I think they should have specified how they fade. It's the bodies immune system that's supposed to attack the tattoo and heal it. If you have a weak immune system it will definitely take longer or your body could perceive it as not a threat and never end up attacking it so it will say there forever.
Even if this DID work, it's not like the tattoo looks nice for 2 years then POOF is gone one morning. You have a mostly-faded tattoo for most of its lifespan.
Precisely this. It'd be better if they made a tattoo ink that's more responsive to being faded by uv or something, so the person can go get the fade treatment and get it removed. Normal tattoos often don't fully fade with the laser treatment... so why not make ink that does? Then you have a nice looking tattoo that can be removed whenever desired

Scientifically speaking, this could never work. The tattoo process is not only dependent on the kind of ink, but on how much scarring is made and how it heals, and also on individual factors. This is one of those marketing scams that oversimplify a rather complex process to prey on people that are new to the subject. What a shame.
A lot of people’s small ephemeral tattoos faded in a time frame of 14ish months to 20ish months. So scientifically speaking it can work but cant be guaranteed to work
@aeridollz if you accept the refund, you most likely won't be able to sue - that would be deemed to be compensation & therefore, if you accept the refund, the situation is already "rectified". If they've got any sense at all, they will also make you sign something to that effect before issuing the refund.
Any one else think it's very... interesting (read: SUSPICIOUS!) that the time Ephemeral claim it takes for the tattoos to fade, lines up with the amount of time they've been around? Last year when they'd been open 2 years, it was "within 2 years", the year before it was one year, now that they've been around for 3 years, that's how long it takes.They never had a clue how long these were going to last and they still don't. I bet you any money, this time next year it'll say "made to fade within 4 years". They've basically been experimenting on the general population with absolutely no idea what they're doing. NOT ACCEPTABLE!
I wonder why they don't just add a year to their fake estimate. Would certainly have delayed this trouble, and given them more plausible deniability, if it's alway meant to last a year longer than the oldest customers have it.

The uneven fading was probably worse than the longer fade time. A lot of the ones I've seen end up looking like scratchers, which is the worst outcome for their customer base.
Seriously!! A large portion of people scared to get a permanent tattoo are probably scared of getting a tattoo that looks bad and being stuck with it forever. Now they’re guaranteed to get a tattoo that looks bad, that they didn’t really plan out, for an indefinite period of time. Brutal.
When I was little my older cousin got a tattoo on her ankle (30+ years ago). She told her parents and my grandparents that it was a special ink that would disappear after a year. It's only been since ephemeral tattoos did all this that I realised that was a lie to chill out our family 😂. Wonder how that bee tattoo is holding up for her? 😂
My worry with closing the studios and selling the ink to traditional tattoo artists is that when it doesn’t fade in a few more years, Ephemeral will blame the artists for applying it wrong and tell the clients to sue the artists instead
I don't understand why people just experiment with henna. It'll fade fast and if you want it to last longer, go over the design until you decide you want to go permanent or continue the fading process. It's super forgivable and still feels good to have something that lasts longer than a day.
it also fades way more nicely than temporary tattoos, without the stickiness and crumbling. lasts a good 2-3 weeks. its so weird that no one thinks of it at all
Also, I'm sure you can get a custom temporary tattoo (you know the ones we all had as kids) for cheaper than this. Get you manufacturer to do a bunch of sheets and you can basically have it for as long as you like.
@@liamcollinson5695 the issue in that case is usually not henna itself, but stuff people add to it to extend shelf life, make it any colour but brown, etc. Those things like PPD (used to make it black) are what cause you to develop an allergy and have an allergic reaction most of the time. Essentially if the henna is not brown stay away

They rushed it to market, didn't do anything like the necessary amount of testing and research beforehand, used polymers notorious for being unreliable and NOT breaking down consistently, hired inexperienced tattoo artists and then promised something they cannot guarantee! I hope there's a class action lawsuit in the works because I personally don't think just getting a refund is acceptable. Rectifying a botched ephemeral tattoo is likely going to cost more than the original tattoo to cover it up or rework it, and laser isn't an option because the guys who came up with this ish didn't bother to even consider the possibility that the tattoos might not fade exactly as advertised! They were deliberately misleading and reckless with people's bodies for a quick cash grab and frankly, that is disgusting behaviour, and they've STILL got the audacity to claim that all Ephemeral tattoos will "100% fade away"! Into the bin with them!
A single health professional could have told them that dissolving stitches don't reliably dissolve. That's fine for stitches that can get removed manually, not something that's literally inside your cells! What a disaster

In another comment someone said they could have been transparent about it from the beginning, said it was in the testing phase and that they weren't sure yet what was possible/how long they'd take to fade etc and people still would have got tattooed, but with the understanding that it might fade or it might not and I agree! They just wanted to make as much money, as fast as possible.

