The audacity to tell someone to go inside on their own porch, then illegally step on their porch and physically move them inside. No training would fix this, it’s a personality problem.
He keeps mocking her for saying she's scared, then proves immediately EXACTLY why she SHOULD be scared of them! I sincerely hope those cops never work in a position of power ever again. They should be prosecuted for what they did here. Losing their jobs isn't nearly enough.
Let this be a sample of what just has transpired with credit card companies creating a new code for the purchase of firearms in their system. By default there is a gun registry and when the time comes officers feel the need to rid you of your lawfully purchased gun this is where we will be.
I respect the HELL out of Mr. Tart for standing his ground and not giving these pigs an inch. So many would lose their temper or concede to their demands. You did everything perfectly with your pride intact.
As I've been saying for years, when citizens successfully sue, the money should come out of these police officers' pensions. Their unions should pay. This way, you also get the other officers to hold them accountable.
When officers abuse their power there should be no immunity and they should lose it for the rest of their career. Officers will only get sued once and either change their attitude or quit. ?
I agree with you; I too have been saying the same thing for years. Also, when the money comes out of the pensions the police union will have a different view about supporting incompetent and ignorant officers (immunity). They should lose their homes and financial stability just like anyone else who may be sued for negligence, such as nurses, doctors, teachers, etc. They are the only ones on the planet who are allowed to use deadly weapons/force (besides armed guards) during the course of their work. However, one excuse they use is "fear for their lives"; but it's ridiculous to them for innocent citizens to say to them that they "fear for their lives". He knew exactly what the lady meant by "the season we're living in". Officers should be held accountable and lose their personal assets.
What hurts my heart is that they expressed their rights in the sweetest, most patient patient way, and the cop still chose to mock the woman for being scared and then proceeds to shove them inside? Oh the irony.

The fact that the officers went up to them essentially accusing them of being involved with some marijuana grow not even on their property..Who wouldn’t be scared of being accused of a crime they didn’t commit? The correct avemue is almost always through the courts. Some people who Are being victimised dont understand this and make it physical. Even if the original thing is tossed in court prosecutors can ruin your life for the physical part. You can sit in jail for years before evem being brought to trial

A friend of mine uses that technique. Ignoring the obvious and even claiming to not know anything about it. "What times we live in?" as if to completely de-acknowledge the legitimate concerns of the person who is just expressing themselves. Both cops in this story are in the wrong.
Ordinary Cops are idiots. If they really wanted to figure out who the plants belong too they could set up a trail camera that texts the photos out. They are inexpensive and work like a charm. We’ve busted several trespassers with them.
He seems to not know the implications behind his particular question, its reasonable that she get scared. If they say yes, they go to jail/prison the whole works if they say no he wont believe them and keep pressing the issue so just by asking that question he already put them in a situation where they should be scared.
So when cops realize they screwed up, they don't show up to court so that the case is dismissed. This way, a "Not Guilty" verdict can not be made. When we fail to show up to court, we are issued an arrest warrant.

Not in all cases. If it’s a criminal complaint alleging criminal activity they have to show up. This is why it’s very important to get a attorney if something like this happens
Whats worse is that the prosecutor didnt drop the case well before the court date. It is somewhat understandable that a police officer might get confused or misapply a law, and if there was a culture of superiors and prosecutors double checking their officers homework then these kinds of mistakes could be generally fogiven and corrected. However what we have is a culture of protection through avoidance. Everyone ignores the problem and hope that either the victims get to tired or scared to pursue a lawsuit, or the officers get themselves canned or killed.
When dude just puts his hands behind his back and says, “Yeah. You right, take me to jail.” The cop panicked because his attempt to escalate the situation absolutely failed. 😆

On top of that, he was acting angry about the question and kept trying to bring it up again. Sounds like he was either offended that she suggests that there is a culture of fear among black people who are disproportionately affected by police violence and tyranny, or he was about to suggest that she's scared because she has something to hide and claim justification for some sort of illegal search and seizure based on that. He was trying to bait her into engaging with him in a no-win conversation when he KNEW what she meant.
That struck me as odd from the officer as well. He is basically saying "hey, why are you scared that I am accusing you of a crime and threatening to arrest you? It's not like people die during police interactions"

That's definitely what triggered him into being so hostile. This pattern plays out again and again - civilians who have obviously committed no crime but are nonetheless in the crosshair of belligerent cops, the moment the police feel like someone isn't kissing their ass they begin abusing their power and behave in a juvenile, retaliatory manner.

