Once he pulled the gun out and saw the other man retreat, he shouldn’t have fired the gun, period.
This^. He shot the guy out of anger and a response to the shove. Not because he feared for his life. It should at most not have passed to point of pulling out the weapon, that was enough to end it
Right, even the „mild Argument“ striked me, when I push someone with full force to the ground, I wouldn’t consider this as a mild argument. What doesn’t make Michaels actions suitable for self Defense. He had way too much time, to see the opponent is backing up. Way too much time,to consider his actions and he wasted this time and made the wrong decision.

@@teribrod4017 both sides are shitheads. You have the selfish mother parking in the handicapped spot. You got the druggie father who goes into a violent rage and assault over petty arguments. And you got the self important parking enforcer getting into arguments with people that he has no business with. In his interrogation he admits there were closer non handicapped spots available, so what's the point? Drejka is probably not the kind of person who should carry a gun. That said I can only imagine how McGlockton would've responded in the same situation. He could've killed Drejka with that push. I know it sounds like exaggeration but all it takes is smacking your head on the concrete during the fall. If McGlockton was willing to push someone like that over words I have no doubt he'd use deadly force in response to deadly force. In hindsight we can see that once Drejka pull the gun McGlockton was done with the assault. But to pretend there are victims here is a bit much in my opinion. These are all bad people who all contributed to McGlockton's death.

When you go to training for your gun permit you learn that you should avoid confrontations. He should have known better. Instead of avoiding confrontations, he keeps causing issues with people.

I was so relieved the jury got this one right. This guy was just waiting to kill somebody after threatening other people with his gun for years. Another person that SHOULD NOT have had a gun.

He wasn’t defending himself, but accelerating the situation. The victim started walking away once the gun was brandished yet he still shot him. It’s clear cut and not that complicated. Part of gun ownership should be how to not involve your gun in a conflict if you can help it.

His arm wasn't that hurt when he was holding that gun up and fired that round. This guy was definitely looking for an excuse to use his gun and thought this was the perfect time but the interaction didn't go the way he hoped it would and decide to shoot him anyway. He couldn't wait!

He took three steps back and one more starting to turn back to the store and away from the gun. Tragic for this family, his little boy watching him collapse was heartbreaking.

10:56 I don't buy that at all. He was staring right at McGlockton with his gun aimed at him as McGlockton backed up. I believe he shot him 100% out of anger and knew he had to pretend he thought his life was in danger, so when he talked to the police, he lied.

@@christinecreamer848 Not sure what state you are in but if you weren't found guilty of a felony you should be able to get one. My friend was 18 and charged with a felony but the felony was reduced to misdemeanor and he got his through the normal paperwork that everyone does without an issue. Most states should be about the same.

As someone who supports 2A, I totally agree with your points and frustration. He should have had his CC permit revoked immediately.
I am 100 percent pro second amendment. But this guy did so many things wrong and the jury gave the correct verdict. Praying for that family, especially the little boy inside the store.

If he had immediately fired after the blind side shove he might have been ok, but the fact that the guy backed off when the gun was in his face and that it took so long to shoot shows that the guy he shot was no longer an imminent threat. What this case does show is some idiots need to know how to control their temper and a precieved

I'm a person who supports 2A but this was NOT self defense. One push was not enough to fear for your life. Pulling the gun, the man stepped back.
The conviction does it bring the victim back. These cases are inevitable when people are allowed to carry guns.

As someone with an invisible disability who has been confronted many times over parking in handicapped spots, this really scares me. I'm worried someone like this guy is going to confront me someday thinking I am using someone else's handicapped ♿️ tag. He scares me.
Isn’t it ironic that the vigilantes who think they’re acting on behalf of disabled people don’t know a thing about disabilities covered under transportation codes? Thinking someone needs to lack the ability to walk in order to be disabled in their eyes is just awful.

I used to work for a disability service and the ADA and we had these stickers (made from paper so no damage to the car) we would put on cars that were parked in handicap spots illegally. The amount of anger and violence some people would show when they we're the ones in the wrong blew me away.

You put disabled stickers on cars of those parked in disabled spots. One is required to have a paper permit of your disabled placard or license plate. You putting o paper permits doesn’t make it legal for the person to park in a disabled spot.
@@dawnanngallagher6389 the paper was made to look like a parking ticket to advice non handicapped people (or when I could see no visible sticker) to not park in handicap spaces.

Unlike what you are trying to say, it’s absolutely legal for a civilian to call the attention of another civilian who is doing an illegality like occupying a disabled spot. There was nothing illegal in Drejka approaching the “lady” and tell her she was illegally parked. It’s not only cops that can do that. But that’s really irrelevant. Had Drejka been a cop you would say precisely the same thing.
From where I come from, he should have minded his own business! He wasn’t the parking lot patrol! He had absolutely NO business confronting the victim’s lady! None at all! This could have all been avoided! The car shouldn’t have parked there, but the aggressor shouldn’t have confronted these people about it, as he did! Period! Peace.

No, the attacker wasn't protecting his kids, the shooter never, at any time, poses or even threatened the woman or kids. The attacker was shot for physically assaulting a total stranger in the parking lot.

@@cwavt8849 That's why he was shot, but it wasn't self-defense, at that point, it was retaliatory. If the gun went off while trying to wrestle the man off of him, that would be different. But, there was never a scuffle, just a single shove to the ground. Or, if the victim had charged at him _after_ he pulled out the gun, which he notably did not, and in fact started to walk away. Bottom line: you cannot bring a gun to a fist fight. Although, if he had just kept his mouth shut and claimed stand your ground... he may have gotten away with murder.