Ephemeral tattoos remind me of my best friend bragging about how she was going to get her ears pierced with a 'special needle that would make it not hurt'. Although we were seven, not grown adults running a company
@TheElf_Online oh yeah, we all did bring that up to her. She was insistent it was an 'even more special needle than that', and wouldn't hurt at all. She'd wanted her ears pierced for ages but was terrified of the pain so it was the only way her parents were able to convince her to go through with it. And no, she was not very happy when she found out it did still hurt.
Yeah but tbh anytbhing less than the claires is so great, I mean 7year old me probably isn't a great judge of pain, but I could barely get though mine, and apparently they barely get trained if at all to peirce kids so it checks out😭@@TheElf_Online

I totally agree with you Lauren. The company should have offered free tattoos to hundreds of people, letting them know the ink may or may not fade. Then document the fading over time for each. I guess some people would rather make money now instead of waiting five years to perfect their product. Unfortunately, it’s their victims, erm, customers who pay the price.

Loved my ephemeral at first… but it was meant to be 9 months. I had a great experience and loved my design, but it looks like shite now. It has been 1.5 years… they NEVER reached out to any of us ( how hard could it be as they have our info) to tell us about the 3 year mark. Honestly anyone with ink still showing after 1.5 years should be given our $$$ back AND let us know if it can be lasered. Sad thing is, when I got mine, a mother was with her teenage daughter getting multiple “temp” tattoos. I just hope they still like them!
There needs to be LOTS of testing on different skin tones, different areas of the body, different designs (black work/shading vs line work) AND different artists!

If the money was an issue and the ink was already semi-okay, they could have started earning money already without lying by selling people a bit cheaper 'test tattoos'. If I knew the ink was 100% safe I would definitely be down to get a tattoo like that, I'd just make sure it's something I wouldn't mind having on me for the rest of my life. If they did it this way, they'd know to change the ink, they have more time to do that, they'd already be earning money, some people would have a faded tattoo and therefore success, and some people would have a cool tattoo thatd normally cost more? Just make sure the consent forms are very clear and completely signed.
One of my favorite tattoo artists is a former Ephemeral artist. I chatted with another client around an appointment and they were one of her ephemeral clients, she covered the piece for free. I believe the piece was old. I think it says allot about her integrity when she has had to deal with drama with industry of tattoos, let alone this problem with ephemeral. She had a good experience working there and was happy to have a regular paycheck and it helped her today.
The fact that they could have marketed the ink that only lasted a few days to be used for medical reasons and could have made money that way. there are people who need to get small dots for different treatments but have reasons they dont want permanent tattoos and well most will do it because its for health reasons think jow much nicer it would be for them if they could know its wasn't going to be permanent.
I feel people would probably like inkbox to help with temporary tattoos and placement that actually works and looks quite good. (I’ve used it for placement planning for a tattoo I’ve been planning to have for several years)

