Decades ago, IN TEXAS, officers appeared for calls from neighbors, where my now-ex-wife had been assaulting me, I answered the door where my shirt was drastically torn for the aggression of the woman. Their ONLY concern... was the WOMAN OK??? I had crawled up into a ball while the woman wailed on me, but NO concern of ANY assault from the woman, while she assaulted me insisting that I should fight to show that I am a MAN. The ONLY showed concern whether the WOMAN was OK. Does this make sense to ANYONE????

They should get double the time. They put themselves into the shoes of a protector and they break that they should be punished x2. For an example I be using assault, if I assaulted someone and the sentence was 5 years, cops should get 10.

He was actually doing quality detective work. He performed the actions of the abuser in order to understand his mindset. Then, he was able to immediately locate the abuser by looking in the mirror.

@chahan The plead bargain is a system when you plea to a lesser charge. That is the bargaining part of the plea bargain. So, he made a deal and got the lesser charge. That is how our court works. It is a wheel and deal system. There is plenty of evidence for the full charges, but that would require a lengthy trial process, so a deal was made.

The neighbors called the cops claiming a young couple was fighting (they were playing video games and talking loudly) the cops came and tried to open the door in the middle of the night. The cops yell “put the gun down” he gets on the ground and put the gun down the cops shoot and kill the poor guy in front of his fiancé he dies in front of her gasping and choking on his blood.
They performed a strong arm burglary. I have had this happen before to me. A girl called the police on me saying i wouldn't let her into my apartment. I would not let her in, because she did not live there. The police broke my sliding glass door and pulled me out of my apartment, then let her go through my belongings and take what she wanted. When i told them what they were doing was against the law, they asked me if i wanted to go to jail tonight? When their sergeant showed up, he again asked if i wanted to go to jail. I had committed no crimes, they did not have a warrant and nobody was in danger inside my apartment. The police have the guns, numbers, and clout. They can do whatever they want. I realized i was fighting a losing battle and went into, yes sir, no sir, mode. They let her finish robbing me, then let me back into my apartment and left. I was totally floored finally realizing that the cops answer to nobody and do whatever they feel like doing.
Officers had the right to enter her apartment. But since the shithead officer grab her neck and force her down all legitimate reasons went out the window.
What should have happened? The first responding officer would actively listen, while showing understanding and empathy. Tell her that she is sorry to hear about bad reputation and expresss the willingness to do anything to make her feeling to be overturned. Give her a card with a telephone number to call anytime if she needs help, and finally assure her that the police is on her side. Everything would have been very different.

I’m trying to figure out how any of the exigent circumstances can exist from a phone call made by uninvolved “witnesses” to the occurrence. How can you have suspicion that the abuser is in the home when the “victim” didn’t call for help, the “victim” says she’s safe in the home with the person she called to be there, and the “victim” saying she doesn’t want to press charges or have any medical attention? This whole thing stems from a third party calling the police

In Texas, making an arrest in domestic abuse cases is not required, and left up to the responding officer. That way they don't have to routinely arrest their brothers in blue.

We had a nosy neighbor call the police cause we were having a verbal argument, and they showed up like the gestapo. Neither one of us wanted to talk about anything so they started saying that if they get a domestic call they have the power to arrest one of the parties. The whole time they bitched about getting called out, while telling us to get a divorce. The one female cop told my wife "sometimes I want to push my husbahnd down the stairs and kill him but I don't." Finally we both kept telling them it was a verbal argument and both volunteered to be the one for them to take, then they left shortly after that and made my wife go to a hotel. It was pretty bad. We've been married for 11 years, and they are telling us to get a divorce based on a neighbor who said we were loud that one day. We were only arguing while walking from the car to the front door, so maybe two minutes tops. If anyone has been married over a decade without ever arguing you must never talk to one another or something.
I hope you put in a formal complaint and asked for the body cam footage. I would've definitely posted it to one of these channels like Lackluster or someone like that to try and make it go viral. Telling you to get a divorce is so out of line and unprofessional.

