I was working for a law firm as a Paralegal where they had poor staff management, wanted cheaper younger staff or persons with different skills. For over a year, they tried to get me to quit. I held out until they terminated me so got pay to the day, unused vacation monies (almost the max allowed 30 days) plus additional monies (treated like a layoff). I was also able to get unemployment for the full 6 months and HIPAA for 18 months to continue with their health insurance plan which was cheaper than an individual plan.
John, thank you. I'm in a job right now that isn't going the way the company has hoped. I was thinking about quitting. I even prayed for a solution and God just answered my prayers when I saw this video.
Too many companies get around this by what I call "quiet firing". Pushing somebody out by drastically cutting their hours and just treating them like crap until they quit. It's pretty messed up and lawmakers should prolly look into remedying this.
In the UK, you cannot be fired from work without a fair reason. ‘Not meeting expectations’ while you actually have is enough grounds to potentially sue your employer.

That was in 2020
Literally just say, "Fire me or I stay." It's that easy. Also, I always audio record my shifts(my state is one-party consent), so I'd be able to hold them accountable for dumb shit like this.
very good tip,but remember to consider folks,is the extra length worth literally destroying your body and mind for them? sometimes the little extra cash is NOT worth the extra long term damage you can get in the meantime when all your teaching and showing the company is that they can treat you however they want no matter what they put you through.
This actually happened to me during COVID. We had 2 scares in 2 weeks and both my mother and younger sister are immunocompromised so I asked for quarantine time. My assistant manager granted it, but then before we were clocking out told me that the manager and HR said I could not take 2 weeks. I could do the next day but would be required to come back. Previously, this place also rejected me promised accommodations because I hadn’t been there long enough (I’d just started Feb 2, this was in mid-July). The next day I wrote to my managers & HR stating that per physician instruction I was to take the full two weeks. Manager said OK but required me to send the note. The next day I got it and sent it. They still said I had to come in and I said no. Had a coworker text me a few days later asking if I was planning on coming back and I said yeah but not until my 2 weeks was up. That following week I got a call from HR but BOTH HR reps were on the phone. They tried really hard to get me to say I wasn’t coming back and that I quit but I maintained my stance: I’d be back on the date after my 2 week quarantine period. HR got VERY upset at my answer and eventually huffed and said they’d be sending me release paperwork.
The company I work for has done this, with the idea that it is much easier to find a new job if you currently have one. And there is no awkward situation where you have to explain during job interviews why you were let go (because you never were). You just look like a gainfully employed person trying to move up in the world.
I got about the same with my last paycheck - my final week of pay, my vacation time (about 220 hours worth) and 30 weeks of unemployment, which began in mid-May and ended the first week of January the next year.
Depends how quick you can find a job. As a programmer I'll be employed the following Monday and be collecting 2 paychecks for 2 weeks. Even if it takes longer, 2 weeks off plus my PTO payout sounds nice.
Same happened to me this February while 6 months pregnant! Had to wait on unemployment since they said it was my performance. But waiting for them to fire me, no matter how miserable they intentionally made it, was the best thing for my family 😊
Did they run KPI’s on you? Were you put on a PIP? If not, you could have grounds to sue. Last I checked, firing an employee for being pregnant counts as discrimination.
