    Tex was also indicted in 1990 for shooting at 3 teens and charged with aggravated assault. He managed to wiggle out of that. He thought he was so well connected, he could slither out of this too.

    Scary that more people aren’t talking about the fact that a juror didn’t even know what the charges meant smh Guilt or innocence aside….there should be a new trial. The courts don’t properly instruct the jury, then act like it’s no biggie.

    I’m from a family who responsibly owns guns and this would never happen as an “accident”. It just wouldn’t.

      It did happen to my brother in law while he sleeped, they woke him up so sudden & he pulled ghe triger by accident, so it is possible...
      One can be amazed at what is possible!!

    My parents were wealthy but never behaved this way if they were in a neighborhood that was unfamiliar! They didn't automatically think they would be accosted.

      Neither did mine. My dad (RIP💕) was a music Professor and was mugged in Paris France going to play in a symphony, and traveled all over the world and never carried or even owned a gun.

      If I was driving in a bad neighborhood, I'd be hypervigilant. Bad neighborhoods decades ago aren't what they are today. Today, some are virtual warzones.

      The neighborhood was near Grady Hospital, the one that could have saved her life, but instead he drove to the university hospital further away because “he knew doctors from there”. Ignorance, recklessness, and stupidity that’s why she died if this was an accident.

    This was one of the weirdest cases I ever saw and I have to come down on the side of him killing her. His story just wasn't good enough for me.

      Agreed. The long, heavy trigger pull on a DA revolver like the Smith S&W Special would be significantly greater than you could manage involuntarily. This was NOT an accidental discharge.

      @@lonewolf5238 Yeah, I was thinking that as well about the gun. A revolver takes some effort to pull the trigger. I wonder how many pounds of pressure it takes for his revolver.

      @@Kkayoodle DA revolvers are generally 14 to 15 pounds, but spec on that S&W is 13 pounds if I'm not mistaken.

    *I think he is innocent of purposely killing his wife. It doesn’t make sense to shoot her in the stomach. It was very likely that she would’ve lived. Maybe he intended to shoot her in the heart but I think that is a huge risk to take that he may not ultimately kill her, many people are shot right beside the heart and absolutely live. That’s way too much of a risk for him to take. If you went to the wrong hospital, maybe he was disoriented because he just shot his wife. As far as not calling 911 who cares. 911 is to get emergency help, But when you were close enough to drive there and already in the car then it’s even better to do that. And also like they said in this video it wasn’t even his decision to get off the exit in the wrong place at a bad part of town, so it’s not like this was part of some grand master plan.*

      Not working people. Also, for years he didn’t do much for the prestigious law firm he was with and wasn’t making much money, hence the loan he defaulted on from his wife.

    He is so guilty. He is so worried about the "bad area" and we know what that really means that he needs a gun for protection and immediately falls asleep? Then he diverts care by going to Emory instead of Grady,, where everyone in Atlanta knows is the best hospital for trauma. Emory is hard to reach and is not a trauma facility. Did he not go to the best trauma hospital because it was in a bad neighborhood?

      Yes he was not guilty on the count of Malice Murder (implying he planned it) but he was guilty for Felony Murder

    This is one of those very rare cases where I think the jury got it wrong on this one. That juror that spoke sounded incredibly biased and not so educated.

      I know right? Also, the lady in the video who said it wasn’t a planned murder because he didn’t shoot her in the head was sooooo wrong. First of all, abdominal wounds can bleed out especially if you don’t get to a ER like Grady soon. Second, they were senior citizens, trauma like that is not the same as it is for a 25 year old. Next, if he’s planning to say it was an accident, he can’t shoot her in the head, he has to have the gun in his lap. That one commentator was so ridiculous when she said that.

    Having a gun in your hand after a lovely night out because you drove into a bad part of town ,well your wife is behind the wheel she must know her way home ,so that doesn't sound correct and then you call your lawyer , well anybody I know would call for help ,so murder is the road that I would be going down.

As if he was jolted out of this deep sleep (after asking for his gun bc he was so nervous driving thru ‘that area’) and the shot ends up in a straight trajectory, killing his wife.

    I honestly don't think he meant to shoot her, or kill her. Have you never fallen asleep in a car -- after having a drink or two -- and been jarred awake in the car? I have. I have "jumped awake" in the car. Of course I never had a gun in my hand when that happened, but I can suppose that if his finger was on the trigger while asleep, it could accidently go off when he jumped awake. The financial stuff was just circumstantial. If he had INTENDED on killing her, it seems to me he would have aimed the gun UP a lot more. Like toward her chest or something - he still could have claimed it was an accident. You don't "aim" at someone's hip or belly when you INTEND on killing them. Him selling off all of her valuables shows there wasn't a lot of love lost... but I don't see that as proof that he intended to kill her. I also think the jury in this trial was confused and clueless as to what the charges actually meant. I wasn't at the Trial, I didn't see ALL the evidence, I didn't hear all the testimony.... I'm only basing my OPINION on what I heard in this 23-minute video. With more evidence, I might change my mind.

