"When It Looks Like A Duck & Quacks Like A Duck, We Have To Take The Assumption That It's A Duck"

- This audit brings us to the busy streets of this coastal town, where I wound up documenting from the (closed to vehicular traffic) public street & public sidewalk just outside this jewelry store celebrating their 95th anniversary. Almost immediately the store security approached where I was standing out in the street getting up close & personal wanting to know why I was documenting the store. He was going to the worst case scenario assuming I was casing the place to potentially rob it. I continued documenting as he retreated inside to speak with the owners/management. A representative from the shop came out wanting to know why I was documenting & I explained that I got a text message regarding the store's 95th anniversary (Thanks to an anonymous viewer) & informed him that he could use it as an opportunity to promote the store . The store rep also went to the worst case scenario about casing the establishment. Eventually security did call police. Two officers eventually showed up on scene , with one of the officers attempting to explain how they treat these types of calls as a potential threat of robbery using an analogy of , If it looks like a duck & quacks like a duck We have to treat it like a duck. The security seemed to tuck his tail after the officers explained that I was within my rights to document out in the public space, as the security guard was talking to a passerby after police left, telling him that I was doing something with the First Amendment, Seems that there was a learning experience for the security & store employees today .

Fun fact: If you don't know what the problem is and you're calling the cops...*YOU'RE THE PROBLEM*
We agree... when it looks like a dum bass, sounds like a dum bass... it is probably... a security cop.😂😂😂
😂😂😂😂😂😂😂
Awesome!
Like a duck he means your guilty until you prove your innocence
Ask him "Where's the duck?"
I love the way you shut them down so politely and with such a calm demeanor. Great audit.
@@markportnoy6290 Why so? Why is the person videoing obligated to tell them what they're doing? I've watched a lot of this persons audits and its clearly stated that they're filming to see if people will respect their right to record/video, what else do you need/want?

The cop just had to try and establish control over you by trying to direct you as to where you could stand. I'm glad you held your ground and established immediately that people do not have to blindly obey, unless is is a lawful order. And the store owner/employee saying, "We don't prefer people to do this." Perhaps they should consider what the public prefers as they record customers and non customers alike.
Well said!!! Noticed that!!!😊😊😊😊😊

If shop owners and their security staff don't like people with cameras coming up to their windows, maybe they need to cover up those large windows. If more stores will cover up their windows, it would be the end of window shopping and less foot traffic. That is the whole purpose of those large windows, to entice customers to come in and shop.
What really makes me upset is when they say don’t engage with anybody and get them upset, but nobody tells them not to engage with you
Exactly!
@markportnoy6290 wrong. Speaking to someone is engaging not filming. If filming is engaging someone then the many camera you see everywhere are engaging you & niusancing?
@@markportnoy6290 typical 🙄
Rather narcissistic to think it’s all about you. You need to look up the word engage.
That security guard should be watching inside not outside. Jewelry is stolen inside. Not on the sidewalk.
Next time when a security guard or police officer come up to you and talk to you, you should talk to them about anything other than what they want. Talk sports, weather, their family history or anything else.
😂
Please use that style when you audit. I’ll subscribe
I recently did that with one. We got to talking about filming locations for movies. That video will be out within the next couple weeks 😁
Just start talking dirty to them. Ask about his sex life. Ask if he cheats on his wife. Ask is she cheats on him.