In my country they try the same tactics. After 20 years I was diagnosed with a disease that made my work more difficult becouse immobility problems and pain. I still did more work than I was required to do but they come up with a idea so I would leaf and not reported me sick. After 4 months struggling there I found out what I was seposesed to do. At the end they had to pay me more then 20.000 dollars. If I had left I had nothing. Some employers are real money greedy. They rather scam us then be loyal to someone that was more then 20 years loyal to them. Always ask a attorney advice before you make such decisions.
Although, getting fired can sometimes be more difficult to explain on a resume / in an interview, and forcing them to fire you would make it a bad idea to use them as a reference. Everyone's situation is different, but keep these potential cons in mind when making that choice
The only negative if this is you may have issues getting your next job if you were terminated for performance issues. Ideally you want to get laid off when times are difficult, that way it's not performance related. So only do this if you are retiring or starting your own business.
Not if you have a head on your shoulders. First of all, don’t put the manager who fired you, as the reference. Second of all, in order to avoid getting sued, most companies have policies where they can only confirm your employment dates. I’m not telling you to lie. But if you got fired, don’t put the manager who fired you as a reference, and tell them you quit, more than likely, they won’t be able to find out that you got fired.
I did this, my previous employer tried to get me to sign a voluntary resignation. Instead I refused and made them fire me. That allowed me to qualify for unemployment during COVID which was supercharged and I was making almost as much as when I was still working
In the US, you can get fired even if you're good at your job, but they'll claim performance issues. Sometimes a person just isn't like the popular crowd, or is threatening. That's often an employers go-to allegation.
Unless you have a legitimate grievance, such as harassment or payroll irregularities. Then you can quit and file. In every state and territory of the USA. Don't forget to sue.
Don't resign! I was "forced" to resign from my lab job to make room for the people of the company that took them over. Yeah, they bought me out. But I couldn't get unemployment after that. So, I started my own lab specializing in providing the elements from the periodic table and chemicals for science experiments. 5 years in and I still do this and my wife works for me now. Though I do keep a job with the state as a backup when school is out or the economy tanks. State jobs can be very secure here.
yeah, the moment someone suggests that *I* quit, when they have the authority to fire me...man that should definitely ring some alarm bells. like, you want me gone...you *could* fire me...why are you trying to convince me to quit?
Good idea. Same in Australia, even though you can later get welfare after 6 weeks, you are better off being fired because it opens you up to welfare immediately. When your company cannot performance you out, their only option is to make you redundant, payout baby 🎉
I got a severence package when i put in a 2wk notice upon an ethics investigation that was filed in response to one i filed (with good reason). I was young, in an abusive relationship at home, and the company was grossly mismanaging from the corporate level. The other unspoken alternative is to offer to buy out the company you work for. Then you'll turn the tables. Don't laugh, it's a highly profitable move.
This tip is trash if you work for the government. The company will fire you under an act that will either make you ineligible for full benefits (conduct unbecoming), or completely bar you from it. It's best to find a better job while you work. Always look up, never down.