Thank you for staying on this and bringing it up. tattoos for the most part, are a permanent body modification. These people were scarring people for life by giving them these tattoos under false pretenses. Their customers went to them because they trusted that the CEO and this business knew what they were doing, and they were failed and deceived by these jerkwads. Ephemeral Needs to be held accountable and if nobody talks about it, it might just get swept under the rug.
The way this product was initially advertised was as a fun, no commitment means of getting a tattoo that they essentially guaranteed to fade within 12 months. The cases Lauren mentioned in this video probably doesn't even scratch the surface of the number of people who are dissatisfied with how their Ephemeral tattoos are holding up. I find it really concerning that in cases where the tattoo does appear to be fading as advertised the skin appears scarred. There are ways to minimise the appearance of scars, and there are ways to cover scars, for example with make up for a temporary fix, or with tattoos as a permanent fix. But my understanding of scarring is that the body creates scars to quickly heal the body after the skin experiences a trauma. Because the body is doing this quickly, the resulting scar tissue is not as strong as non-scarred skin. I am sure different factors come into play like size of the scar, placement, individuals etc., but I have seen figures of around 70% (so the scarred skin is around 70% as strong as non-scarred skin). So even if the scars fade, given time and treatments which may or may not work in reducing the appearance of scars, the integrity of the skin will still be permanently damaged. So... yeah.
Good point! Especially with bigger surfaces, this could pose a serious problem. I know from my own experience that scar tissue can also be way more sensitive to temperatures, so that's also a thing that might happen if the scars are big/deep enough. (Granted, mine is a scar from an old OP, so obv. it's pretty deep. These tattoo scars might act differently. Still, getting unexpected burns on a scar really sucks and I don't wish that on anyone.)
My body scars differently in different spots. On my back I get keloid scars (thick, raised, rope like scars that itch for years) but on my legs my scars are flat and just slightly different color than the surrounding skin. Another difference between the two locations is that the ones on my back are from surgical mole removals (deep into the dermis) while the ones on my legs are more superficial from falling down as a kid. Scaring isn’t an exact science and everyone scars differently. That’s why I find it interesting that people would go through the pain of having ink drilled into your skin and then the scaring and healing process (which you are never quite sure how the body will respond) for something that is “supposed” to be temporary. For me I am much more interested in inks that don’t fade so my tattoos will continue to look good when I’m 90!

Hear me out- using this ink for artists to use for color dot testing for all skin types before large pieces. Also for newer artists with their first pieces with the promise from the shop to get a discount on covering or reworking the piece later on. I know touchups should be free but with the lower price of an apprenticeship tattoo this makes sense to me

I really can undersstand people being desparate to cover it or get rid of it. But if Ephemeral are currently offering a refund at the 3 year mark, anything you do to it could invalidate their future claims, like having laser after 18-24 months... if it goes badly you will have no place to get a refund or even sue them, unfortunately. As much as it sucks, it is probably best to stick it out til the 3 year mark and apply for a refund or look into legal action. And only the once that is sorted out go for any kind of corrective stuff, whether laser retinol treatments, or a cover up. This is probably more so important if you are within that year 2-3 where you have more chance of getting a refund those in 12-24 months. Those tattoos were really expensive, as I recall, like thousands of $, so it seems wise to me to hold out because if you can secure the refund it will cover some or all the corrective treatment. I could have sworn though, that when you covered them last time (when they had shut all but one studio, I think) they were offering something like "disappears within 2 years or your money back". Though it is possible I hallucinated that lmao. I am curious, if Ephemeral was created during PhD work...did they get their PhDs based on this whole fading tattoo ink creation? If so, imo, they should be stripped of them.

If people want to sue them they should talk to their state's attorney general. The position often files class actions for consumer protections. Also the effects of a waiver can wildly vary. There's a reason that you can't sign a contract allowing a person to murder you and have it hold up in court. Some things are not waivable. Fraud will make a contract void as well.

There are already semi-permanent tattoos, like ones sold by inkbox, that fade in a few weeks. Of course, this is a different concept, but they're being advertised basically the same way, so I don't blame people for being misled
I know that cosmetic tattooing, like getting makeup tattooed on, often can fade and has to be redone so it's often considered sort of semi permanent, but I don't think that this was done the same as that.
I don’t blame the customers at all, temporary can be appealing, but personally if I am going to pay hundreds of dollars to have something drilled into my skin with needles it better be permanent. I have a few tattoos (some of questionable design decisions) but if any of them faded I would be pissed. But personally, if something hurts it better be permanent to some degree or I choose when it goes away (like piercings). I feel so bad for these customers because it seems like they didn’t really choose something they loved since it was “temporary “ and now they have to deal with all the pain and healing of getting it and dealing with it without even a fond memory of the process

Before I got my very first tattoo, I used an eyeliner pencil (and sometimes a sharpie), and drew a simplified version of my tattoo design on my arm every day for a couple weeks. It helped get the general idea, size, and location just right, and also got me used to a strange new mark on my body. 15/10, easy to remove, would repeat in the future.

the crazy thing is if you know how tattoos work and how they stay in the body it literally doesn’t make sense what they promise. they literally become part of your immune system when macrophages in the dermis eat the tattoo ink that they are then unable to digest so the ink sits inside of it until that macrophage dies and the next one comes along to eat that one and so on and so on. either the macrophages can digest it or they can’t. if they can break it down the tattoo wouldn’t last past the healing period at all…
You could make the ink more toxic on purposes to make them die faster, or increase how quickly it breaks down into way smaller sections so you need less cycles of macrophages to get the ink away Both probably aren't ideal
I got one almost 3 years ago and it's just now STARTING to fade. It definitely will not be gone by the 3 year mark. Thankfully, I was doing a favor for my friend that worked there and didn't pay for it. (They were "interviewing" tattoo artists to get a job there.) As someone that's pretty tattooed already, the entire concept was so weird to me and it's pretty clear the founders did not take into account tattoo culture in general.