I loved how 'the beard' had a look of absolute knowledge and superiority on his face like he had never been wrong in his entire life. Hey, man you're fifty-odd years old and you're standing in a mall guarding a jewelry store for a few bucks an hour.
@DrZook
It's one of the reasons a guy with a full head of hair shaves it all off; to look tough and put on a show, not realizing that it can scare many customers away.
@@ajm5007Ty for your service. Happy Holidays.
I wouldn’t dare go into his store now for any reason! He’s standing in front of his own store giving it bad press. The send a invite then accuse the people they invite of casing their joint. That purely ignorant. I sure wouldn’t go near that store now. I would not buy anything from them. The jewelry store sent a invite. Then accuse people who come of bring a thief.
Stupidity cop. Tell him they sent out a invite then accuse a person who shows up of theft.
A totally new legal standard...the Duck Standard!
It doesn't matter what the facts are, just what the officer assumes. So, what are the objective facts? FAR is in a public area (in the middle of a closed-off street) during the day, FAR is performing a constitutionally protected activity (recording video), FAR is approached by a stranger while still in a public area who identifies himself as security and asks questions about what FAR is doing, FAR doesn't answer the questions of the stranger, FAR gets told by the stranger that the stranger has a hunch that FAR is casing the jewelry based solely on FAR's recording and unwillingness to answer the stranger's questions, the stranger calls the police, and FAR waits for the police to arrive.
Based on those objective facts, if a looks like a duck and quacks like a duck, we have to make the assumption that it is a pterodactyl.
Its so disgusting to watch people exercising their freedom but only want it for themselves... and are completely willing to violate someone else's right to freedom because of their personal feelings. Read the Constitution, learn the law.
@countsd1 Photography is not a crime and there is no privacy in public. What freedoms for others were violated? She knows the law related to her actions.
It's not personal, he's on alert to a California flash mob theft. Google and it will make sense to you. It's the dudes job to send a message no gang theft is happening here. And yes people with advance knowledge of these flash thefts do come and film for social media hit.
@@SABOARITIwho is the she/her in this video?!
What is really sad is that the guy comes out of the store filming in public yet complains about you doing it 🤯
He didn't complain about filming, he was checking out a possible flash mob robbery threat which was apparent from his questions. The habit of the flash mob spree is that people with access come and film it for social media, a woman was just arrested for it recently because she was promoting the crime. We have the privilege of knowing now this is an audit, but the guard doesn't and the reason he's standing there visible by the door is to make it clear that if you come for the flash smash and grab then the football player at the door is going to snap you in half before you come in. If the auditor was filming for a flash mob theft the guard would have sent a clear message it wasn't happening today here.
@@timothyburke6949so worried about flash mob robbery that they keep their door wide open? Absolutely ridiculous! Jewelry stores that are worried about that have a buzz in, buzz out system.
@@timothyburke6949 just stop , flash mob lol , one guy with a camera does not a mob make
@@timothyburke6949- But would an out-of-shape hourly guard deter a flash mob robbery crew?
Nope.
Annoying a calm, orderly citizen on the sidewalk cannot be justified because someone (somewhere) *might* have ill intent.
That's unconstitutional blather.
And he did it in such an aggressive way and then says the camera person had a bad attitude!
’Passive aggressive’ security guy!!🤦🏾♂️🤦🏾♂️
Very passive aggressive!! Brut!! And we need know where NOT to shop!!
I call that overt aggression. Small cop Lopez is the passive aggressive. Silly little quacker Short men shouldn’t be cops. They always overcompensate
In more ways than one…

"We think you're trying to provoke us, so we'll teach you a lesson by GIVING YOU EXACTLY THE REACTION WE THINK YOU WANT."
If you really think someone's trying to provoke a reaction, then don't give them the reaction. Ignore them. That's how you defeat their provocation.
When it looks like a doork and talks like a doork it’s a cop
Strangely enough, I didn’t hear the cops tell security not to engage you directly. Cops always have to give the directives to the camera holder instead of the caller.
They wrongly perceive the business proprietor as their client or supporting taxpayer, when in fact the person that they confront may be paying as much or more taxes then the complainant.
I hate when they call the cops and, while waiting, still get in our personal space. Um, is that what Dispatch told you to do? To KEEP APPROACHING me?
@DrZook Our sarcastic comebacks aren't cutting enough. The cop is serious. Implying our behavior barely legal, almost criminal.
Make him feel the same. Give a SERIOUS directive back.
All right, popo, you know the deal, right, i'm o k with you having that gun,
You can carry it around all you want

You should always record the name of the store and the address to let us know what stores to never shop at