My old job used a loophole of just lowering the amount of shifts a person got too 1 as a way of saying we won’t fire you but you will not get paid out from us.
Depends on the company and terms. In a company my brother works for, after changing ownership and leadership, they want to reduce the workforce significantly, especially those who get paid a lot and have protection from firing (and their work doesn't justify their salary). So they offer to give those who worked enough time there 5 years salary (including all benefits) times 1.25 if they agree to quit voluntary.
Yeah. In my last job I had some problems with a manager and HR told me I had to leave and it would be best for me to just resign (with 90% of my paycheck) as they had “evidence” of my bad attitude, and told me they were being nice to me for not firing me without a single penny. I simply told them that I loved so much my job that I couldn’t resign and if they want, we could take this to court. In the end I got more than 200% of my paycheck. Just don’t let them intimidate you.
Important extra fact for why they do this. When a worker becomes separated from his or her job and files for unemployment benefits, the worker’s past employer or employers will probably be charged for any benefits that may be paid.
Problem with waiting until they force you out, most, if not all unemployment claims require that you lost your job on NO FAULT OF YOUR OWN. Most companies will argue that it was your fault for not meeting the job's requirements and then you won't get benefits. But, you can leave your job and still get unemployment in certain circumstances, it just won't be as much otherwise.
Yup. Some people think being fired automatically disqualifies you... but it doesn't. Not even firing for cause all the time. The standards of fairness for denying benefits are much stricter than for firing itself.
I’m no legal expert but I’m pretty sure that someone would do that because they don’t have a actual reason to fire them and they don’t want to have an unlawful termination lawsuit
Can confirm, my former employer laid me off for covid and I wound up having to pay the govt back like $3k when they contested my unemployment. They lied about doing that to every single gay employee they had.
I banked up that pto. 150 hours paid out as cold hard cash. Only problem is finding a job that pays more. Also, you can use your HSA to pay for COBRA. However, taking money out of your HSA is taxable. So be mindful of the extra withholding.
My mom is an administrative law judge who is employed by the state (Indiana) to oversee claims involving unemployment law. I had a friend who’s employer tried exactly this with him. Because he knew my mom, he knew what they were doing. He told them he this was his job, he wasn’t leaving, and told them to shove it!
Wish I would have known this when I had my “contract terminated” at a job I LOVED and excelled at. (I made the bosses pets look bad. Then when I filed for unemployment. They fought it and told me if I knew what was good for me I’d drop it. They strong armed me (23 at the time) into backing down. I had a baby and a wife to feed. Absolutely bullshit.
EI (unemployment insurance in canada) is the difference between job hunting for 2 months to find something appropriate for you in the economy versus grabbing the first thing. Everybody benefits when you dont have underemployed people
I got fired at my last job for missing work do to medical reasons and I didn't qualify for unemployment or anything. That was over 8 months ago and I'm working for myself now, not getting by to well. Employers and HR don't care 99% of the time. For someone who likes working and wants to work it can be infuriating at times.
"Asked to resign" to a lot of employers is just as bad as "fired", but absolutely take that as an excuse to go ahead and start looking for another job.
Caveat is depends on which state you are in. If you laid off or fired for poor performance you get unemployment. If you got fired for stealing or other misconduct you may not get anything
When I was in high-school I worked for a traffic control c9moany that would not fire anyone. They would keep them on but either work them 1 hour a week or nothing at all until they quit.
Also keep your employment agreement. If you were hourly and worked more than contracted hours or did more than you assigned duties, contact wage and labor relations for a chance to get that extra pay, they will also have to pay all other employees they shorted. Nothing like the taste of justice and a nice check when you were termed after doing more than you were hired to do.
I worked at a job for 15 years that well was in no longer in need of my employment. The firing process was all ready initiated. Instead I simply put in my 2 week notice. Then I put in for a vacation UNTIL my last day. I was granted vacation. Last day I worked the whole day without incident. I recieved around 12,000 before taxes in unused vacation and sick time 3 weeks later. If I was fired I would have gotten 300 a week unemployment for 6 months. The lesson I am passing along is research before leaving a job. Ask about unused benefits especially health care. In my case I had company sponsored health care for the remainder of the month. And use diplomacy in asking for a severance package. In the case of a boss that was fired for no reason, lawyer up. The boss was awarded 200,000 in damages, true the lawyer got half.
i try to do this for my first job but they took too long and my mental state was not getting any better end up leaving they where getting ready to sell but It took them almost 2 and a half years for that.
This definitely depends on the law in the state as in my state as it can be rules as a lay off or discharge in addition to a quit. If the employer was going to terminate, it is a discharge. If the employer would have downsized the position, it is a lay off. In either of those cases, it doesn't matter if you accept or not, the result is the same. One thing you need to do is ask "Would I be terminated if I don't accept?" And if you file for unemployment, make sure that you include that your employer approached you about you quitting. Your former employer will almost always argue you quit
That arguably could fall under constructive dismissal which means you could be entitled to an unfair dismissal payout, right? Like obviously it’s a case by case thing but shouldn’t you contact a workplace lawyer if the ask you to resign?
Depends on the letting go and thr state for sure make sure you don't get fired for blatantly breaking company rules because that also sometimes disqualifies you for unemployment
I don't understand what's the point of having unemployment benefits/severance pay if companies just use loopholes to not pay for them. Companies don't get held accountable for evading laws like this often enough.
My wife took the severance package, and got it, but I think she should have taken unemployment. She got a job a week later, for 1/3 of the hourly pay. She gets paid a little more now than she would have gotten on unemployment, but now she’s cranky and annoyed and tired all the time like me. While making a lot less money.
Depends on where you live. For me, other employers can see in my record that I have been fired but not quit the job. Some of them can be judgemental about being fired and might not offer a job. But yeah, if you have no such thing to worry about then do not quit, let them fire you

