Think of the raw recruit that pulls over the chief constable for drink driving that gets told to mind their own business. On the ground these constables have very limited powers despite them trying to trick you otherwise so if/when these matters get to court before a judge, Mark's testimony under oath could go in favour of the defense. It pains me every time to defend their profession as my own experience with them has never been positive for both good & bad reasons on the whole. However there are the odd good one out there and this guy was one of them. Which is a very rare event in this day and age.
RTA 165 applies to persons driving a motor vehicle. If you're sat in a parked car and they didn't witness you driving it then you have no obligation to provide details. If they ask if you were driving it/how did it get here then your answer is "no comment". Failure to provide details is a summary offence. So if they wanted to arrest you they would have to wait until you're outside the vehicle. Section 17 of PACE doesn't allow entry to premises (including vehicles) to perform an arrest for summary offences.

PC Mark Golding 3993 comes out of the whole event with flying colours and a gold star. He handled everything politely, professionally and took his time to listen and understand and educate himself and didn't try to go beyond his knowledge or abuse his powers.

From how I understand it, the coins cost new what the face says. People try to auction them on internet sites in the hope of selling for more than they paid thinking it an investment, but when this fails they have to let go for less than face value when the auction time limit is reached and it does not get to what they hoped. The value of the metal is no way near the face value of the coin. Now, if you want to invest in this kind of thing, it has to be gold bars:- 1g, 5g, 10g, 1oz etc. Probably the most stupid bint cop in the area. This is like modern stamps, if you buy say a Christmas set from the post office as soon as you have them they are worth 20% less than face in the stamp trade - too many stamps, not enough collectors. This will change next year as to be used for postage stamps will need a bar code. Apart from the pushy policewoman, this is exactly what happened to me at Tesco. They too are threatening me with civil recovery. Why was she pushing for your details for a civil claim? That will now be entered into the police system and could have unknown consequences at a later date. I am hoping that after I pointed out again that they have stated in writing that they do accept these coins they will not proceed. Magistrates are not well versed in the law and are inclined to take the side of corporations and that could end up as an appeal.

Julian, Always ask "Am I being detained" then if they say yes ask under what section as you haven't broken a law or suspected of breaking a law and can't be legally detained. This allows you to sue the police for illegally detaining you..Theyll learn that way. Otherwise they'll continue to hassle you.

There is a famous case in our High Court that made a judgement that people are under no Lawful Obligation to help the police. This is why they read you your Rights we all have the Right in Law to say nothing whether we are under arrest or not. Learn it and use it against them. Remember this, for anyone to be found guilty of a crime the prosecution has to prove that you are guilty of mens rea and actus reus do look those terms up.
They don't have to accept the coins. They can do what they want with them. Build a little coin castle. It's up to them. But by making an offer of payment using legal tender, the debt is discharged. You're involvement in the transaction was complete the moment you placed those coins on the counter for them to pick up if they wanted. That's the law.

She could have waited for me to leave and then pulled me over, which is why I provided details. Don't want to give her any reason to lawfully arrest.

This is like modern stamps, if you buy say a Christmas set from the post office as soon as you have them they are worth 20% less than face in the stamp trade - too many stamps, not enough collectors. This will change next year as to be used for postage stamps will need a bar code.
Every set since 1971 at the moment can be used for postage, by next Feb (I think) they will not be legal so could be worth 20% less than nothing in the trade.

Apart from the pushy policewoman, this is exactly what happened to me at Tesco. They too are threatening me with civil recovery. Why was she pushing for your details for a civil claim? That will now be entered into the police system and could have unknown consequences at a later date. I am hoping that after I pointed out again that they have stated in writing that they do accept these coins they will not proceed. Magistrates are not well versed in the law and are inclined to take the side of corporations and that could end up as an appeal.

I am absolutely amazed how many people are there dealing with the issue of accepting royally decreed legal currency. I wonder if they would have made such an issue if Her Majesty or any member of the royal family had turned up and gave the coins to them.

She was so sure that she should help the shop rather than the public.
I'm also sure that she will give your details to the shop keepers. If I were you I'd get the camera footage ASAP because it will still be on after your interaction and even if they blur out the faces of the shop keepers their voices will still be heard.

Julian, Always ask "Am I being detained" then if they say yes ask under what section as you haven't broken a law or suspected of breaking a law and can't be legally detained. This allows you to sue the police for illegally detaining you..Theyll learn that way. Otherwise they'll continue to hassle you.

But I aquire the coins at least 20% below face value, make the cost of the diesel back in youtube revenue, get thousands in compensation from the police when they mess up and generally find the whole palava rather amusing.

There is a famous case in our High Court that made a judgement that people are under no Lawful Obligation to help the police. This is why they read you your Rights we all have the Right in Law to say nothing whether we are under arrest or not. Learn it and use it against them.
Remember this, for anyone to be found guilty of a crime the prosecution has to prove that you are guilty of mens rea and actus reus do look those terms up.
They don't have to accept the coins. They can do what they want with them. Build a little coin castle. It's up to them. But by making an offer of payment using legal tender, the debt is discharged. You're involvement in the transaction was complete the moment you placed those coins on the counter for them to pick up if they wanted. That's the law.

I have previously looked into the law surrounding matters of legal tender. Please refer to the coinage act 1971.
Overall a good video and the male Police constable, Mark was the most professional and knowledgeable PC I've ever seen.