Doing anything to help speed up the fading process might screw you over in a lawsuit. They can blame the scaring or lack of fading on any actions you take that are not in alignment with the suggested aftercare.

Can I just say - I work in skin cancer removal in Australia, and our doctors use the Fitzpatrick scale. It isn't racist, its a good indicator of risk factors for skin cancer, and therefore groups together different complexion types.
I think the issue is that it gets misused a lot, for non-skin-cancer-related colour typing. As in, conflating race & ethnicity with Fitzpatrick skin type. I'm not 100% sure, so I could be wrong, but I think that's why some people don't like it.
The switch to only selling the ink instead of owning the studios themselves sounds like an attempt to shift future legal woes as a result of their ink onto the artists themselves and not taking accountability for their (probably still) faulty product...
The whole thing is a big mess 😬. I just wanted to mention a company that I got some temporary tattoos from back in October this past Fall. It’s called Inkbox. I was both looking at possibly getting an actual tattoo and wanted to see how I felt about them on me and I thought it’d be kinda fun for Halloween. I bought 4 (and was given an extra little one of a spider web). They took about two days to develop and the ones I got lasted about a week, maybe a few days longer. But they faded out nicely. To no surprise the ones with darker/heavier line work took longer to fade completely. The tattoo I got of the anti-possession seal from Supernatural that was blacked out was the largest and was the last of fade out. I remember that Inkbox had tattoos that could last a bit longer though (and the placement and amount of direct sunlight were other variables). Sorry for the long comment but I just thought I’d mention it. (And yes I am still really considering getting a tattoo (possibly more) at some point).
The problem with trying topical cremes is the ink is below the top layer of skin. They still put the tattoo, its the ink. Sun makes some inks fade... ? I hope they get a class action suit against ephemeral.

I assume they have calculated that it is better to give refunds than to have class action lawsuit. I bet that they have some fine print somewhere that says that by accepting the refund you agree not to sue them. And the refund is the least they could do. People will be spending money on cover-ups, laser removals... imagine that you planned a tatoo for summer, to have it fade over the winter, you had it somewhere visible. Now you are going on 2nd summer with some ugly faded mess. This could amount to additiional money in lawsuit (loss of enjoyment of life or some other clause). The refund is the least they could do really. Actually, they should reach out to their customers and offer it.
I work in research and development that's not even biological and "hundreds" of test tattoos is not enough to launch a product. Imagine if a medication were only tested a hundred times. They've never released control data to test effectiveness against traditional inks and have never discussed potential skin reactions. The lack of testing tells me they're either negligent, ignorant, or deceptive and have been using traditional ingredients in their formula

I think it was in the late 90s early 2000s a friend got a temporary tattoo, it lasted more than a decade.

@aeridollz if you accept the refund, you most likely won't be able to sue - that would be deemed to be compensation & therefore, if you accept the refund, the situation is already "rectified". If they've got any sense at all, they will also make you sign something to that effect before issuing the refund.
Any one else think it's very... interesting (read: SUSPICIOUS!) that the time Ephemeral claim it takes for the tattoos to fade, lines up with the amount of time they've been around? Last year when they'd been open 2 years, it was "within 2 years", the year before it was one year, now that they've been around for 3 years, that's how long it takes.They never had a clue how long these were going to last and they still don't. I bet you any money, this time next year it'll say "made to fade within 4 years".
They've basically been experimenting on the general population with absolutely no idea what they're doing. NOT ACCEPTABLE!