It's pretty likely that the reason why she doesn't like talking to them because the police have actually mistreated her in the past too, which would mean her position is entirely justified and it's really all the police's fault to begin with, so maybe they should be looking more at their own behavior if they want people to actually like them more. Plus, *she is the f*cking victim here.* Regardless of why she doesn't like talking to them, not respecting her discomfort and forcing her to do so longer than necessary is just _adding extra emotional abuse to somebody who you believe may have already been abused_ and making everything even worse than before. The police should not be deliberately causing additional emotional stress or physical harm (or causing them to fear for their future safety) to people who are the _victims_ of crimes to begin with. Only Hernandez should’ve been prosecuted, and that’s exactly what ended up finally happening, thank goodness. What a shame that it took a new sheriff to clean up the department and take that action though. Shame on the sheriff that was serving when this happened and only put Hernandez on one day suspension without pay. The former sheriff should be prosecuted, but not put in prison for what he did. What he did was wrong, but it’s not to the extent that he should be serving prison time for it. I will say though that the former sheriff’s history should be looked over with a fine tooth comb though, and if he did something more severe than this, then perhaps prison time would be in order.

However, the scariest thing about the videos you post is that almost every situation you audit, even YEARS after the fact, are not resolved. Whether it be charges or lawsuits. What follows is the alternate course this could've taken. - Cop says: "Ok, I understand that, I see you are ill at ease so let me take a step back so we can hopefully talk without feeling intimidated." - Woman reaffirms her stance on not wanting the police involved, not wanting to press any charges and invoking her right to remain silent on whatever happened. - Cop says: "Ok, feel free to go into your domicile if you feel safer there, if there is danger for you or anyone else within your domicile, I ask you to communicate that with me now, repeatedly winking would be a good non-verbal way of communicating that to me." - Woman says there is no such danger and does not give any indication of danger within her domicile, starts to move back to her door. - Cop says: "Ok, let me give you my card, you can contact me directly if you ever feel threatened or in danger, or if you wish to follow up on this call-out. Feel free to call any time, we are here to help." - Woman takes card, goes inside. - Cop turns to neighbors house to see if she can get extra information of what was going on. I'll assume neighbor has some talk about yelling and a loud argument, they may or may not confirm that they called the cops and whether they saw someone leave. - Cop knocks on door of woman again, states she has gathered some information of a loud argument and asks again if everything is okay. - Woman reaffirms that everything is okay now. - Cop files report, possibly visits back a week later to check that everything is okay. - Cop has protected and served...

I'm getting PTSD watching because the last video I saw the cops said "We're just here to help you" then, moments later shot her many many times.
She committed the offense of disrespecting a cop. It says it in the constitution that all citizens must at all times, in words and with actions, show 100% deference to any and all members of law enforcement. I'm surprised you don't know it. That's the one part of the constitution that every cop is taught day 1 in the academy.

@chahan The plead bargain is a system when you plea to a lesser charge. That is the bargaining part of the plea bargain. So, he made a deal and got the lesser charge. That is how our court works. It is a wheel and deal system. There is plenty of evidence for the full charges, but that would require a lengthy trial process, so a deal was made.

I would not let her in, because she did not live there. The police broke my sliding glass door and pulled me out of my apartment, then let her go through my belongings and take what she wanted. When i told them what they were doing was against the law, they asked me if i wanted to go to jail tonight? When their sergeant showed up, he again asked if i wanted to go to jail. I had committed no crimes, they did not have a warrant and nobody was in danger inside my apartment. The police have the guns, numbers, and clout. They can do whatever they want. I realized i was fighting a losing battle and went into, yes sir, no sir, mode. They let her finish robbing me, then let me back into my apartment and left. I was totally floored finally realizing that the cops answer to nobody and do whatever they feel like doing.

What should have happened? The first responding officer would actively listen, while showing understanding and empathy. Tell her that she is sorry to hear about bad reputation and expresss the willingness to do anything to make her feeling to be overturned. Give her a card with a telephone number to call anytime if she needs help, and finally assure her that the police is on her side. Everything would have been very different.

We had a nosy neighbor call the police cause we were having a verbal argument, and they showed up like the gestapo. Neither one of us wanted to talk about anything so they started saying that if they get a domestic call they have the power to arrest one of the parties. The whole time they bitched about getting called out, while telling us to get a divorce. The one female cop told my wife "sometimes I want to push my husbahnd down the stairs and kill him but I don't." Finally we both kept telling them it was a verbal argument and both volunteered to be the one for them to take, then they left shortly after that and made my wife go to a hotel. It was pretty bad. We've been married for 11 years, and they are telling us to get a divorce based on a neighbor who said we were loud that one day. We were only arguing while walking from the car to the front door, so maybe two minutes tops. If anyone has been married over a decade without ever arguing you must never talk to one another or something.

