Will you be making a video on the time news now Patrick was assaulted by the York Nebraska police?
He requested a complaint form, was denied and then the officer who denied him the form followed him into the parking lot and attempted to batter Patrick by his own admission after taking several pictures of Patrick. Patrick and the girl he was with (not sure what his relationship with her is) left and went back to their vehicle to discover the same officer stalked them to their vehicle to take their tags and vin number off the vehicle. When they blocked the officer's view of the tags he went to the front to get the vin and broke Patrick's finger with his flashlight. Finally he went to the back and used force to move the girl out of his way to take their tags.
He claims to be a 40+ year veteran of the force but breaks several laws to deny people a complaint form and find out who they are.
One of the best 1AA related channels. I remember this. "Totality" is simply theory, once graduating cadet school . . . I consider it defrauding the public to take an oath to the Constitution; number one, without knowing what the basis of that oath might be and two, NEVER INTENDING to keep that oath, with prior expectations of transferring its primacy to the Blue Line Flag. Just sayin'. Plus, potential collusion, of course.

You don't have to point a gun at someone. The act of unholstering the gun is use of deadly force.
I see that as a distinction with out a differance, whether they point the guns or not it is still a threat, a gun can go from not pointing to pointing in less than a second.
@@traog Right, if an officer can kill someone simply for having a gun on their person, than unholstering theirs is a direct threat.
The officer lied over the radio, that alone should be a crime.

I'm not sure if the officer mentioned African American over the radio or not but how does the officer mention that the person has a blunt object and 9 officers turn up for back up, really? The original officer already has a gun and taser if needed. The most he needed was 2 more officers in one car as back up but 9? That's terrible situation control right there

The fact the police office described the trash grabber as a blunt object makes me think the officer was trying to put the officers in an alert and defensive mode.

$125,000 was not enough! This officer should be fired completely. This police officer must have done this to many others and he even lie to dispatcher.
Agreed.
Imagine a cop coming to your house and accuses you of trespassing for no reason at all...
Start paying court settlements with cop pensions and see how quickly they start behaving.
I have been advising that for several years. Make the policy apply to all at a particular station or for a particular forces and when the payments start the premiums will go up.That will save the taxpayer and cops will be on the same footing as doctors or householders who have to insure against people getting hurt on their property.
That's a double edge sword that could yield multiple results. You can have officers abiding by the law and keeping themselves accountable, but you can very well see the other end of more corruption and making sure they don't lose that pension. What really needs to happen is more body cameras, one's that can't just be turned on an off on a whim. More training and background checks. And a separate entity to investigate cases of the police. To many times we hear stories of "We investigated ourselves and found we did nothing wrong."
And one more thing, we can't allow police officers who have been fired (on legit grounds that they are not fit to be an officer) from one county to be allowed to become an officer again in another. That defeats the purpose of firing them to begin with.
I cant believe the officer got to get a $69k "I quit" bonus too!
true enough, however, some officers ,even behaving well, get shot and killed,in this incident i am not on the officer's side, but i will not generalize.

simple logic that most cops do not have
we actually have a regular homeless man that picks up trash outside of our building and comes in to ask if he can use our lan line. Cops should NOT be allowed to alter their bodycam in ANY WAYS.
I offered up ideas where they work like other dash and security cameras. Constantly loop recording, but only saving once activated. They cannot turn off the camera or alter it in any way. It includes the 5 mins prior to the activation signal and the 5 mins after the all-clear signal. The camera is tied into the radio so if they use it, it starts to save the recording. Dispatch and the commanding officers are the only ones able to send the all-clear command to stop recording. Dispatch will also activate the recording if they dispatch a particular unit. Rules in place about shutting off the radio. The data on the camera must be saved, stored and VERIFIED at the end of each shift by a superior. If any shenanigans happen, that commanding officer gets caught up too. Not to mention adding federal level laws that govern the way law enforcement interacts with the public. There HAS to be a standard.
Wait are they?