This was a straight up execution. The conflict was over the moment he pulled out the gun. The guy wasn't making any aggressive motions. He got pushed, he was angry, so he just shot the guy. Absolutely unneccessary. He fired out of anger, not out of necessity.

No. Conflict happened the moment the jerk got out his car to even confront the lady about her parking in a handicap spot. He's a hot head and he's gonna run up on the wrong one and they gone do what he did to this guy.
I think mostly fear, like even cops will shoot suspects that are no longer a threat, but the adrenaline of the fear causes them to pull the trigger. Listen to cop's testimonies at trials.

Do you notice in the interview, there's nothing wrong with his arm. He has no remorse about the shot victim. Drejka is a wannabe boot-licking cop, that wanted to show his authoritative views, even when he parked illegally.

He sure wasn't minding his own business. What's funny to me is the handicap spot was further from the door than the cars pulling up to the store. Bottom line he pulled out his weapon and the victim began to retreat and there was no need for him to take the man’s life. So the excuse that he feared for his life was absolutely bogus .He could have called the police and had the victim arrested for assaulting him. The fact that he had a concealed weapon permit apparently emboldened him so he sought confrontation .

I studied this case. Michael was a guy bored with life and wanted to kill someone just for pure personal satisfaction. In court, the judge is precise in his explanation why Michael did what he did.

@BekGrou PRIMUS shouldn't have shot him. A normal person would have either met that shove with equal force or better yet, realized that he had caused the whole thing by yelling at a mother with kids in the car and just took the L, walking away.
@BekGrou PRIMUS shouldn't have started the confrontation in the first place. He's not the parking police. Even so, the victim was walking away and backing up when he shot him, making the shooting unjustified.

My heart breaks for the little boy who watched his daddy collapse at his feet and he will never get to see his father on this earth again. Some people shouldn't own guns. I'm glad he was found guilty (eventually)
He did this to 4 other people, a pregnant woman and her child, 2 teens who slowed and stopped for a yellow light instead of running it, and another African American guy who was trying to get a drink in a 90 second break from work, he called the guys boss and told the boss he should have shot and killed his employee for parking in the spot. The cops, owner of the store, so many opportunities to take the gun out of this loser’s hands and until a father died at the feet of his 5 year old did this guy lose the gun. It’s mind boggling.
Let's hope he doesn't take his father as an example, parking on handicap spots and attacking people telling him he shouldn't...

@@Craig-pm2kc exactly anyone was going to do that, most people act that way anyways and he was only thinking of separating the dude from his family but what actually triggers me is after the gun is pulled you can clearly see the body language of the guy and you can tell he had the dude subdued due to the gun, now if the guy charged him again after noticing the gun then it would be justified.
You’re not allowed to physically assault someone because they’re mad at your girlfriend. He had a tough guy complex and chose to immediately go to violence first in his life and unfortunately he assaulted a guy that was looking for a reason to use his gun

Even his lawyers doesn't mention the victim taking steps towards him. The guy literally waited a few seconds- watching the guy take steps back and shot him anyways.
He was just a trigger happy bully. I think he had been looking for an opportunity to use his gun and when he saw that, he shot the victim. He should have minded his own business about people parking in disabled space - it is not his store so he doesn’t have the right to trouble people who parked there. Although the victim was wrong to push him, but shooting an aggressor is not the answer. Hand to hand combat would have sufficed in this situation which was how we settled scores in the olden days.

I wasn’t surprised when I saw him in court arranging the chairs at his counsel table and suggesting where his lawyers should sit.
He was so excited, happy explaining how he was fighting for the justice of handicap parking spaces…. His mugshot clearly displays his true demeanour…. It’s a look into his soul…. And apparently his injured arm was only injured when it was convenient… many times he was using it to express himself… there is so much more that could be said about this guy… he is exactly where he should be. Hopefully in time he will come to realize that he’s the problem and seek true forgiveness and sorrow to the family… especially the children who have to grow up without their Dad….
This is why I’m so against guns…. This guy has serious issues and should never have had one… I’ve never understood why the US is so adamant about having their guns…. Guns aren’t dangerous… it’s the people holding them… just look at Alec Baldwin… again… it’s not his fault… it’s the victims fault… it’s never the person who shot the gun…. Including bad police shootings… it’s never the officers fault… I think I’d be more okay if people took responsibility for shooting the gun… but they don’t… as well the manufacturers don’t take responsibility either… it’s sad all the way around.

To say he wasn’t the aggressor because he didn’t threaten her is ridiculous. A total stranger confronting you in a parking lot because of some weird belief they have is VERY aggressive. It happened to me, but when I ignored the weirdo he followed me into the store. I’m glad I didn’t have a firearm on me because I would have brandished it because nothing good happens when a random stranger follows you. But once I got back to my car I grabbed my Kimber .45 from the glove box and made sure it was cocked, locked, and ready to rock.
A persons' personality changes once they are allowed to carry a concealed Weapon, from regular Citizens to potential vigilante that will try to Police others, and knowing the stand your ground Law, will take advantage of having the upper hand on someone without a weapon.
Pulling a gun on someone who pushed you because you were being the parking lot police and shouting at them is just plain wrong. I carry a gun to protect me not to empower me to get in shouting matches with people.
I was taught in my CCL class that avoiding confrontation and de-escalating should be your #1 priority, even if it means looking like a coward, or apologizing, or walking away-- it doesn't matter. You inherently know that you possess the power to end that person's life in two seconds if you have to, so you need to be the bigger person and do whatever it takes to not put yourself in a situation where that's necessary. Shooting is a LAST resort, where all other options have been exhausted, and where it is truly a "my life or his" type of deal. There will likely be consequences, so it needs to be taken very, very seriously.