Store is Fredric H. Rubel Jewelers in Laguna Beach, CA
Funny it’s actually legal to case a store as long as you don’t say that’s what you’re doing.
I know 100% if I was to case a business to rob I wouldn't go inside posing as a customer to get the layout of the store
and see what they have. I certainly wouldn't use a clandestine camera that wasn't obvious to film the interior and exterior.
What I WOULD do is stand outside, super obvious with a camera or phone and draw attention to myself and initiate a police
contact.
@DrZook lol...i just had a brilliant idea , take a cue from James Vetch and his duck video ...everyone start sending them ducks....store or cops, your choice
@DrZook I quack like a duck sir. Therefore, LEOs must check me out.
If I saw the store with this guy standing in front of it, I would never even go in there. He looks very intimidating and threatening. Why would you want to go in the store with a guy looking like that in front of the store and treating people the way he treated you That store will fail eventually if they keep with the same policies
good point and there is really nothing identifying him as store security that can easily be seen on the front of his shirt ..and really anyone can buy a shirt that says security on back....who is to say he isnt casing the joint posing as a guard...lol
I can not grasp how the owner and security are so stupid that they call the popo for a someone standin outside takin photos!!!!!watching from sweden lovin your style of answering the fools!!!!!
12 years of indoctrination by our Department of Misunderedukasjon.
"You have to turn your camera off when you go inside"
Someone actually casing the jewellry store would go inside with covert cameras.
Yes, you can get some good glasses cameras. That's what I use when I'm casing joints...
Absolutely, and those cameras can be the size of a pill. You would never see them if they didn't want you to.
No need to go inside. Just go to google maps where there are quite a few pix of the interior of this store. Also, that security guard should be fired. While he is facing the street there could be shoplifting galore behind his back.
YIKES ! I REALLY think you handled this audit extremely well ! ! I especially liked the fact you told the "owner " you had received a invitation by text to come to their store ! Sadly mr security guard was a typical oaf . And the cop , was trying to lecture you something about ducks ? Walking ducks , swimming ducks , looking like a duck , not sure . But then , he just had to COPSPLAIN !
You are such an enjoyable Auditor, no stammering, know your stuff, quick witted. New subscriber.
That jewelry store is probably worried about theft. Maybe that’s why that security guy and that guy who cam-backed were so passive aggressive towards you. But sadly they weren’t taught public photography laws in school.
Their only concern should be 'inside' their own boundaries/walls.
"Casin' da store" ? Must be a fan of 1930s gangster movies. lol Maybe you need to carry a big sign like "No I am not openly casing your place, Birdbrain." If SG want to chat, ask him how many pending assault charges are on his rap sheet.
No thief has EVER filmed a store in this manner. Guaranteed.
We all know if someone robbed this idiot, his "reported losses" would be far more than actual losses. Make bank from insurance payout!!!
@DrZook right?
It's a nice summer day, you buy an ice cream cone and sit down to enjoy it.
(shop owner comes up)
"How's it going, I noticed you were sitting on a bench eating ice cream. Is there any particular reason you're doing that? Who do you work for?"
(customer walks out)
"Hey, you, I don't want you to eat ice cream, stop it right now!" (tries to bat the ice cream out of your hand)
(shop owner calls 911)
"There's a guy sitting on a park bench eating an ice cream. I don't know why he's doing it, and he's refusing to identify himself. He's scaring our customers, please send help."
(police show up)
"We got a call. You got some ID on you?"
...when you think about it, it's utterly absurd behavior from everyone, except the guy just minding his own business eating ice cream.
I will always watch your audits because I absolutely love your style of filming you always have the perfect comebacks
"Yeeeaaaahhhh" see..... casing the joint"
People watch too many gangster movies.
Since using a camera on public property is not illegal and totally within our rights, who do these people think they are to call the cops? Stupid Karens.
Worse, why does 9-1-1 keep SENDING cops?
@@rayubinger9780call and response numbers equates to more funding and taking tax dollars that could be used somewhere else. Go to any city council or county council meeting when police chiefs and sheriffs are making budget requests and you’ll see.
I like how you bait the cops when they ask your name. 😂 No way they are getting that.
The reality is there is less of a chance of a crime while the place is being filmed by citizens exercising their rights. The security guards logic is wrong and dangerous.
Thanks for all you do Chris. I can only imagine how stressful it would be for me to do this so I commend you brave soul!
❤❤❤❤❤
Why would anyone shop in a store that automatically assumes a possible customer is a criminal?
I don't allow Walmart to get away with it.
If they ask to see my receipt going out the door I immediately take my cart full of stuff to customer service and get a full refund and walk out.
I tell them I will not be treated like a criminal for patronizing a business.
About twice of that and the manager has informed all employees I am not to be questioned about a receipt.
If everyone did this maybe these places would stop with the self checkout crap and get more employees to serve us in checkouts.
We get better service and more people get jobs.
Photography was invented in 1839, you would think people would be used to it by now.
If someone was casing the store I don't think they would be sitting outside with a camera pointing in plan site at the store. 😂😂😂😂😂
I'd call that cop more sanctimonious than cordial.
"If it looks like a seventies porn star, and walks and talks like one" than it is! Great police work, lol!
I love watching!
I'd call thatxa double fail. "Fail" for the store because they called police. And a "fail" for police forcthe unnecessary directives.
Who would want to visit the store with a big guy blocking the doorway.
Haha