Quiet Quitting = You only do the job you are paid for. Instead of working extra for free.
This is excellent advice! Some companies seem to set you up for failure! It makes me so angry!😡👋🏽👨🏽⚕️
This is EXACTLY what just happened to me. Long story short, after 7 great years at my company, my entire dept not only fell apart but landed solely on my shoulders. New management came in and wanted no trace of the previous dept (which was only me at that point) and made my life a living hell. I barely got through each day these last 3 months but finally received the pink slip along with severance and another month of insurance. It’s still tough to accept after the great run I had for 7 years but once my old boss and admin left, it was time to go.

Well just be sure to check the applicable law in your state. Consultant an employment attorney!
Always, always check with a professional before doing something big in your life lol
Each state is different. There are states where poor performance could be deemed as cause.
@@bige3969Yes but the employer's claim of poor performance is not undisputable. Actually it may be very easily disputable if the employer has never cared to document any alledged performance issues - and specially if the alledged performance issues are related to tasks outside of the employee's job description/work schedule.
@@bige3969 for the vast vast maniority of states, poor performance and misconduct are two very different things. Unless you were able to do your job up to standard and suddenly are intentionally not doing it in order to get fired, they will mark you down for poor performance and you’ll qualify for unemployment.

I got sooo screwed over by this. Always force them to fire you.
Too many companies get around this by what I call "quiet firing". Pushing somebody out by drastically cutting their hours and just treating them like crap until they quit. It's pretty messed up and lawmakers should prolly look into remedying this.
I've heard if they cut your hours, you can claim unemployment even if still employed by them.
In the UK, you cannot be fired from work without a fair reason.

@@MsSarahET if you can afford to have that mentality your doing better than most.
Many of us have worked for lesser human beings. You got lucky.
I got $6,000 & unemployment! :)

10 years of HELL
I got about the same with my last paycheck - my final week of pay, my vacation time (about 220 hours worth) and 30 weeks of unemployment, which began in mid-May and ended the first week of January the next year.
I like the idea that these characters are becoming self aware and will one day just go "is this who I am"
Depends how quick you can find a job. As a programmer I'll be employed the following Monday and be collecting 2 paychecks for 2 weeks. Even if it takes longer, 2 weeks off plus my PTO payout sounds nice.
In other words the taboo around getting fired is just like the taboo around discussing wages! Only more embarrassing to get fired!
Bob learns he doesn’t meet expectations after 9 months? Manager should have been sacked 8 months ago.
The only negative if this is you may have issues getting your next job if you were terminated for performance issues. Ideally you want to get laid off when times are difficult, that way it's not performance related.
So only do this if you are retiring or starting your own business.
A company can't tell employment verifiers that you were fired.

@@wil_L damn, your jurisdiction must suck. I get all kinds of protections from my state.
Appeal the termination. If you really were performing well and it was a manager’s unrealistic expectations, you can walk away free and clear.
Nope let them fire you instead of quitting!
They have to pay you redundancy payments in the uk if they fire you without reason, good advice for here too
In the US, you can get fired even if you're good at your job, but they'll claim performance issues. Sometimes a person just isn't like the popular crowd, or is threatening. That's often an employers go-to allegation.
Unless you have a legitimate grievance, such as harassment or payroll irregularities. Then you can quit and file. In every state and territory of the USA. Don't forget to sue.
I never quit. I've been fired..... ALWAYS 💀
In my country if someone wants to quit, the company will fire him to allow him to get unemployment.
I like how he just appears out of nowhere
Ya like jazz?
How tf did you get fired from a government job?
@@darbodrake89 Local, State and Federal are all considered government jobs. It really depends. Sometimes getting fired isn't as ideal especially if you need your old company as a reference for a new job.

