    You're only partially right about the people who agreed to an earlier version of the EULA. Whenever the EULA is updated, you are told about it (whether via email or a popup in the launcher) and it always says something along the lines of "by continuing to play minecraft, you agree to the updated EULA". the only people who have a case against the previous EULA are people who have accounts that have remained unused for the last several years.

      @jort93z Год назад +61

      It depends on where you live.
      In many countries, just continuing to use the service can not constitute agreeing to new eula. You need to explicitly agree to changes in a lot of places.
      And, in many places, it is also not possible to waive the right to sue someone in a EULA.

    • @mcbyt
      @mcbyt  Год назад +67

      Yeah, ofc anyone that's agreed to an updated version doesn't really have a case here, but there's still millions of accounts in that inactive group. Then again, if they haven't agreed to that in years, I don't see why they'd start caring about it now.
      Plus, I don't remember exactly how the updated EULA agreement has worked, but they definitely need to be careful with it. It needs to be pretty explicitly agreed to, I think, based on court precedent (for example, Google just won their lawsuit against Genius because Genius' TOS wasn't forced on you when you first opened the site, even though the courts found Google did break it.)

    • @LucidPoseidon
      @LucidPoseidon Год назад +18

      I'm fairly certain that, at least in some US states, passive agreements are not legally enforceable. A direct, affirmative action is needed to prove that the client has agreed to whatever terms are present in the connected document.

  • @Tinkuwu
    @Tinkuwu Год назад +286

    What's funny is that EULAs are never seen as something that can be held up in court. People think they can just point to it and say "THEY PRESSED THE AGREE BUTTON" but the courts in the United States do not see that as a valid agreement. Seriously, if they put "we can take away your account at any time" in the EULA, they would still be committing fraud by taking away a product/license you paid for, which is illegal in the United States, where Microsoft does a lot of their business. Essentially Microsoft would wind up in court, their EULA would not have a second glance, and they would likely lose to even the worst lawyer.
    But I would still recommend migrating if you haven't already. No sense in going through the legal system when you could just click a few buttons and continue enjoying the game.

    • @XG_
      @XG_ Год назад +9

      It’s not fraud as they are taking away a limited license they gave you which you accepted the terms to when using. You as an individual would know that at any point they can revoke access. "Forgotten their login credentials": Contact Mojang support and get hold of those credentials. If not possible, tough luck; you were never getting in anyway, the account is gone.
      Anybody who has managed to hold onto a non-migrated account (meaning they've owned the game for like 7 years at this point) and not migrated it, after having over half a decade to do so, should not be surprised if their account gets deleted. If they valued their $30, they'd have done so a long time ago.

      Microsoft saw a cash cow in terms of farming people's data and wanted to force migration into Microsoft's account ecosystem. The Microsoft account is not only a steep downgrade in terms of protections against account deletion or ban, but an intrusion of privacy. And as an alpha customer it's a complete violation of the agreement with Mojang. Customers with multiple accounts can't even link them to the same account with Microsoft. If they know that an individual has multiple accounts, their policy is to ban those accounts. This is just another way in which Mojang has failed. Failed to honor the sales it has made to its customers.
      Microsoft really only cares about new money coming in, and that is from new game purchases, and purchases of minecoins. They don't believe they are gaining anything by treating the existing customer base with respect. Did you know that Alpha customers are also entitled to add-on content at no additional charge, and that Microsoft hosts Mojang add-ons and sells them for money but provides no avenue for people grandfathered into the game to even get this content? Mojang to my knowledge hasn't even addressed this issue. This is what happens when a company loses touch with its customers, both in terms of mutual appreciation and abiding by contractual agreements.

      The action that needs to happen: Minecraft authentication used to be done with Yggdrasil, an authentication API server. There are already a handful of individuals who have coded viable clones of Yggdrasil but it needs to mature as a software solution and then gain community adoption. It is possible therefore to point to an alternative authentication solution and maintain online play operability. Alpha customers are within their contractual rights to do such a thing as well and Mojang has no legal basis to prevent it.
      Until Mojang acknowledges that they have breached contract and failed to support their customers, particularly those from alpha who helped make the game what it is today through their early support, they should face the consequences of alienating their userbase and forcing them to self-help their way into use of what they paid for. On top of that, they should learn what their support for censorship and fraudulent treatment of the customer costs them.

  • @CZghost
    @CZghost Год назад +26

    The biggest issue is people who cannot migrate because they've lost the access to the old email. Not only they can't play on their original account anymore (because unmigrated accounts are locked and cannot play, unless you migrate), now they'll lose their account completely, which will free up their original username, and somebody could potentially take it up before they even have a chance to register it again (paying for the game again). Because in order to complete migration, you need access to the email associated with your account. If you no longer have that access, then anything related to your account safety and security is practically unsolvable. So unfortunately, those people will no longer have an account.

Suffice to say that if I lost access to my Gmail account, then Minecraft account would be the last thing to defend, since I have pretty much everything on my Gmail account: payment method, couple of linked accounts, but most importantly it was used to register bunch of online services, including various social media, and it holds the keys to my RUclips channels as well, so I'd have much bigger issues on my hand than losing my gaming account.

Ive been playing minecraft since 2010, purchased july 2011, and redeemed my free windows 10 code back in 2015. However, all these years later when i wanted to migrate my account, I use a different microsoft account as my main so i migrated to that one. No big deal but then after all that had been said and done they tell us about the vanilla cape which i didnt get because i redeemed my windows 10 code, which may i remind you was given to me for free by mojang themselves, on a different account. The solution is alternative Yggdrasil server for authentication. Why fuss with Mojang's forced migration? Why worry about your username? If you're alright playing with a select group of friends and hosting your own server, you can have full control over your own username, skin, etc. There are examples of this software online but it needs more development to mature as a solution, but it's clearly the only path left to people who refuse and are not legally obligated to accept a Microsoft account to access what they paid for. Alternative servers, and a mod that allows you to log into said alternative will alleviate the tension and for Alpha customers it's all supported by the Mojang terms of sale.

    It would be cool if the community joined up make one mod or something. One that's made by the community and for the community, not money. Maybe that would remake the new updates into it, make it's own updates that are inspired by majorities or something.

      I'm an owner from 2010. My opinion is put all that energy and money you'd pay a lawyer instead into supporting development for alternative authentication. Mojang used something called Yggdrasil server for their authentication and skin support. Individuals have already coded examples of alternative authentication support for Minecraft but the software requires some more development to fully mature. With it, you will be able to authenticate your clients by pointing to alternative servers. Now all the pre-migration versions of the game and mods can be played and you don't have to worry about interacting with Microsoft or Mojang. For alpha customers this is entirely within the letter of the terms of sale.

    "We reserve the right to change this agreement at any time with or without notice, with immediate and/or retroactive effect." from September 23, 2011 with it being unchanged during its official release date (November 20, 2011 being the snapshot closest to November 18, 2011).
    Whether or not this has always been the case through 2015 I do not know but Mojang (actually, Microsoft, let's be real for a second) wouldn't do this willy nilly and likely already has arguments to counter any lawsuit
