think nothing would happen and it’s so easy to avoid.

    The fact that they are upset that they are being held accountable for their own actions goes to show the culture that is cultivated by too many police departments. Police officers must be held to a higher standard than the general public, not a lower one.

      Also, if it weren't a cop they would have been treated much worse. The cop frankly had no good reason to pull them over. Crossing a line like that, in an intersection like that, with nobody else on the road late at night would be a reason to follow someone to see if they're having trouble controlling their vehicle. He followed them and they drove perfectly from what I could see. Shitty cops all around. All of them.

      I've gotten out of many charges, as a civilian, because the cop cut me slack. They do this all the time for ANYONE (if they can) ...I think primarily to keep things peaceful. It leaves you feeling thankful and thankful people are less likely to retaliate.
      If you're a prick though then, yes, they're gonna throw the book at you. So, if you find you're always getting slammed by the cops, well, be nicer.

      Imagine how many people were shot and beaten and had evidence planted before cameras. Dna saved a lot of them after 20-30 years in jail . Our justice system is a joke , holding eye witness testimony as fact and sending people to prison over the memory of anyone has been proven to be wrong because 100 people can watch the same person commit a crime and they would all pick a different person out of a line up and remember most of the facts wrong .       If the guy was driving, he'd of gotten both from this guy, no doubt.
      He didnt slam him solely because he was looking out for her. Didn't want to ruin her night even more by locking up the husband on felony charges.
      Add to that, if ur not a scumbag, they generally will easily get reduced to a misdemeanor even a summary charge many times.

      Actually no, cops always take their time about arrests. For three reasons: to fill in the time; to make sure that they understand the situation correctly and are making no mistakes and waiting for info like outstanding warrants to come back from the dispatcher; and to see if the perp commits any further crimes in their presence (like trying to hide contraband.)

      It doesn't just apply to cops though. Before these cameras, police routinely had a bit of leeway, and could decide to give you a break if he/she felt like it. Now, you are effed if you are pulled over for anything remotely serious. They have no choice anymore.

And when they would start going off about something like the prices or us not lending them our phones, we would say things like “our hands our tied it’s company policy for us not to lend you our phone we can get fired” when we in no way ever had any intention of lending the crack head covered in puke dropping rocks everywhere our phones. Really seemed like the arresting officer was trying to get the bad cop off the road with as little arguments as possible.

      They should have been charged for the firearms as a felony as well. If any individual who wasnt a cop acted as that man did they would have been shot. If any individuals who were cops were found to habe firearms on them while drunk they would have been charged with felonies.       They were driving safely. It used to be if you were too drunk, you got a ride ,walked home or put In a drunk tank with no charges. The car would stay by the road for 3 days to pick it up. The law states there has to be a victim to go to court. There was no victim. There should have been no charges.

    No one deserves kindness after drinking and driving. A drunk driver killed my best friend. He literally drove on top of his car and smashed him and the car and kept driving until a wheel fell off. There’s no excuse for drunk driving. If you don’t have a safe way home don’t drink.

      Im sorry about your friend. I had a friend die because of an intoxicated individual. It was a single vehicle, motorcycle, crash but my friend didn't know the man. It was a mistake on my friends part, being under the influence as well. Ever since that day, I have anxiety seeing anyone on a motorcycle without a helmet, and anyone who, by their driving pattern, are clearly intoxicated. I would happily volunteer and refrain from drinking if I knew it meant my family or friends get home safely. I'd even have enough guts to take away a strangers keys. I never want to regret not taking a stand and finding out I could have prevented an accident.

    Why would you apologise and cover for a criminal? Why would you tell her you respect her when she doesn’t even respect your and her job? Why would you let her out of a night in jail? Why would you not charge them for having their patrol gun outside of the job? Why would you let her not do the tests but somehow it’s not a problem even though your hands are supposedly tied? Why would you not make her take her high heels off to do the tests as you would a non cop citizen? Why would you nearly cry and beg for her to forgive you/not get mad at you when she’s in the wrong? Why would you guarantee her getting home? Why would your college not intervene when he is witnessing you not doing your job and deciding how to deal with it with her instead of following the simple laws?Because she’s a cop.

      Jackson Smith thanks and agree. I’ve been in this officers predicament having to arrest a fellow officer. If the law is broken it’s broken no special treatment from me. And before any cop haters reply that I would treat a cop differently than any other citizen... I give people the same respect and treat everyone the way I would like to be treated. I used to have our local high school kids ask specifically for me whenever they got in trouble because unfortunately a few guys I worked with were arrogant and badge heavy towards them. They always asked if I was on duty for me to come detain them and talk with them. I didn’t show favoritism to them but I still respected them as long as they respected me. Truthfully on the most part my job was a lot easier when you’re not in shouting matches or over aggressive to escalate the situation worse or into something which causes me or the person I’m dealing with some sort of harm or even a court issue or civil suit because of it.