The uneven fading was probably worse than the longer fade time. A lot of the ones I've seen end up looking like scratchers, which is the worst outcome for their customer base.
Seriously!! A large portion of people scared to get a permanent tattoo are probably scared of getting a tattoo that looks bad and being stuck with it forever. Now they’re guaranteed to get a tattoo that looks bad, that they didn’t really plan out, for an indefinite period of time. Brutal.
When I was little my older cousin got a tattoo on her ankle (30+ years ago). She told her parents and my grandparents that it was a special ink that would disappear after a year. It's only been since ephemeral tattoos did all this that I realised that was a lie to chill out our family 😂. Wonder how that bee tattoo is holding up for her? 😂

My worry with closing the studios and selling the ink to traditional tattoo artists is that when it doesn’t fade in a few more years, Ephemeral will blame the artists for applying it wrong and tell the clients to sue the artists instead
I don't understand why people just experiment with henna. It'll fade fast and if you want it to last longer, go over the design until you decide you want to go permanent or continue the fading process. It's super forgivable and still feels good to have something that lasts longer than a day.
it also fades way more nicely than temporary tattoos, without the stickiness and crumbling. lasts a good 2-3 weeks. its so weird that no one thinks of it at all

Also, I'm sure you can get a custom temporary tattoo (you know the ones we all had as kids) for cheaper than this. Get you manufacturer to do a bunch of sheets and you can basically have it for as long as you like.
I believe some people can be allergic so it's best to be careful
@@liamcollinson5695 the issue in that case is usually not henna itself, but stuff people add to it to extend shelf life, make it any colour but brown, etc.
Those things like PPD (used to make it black) are what cause you to develop an allergy and have an allergic reaction most of the time.
Essentially if the henna is not brown stay away
This whole thing was a MESS. They rushed it to market, didn't do anything like the necessary amount of testing and research beforehand, used polymers notorious for being unreliable and NOT breaking down consistently, hired inexperienced tattoo artists and then promised something they cannot guarantee! I hope there's a class action lawsuit in the works because I personally don't think just getting a refund is acceptable. Rectifying a botched ephemeral tattoo is likely going to cost more than the original tattoo to cover it up or rework it, and laser isn't an option because the guys who came up with this ish didn't bother to even consider the possibility that the tattoos might not fade exactly as advertised! They were deliberately misleading and reckless with people's bodies for a quick cash grab and frankly, that is disgusting behaviour, and they've STILL got the audacity to claim that all Ephemeral tattoos will "100% fade away"! Into the bin with them!
A single health professional could have told them that dissolving stitches don't reliably dissolve. That's fine for stitches that can get removed manually, not something that's literally inside your cells! What a disaster

In another comment someone said they could have been transparent about it from the beginning, said it was in the testing phase and that they weren't sure yet what was possible/how long they'd take to fade etc and people still would have got tattooed, but with the understanding that it might fade or it might not and I agree! They just wanted to make as much money, as fast as possible.

@TheElf_Online oh yeah, we all did bring that up to her. She was insistent it was an 'even more special needle than that', and wouldn't hurt at all. She'd wanted her ears pierced for ages but was terrified of the pain so it was the only way her parents were able to convince her to go through with it. And no, she was not very happy when she found out it did still hurt.

Loved my ephemeral at first… but it was meant to be 9 months. I had a great experience and loved my design, but it looks like shite now. It has been 1.5 years… they NEVER reached out to any of us ( how hard could it be as they have our info) to tell us about the 3 year mark. Honestly anyone with ink still showing after 1.5 years should be given our $$$ back AND let us know if it can be lasered. Sad thing is, when I got mine, a mother was with her teenage daughter getting multiple “temp” tattoos. I just hope they still like them!

If the money was an issue and the ink was already semi-okay, they could have started earning money already without lying by selling people a bit cheaper 'test tattoos'. If I knew the ink was 100% safe I would definitely be down to get a tattoo like that, I'd just make sure it's something I wouldn't mind having on me for the rest of my life. If they did it this way, they'd know to change the ink, they have more time to do that, they'd already be earning money, some people would have a faded tattoo and therefore success, and some people would have a cool tattoo thatd normally cost more? Just make sure the consent forms are very clear and completely signed.
One of my favorite tattoo artists is a former Ephemeral artist. I chatted with another client around an appointment and they were one of her ephemeral clients, she covered the piece for free. I believe the piece was old. I think it says allot about her integrity when she has had to deal with drama with industry of tattoos, let alone this problem with ephemeral. She had a good experience working there and was happy to have a regular paycheck and it helped her today.
The fact that they could have marketed the ink that only lasted a few days to be used for medical reasons and could have made money that way. there are people who need to get small dots for different treatments but have reasons they dont want permanent tattoos and well most will do it because its for health reasons think jow much nicer it would be for them if they could know its wasn't going to be permanent.
I feel people would probably like inkbox to help with temporary tattoos and placement that actually works and looks quite good. (I’ve used it for placement planning for a tattoo I’ve been planning to have for several years)

Thank you for staying on this and bringing it up. tattoos for the most part, are a permanent body modification. These people were scarring people for life by giving them these tattoos under false pretenses.
Their customers went to them because they trusted that the CEO and this business knew what they were doing, and they were failed and deceived by these jerkwads. Ephemeral Needs to be held accountable and if nobody talks about it, it might just get swept under the rug.