It took me about 5 minutes research to find the information on this amazing man, whose helping to improve his community. I'm generally a supporter of our Police but this incident was absolutely uncalled for! He's owed an apology and restitution. The lady was being so articulate and careful, trying to express to the officers how it feels to her and her husband. Why he was so triggered by "the season we are living in" makes no sense. The police doesn't need to care about doing a good job because their income is obtained though coercion, this is not like a private security company that will bankrupt for things, in any case the worst that will happen is that they will be sued and the taxpayers will have to pay the bill (which also doesn't affect them in any way).

I was once asked if i was the one running. I honestly thought the cop was gonna ask me something else, and it kinda left me speechless. I said no. And he just gave me a weird look, i wasnt even out of Breath, i was outside my house, so why would someone who ran stay out in public like that.after a bit he started talking with another cop about how i could go to prison. Only to then realize they hadn't ask for my name or age, i was under age at the time. Neither saw the one who ran but said he had blue jeans, my jeans where a faded gray, almost white, and i told them that, which again was odd. The cop who saw the one who ran from them didn't even take a second look at me, the second he stepped out of his car he knew it wasnt me. By that time there was 4 or 5 cops. I guess they really wanted to catch the guy haha
I once had a cop come over and ask me if the bike I was on was mine. As if a bike theif is just gonna admit to robbery, to an officer in uniform! I could have hopped on the bike and easily got away from him but I dismounted and waited until he approached me to ask the question. I was gobsmacked at how he ended up in that uniform. I sarcastically told him that was some "stellar detective work." He just waved me off.
literally, i parked in a desolate parking area where cops usually park and then they started saying people do drugs in the area and all that, asking me accusatory questions and asked to search my car, i let them cause i have nothing to hide and when the main questioning cop knew they weren’t gonna find shi he was like “be honest what were you doing here?” literally just chilling and i started laughing at him and his searching officer cause they’re total bums
They have guns legally because their supposed to protect and serve so I would be fearful since history dictates unlawful authority is consistently occurring on black homeowners, Latino homeowners without true need for just cause. The Marijuana issue warranted removing of the illegal substance rather than assuming someone is involved with the existence. Police the police. Mr. Tartt said they were not involved with the Marijuana and that's what you should believe. These people were decent and kind regardless.

@@crabbyalthegrump641 don’t forget that there’s both good and bad in every profession. Analyze every situation case by case. There is a corruption problem in law enforcement, and it needs to be addressed, but writing off the whole system as corrupt defeats the purpose of calling out the bad in the first place. Seeing dead leaves on a plant doesn’t mean the whole plant is dead, just gotta do the work to trim the ones that are. And you’ll keep seeing dead leaves, the work is never done, you just have to do the best you can to maintain it if you want to see it look the best it can. These officers are dead leaves, but I’ve personally met good officers who go out of their way to help those in need, no matter their race. And despite what some may say, they do exist and they deserve commemoration. Just like how the bad ones deserve to be held accountable for their crimes and punished accordingly.
Googled Jason Tart West Virginia. I don't know if it is a coincidence or not but CNN Kamua Bell interviewed him for a number of plants including hemp plants in West Virginia. No idea if the farmer was pushed into a direction he wasn't going or not.

Technically, they weren’t trying to film police in public. They were on their own private property. I love how he kept his cool, and was willing to comply. Everyone on that patio had far more patience than the officers deserved in this case.