      This is one of the most bizarre cases in the world but I agree with your comment. This case really tests one’s neutrality and just wanting the truth nothing else. I think there’s alot of reasonable doubt on whether this was an intentional homicide. I want to hear more from the driver. What was being said in that car as they were driving her to the hospital

    Something people not from GA won’t understand…old Atlantans don’t see Grady the way it is today. They see it as a terrible hospital bc once upon a time it was. It doesn’t surprise me one bit that he never considered Grady an option. Someone of his age would have thought Emory was better

    I watched the trial in it's entirety and regardless of what you think about his recklessness in handling the gun and his behaviour after the event, I do not believe the prosecution proved guilt beyond a reasonable doubt. If you asked anyone "why wouldn't you fall asleep with your finger on the trigger," they'd surely answer that there is a risk of accidental/unintentional discharge?

    Not to say either way but what I find interesting was the gun. I own one like it. If put in single action which means you pull the hammer back to make it way easier to shoot instead of a long trigger pull. It would be very likely if you fall asleep and just a small amount of pull on the trigger it would shoot.

    When they said ``he worshiped the ground she walked on,'' I said, ``uh-oh.'' Pedestalization leads to objectification. And people on pedestals tend to fall off. That's where statues go, rather than humans. Also, ``fairy-tale romance.'' And how do husbands/wives loan each other money. It should be gifts -- hey, they're that much in love, right?

    Agree with the Prosecutors depiction. I don't think there was anything controversial at all. They did their J O B. The talked and reviewed and the lightbulb went off for those that had an issue (gun went off all by itself) guilty. TaDa. In my opinion it was premeditated from the moment he heard them talk about the accidental discharge his lightbulb went off. She would have let him fall. I wasn't shocked at all.

    You must never forget something, all prosecutors want to charge you as a crime. They just have to see if there's enough evidence to do so. But that's all prosecutors think about is what charges can we bring against this person they live for it.

      Actually, having a witness present-- in fact her best friend-- is a highly strategic move. The best way to hide something is to put it in plain sight. It caught me early on in his interrogation-- how he went into great detail to describe who drank and what, and that Dani was driving " because you- know." The degree of detail...was thought- provoking. And sorry, not calling 911 and avoiding Grady( because of his old school bias)--- those are not the actions of a man desperately trying to save his wife. That footage of him rolling her poor dead body into the ER, slumped in a wheelchair, was heartbreaking.

    There is a safty clip on the gun, how did it just go off, you need to release the safty before the gun can fire, so the gun just going off does not sound right.

    There should be some kind of cognitive aptitude test required in order for someone to sit on a jury. Most cases contain a lot of information, coming fast and furious, and the fact is that not everyone has the ability to parse, absorb, and process all of it in a critical and objective. manner. There is simply no way that un-cocked gun went off accidentally. There is just too much pressure required on an uncocked double-action revolver for the kind of _it just went off_ situation he described. From a gun site: _The trigger pull can be long and uncomfortable in a double-action revolver, but they are safe in that you have to want it. In other words, you have to mean for it to happen._ They might have taken the jury to a dun range and had them fire an identical weapon, if that was possible.

    not true becasue the cops will still hold you and when you say something then they will use it against use so having a lawyer on stand by is good. the rights are you have a right to have a lawyer, anything you say will be use against you so maybe he didnt want that. everyone has a right to these rigths regardless of innonetn or not

    I know someone who accidentally shot the household cat after he was unloading the car while drunk, the gun slipped and he caught it. Shot the cat right through the stomach. It was awful. But it does happen

    That woman at 21:00 doesn’t have the intellectual capacity to be a jurer but she was.

    The weapon used did not lend itself to an accidental discharge, if he'd been out drinking all day in the "hot sun", it's possible that he'd fall asleep in the vehicle, but a hammerless weapon does not "go off" by accident, - be interesting to see how this goes on appeal

    I watched the entire trial and did not believe he was guilty! I was shocked when he was found guilty. I heard a juror interview where the juror stupidly said “well, SOMEone had pay for it!” How sad that this was her reason for finding Tex guilty.

    That's a scary jury member. I'm not saying he is innocent, but he needs a retrial based on just her statements alone.

    Im from the UK, nothing surprises me about American legal system... Should of stayed under British rule for another couple of hundred years, would of done you the world of good...

      @@Dylanfielding if you're an example of that superior education, you should at least be capable of elementary grammar. The correct verb phrase is "would have" (or its contraction "would've "), not "would of".
