    The raid on Joan’s home caused her anguish and undue distress. Her son Eric said his mother was so upset she wasn’t able to get to sleep that night and didn’t even lay down to sleep till around 6am the next morning. When she woke up later on her son said he tried to get her to eat something. She responded she wasn’t hungry and didn’t feel well. She was mid-sentence with her son when she collapsed and died. Upsetting a 98-year old, especially to the point they can’t even sleep, can cause a prolonged surge of stress hormones and precipitate a cardiac event. It’s sad but true.

      A tiny fall or UTI can end their lives, so imagine what a full on police invasion into your safe space would cause 😢

The elderly are known to be particularly vulnerable to physical manifestations of stress like heart attacks and strokes

      Yes, it seems so. Poor lady couldn't sleep that night, nor eat the next day. She died shortly after the invasion of her home.

Too many times corrupt cops get shuffled around rather than facing any type of real justice. Same with teachers too. If it's public record the guy had no right stopping the paper from posting about it nor harassing them over what they post. Why are you defending dirty cops?

      Exactly! From what I've been hearing it can be difficult to file charges against a sitting judge / magistrate. It might have to be through a disciplinary hearing. The best punishment would be for us to keep the heat on Laura Viar 24-7 and force her to resign in disgrace. But in general, we have allowed a system of laws to be put into place that protect judges, prosecutors and police way too much from their misconduct. All under the name of preserving law and order

      My grandfather was a judge, and I think that's part of the reason that my grandmother told people he wasn't home. The sheriff's department would show up at his house with warrants because his house was easy to get to. They count on judges signing them just to get them away from their door, but he wasn't going to do that.

      It just came out in the Wichita paper four days ago that the magistrate in this case, Lori Viar, also has a history of drunk driving. She was arrested in two other counties (not Marion county, where she was the prosecutor at the time), for DUI in 2012. Apparently officials in the second county did not find out that her driver’s license had already been suspended in the earlier case-or about the existence of the first case.
      It looks like she refused to cooperate with her diversion requirements in the first case to seek an alcohol and drug evaluation and refused to cooperate with her attorney. All that happened was that that it was extended for six more months. I don’t know what happened in the other case, where she drove off the road and into a school building. Probably not much, because neither county knew about the other incidents.
      I’m not surprised this happened, when there is such a history of acting without consequences. As a former small town Kansas resident, it’s immensely satisfying when small town corrupt officials finally have their shitty behavior held under a magnifying glass and shown to everyone, because I can guarantee this wasn’t the first time this kind of thing has happened.

Typically judges don't sign off on shyt without a legal basis, it's also typical for cops to lie as often as they breath so

    It was horrible to watch police antagonize a 98 yo woman in her own home for hours! Of course this cruel behavior contributed to her death and prevented her from becoming a centurion. 😢

    Photo shot of the actual search warrant on another legal channel shows it listed absolutely no evidence whatsoever to justify the raid, as they are legally required to do. The local magistrate was complicit. Which is why the DA required everything seized in the raid be returned to the paper and the family. The police performed an illegal raid and a woman died because of it.
    Should be an interesting 4th Amendment lawsuit.

    Oh my stars! A petty, small little man who joined a police force, lost his job with that police force for inappropriate behavior, and then got another law enforcement job, where he proceeded to abuse his authority?       I mean, didn't they check his references? We all know that they cannot say why someone left or if he was in trouble for misconduct. BUT, if you call up a reference and all they say are dates of employment and don't expound on things like "I so miss him in the office/you will love him just like we did...", That is the time to bypass that applicant. There are ways around the legal blocking of work references, as we all know!

    There aren't many newspapers like Marion's left in this country; I feel sorry about the police and their very unprofessional behavior. When warrant approval is delegated to Magistrates, who are locals and may have an axe to grind, this unfortunately is what can happen.

      The simple way around this is swift and harsh penalties for those officials who should choose to violate citizens rights. So long as we have immunity to some people given by them selves, there can be no justice. They hold themselves to a significantly lower standard they they hold the average citizen.

    Every time I think I’ve seen the lowest rung of humanity, I realize there is a layer just beneath. Seven young officers tossed her house? Where were they raised? Who brought them up? This lady was 98. If they really thought there was something in the house, one officer could have knocked on the old girl’s door and said, “Ma’am, could we have a chat when you have a free moment.”

    By raiding the newspaper and taking all their computers and files, the police were effectively attempting to close down the paper and put it out of business. They knew the owners did not have the money to replace the seized equipment and continue to publish the paper. Luckily, a neighboring town’s newspaper stepped up and allowed them to use their resources to continue to operate.

    I’m so angry about all the police misconduct and disregard for the first amendment. This case and the Maui governor/ police chief are just the ones we hear about. They have the power and will do anything to silence us… including a raid on a elderly disabled woman in her own home. Our country is failing apart.