@@louiseely3930 That's not true. I had an employer who would discuss details if asked.

I'm not sure on the specifics of your suit, but it probably had to do with defamation. Unless you're in a state that has laws further limiting what can be asked/discussed. But even then, the safe question to ask is always "would you hire this person again".
@@louiseely3930 How TF would you know if they gave your potential new employer a bad review? Why would the potential new employer tell you "your ex-employer had only terrible things to say about you" and risk getting dragged into a lawsuit between you and your ex-employer?

My previous employer tried this crap. However, I've got a new job that's much better so I never needed unemployment.
True, but even better when you can afford to quit.
They used to tell people getting fired is terrible for your reputation
My old job used a loophole of just lowering the amount of shifts a person got too 1 as a way of saying we won’t fire you but you will not get paid out from us.
Sounds about right they give you 4 or 5 peoples workload but only pay you for one person's job. This even happened at minimum wage fast food jobs.
"I'm not quitting, but we can discuss a severance package."
In the first 5 seconds, I thought they were together lmao
Problem with waiting until they force you out, most, if not all unemployment claims require that you lost your job on NO FAULT OF YOUR OWN. Most companies will argue that it was your fault for not meeting the job's requirements and then you won't get benefits. But, you can leave your job and still get unemployment in certain circumstances, it just won't be as much otherwise.
Depends what you get fired for! John taught me that
They never state the fact that they could just lie to unemployment and you can still gwt denied
Can confirm, my former employer laid me off for covid and I wound up having to pay the govt back like $3k when they contested my unemployment. They lied about doing that to every single gay employee they had.
In Australia it’s against the law to ask an employee to resign. It’s called constructive dismissal and carries hefty fines and sanctions.
Everybody benefits when you dont have underemployed people
Unfortunately unemployment in the state of Florida is around 300 who can serve on that?
When you're ready to get fired, they never want to fire you even if you keep fucking up
The opposite is true in my state. If you get fired, you do not qualify for unemployment.
You can appeal an unemployment denial decision.
"Asked to resign" to a lot of employers is just as bad as "fired", but absolutely take that as an excuse to go ahead and start looking for another job.
Hey John just wanted to ask if you’re going to make a video about the Wells Fargo Autograph card?
I love how companies (even the US government when you apply for the post office) ask you if you’ve ever been fired/asked to resign. Really?
It's because most people can just leave a job when they're done instead of trying to scam unemployment money they don't need.
Two lessons learned here. With poor management, the “subordinates” ALWAYS take the fall. And two: do what it takes to get that money.
One thing you need to do is ask "Would I be terminated if I don't accept?"
And if you file for unemployment, make sure that you include that your employer approached you about you quitting. Your former employer will almost always argue you quit
It worked for me 5 yrs ago... I was able to go to school and travel 😊
They can also state they fired you for stealing or something like that which would also disqualify you for unemployment.
Thanks for this Information 💕
Increases their taxes and also leaves them open to potential litigation.
That arguably could fall under constructive dismissal which means you could be entitled to an unfair dismissal payout, right? Like obviously it’s a case by case thing but shouldn’t you contact a workplace lawyer if the ask you to resign?
knowledge is power
Depends on the letting go and thr state for sure make sure you don't get fired for blatantly breaking company rules because that also sometimes disqualifies you for unemployment
"Dont do this, but also do it, but we wont tell you which :)"
Not what was said
I don't understand what's the point of having unemployment benefits/severance pay if companies just use loopholes to not pay for them.
REMEMBER that collecting unemployment is NOT GOOD GOR YOUR RETIREMENT.
Depends on where you live. For me, other employers can see in my record that I have been fired but not quit the job. Some of them can be judgemental about being fired and might not offer a job. But yeah, if you have no such thing to worry about then do not quit, let them fire you
I tried this and ended working there for 15 years.
Unemployment benefits is such a joke. It's a downfall for both involved and should only be used for people who work seasonal.