The way this product was initially advertised was as a fun, no commitment means of getting a tattoo that they essentially guaranteed to fade within 12 months. The cases Lauren mentioned in this video probably doesn't even scratch the surface of the number of people who are dissatisfied with how their Ephemeral tattoos are holding up. I find it really concerning that in cases where the tattoo does appear to be fading as advertised the skin appears scarred. There are ways to minimise the appearance of scars, and there are ways to cover scars, for example with make up for a temporary fix, or with tattoos as a permanent fix. But my understanding of scarring is that the body creates scars to quickly heal the body after the skin experiences a trauma. Because the body is doing this quickly, the resulting scar tissue is not as strong as non-scarred skin. I am sure different factors come into play like size of the scar, placement, individuals etc., but I have seen figures of around 70% (so the scarred skin is around 70% as strong as non-scarred skin). So even if the scars fade, given time and treatments which may or may not work in reducing the appearance of scars, the integrity of the skin will still be permanently damaged. So... yeah.
Good point! Especially with bigger surfaces, this could pose a serious problem.
I know from my own experience that scar tissue can also be way more sensitive to temperatures, so that's also a thing that might happen if the scars are big/deep enough. (Granted, mine is a scar from an old OP, so obv. it's pretty deep. These tattoo scars might act differently. Still, getting unexpected burns on a scar really sucks and I don't wish that on anyone.)
My body scars differently in different spots. On my back I get keloid scars (thick, raised, rope like scars that itch for years) but on my legs my scars are flat and just slightly different color than the surrounding skin. Another difference between the two locations is that the ones on my back are from surgical mole removals (deep into the dermis) while the ones on my legs are more superficial from falling down as a kid. Scaring isn’t an exact science and everyone scars differently. That’s why I find it interesting that people would go through the pain of having ink drilled into your skin and then the scaring and healing process (which you are never quite sure how the body will respond) for something that is “supposed” to be temporary. For me I am much more interested in inks that don’t fade so my tattoos will continue to look good when I’m 90!

Hear me out- using this ink for artists to use for color dot testing for all skin types before large pieces. Also for newer artists with their first pieces with the promise from the shop to get a discount on covering or reworking the piece later on. I know touchups should be free but with the lower price of an apprenticeship tattoo this makes sense to me

I really can undersstand people being desparate to cover it or get rid of it. But if Ephemeral are currently offering a refund at the 3 year mark, anything you do to it could invalidate their future claims, like having laser after 18-24 months... if it goes badly you will have no place to get a refund or even sue them, unfortunately.
As much as it sucks, it is probably best to stick it out til the 3 year mark and apply for a refund or look into legal action. And only the once that is sorted out go for any kind of corrective stuff, whether laser retinol treatments, or a cover up. This is probably more so important if you are within that year 2-3 where you have more chance of getting a refund those in 12-24 months. Those tattoos were really expensive, as I recall, like thousands of $, so it seems wise to me to hold out because if you can secure the refund it will cover some or all the corrective treatment.
I could have sworn though, that when you covered them last time (when they had shut all but one studio, I think) they were offering something like "disappears within 2 years or your money back". Though it is possible I hallucinated that lmao.
I am curious, if Ephemeral was created during PhD work...did they get their PhDs based on this whole fading tattoo ink creation? If so, imo, they should be stripped of them.

If people want to sue them they should talk to their state's attorney general. The position often files class actions for consumer protections. Also the effects of a waiver can wildly vary. There's a reason that you can't sign a contract allowing a person to murder you and have it hold up in court. Some things are not waivable. Fraud will make a contract void as well.

