@@julianchamberlain5399 Expected, partly because he’s uneducated, but mainly because the interview is all about him improving his case against you. He controls the questions and he doesn’t want to make a mistake that helps you.
Personally my advice may have been say nothing in interview, just give him a prepared statement which states the facts, the events, the Law - and to frustrate the fools keep repeating “you’ve read my statement which clearly demonstrates your arrest was illegal and further malicious charges would be of further detriment to you. Everything else is completely irrelevant”. Answer that for EVERY question, rather than “no comment”. They’ll quickly get tired and the Court will recognise you’ve explained your position throughly. Further, the CPS will have only that to go on. It weakens them.
If he wants to pick holes in it he can do so in court, and your Barrister can control the answers to a degree. Answering questions may “feel” like it’s the right thing to do. It always isn’t. All answers only help the Police.
Clearly an unlawful arrest and detention so I hope you follow the civil case through.

Sergeant Ben Atwood, I’m rarely surprised by the idiocy displayed by police officers, nor am I surprised when they break the law. I have four decades of experience of police officers committing criminal offence.
But you really outdid yourself and your ilk with this one. If I wanted to I could not only point out the specific pieces of evidence in your conduct during this interview when you betrayed the fact that you were fully aware that you had unlawfully arrested this man, but chose to pursue the matter on the basis that the process is the punishment. Specifically, your purpose for keeping him in detention was to punish him.
I look forward to the day when glorified policy enforcers and revenue collectors in fancy dress costume like you are held accountable - by whatever summary justice system is in operation at the time.
Throughout the interview you lead the process towards the point where you expressed your utterly perverse a d warped belief that making a profit is illegal. You are clearly aware that you can not only get away with kidnapping people, unlawfully imprisoning them, steal their lawfully owned property, and face no individual legal penalties. That will not always be the case.
This type of disgusting behaviour needs to be stopped.

I'm an ex-cop and I'm trying to work out how Attwood has managed to keep his job, let alone how he has made it to Sergeant. Someone, higher up the chain of command, has questions to answer as to how Attwood has been allowed to get away with the sort of behaviour displayed in the video and not get pulled up about it or warned his job is at risk.

Yeah, someone not involved in the arrest should have done the interview. Instead, it became an interogation with the arresting officer clearly invested in fitting the guy up for some offence given he was cross examining because his little ego had taken a knock.

The copper wasn't prepared to discuss points of law yet the arrest was based on false interpretation of the law. In that interview his brain cells were frantically working to twist your answers in order to validate his mistaken belief that your arrest was lawful.
thanks for publishing this, certainly educational for anyone that has not been arrested before showing them the interview process. He was holding his head in his hand because he realised he had let his ego get the better of him and arrested you. When you pulled your ace out of the bag (his words) he could have asked if you would show the email to the manager and un arrested you instead of dragging you down to the cop shop.

I took from this police interview video that it was not about getting you on a hook but getting himself of the one he impaled himself on. The salient point here is that you would reasonably expect both the Tesco Manager and the policeman to validate the authenticity of the coinage or otherwise prior to involving the police and the subsequent arrest. You're a brave man for puting yourself through this.

I agree the arrest should have stopped as soon as he was shown the email from Tesco stating that they accepted the coins. The Sargents EGO was being tested and he didn’t like it. He then abused his power, knowing he was wrong, to inconvenience Brett. Even that backfired as the video has has gone viral and helped Brett get the message further.

If a corner shop owner goes to a cash & carry to buy a box of 20 Mars bars at £9 making the unit price 45p but the sells each in his shop for 70p, is he being dishonest? When Tesco bank it, it won't be worth less than £100 will it.

A boss used to pay his staff in gold sovereigns. Giving the staff (say) five sovereigns as their salary, and given the high market price for gold, meant they had a very reasonable income, but the legal tender value of £1 meant a zero income tax liability and no messing about with national insurance contributions. I seem recall capital gains tax thresholds were high enough at the time to allow them to get away with that as well.

You handled the whole thing very well and made him look the fool he clearly is. The only thing I would have added, when he was suggesting buying them for £70 and getting £100 back was illegal was that Tesco were not being disadvantaged as the face value is £100, and they would have given you £60 in fuel and £40 change. Hence they were fully recompensed in the contract. When they banked the coin with all the days takings they would be credited with £100 so no crime or deception would have taken place. I would also have asked the copper "So if I buy Kruggerands for $1500 and sell them a few weeks/months later for $1800, is that dishonest?"
Now seeing as he has checked the price and seen the potential here, I wouldn't be surprised if he and his colleagues start paying for their doughnuts with £100 Coins 😂

However legally the whole case against you falls down because you had no intention of leaving and in fact you didn't. What she said was absolutely correct, Tesco have previously informed him in writing that they would accept the coins as they are legal tender. Nobody is feeling bad we know exactly what he's doing it's a shame you aren't quite as bob on with your cut and paste replies.

The officer’s guard is down though, which means the detention is longer and the payout is greater.
There may be an artificial value for such coins on eBay but Tesco could present it at their bank and be credited its full £100 value. This is a no brainer wrongful arrest and the officer knew that a few minutes into the discussion.

If he's got such a problem with you buying these coins on ebay, and is suggesting that you're being dishonest (or even criminal) by doing so, he should petition his MP to make buying/selling currency for less than face value illegal.

Basically the whole point of a police interview is to try and make you incriminate yourself. Most of the general public who are ignorant of the police make the mistake of thinking that the police take a balanced impartial view to investigations, they are in reality there to get convictions at any cost, regardless of what is legaly or moraly right.

Can’t believe he actually admitted on tape that it was legal tender and then calls you dishonest- don’t know how you kept so cool - he needs retraining at the very least but really that should be a disciplinary case - can’t wait for the sequel in the civil court
It looks like shopkeepers and the police need training as to what 'legal tender' is. This should actually be taught in primary schools. a) paid b) didn't make off c) gets arrested.

At 24 minutes that cop knew he was in deep do doos so went down the route of blame the victim for his own inadequacy. He should have taken steps to discover the validity of a £100 coin before arrest. But failed. And will now have to pay compensation.

@@rogerchadwick3452 The conundrum is they are legal tender according to the Royal Mints website. Therefore commemorative coins can be used to settle any form of monetery debt, if the legal tender is refused, the creditor cannot pursue the recovery of said debt.
If your arrested for stealing fuel and your car is still on Tescos premises with the fuel in it how have you haven't driven away without paying.