He identified himself as the owner of the property. The investigation should have been about the marijuana. If they suspected him for growing it, they should have arrested him for that. I don't see how his date of birth had anything to do with it.

One of the most disturbing aspects of this encounter was the way that the officer mocked the woman for saying that she feared interactions with unknown people and simply asked for the officers name for her peace of mind. This police department's motto must be "To gaslight and intimidate" instead of server and protect.
Based on this interaction alone, at least the one arresting officer (and I would argue both) should be fired and prosecuted not only for Criminal Behavior but also for ignorance of the law, and the completely unlawful threats [under duress] against innocent people who pay their salary.

When a cops comes, and says : "Hello sir!", it's already in a grumpy way: "Do I need to answer any of your questions? Does the police there really have such a bad reputation? In my country they usually are seen as much too soft, but most people (of decent social stature at least) still have respect for them.
Forcing the man into the house to keep from being recorded or having "witnesses" should be grounds for immediate termination. It shows the intent to HIDE his conduct and that is proof of guilt. Officers often use the "if you haven't done anything wrong then why are you being elusive?"
I also wonder if that can be false imprisonment and kidnapping. He forces the man into the house, but it's unclear when he can leave it. Even if it was clear, he was pushed into a location where he didn't want to go.
Any monetary settlements from bad policing should come from police pension funds, not public coffers. This would encourage police to purge their ranks of bad cops.
Humans will be humans and there are always dicks out there, what we need is a better way to weed these fool's out before hiring and for the police force to not defend them once they are found out.
This is the truth. It takes three years to become a cop in Sweden or Norway, as just two examples of superb training requirements. I wish we had such requirements here in the US. Maybe having to get a bachelor's degree in police work before becoming a cop would eliminate some of these morons.

Courts give cops too much power. Prosecutors mostly are responsible for not prosecuting them. They need to send a message to all cops, you will be arrested and prosecuted! This should be national!

Apparently, the only safe thing to do when you see cops near your house is to move quickly inside and refuse to answer the door when they knock, unless they say they have a warrant. Beyond that, there's no value to be gained from participating in dialogue with the police because they can lie to you or, at least, be uninformed as to their rights as officers.
That's how I am. When I see cops running red lights and speeding on roadways, I perfer that as it means they get further away from him. We already know they think they are above the law, so break it so you can separate the distance between us.
the way the officer reacted to that extremely kind lady was telling. she perfect articulated why she wanted his name and how it would make her feel safe but he wanted to play stupid and act like there was no implications to the situation he created. Every time I get stopped by cops (happens a lot for some reason), I comply with providing my ID but I never let them search me and I always tell them that if they suspect me of anything, they can arrest me and take me to the station for further investigation, and after the "investigation" is over and they figure out that I have nothing to hide, I will sue them. So far, no one actually arrested me, most of the time they simply give me my ID back and tell me I'm free to go, but sometimes they don't like how their ego just got crushed by a civilian knowing the law better than them and ad in some snarky comments. Most threating comment I got was "We will remember you". Told them they can follow me on Instagram so they can't forget how I look... Most cops are egoistical assholes.

I just want to know why the police are allowed to just step all over our rights. Even if a person doesn’t understand their rights, shouldn’t the police have to respect and honor them? Like if we don’t lawfully have to give the police our information, why do these jerks continuously ask for it and act like the law demands that we do? It’s so damn ridiculous. The police are supposed to uphold the law but they break it more than anyone.