    What sort of person would stand around in a group and watch an elderly woman in a walking frame become more and more agitated over their unwelcome presence? These people are police officers and would be well aware of the stress that their actions were placing on the woman, yet none of them seemed to try and lower the concerns of the lady by withdrawing from her home? Did ALL of them need to be in plain sight of her? How proud they must've been felt, showing the power they can wield over her? Disgraceful!

      Sooo cruel. Especially from seeing her on the tape, Joan seemed to be in remarkably good health physically and mentally for a 98 year old. Unfortunately her little home, serenity and private belongings were violated, and she went into shock afterwards. She could easily have had much more life to live. Elder abuse..disgusting behaviour from " protect and serve" advocates.

      Another fact I don't see anyone mentioning is that the restaurant owner had never gotten her driver's license restored and continued to drive illegally for years. How was she able to qualify for a liquor license for her restaurant?

    I barely heard a snippet of this last night, thanks for all the details! In my personal opinion, if that raid had not happened that woman would not have passed away the following day. 🙏🏼 Also, who doesn't know that everything you do whether it be criminal or traffic is all public record??? Even bodycam footage can be requested.

      There's a thing called the freedom of information act. If my son was one of those officers I'd be so deeply, deeply ashamed of him. Did it make them feel like big men bullying a 98 year old woman?? If I had been told I was raiding a 98 year old woman's house I'd have said no I'm fxcking not! 7 officers for an old lady?? I'm surprised they didn't get swat and set off a flash grenade at 4am.

    that old lady was great, she told those cops right where to go. I think it very rare for someone that old to commit crime. the moment those cops seen her they should have known there was a mistake and left while apologizing profusely for the intrusion. instead, they carried on like a bunch of mindless meat puppets.

      Yes, the raid team could have averted this tragedy by acting in a humanitarian way. No 98 year old should be alone with this.

    Wow it all sounds so trivial but you know that this little media outlet really got under the skin of some powerful people, the big fish in a small pond kind. It seems pretty obvious that they had the ability to make them regret messing with them, and they used that wherever they believed that they could get away with it.
    I feel so very sorry for the 98yo mom. What a horribly invasive and scary experience that clearly had her feeling stressed and unsafe, and for no reason other than spite. Seeing her backed into a corner and trying to protect her supposedly safe space was very sad. That just felt like elder abuse

      Restaurants are often set up as corps or separate legal entities. I don't see any necessary connection between a businesses liquor license and an owner's personal driving record that has a 15 year old violation on it. How are those two things related? I would think there would be a statute of limitations anyway.

      @@gosolxsolar I think it's because state law prohibits issuing liquor licenses to applicants with DUI convictions. Anywhere on the premises of any business. Applicant, in this case, was the owner. They never should have been given the license in the first place.

    I live in Reno County, not far from Marion.
    I subscribe to their newspaper because it is one of the best, in my opinion, in the area and as our Newspaper was bought out by one of the big Corporations.
    I'm outraged about this. It is unconscionable and is on the edge of unconstitutional, let alone harassment with no probable cause against a person of delicate heath.
    Just despicable and I hope they are taken to court and that the family gets Justice for the early demise of their loved one !

    Excellent as usual. But the one thing your story doesn't go into in-depth is the magistrate who authorized the warrants. Legal experts have said that it should have been obvious to any magistrate that the searches were illegal. They also said that too often the warrant process is just a way for police to launder their lack of probable cause through a complicit local judge. Her name is Laura Viar, and she has at least one DUI conviction in her own past which might make her sympathetic to the café owner's own past with a DUI. I think it's crooked all the way through. The DA was smart to quickly do the right thing and wash his hands of it

    Joel Ensey is the name of the county attorney that approved of the warrant before changing his mind after the fact (and with a little push from KBI). His sister in law owns the hotel that Karis restaurant is in. The liquor license was in the Ensey (hotel owners) name and expires at the end of august. The county attorneys brother (Hotel owners Husband) use to be the local hospitals CEO until an article the Marion Record wrote about some shady happenings there. He resigned shortly after. The vice mayor who's home was also raided by police has been a target of the mayor from asking some tough question regarding hundreds of thousands of dollars missing from the city.

    I live in Marion County, Texas, lol, in a small town with an equally small weekly newspaper. I had a subscription sent to my sister-in-law in Wyoming as this was her hometown. When she finished reading the paper, she sent it on to her Oregon relatives who absolutely loved it. You never know what people will be interested in.😊❤️💙

    Dr. Grande, there are a few details you unfortunately missed in the video. Reason for the newspaper obtaining information about the restaurant owner's 2008 dwi conviction, is because said conviction would prevent her under state law, from obtaining a liquor license for her restaurant. The paper also never published the story but did report the possibility of the restaurant owner driving while suspended to the police, which likely set the whole thing in motion. There is also speculation the police department knew of the woman's suspended license yet never did anything about it due to her political connections. The event where the reporters were asked to leave was a speech by a state political representative of the Republican party. Moreover, given the fact both prosecutors and the local judge signed off on the warrant, reeks heavily of widespread county corruption which is unfortunately all too common in small Midwest towns.