He left his post and kept his back to the door for a good two minutes. Anything could have happened at that point.

15:52 Chagrin: The face of little weenie is the thumbnail for the dictionary definition of Chagrin 😂😂😂
Why do police have to tell you that in your rights to do this? And then continue to give directives. Just walk away and let you be, need to tell those that called.
Hysterical that the security guard said that maybe the store is being cased for a robbery but personally I think the security guard works there because he wants to know the ins and outs of the security there so then he can be part of an inside job to rob it later. If we're going to throw out ridiculous accusations that one makes far more sense.
I wouldn't shop there, it seems they have an issue with "crime" in the area. It seems unsafe and therefore should be avoided.
RESPECT is always shown when sunglasses are removed during a conversation with someone, RESPECT the other person be sincere and respectful, show your eyes.
A police officer in uniform should show that respect to a member of the public, after all they are there to serve the public, not the public to serve them. RESPECT
The cop with white hair was absolutely amazing, he was also waiting for the other cop and security guard to mess up, just to correct them, best cop I've seen in a while
What is "GOING ON IN THE WORLD" ?
What a way to live.
Turn off the news.
Talk to your neighbors.
So security guy calls the cops and tells them there is a citizen on a busy sidewalk recording and they actually send a cop??...they will show up for anything...even if no one is breaking the law?
If there was actually a crime - they would not show up!!

I've had to unsub a few other auditor channels. They're rude and loud mouthed. I really enjoy your calm and polite demeanor. Keep up the important work.
Word of advice: IF you are going to rob a city hall, library, jewelry, or whatever, do NOT record with 1 or more VERY visible cameras, but buy one of the few dollars tiny cameras/lenses, that are not visible, as that will make the employees feel A LOT more safe!!
You know: If it draws attention by very visibly recording, and it doesn't run and hide when knowing the cops are coming, they have to assume you're are hardcore criminal casing the joint!!
Imagine the American elementary schools one day began to teach logic and irony, and 1A rights, and these rights are for ALL, (just for a start) and it wasn't only for the intelligent people who like to educate themselves to recognize, know, and understand, and I bet the 911 non-emergency calls would decrease about 90 percent!
I know, it's not very likely!! Not when about half of the voters (+70 MIO Americans!!) openly, proudly support a presidential candidate, who openly and proudly has stated, multiple times, that THE 3 smartest and nicest guys he has ever met were:

3 of the strongest enemies of civil rights, equal rights for the people, etc. etc ...

Can you imagine what they think of ALL their customers???? Everyone must be casing the joint. It would have been royally funny if you pulled out a roll of cash......
I sometimes wonder if people who, in the midst of enjoying their day out, are falsely accused and threatened feel the urge to retaliate by hurting a business (for example) that they had never intended to hurt until they were falsely accused and threatened by that business.
The security actually earned his money today. Thwarted disaster!