Exactly, he gave his name the first time they asked him. This entire situation obviously had nothing to do with collecting his name/info. He already gave it. The lady pissed off law enforcement with her comments, so they clearly took it out on this man (since they couldn't do anything to the lady). I hope he wins millions.
They didnt arrest him there because he was in the curtelage of his house. Performing a warrantless arrest automatically makes the arrest ilegal (except during extreme circumstances) so they instead made him go to the driveway in order to do so. Which rules out ignorance from the officers. They wanted to arrest him and charge him just because. The FTA in court from the officer further proves it. He didnt need to ask him anything after he said his name. If he owns that property they can connect the dots and investigate to get the rest of the information. They didnt.
I would like to see issues like this expediently brought before a court of law, without dismissal by a magistrate who doesn't want to be burdened with intricacies of the case. The Constitutional statues need to be addressed immediately not shoved off so that to victim needs to appeal with extenuating court cost as a victim. Anyone see the irony, the cop refuses to give his name in the performance of his duties to the lady at the beginning and then demands ID from the gentleman and says “what’s the big deal just give me your information”…I highly doubt that any court is going to find that owning s property adjacent to a property that has marijuana constitutes reasonable suspicion in itself. If the officers had seen him in that property or received a complaint by a witness that it was him growing in that property in addition to him owning the adjacent properties that would be a different story.
How would it matter if someone saw him growing on the adjacent property? Cop would need probably cause, and even if that gave probable cause, that's sufficient for arrest, which would then require him to identify. It has no bearing on whether he is required to give his name without arrest.
It would matter because they could argue the investigation was legitimate after that. That's why the make false statements and accusations. It's to cover their own ass.
Why would a policeman ask something that no one needs to answer to them and then not to provide his identification, when he's legally required to do so?

Not issuing a bench warrant when a officer refuses to show up when order to shows that cops have entitlements and aren't held accountable. Let's say you were a victim of theft, you called the police, found out who did it and pressed charges. The courts ordered you to show up to testify. If you don't show up you get a bench warrant for failure to show up in court. Now idk if the charges on the person who stole your stuff gets their changes dropped but fact is the judge would still issue the warrant for you because you didn't show up when you where by law supposed to. Should be no different for a cop. Just because the person is a cop doesn't mean he shouldn't have a warrant for failure to show up to cort when ordered to.
Because of the statement the deputy gave to Mr. Tart requiring him to identify himself, he should file complaints with their agency and the state certifying agency that grants police powers and request that the officer’s certification be suspended or revoked until he is properly trained and tested in constitutional law and civil rights, then sue him and his agency and the state certifying agency for failure to properly train the officer. They let officers get away with either not knowing the law or violating the law, now they have to pay for it.

If a cop has to be trained to not push someone into his own home to prevent him from peacefully recording cops, the cop should be arrested, fired, and sued, not sent for more "training." As I've been saying for years, when citizens successfully sue, the money should come out of these police officers' pensions. Their unions should pay. This way, you also get the other officers to hold them accountable.

Also, when the money comes out of the pensions the police union will have a different view about supporting incompetent and ignorant officers (immunity). A friend of mine uses that technique. Ignoring the obvious and even claiming to not know anything about it. "What times we live in?" as if to completely de-acknowledge the legitimate concerns of the person who is just expressing themselves. Both cops in this story are in the wrong.

Ordinary Cops are idiots. If they really wanted to figure out who the plants belong too they could set up a trail camera that texts the photos out. They are inexpensive and work like a charm. We’ve busted several trespassers with them.
He seems to not know the implications behind his particular question, its reasonable that she get scared. If they say yes, they go to jail/prison the whole works if they say no he wont believe them and keep pressing the issue so just by asking that question he already put them in a situation where they should be scared.
So when cops realize they screwed up, they don't show up to court so that the case is dismissed. This way, a "Not Guilty" verdict can not be made. When we fail to show up to court, we are issued an arrest warrant.

Not in all cases. If it’s a criminal complaint alleging criminal activity they have to show up. This is why it’s very important to get a attorney if something like this happens
Whats worse is that the prosecutor didnt drop the case well before the court date. It is somewhat understandable that a police officer might get confused or misapply a law, and if there was a culture of superiors and prosecutors double checking their officers homework then these kinds of mistakes could be generally fogiven and corrected. However what we have is a culture of protection through avoidance. Everyone ignores the problem and hope that either the victims get to tired or scared to pursue a lawsuit, or the officers get themselves canned or killed.