Every one of the officers should be in prison? What the fuck for? The female police officer was very professional. Only Hernandez should’ve been prosecuted, and that’s exactly what ended up finally happening, thank goodness.
What a shame that it took a new sheriff to clean up the department and take that action though. Shame on the sheriff that was serving when this happened and only put Hernandez on one day suspension without pay.
The former sheriff should be prosecuted, but not put in prison for what he did. What he did was wrong, but it’s not to the extent that he should be serving prison time for it.
I will say though that the former sheriff’s history should be looked over with a fine tooth comb though, and if he did something more severe than this, then perhaps prison time would be in order.

Anyone else would be arrested for the level of association with the suspect during the commission of a violent felony, and be forced to prove their innocence in court.

I love watching these videos. Always great to learn more about the law and my rights. However, the scariest thing about the videos you post is that almost every situation you audit, even YEARS after the fact, are not resolved. Whether it be charges or lawsuits. Charges still pending, lawsuits being put off. There needs to be major reform for our judicial system.
As a former victim of domestic violence, this is absolutely horrifying! Being abused like this by the people whose job it is to protect you would completely destroy your faith in humanity.

However, this can increase his hold on her, just to prove how no one else is going to help her. But I do hope that after the case she learns that she can get justice and get away from her abuser.

While bad. I think people are missing another possible crime. An old woman with dementia probably does not have the mental state or legal knowledge to even file a federal lawsuit. Which means she likely has caregivers or someone else has power of attorney over her. That person or persons was neglecting her to the point she had to steal for basic items and that person or persons will likely keep and "manage" the 3 million lawsuit money. I hope some "auditors" follow up with this to make sure she isn't being taken advantage of and her money is not being stolen/siphoned from her. She has been through so much, it would break my heart to find out the scoundrels who neglected her are getting rich.

How do we know she was the victim? She could have been trying to stab the guy and he was trying to defend himself. Or, he was just an @sshole trying to strangle her. The point is, we don't actually know. The knee jerk reaction to " there may have been violence in a room containing a man and a woman " is usually " The women must be the victim and the man the attacker" even though it happens both ways.

Their quiet little life got disturbed somewhat by a circumstance that is yet to be confirmed and you immediately come to the conclusion that it's a regular occurrence. Even if it were, arguments happen, and in no way excuse the police brutality that occurred here.
If anything, the neighbors would've heard the cops arrive and chose to not exit their domicile to give their side of the story, possibly confirming that the alleged perpetrator left the building, something they'd surely have noticed. Instead they stayed inside, probably eavesdropping on what was going on outside their door.
It is unconfirmed, but likely, that they called the cops, yet it does not seem that they were even contacted by the police. It would've been easy enough for the cop to just turn 180 degrees and knock the other door to get more information and confirm what she claims as indisputable from a seemingly anonymous call...
Every step of the way the police showed laziness, arrogance, insincerity and an authoritarian reflex towards violence.
When she said she did not want to press charges and that the alleged perpetrator had already left, the situation should've been defused from there on.
Let me give you an alternate course of events:
- Cop knocks, woman comes outside and gives same information as we've seen. She also states her reluctance to talk to the police, citing concern with the departments reputation for violence.
- So far everything is the same... What follows is the alternate course this could've taken.
- Cop says: "Ok, I understand that, I see you are ill at ease so let me take a step back so we can hopefully talk without feeling intimidated."
- Woman reaffirms her stance on not wanting the police involved, not wanting to press any charges and invoking her right to remain silent on whatever happened.
- Cop says: "Ok, feel free to go into your domicile if you feel safer there, if there is danger for you or anyone else within your domicile, I ask you to communicate that with me now, repeatedly winking would be a good non-verbal way of communicating that to me."
- Woman says there is no such danger and does not give any indication of danger within her domicile, starts to move back to her door.
- Cop says: "Ok, let me give you my card, you can contact me directly if you ever feel threatened or in danger, or if you wish to follow up on this call-out. Feel free to call any time, we are here to help."
- Woman takes card, goes inside.
- Cop turns to neighbors house to see if she can get extra information of what was going on. I'll assume neighbor has some talk about yelling and a loud argument, they may or may not confirm that they called the cops and whether they saw someone leave.
- Cop knocks on door of woman again, states she has gathered some information of a loud argument and asks again if everything is okay.
- Woman reaffirms that everything is okay now.
- Cop files report, possibly visits back a week later to check that everything is okay.
- Cop has protected and served...

Also what is extremely disturbing and telling about “internal investigations” is that deputy Hernandez was suspended for 1 day, then promoted two months later, and a month after that an actually independent investigation by a grand jury chose to indict him for the assault! The internal review didn’t even find him worthy of being fired for cause but an external review found he should be in jail!!!