      0:08 the dashed-yellow line disappears mid-turn, so his initial reason for pulling them over was legally invalid: The engineer who maintains this road has a MUTCD violation of "too dim paint markings" -- very common in USA; in this case the left-turn-only dashed (short) yellow lines are crucial to safely navigating the L turn they just made @ 0:10 because they're approaching crest of a hill, so they cannot see the pavement (and its mark-out of where the oncoming-lane's-L-turn-only lane, and the radius you must take to avoid crossing into his lane, aren't visible to give you a 2-second reaction time -- or what we engineers call "sight distance" is limited. The "left turn only painted guidance markings (short dashes showing the radius through this wide intersection that you should take, i.e. that you must keep right of) is very short sight-distance, and the 15'-20' length of paint missing mid-radius puts LIABILITY for any collisions or moving violations related thereto on the shoulders of the city/county/state who failed to maintain the mark-outs (paint), not the driver.
      So all evidence (officer observation of bad breath) is invalidated as "fruit from the poisoned tree". The extra paint IS there for a reason, especially in this case since they come up a hill into a WIDE "sea of pavement" (several lanes of width for both roads), then every "leg" into the intersection flattens out, creating, for this vehicle, a "hill crest" so she cannot see until the last second that she's cut the radius to tight, because the paint DISAPPEARED (poor maintenance...especially at night). Now IF a vehicle WAS in that lane, they'd have an easier time seeing that, unless he rushed up then SLAMMED his brakes... because his roof (unless it's a Corvette or other VERY low sportscar) sticks up WAY higher than the paint markings so you can see that DESPITE the "hill crest," but I'm betting the cop KNOWS this intersection is tricky especially for ppl unfamiliar w/the area, esp at night... and they take advantage of drivers who aren't familiar w/MUTCD requirements, until it kills someone in a head-on & they get a LAWYER who hires us engineers. Same thing is a home-owner on a corner lot builds an opaque wood fence 6' tall in his front yard in an intersection's "sight triangle" and the City Engineer doesn't make him tear it down.

      As a "warehouse lead man," I'll give you the "professional courtesy" of walking into my mechanic's or paintman's work area to discuss something you need done on your car, and trust you whereas I'd kick out or say "no, show me from there, from behind that yellow line" to some bubbleheads who I can't trust to not trip over airhoses or knock over my oil recovery, and then sue me. We all get "professional courtesies"/fringe benefits COMMENSURATE with our fields of expertise. 🙂

He simply would have, because it is an unwritten rule with cops that they don't bust each other, at least, they don't do it unless there is no other reasonable choice. There are rare exceptions, of course, but in general, that is reality. Also, an officer can smell alcohol on someone's breath, and say the he/she smells it, and still legitimately let someone go, as having alcohol on your breath doesn't mean you are drunk. You need to think things through more deeply.

    Cops are so corrupt. “regardless I’m not gonna charge you for the gun, I have too much respect for you” since when is it legal to carry a weapon when you’re intoxicated? And that’s with the camera on? He should be respecting the people he signed up to serve and protect instead of her just because she’s a cop. I really don’t get this. I’m a psychotherapist if one of my colleagues was doing something unethical that put others lives at risk I certainly wouldn’t respect them. This is why so much of the public doesn’t trust police, too many lacking integrity.

      The expectation was for special exception. She mentions being a cop like its supposed to matter.
      I have known people who are given cards by cops who are boyfriends or realitives and they basically tell you they can get away with things because of that card. Seems like corruption is common.
      Turns out, the DUI being a cop helped. The passenger telling the arresting officer that he won't lose his job either if he ignores the offense!

      As a psychotherapist do you group and judge your customers/patients like you do cops because you said “cops are so corrupt”…that’s pretty broad and includes them all in that blanket statement. As a therapist are any of your patients ever cops? Do you ever say something to your patients about them or their emotions or behavior or there reasoning that you don’t believe?
      The fact this cop did many things his drunk colleagues didn’t like, want or agree with. They did not leave without being identified and processed. Now what happens to them afterwards is up to courts and this cops superiors. I would think as a psychotherapist you wouldn’t group people together with such a judgmental comment

    Passenger is agitated and obviously too intoxicated to drive but is allowed to leave unchallenged/unmolested in illegal possession of his concealed firearm while intoxicated......
    I wonder what the plan was to secure the officer's weapon that was placed in the trunk....
    Lastly, there's not a single "ordinary" citizen on earth that can say they were treated this well after being arrested for suspicion of DUI.....

      I've gotten out of many charges, as a civilian, because the cop cut me slack. They do this all the time for ANYONE (if they can) ...I think primarily to keep things peaceful. It leaves you feeling thankful and thankful people are less likely to retaliate.
      If you're a prick though then, yes, they're gonna throw the book at you. So, if you find you're always getting slammed by the cops, well, be nicer.

    It always astonishes me that cops try to talk their way out of a DUI and that 99.9% of the time, the cops who arrest them, go out of their way to stretch the law to charge them with as little as possible. If that had not been cops, both of them would have went to jail!

      Yes. Multiple times I have been cut a break by a cop. Got cut loose of a DUI charge on one. I am not going to go into details on the other times but they were pretty heavy charges possible not placed on me.

      Yes, as a matter of fact, I have been let go. In the old days. I've since led a productive and law abiding life and am very grateful for the mercy. Look up "The letter of the law vs. the spirit of the law" and perhaps you might understand that an officer's discretion can indeed serve the best interests of a community (the people) instead of serving only the interests of the state (the government). Put THAT in yer pipe and smoke it, cop hater.