On top of that, he was acting angry about the question and kept trying to bring it up again. Sounds like he was either offended that she suggests that there is a culture of fear among black people who are disproportionately affected by police violence and tyranny, or he was about to suggest that she's scared because she has something to hide and claim justification for some sort of illegal search and seizure based on that. He was trying to bait her into engaging with him in a no-win conversation when he KNEW what she meant.

This police officer can't just walk up to someone and ask "Did you just murder a person?" and expect the person to respond in any normal way, of course it's accusatory.
I was once asked if i was the one running. I honestly thought the cop was gonna ask me something else, and it kinda left me speechless. I said no. And he just gave me a weird look, i wasnt even out of Breath, i was outside my house, so why would someone who ran stay out in public like that.after a bit he started talking with another cop about how i could go to prison. Only to then realize they hadn't ask for my name or age, i was under age at the time. Neither saw the one who ran but said he had blue jeans, my jeans where a faded gray, almost white, and i told them that, which again was odd. The cop who saw the one who ran from them didn't even take a second look at me, the second he stepped out of his car he knew it wasnt me. By that time there was 4 or 5 cops. I guess they really wanted to catch the guy haha

I once had a cop come over and ask me if the bike I was on was mine. As if a bike theif is just gonna admit to robbery, to an officer in uniform! There is a corruption problem in law enforcement, and it needs to be addressed, but writing off the whole system as corrupt defeats the purpose of calling out the bad in the first place. Seeing dead leaves on a plant doesn’t mean the whole plant is dead, just gotta do the work to trim the ones that are. And you’ll keep seeing dead leaves, the work is never done, you just have to do the best you can to maintain it if you want to see it look the best it can. These officers are dead leaves, but I’ve personally met good officers who go out of their way to help those in need, no matter their race. And despite what some may say, they do exist and they deserve commemoration. Just like how the bad ones deserve to be held accountable for their crimes and punished accordingly.

Googled Jason Tart West Virginia. I don't know if it is a coincidence or not but CNN Kamua Bell interviewed him for a number of plants including hemp plants in West Virginia. No idea if the farmer was pushed into a direction he wasn't going or not.

One of the most disturbing aspects of this encounter was the way that the officer mocked the woman for saying that she feared interactions with unknown people and simply asked for the officers name for her peace of mind. This police department's motto must be "To gaslight and intimidate" instead of server and protect.

Does the police there really have such a bad reputation? In my country they usually are seen as much too soft, but most people (of decent social stature at least) still have respect for them.
Forcing the man into the house to keep from being recorded or having "witnesses" should be grounds for immediate termination. It shows the intent to HIDE his conduct and that is proof of guilt. Officers often use the "if you haven't done anything wrong then why are you being elusive?"
I also wonder if that can be false imprisonment and kidnapping. He forces the man into the house, but it's unclear when he can leave it. Even if it was clear, he was pushed into a location where he didn't want to go.

Apparently, the only safe thing to do when you see cops near your house is to move quickly inside and refuse to answer the door when they knock, unless they say they have a warrant. Beyond that, there's no value to be gained from participating in dialogue with the police because they can lie to you or, at least, be uninformed as to their rights as officers.

Every time I get stopped by cops (happens a lot for some reason), I comply with providing my ID but I never let them search me and I always tell them that if they suspect me of anything, they can arrest me and take me to the station for further investigation, and after the "investigation" is over and they figure out that I have nothing to hide, I will sue them. So far, no one actually arrested me, most of the time they simply give me my ID back and tell me I'm free to go, but sometimes they don't like how their ego just got crushed by a civilian knowing the law better than them and ad in some snarky comments. Most threating comment I got was "We will remember you". Told them they can follow me on Instagram so they can't forget how I look... Most cops are egoistical assholes.

