  • blog.cleveland.... Raymond Towler, who spent 29 years in prison, walked out of the Justice Center in Cleveland after his life sentence for a rape in 1981 was vacated. Towler was found innocent through new DNA testing.

      fckingkim I'm pretty sure there were a number of factors at play. She could've easily just said it was a black guy (eg. it was dark, she only saw his hands etc.) and he could've been in the wrong place at the wrong time. I don't think they did any DNA tests at the time so that complicates it a lot as well.

      the biggest punishment i have seen for a women was 3 years and that was for falsely accusing a man of raping, same thing. he got accused for *16* years and she only got a 3 years sentence to try and ruin a man’s life. horrible.

      Should be the police and DA. That's what happens when DA's are judged by their conviction rate. Doesn't matter if the person is actually guilty. As long as they get the conviction.
      The victims in this case were two children. It's hard to blame the children. They had to be traumatized so the police and DA should have known their recollection of things is likely to be skewed.

      Cherokee Woman I have a relative that is currently living in New York City.Crazy wife got his kid, car, house, and she was not charged for any of the physical violence commited on him(he did not want to hit her even though she was hitting him).Luckily enough 3 years later he got back custody of his daughter and did not have to pay for alimony anymore because he filmed a physical assault on him commited by her.Put a camera up in his house, that recorded an argument between the two.His at the moment ex-wife wanted him to not visit their daughter at all, and more alimony.When he disagreed, she pulled a knife on him.He managed to stall her until the police arrived.By the time all the court ordeals were done, his daughter was 6 years old, just in time for school.Luckily she's in prison now and he has full custody of his daughter.

      I’m no expert on US federal law because I’m way over here in England but unless I’m wrong I believe the max payout is $50k a year for being thrown in jail while innocent. Over here in the uk it works out to be roughly $1000 (£800) PER DAY if this happened

      sam neale Well, not this case I mean. However, there are cases where people will plead guilty to soften their sentence. If they plead guilty and are later found innocent, they are not entitled to the amount normally given for false imprisonment (in the US most states that do compensate will offer $50k per year). This is true for a few states where you don't get compensated also. You can sue but the case will get thrown out if you pleaded guilty.
      These laws are judged at the state level. So you will see a large amount of variability about how cases like this will be handled. Only around 20 states in the US actually offer compensation for each year imprisoned. This compensation can be as low as $2k per year to $80 per year depending on the state. The other states that don't compensate you will have to sue for the time served. States like Iowa won't allow you to sue them if you plead guilty to the case you were tried for. This variability is due to the size of our nation.

      +ihazdaforks No, 5 years Is not enough if the sentence they would have someone innocent serve is longer (as it typically is). The accusation of a crime not committed intends the punishment applicable to that crime. That punishment should be the starting point for the false accusation.

The OJ Simpson case is a great example. So, in the US, it is fair to say that finding the wrong persons guilty is worse than letting the true felons get away with it.