    The paper got an tip about Kerry's dui. They decided not to publish anything about it because they thought that it originated from her estranged husband: they were in the process of divorcing. Shortly thereafter Kerry brought up the matter at a city council meeting, apparently accusing the paper of malfeasance in obtaining the information. It was only after Kerry made her DUI and driver's license suspension public herself that the newspaper published an article defending itself from her accusations. Prior to Kerry's complaint at the city counsel meeting her driving record was not known by the general public.

    A bar owner with a liquor license who is driving without a valid driver’s license because of a DUI is 100% a valid story to report on. Did she really follow other laws, such as not serving people too much or not serving folks she knew were driving drunk? It’s valid to be concerned by her behavior considering her role in the community. That poor woman spent the last hours of her life worried her son may be arrested and her legacy ruined, that is so very sad.

    This case has so many layers. You could have made this one a couple hours! It’s interesting that the judge had at least one previous drunk driving conviction, but nothing on record as for her sentence. It’s like it disappeared or she was never sentenced ! Also, the chief prosecutor either owns or closely related to the person who owns the hotel where Kerri Newell leases to have her restaurant. The are all in cahoots!!!

      The major and police chief had a meeting but the paper isn't saying what they said because they aren't talking. There is absolutely no reason for Mag and Kari's husband to be interviewed before any raid was even on anyone's thoughts. That doesn't make sense either. The paper has an article about it.

    It was ridiculous to issue a general search warrant for a newspaper office. The warrant was issued by a magistrate with 8 months experience on the bench; unaware of the 4th Amendment, and (impossibly) unaware these were public records.
    What a cluster. And I think it's worth noting that the paper had chosen NOT to publish what they had on the woman.

      Unlike the police officers mother, who was not violated, the paper owners mother, who co-owned it, was protected, as well as the material they seized, under the Shield Law Statute, as well as the the First and Fourth Amendment of the Constitution.     Your sarcastic dismissal of a small town newspaper as only reporting on things like loose cows was the one sour note in this video. Our country has not been made better, safer, or more knowledgeable by the widespread loss of local investigative journalism.     I’m from a village of 2,000 people. It never ceases to amaze me how places of that size in the United States have so many institutions and businesses. My village has one primary school, one shop and two pubs, and that is it. (Actually it also has a university, but that is obviously highly atypical.)       This one actually does have a law degree, and she had been the county prosecutor for years before becoming magistrate.
      But she did have a history of drunk driving convictions, and she may have failed to disclose that. So, she might not have an actual license after all of this is reported to the state Bar association!

    Drunk driving is unacceptable. When one chooses to drink and drive, they're selfishly putting other lives at risk. I've lost 2 close family members to drunk drivers, so it's not an insignificant crime, no matter how many years have passed.
    My heart goes out to that poor little lady, Joan, who passed away due to elder abuse (bullying via a search warrant).

    This woman didn’t want a handful of people in a small town to know that she had a DUI and now the entire country knows about it. And any cop from Kansas City should probably be in jail.

    What a terrible day for the 98 year old lady, her comments show that she had more dignity than the 7 police officers who attended. I sincerely hope that there is a full investigation to ensure this does not happen to anyone else!
    It appears that Gideon’s job history might not be conducive to his current job?
    I have seen reports that police officers can be fired by one US police authority and then gain a job working for another US police authority, I’m not sure if this happens in other US public services such as fire departments etc as well?
    Justice must be served for the sake of the 98 year old lady especially as the video showed how upset she was due to the heavy handed execution of the warrants which had been obtained by false means!

    I'm glad that she was so angry with them. I hope those cops go to sleep at night hearing her call them assholes and wondering if their mom's love them

    That's terrible! I saw the video of the elderly lady protesting the police accessing her home. Poor dear! Don't mess with old people! They'll die just to get even with you!

    I think that the raid on her home and due to her age the police did bring on her death after getting her extremely upset. Sad 😢 there probably won't be any justice for her.

    Oh it’s sad that from now on, I can’t feel your video summaries of other circumstances are thorough to the facts as you left out broadly available details, which are key to the context of this story. The paper chose to not publish a story about the restaurant owner, feeling they were being manipulated by her divorce proceedings, and instead approached the police about the information they were provided, since it was so suspect of intention. Instead of asking the paper for further details, the police manufactured this scheme.
