Petrol station should've stipulated the legal tender they accept before allowing people to take on the debt.
one auditor did exactly the same at TESCO
and he returned to his car in 2 minutes
with some change and his bonus points 🤔
I would make it my life's aim to get that man sacked.

Just a correction: They do not have an obligation to accept the coin. However, the transaction was over as soon as you tendered payment with legal tender. The debt was extinguished at that moment, that is the law. After that they can give you the coin back if they want but there is no longer a debt for them to try to recover. As long as it's all on Camera don't feel that they have to accept the coin for the matter to be settled. They think that if they give it back they can claim that the debt wasn't paid, but they are wrong about that as a matter of law.
I’m aware of all of that. I personally prefer for them to have the coin, as it doesn’t leave any doubt that I’m not acting dishonestly. However in the future, I think I shall keep any coins thrown into my car etc.
@@AbsoluteAudits Absolutely you want them to keep the coin, you don't want to leave anyone out of pocket. But when they are being stubborn like that they are kind of playing a game of whoever has the coin last loses. All I'm saying is don't feel you have to play that game. If it were me I'd gently let them know that they wont be able to pursue a debt and they'll be out of pocket if they give the coin back. Maybe you could tell them you'll accept their offer to return the coin, but you'll keep it safe and not spend it, incase they want it back at some point.
@@monkeysaur4305 I agree regarding the game, it felt an ego battle to me, which I didn’t want them to win! If I took the coin it gave them a glimmer of hope that I’ve made off without paying. However in future I think I’ll have a pre printed notice that I’ve been thinking about for a while, saying something along the lines of “by returning this/these legal tender coin/s to me, you acknowledge that I offered to settle this debt, but you have refused the payment. I am now no longer legally liable for this debt. For the avoidance of any doubt to my integrity, as a gesture of goodwill, I provide you an email address which you may reach me on if you decide you wish to keep the coin/s. This offer only stands for 14 calendar days after the date of this notice, and any expenses accumulated to provide this coin within the 14 days, will be met by yourself before the coin/s is/are returned.”
Not necessary, but could be an interesting idea to see their reaction if anything.

*Because Tesco allowed a debt to be incurred by providing the petrol before the customer paid for it, they have to accept the customer's offer to settle the debt using legal tender currency. If they refuse to accept this form or payment, they cannot lawfully sue the customer to recover the debt, or have him arrested and charged with any crime relating to non-payment of the debt, because he has already made a legally reasonable offer to settle the debt in a form recognised as legal tender throughout the UK.*
*This means they don't have to accept his coin but can't sue or arrest him afterwards because he offered to pay with legal tender but they declined.*
Good job. Nice coin that lives to fight another day. Civil recovery generally requires you to fill out an agreement, supplied by a company that specialises in this subject. Without the legally binding agreement I doubt they would be interested and assume its a police matter. Their alternative will be to phone the police who will likely tell them that its a civil dispute, one they would loose in court because they refused to take the legally reasonable payment. Why are they so stupid?
What would you say if someone just puts the coin on the counter and drives off before the counter staff could do anything. All recorded mind you. I note that the education aspect would not be there at that point in time. But since they would then initiate the "debt recovery process" unfairly and unlawfully it could be a justification to initiate some civil claim for them hounding and harassing without lawful authority. The claim doesn't need to be large, maybe £100. But you'd effectively get free fuel. No hassling the counter staff which many trolls say is unfair and leaves all the handling of the situation to be done by head office staff, who have the time and resources to check the law. Since head office staff are handling it, the putting up of signs not accepting or the training of staff would be more likely to happen than if the local manager had to do it since the local manager is very limited in what they can do.
@@TheSadButMadLad A friend of mine did the £100 coin thing. Left it on the counter. Got a letter from civil recovery saying he drove off without paying. He informed them that he did pay and has evidence. They looked into it and said about £100 coin not being acceptable and a load of threats etc. He explained his case and as far as I know they have given up on it.
@@julianchamberlain5399 Sounds like your friend should send a simple straight forward letter before claim for unlawful harassment of the debt recovery initiated by the petrol station company. £100 would be reasonable to me. 🙂
He cannot use the debt recovery normally BOSS Payment Watch (British Oil Security Syndicate) if he has asked you to leave, as you have to sign the agreed civil form. You had free fuel then.
@@Robert-jf5oi his argument is that they are only legal tender as a payment into court as a defence. They are legal tender for payment throughout our United Kingdom, not just in court. He maybe a lawyer but in every court case one wins and one looses.

If you refuse legal tender as payment as legally required , are you still responsible for that dept ?
If you offer to pay and they refuse legal tender then the debt is squashed. You can you use them to pay court fines, bailiffs, council tax etc.

The fact that he threw the payment back into your car is not a problem that concerns you nor that he didn't issue a receipt as whole thing is on video and reported to the police! What more evidence is needed that that? None!

@@AbsoluteAudits Have you attempted to obtain a new loan since then? If the garage did commence debt recovery you may have been added to the 'bad debtors' list which will affect your ability to raise credit.

I chucked the coin, and left. That’s it. Nothing happened, nothing ever happens as they know they don’t have a leg to stand on.

I wish I had a petrol station idd willingly accept these coins as I'm a collector but never seen any 20, 50 100 pounds.
We don't take "coin" - your reply should simply be "It's not your decision."

Just looked on site for royal mint it says nothing parties have to agree and you can't ask for change from it can you please clarify
They are not under any obligation to provide change for a debt, this should be clarified before settling if you’re concerned about change. A similar example of this is in pay and display car parks where it says “no change given”. You can’t sue them for not giving change, as technically all debts should be settled with the exact amount.
Can’t remember exactly where I read it, try in the coinage act. Iain Gould wrote an article about it I think too.
@@AbsoluteAudits I've seen that before but I think it was about taxis. I doubt it's rarely put to use tho as there can't be many people scum enough that wont let you change the currency.
Ive just had a thought. Would you consider trying this in Toby carvery. I've just had one after years and you get your food and then pay at the end. So surely the principle with fuel would be the same?,

Yes, but it would have to go to court as most councils and private parking companies do not accept cash as payment. You could then pay the coin/s to the court (but you’d incur more costs and often courts no longer have cash desks, so back to square 1).
They are making it an inconvenience to use cash to justify a cashless agenda. This video is a protest of sorts against that.

Find out if they accept cash, get it in writing. If they don’t accept cash you’d have to go to court to insist on using cash.
