  • Accused of rape by a fellow student, Brian Banks accepted a plea deal and went to prison on his 18th birthday. Years later he was exonerated with the help of the California Innocence Project.     I watched the video and started to cry, not only because of the injustice to Mr Banks, but also the injustice to my brother, accused of similar charges and wrongfully imprisoned. I have spent several years trying to find someone who can help me to get my brother released and his name cleared. We are in North Carolina, a state still so filled with racism and a very unhealthy healthcare system. We need help before my brother dies in prison.

      The school actually sued her back for 2 million dollars and won the case. She has gone into hiding and skipped all of her court dates so I'm sure there is a warrant for her arrest and she will wind up spending some time in jail when caught. Doesn't take back what happened to him, but at least a small amount of justice is being dished out

      @@sldrmedik Unfortunately there is currently no precedent in the law that if you were to be accused of a crime you didn't commit your accuser would go to jail. However he can pursue a civil case against the accuser and sue her for all she's worth for malicious prosecution, he'd most likely win given the fact that she confessed she lied and he was exonerated.

    This is real. I was just falsely accused of sexual assault here in Japan spent 15 days in interrogation. The process was punishment and caused horrendous damage in my life I don’t know if I can ever recover from.Despite the charges being dropped, there’s now a mark on my record forever here that will be used against me in the future.

      Didn’t she Confess on tape which was recorded against her knowledge? I think that’s inadmissible in court, doesn’t make sense to me btw, as far as I’m concerned a confession is a confession is a confession and evidence is evidence is evidence.
      In fact I’d argue that it’s the most reliable form of spoken evidence because nobody lies in secret whilst telling the truth in public.

    omg as a USC alum, I remember reading about this. People who lie to falsely accuse someone should get punished matching the sentence of the person they falsely accused. So in this case, 5 years in prison.

      My best friend had a similar option. "Plead guilty to a lesser charge and lose your entire military career....or go to court martial and spend the rest of your life in prison." He suffers from tremendous ptsd from the trauma of the accusation and loss of career (14 years) and reputation even still...30 years later.

      It's not about believing him or not. He already signed the plea deal and did the time, which means he basically stated that he did the crime. Therefore, the only way to have it overturned was to have her admit she lied. What she did was horrific but your statement is an attempt to push your own lame "woman-hating" agenda.