I just want to know why the police are allowed to just step all over our rights. Even if a person doesn’t understand their rights, shouldn’t the police have to respect and honor them?

He applied what he knew to the best of his ability, the cops were on an ego trip and as a result he just said "You know what, go ahead, arrest me" because he knew it wouldn't hold up, he knew he'd be able to file a lawsuit against them and have those officers removed from their positions. Smart man right there. Hats off to you sir.

They were clearly bored. He gave his name immediately when asked. With his name, they could’ve easily gotten the date of birth and been on their way. He asked Tartt to put his hands behind his back, but when he did so, the officer oddly didn’t cuff him. The officer tried escalating the situation hoping Tartt would give them something to charge him with, but failed.

The lady pissed off law enforcement with her comments, so they clearly took it out on this man (since they couldn't do anything to the lady). I hope he wins millions.
They didnt arrest him there because he was in the curtelage of his house. Performing a warrantless arrest automatically makes the arrest ilegal (except during extreme circumstances) so they instead made him go to the driveway in order to do so.
Which rules out ignorance from the officers. They wanted to arrest him and charge him just because. The FTA in court from the officer further proves it. He didnt need to ask him anything after he said his name. If he owns that property they can connect the dots and investigate to get the rest of the information. They didnt.
I would like to see issues like this expediently brought before a court of law, without dismissal by a magistrate who doesn't want to be burdened with intricacies of the case. The Constitutional statues need to be addressed immediately not shoved off so that to victim needs to appeal with extenuating court cost as a victim. The victim gets to pay everyone for being victimized? No..he should be awarded his damages for being victimized.
Even if you gave them your name, they still need your date of birth, it is likely more than a few people with that same name. My name is very common with about 50+ in my city

The fact that the officer replied to the woman's genuine fears with "it scared you" rather than apologise or attempt to deescalate the situation says everything and more about US law enforcement.

As far as being on there property sure they were there investigating but had no right to do anything else other than ask questions. It shouldn't matter. They arrested him for something found on someone else's property. It should NOT be emphasized. It should be emphasized that he was arrested for suspicion of someone else growing weed on someone else's property. Or for being black while on a porch.

Anyone see the irony, the cop refuses to give his name in the performance of his duties to the lady at the beginning and then demands ID from the gentleman and says “what’s the big deal just give me your information”…I highly doubt that any court is going to find that owning s property adjacent to a property that has marijuana constitutes reasonable suspicion in itself. If the officers had seen him in that property or received a complaint by a witness that it was him growing in that property in addition to him owning the adjacent properties that would be a different story.
How would it matter if someone saw him growing on the adjacent property? Cop would need probably cause, and even if that gave probable cause, that's sufficient for arrest, which would then require him to identify. It has no bearing on whether he is required to give his name without arrest.

Not issuing a bench warrant when a officer refuses to show up when order to shows that cops have entitlements and aren't held accountable. Let's say you were a victim of theft, you called the police, found out who did it and pressed charges. The courts ordered you to show up to testify. If you don't show up you get a bench warrant for failure to show up in court. Now idk if the charges on the person who stole your stuff gets their changes dropped but fact is the judge would still issue the warrant for you because you didn't show up when you where by law supposed to. Should be no different for a cop. Just because the person is a cop doesn't mean he shouldn't have a warrant for failure to show up to cort when ordered to.

Because of the statement the deputy gave to Mr. Tart requiring him to identify himself, he should file complaints with their agency and the state certifying agency that grants police powers and request that the officer’s certification be suspended or revoked until he is properly trained and tested in constitutional law and civil rights, then sue him and his agency and the state certifying agency for failure to properly train the officer. They let officers get away with either not knowing the law or violating the law, now they have to pay for it.

"More training" - so frequently used as an excuse for a thug. If a cop has to be trained to not push someone into his own home to prevent him from peacefully recording cops, the cop should be arrested, fired, and sued, not sent for more "training."
