A totally new legal standard...the Duck Standard! It doesn't matter what the facts are, just what the officer assumes. So, what are the objective facts? FAR is in a public area (in the middle of a closed-off street) during the day, FAR is performing a constitutionally protected activity (recording video), FAR is approached by a stranger while still in a public area who identifies himself as security and asks questions about what FAR is doing, FAR doesn't answer the questions of the stranger, FAR gets told by the stranger that the stranger has a hunch that FAR is casing the jewelry based solely on FAR's recording and unwillingness to answer the stranger's questions, the stranger calls the police, and FAR waits for the police to arrive. Based on those objective facts, if a looks like a duck and quacks like a duck, we have to make the assumption that it is a pterodactyl.
Next time when a security guard or police officer come up to you and talk to you, you should talk to them about anything other than what they want. Talk sports, weather, their family history or anything else.

He didn't complain about filming, he was checking out a possible flash mob robbery threat which was apparent from his questions. The habit of the flash mob spree is that people with access come and film it for social media, a woman was just arrested for it recently because she was promoting the crime. We have the privilege of knowing now this is an audit, but the guard doesn't and the reason he's standing there visible by the door is to make it clear that if you come for the flash smash and grab then the football player at the door is going to snap you in half before you come in. If the auditor was filming for a flash mob theft the guard would have sent a clear message it wasn't happening today here.

I know 100% if I was to case a business to rob I wouldn't go inside posing as a customer to get the layout of the store and see what they have. I certainly wouldn't use a clandestine camera that wasn't obvious to film the interior and exterior. What I WOULD do is stand outside, super obvious with a camera or phone and draw attention to myself and initiate a police contact.

Why would anyone shop in a store that automatically assumes a possible customer is a criminal? I don't allow Walmart to get away with it. If they ask to see my receipt going out the door I immediately take my cart full of stuff to customer service and get a full refund and walk out. I tell them I will not be treated like a criminal for patronizing a business. About twice of that and the manager has informed all employees I am not to be questioned about a receipt. If everyone did this maybe these places would stop with the self checkout crap and get more employees to serve us in checkouts. We get better service and more people get jobs.

Word of advice: IF you are going to rob a city hall, library, jewelry, or whatever, do NOT record with 1 or more VERY visible cameras, but buy one of the few dollars tiny cameras/lenses, that are not visible, as that will make the employees feel A LOT more safe!! You know: If it draws attention by very visibly recording, and it doesn't run and hide when knowing the cops are coming, they have to assume you're are hardcore criminal casing the joint!! Imagine the American elementary schools one day began to teach logic and irony, and 1A rights, and these rights are for ALL, (just for a start) and it wasn't only for the intelligent people who like to educate themselves to recognize, know, and understand, and I bet the 911 non-emergency calls would decrease about 90 percent! The auditor has found several individuals all with the same common ailment. The Beefy Security Guard, the store owner, and the Cop Lopez. All show various signs of PPD. That's Paranoid Personality Disorder. These individuals are constantly on "guard". They are always believing that others are trying to demean, harm, or threaten them. PPD is almost a requirement for police recruitment.

I don't allow Walmart to get away with it.
If they ask to see my receipt going out the door I immediately take my cart full of stuff to customer service and get a full refund and walk out.
I tell them I will not be treated like a criminal for patronizing a business.
About twice of that and the manager has informed all employees I am not to be questioned about a receipt.
If everyone did this maybe these places would stop with the self checkout crap and get more employees to serve us in checkouts.
We get better service and more people get jobs.

Hysterical that the security guard said that maybe the store is being cased for a robbery but personally I think the security guard works there because he wants to know the ins and outs of the security there so then he can be part of an inside job to rob it later. Word of advice: IF you are going to rob a city hall, library, jewelry, or whatever, do NOT record with 1 or more VERY visible cameras, but buy one of the few dollars tiny cameras/lenses, that are not visible, as that will make the employees feel A LOT more safe!!
You know: If it draws attention by very visibly recording, and it doesn't run and hide when knowing the cops are coming, they have to assume you're are hardcore criminal casing the joint!!

What the officers should say to the auditor is "we told the security guard and owner you are doing nothing wrong, do you need to say anything to us". Then leave. They always go behind their authority as law enforcement and start giving their opinions to show they are more important than they really are, comes across as intimidation. Police have to stop lecturing. That can escalate engagements. Why our country needs to rethink how and when should officers should talk to the public. Remember serve and protect, not control and intimidate. These officers get a B .

The auditor has found several individuals all with the same common ailment. The Beefy Security Guard, the store owner, and the Cop Lopez. All show various signs of PPD. That's Paranoid Personality Disorder. These individuals are constantly on "guard". They are always believing that others are trying to demean, harm, or threaten them. PPD is almost a requirement for police recruitment.