One of the issues here is that a student’s address on their license will be their home address not their dorm.
You are smart unlike the thug playing dress up in a police uniform.
That cop targeted him for sure WOW
turning off a body cam, audio or video while somebody is still detained should be a instant felony and dismissal! the fact that it is even a feature just amazes me!
The officer "resigned" with a $69,000 salary! That is absurd
It is already a felony. It's tampering with evidence.
Body cams are useless if they have the ability to turn off at notice
@@AT-yj8gl I mean they gotta use the bathroom. Every tool can be used for good or bad. So it's not an issue of the feature it's an issue of who commands that feature.
Amazingly he did that and that wasn't discussed
The last line of that officer's report:
"I did not give him any commands, use any force, or display any official authority."
So, we are just straight-up writing fiction novels as police reports now, huh?
The fact that an officer can so blatantly lie on a police report while threatening this man's life with a gun, and is not currently sitting is prison, mean that the entirety of the policing system is rotten to the very core.
The police decently have an issue with chronic liars and narcissists.
All the time.
OMG?! I was going to say jaw-drop, but sadly it’s not surprising anymore .
Didnt the police officer say the exact words, "OBEY MY COMMAND, SIT DOWN," like babes? even u called it a command. im so glad someone caught that at the end of the report. good on you mitch
Shoutout the 1 cop for securing the “blunt object” and bucket 😂
Tbf, from the get-go the sergeant should have just said, "that will do officer Smiley, I'll handle this, you can go now".
I HATE how cops antagonize and escalate a situation and then expect the person they angered to "be calm and let's talk".
And they can absolutely get fucked with their favourite "can we have an adult conversation" line which is nothing but a backhanded accusation of childishness.
they are cowards
The expectations of citizens to "stay calm" during extreme duress and profiling but cops can feel threatened by a bucket and trash grabber is unreal. Cops "fear for their life" all the time and we hold their fear to a MUCH higher standard when they are the ones who have received training, when in reality many don't, to handle these high pressure situations.
@@jaycarrillojc They are trained how to kill, to draw fast put the maximum amount of lead on target as soon as possible and reload fast to do it all again. This is supposed to build confidence but for them to still act as if they're afraid is so phoney the only explanation is they aren't afraid.
He basically swatted him.
He called in backup phrased in such a way to trigger an armed response. All in retaliation for him using his rights and not letting the cop act outside the scope of the law.
@@Treblaine agreed...and a reason I personally think ex combat soldiers should not be police officers as they are trained to be lethal
The only weapon this guy is carrying is the balls of steel he has.
And let's be honest they could seriously harm this officer lol
@@michaelsorensen7567 without the uniform the coward has no chance.
@@michaelsorensen7567 No chance of that happening because he need to be in close range, the cop have a gun who can one shoot him (it’s say that Smiley had his hand on the gun for 7 minutes I think , so he would have been able to react )
He's a fucking badass dude
It’s not a trash grabber- it’s a reach extender, reacher, grabber arm, helping hand, trash picker, picker-upper, extended gripper, long arm gripper, extended reach grabber, grabber tool, litter picker, or caliper!! Settled.
Would love to see you cover Saun Paul Reyes AKA Long Island Audits interactions with the Nassau County PD, Specifically his assault by police sergeant Bryan Fahey.
"You have a fucking gun that kills people, how I am supposed to kill someone with this??"
this line is just gold
I understand his very reasonably distraction. But for those of us with the benefit of hindsight, yes, that could be used to kill someone. It's not nearly as effective as a baseball bat, but even bare fists can kill. A trash picker doesn't make a very good weapon (it's far too light), but it could be employed as one.
This is, of course, rather beside the real point: compliance. But setting that aside, it's reasonable for an officer to see the trash picker as a potential weapon. Though it probably wasn't in his best interest to emphasize that point to a suspect if he actually thought violence was imminent.
@@gdshoe5822 I think a trashpicker is a less effective weapon than bare hands.
Unless this agent goes around the city intimating everybody to remove their hands, i suppose this cannot be seen as reasonable at all, it was just a mere excuse
@@feffo9908 You can go ahead and think that. I don't. I don't want to get into a fight, but if I was forced to, I'd rather have a trash picker than not. It would be a very poor choice of weapon, but better than nothing.
As for "mere excuse", I half agree. I think the motivation was a bit deeper, probably subconscious. Again, it was about regaining compliance. "Safety" may have played a minor role, but it wasn't the overarching issue at play.
@@gdshoe5822 agree with you, it's totally about compliance. Point is the request of the officer for the guy to comply to his orders, is unreasonable. Only kids pretends other to comply no matter what, and get mad when others do not
@@feffo9908 I see some parallels to unskilled parenting too. (for what that's worth) Since a large portion of what we ask cops to do is babysit supposed adults all day, it's hard not to draw the comparison.
They're probably not at all accurate numbers, but I heard one cop say that 95% of their time is spent babysitting 5% of the population.
The fact that he’s picking up trash makes this even worse somehow. He’s actually CLEANING the property and making the place nicer. I wish I had trespassers like this in my area!
I know right. You would think that an officer would be able to look at the big picture or the totality of the circumstances. SMH
In a way, he helped clean up the real trash: A police officer.
@@andrewnavarro1185 you think so? The trash got a huge severance package and I would bet he went straight to a different department. Maybe even in the same state. He didn't clean up anything. He just polished that turd and moved it somewhere else. FTP
I need someone to "trespass" my backyard.
Hence why he told the cop to get of the property
Quite obvious that the officer was engaging in a power struggle and his ego wouldnt let him back down. "You must drop that stick and sit down bc i told you too."
The only person trespassing was the cop
I just need to verify that you have a right to be here, on this public sidewalk, performing a community service, on your own time.
Apparently he was sitting on the patio at one point which is bs
Then he offered to show him he lived there by the front desk, and the cop said no to that. So at that point the cop was just trying to cause a problem.
We need to verify that cops have brains.
@@johnsugrue4155 how dare he a non white person, existing? Illegal
I mean, did you see the picture of the officer? No doubt in my mind that kid is scared of color.
The disappointed tone of officer Smile's voice when he was ordered to return the ID and end the investigation shows he was determined to get his way and didn't really care about the laws.
He just wanted to shoot that poor guy i have no doubt. He said he disnt see the grabber until "he acted like he was gonna destroy the cars or something"....bullshit he saw it from minute one and those things way less than a pound!

If the police officer can simply turn off the audio or simply cover their camera view, they will always corrupt themselves by creating a false justification to distort the situation in their favor, regrettable.