There are already semi-permanent tattoos, like ones sold by inkbox, that fade in a few weeks. Of course, this is a different concept, but they're being advertised basically the same way, so I don't blame people for being misled
I know that cosmetic tattooing, like getting makeup tattooed on, often can fade and has to be redone so it's often considered sort of semi permanent, but I don't think that this was done the same as that.
I don’t blame the customers at all, temporary can be appealing, but personally if I am going to pay hundreds of dollars to have something drilled into my skin with needles it better be permanent. I have a few tattoos (some of questionable design decisions) but if any of them faded I would be pissed. But personally, if something hurts it better be permanent to some degree or I choose when it goes away (like piercings). I feel so bad for these customers because it seems like they didn’t really choose something they loved since it was “temporary “ and now they have to deal with all the pain and healing of getting it and dealing with it without even a fond memory of the process

Before I got my very first tattoo, I used an eyeliner pencil (and sometimes a sharpie), and drew a simplified version of my tattoo design on my arm every day for a couple weeks.
It helped get the general idea, size, and location just right, and also got me used to a strange new mark on my body. 15/10, easy to remove, would repeat in the future.

I have the same opinion of Ephemeral i had when I first heard about it. It shouldn't have been a thing in the first place.
the crazy thing is if you know how tattoos work and how they stay in the body it literally doesn’t make sense what they promise. they literally become part of your immune system when macrophages in the dermis eat the tattoo ink that they are then unable to digest so the ink sits inside of it until that macrophage dies and the next one comes along to eat that one and so on and so on. either the macrophages can digest it or they can’t. if they can break it down the tattoo wouldn’t last past the healing period at all…
You could make the ink more toxic on purposes to make them die faster, or increase how quickly it breaks down into way smaller sections so you need less cycles of macrophages to get the ink away

Thankfully, I was doing a favor for my friend that worked there and didn't pay for it. (They were "interviewing" tattoo artists to get a job there.)
As someone that's pretty tattooed already, the entire concept was so weird to me and it's pretty clear the founders did not take into account tattoo culture in general.
Also to add to the fade chart, there's absolutely no way the tattoos would fade that evenly. Mine is coming out in random spots faster than others.

Doing anything to help speed up the fading process might screw you over in a lawsuit. They can blame the scaring or lack of fading on any actions you take that are not in alignment with the suggested aftercare.

Can I just say - I work in skin cancer removal in Australia, and our doctors use the Fitzpatrick scale. It isn't racist, its a good indicator of risk factors for skin cancer, and therefore groups together different complexion types.
I think the issue is that it gets misused a lot, for non-skin-cancer-related colour typing. As in, conflating race & ethnicity with Fitzpatrick skin type. I'm not 100% sure, so I could be wrong, but I think that's why some people don't like it.

I just wanted to mention a company that I got some temporary tattoos from back in October this past Fall. It’s called Inkbox. I was both looking at possibly getting an actual tattoo and wanted to see how I felt about them on me and I thought it’d be kinda fun for Halloween. I bought 4 (and was given an extra little one of a spider web). They took about two days to develop and the ones I got lasted about a week, maybe a few days longer. But they faded out nicely. To no surprise the ones with darker/heavier line work took longer to fade completely. The tattoo I got of the anti-possession seal from Supernatural that was blacked out was the largest and was the last of fade out. I remember that Inkbox had tattoos that could last a bit longer though (and the placement and amount of direct sunlight were other variables).

(And yes I am still really considering getting a tattoo (possibly more) at some point).
The problem with trying topical cremes is the ink is below the top layer of skin. They still put the tattoo, its the ink. Sun makes some inks fade... ? I hope they get a class action suit against ephemeral.
Inkbox does custom stuff too. Just go with one of those if you don’t wanna commit or can’t get ink

I love that they're like "the reason it doesn't fade is bc the artists aren't using it properly". At the same time, the only way to get an ephemeral tattoo is through an independent artist that just had to buy the ink and watch probably a 10 minute training video. Seems to me like they'd want the tattoo artists to be one of their "controlled variables" but ig not
I assume they have calculated that it is better to give refunds than to have class action lawsuit. I bet that they have some fine print somewhere that says that by accepting the refund you agree not to sue them. And the refund is the least they could do. People will be spending money on cover-ups, laser removals... imagine that you planned a tatoo for summer, to have it fade over the winter, you had it somewhere visible. Now you are going on 2nd summer with some ugly faded mess. This could amount to additiional money in lawsuit (loss of enjoyment of life or some other clause). The refund is the least they could do really. Actually, they should reach out to their customers and offer it.

I work in research and development that's not even biological and "hundreds" of test tattoos is not enough to launch a product. Imagine if a medication were only tested a hundred times. They've never released control data to test effectiveness against traditional inks and have never discussed potential skin reactions.
