For anyone who didn't get it:
When you have a trial, and you need some other organization to produce evidence for you - that organization is entitled to ask for costs to be compensated. It makes sense - they spend work hours, paper, printer ink, etc. If someone needs to be deposed or called as a witness - it is reasonable to ask for the time of that person to be compensated accorfing to their wages. Why should a firm pay for you having a lawsuit that doesn't concern them? That is fair.
ACLU's expenses were around 1080 I believe. That is what they are entitled to.
But ACLU didn't want to testify or produce stuff. So they hired lawyers to try to wriggle out of it. They also hired lawyers to go through the requested documents and try to make a case not to disclose them. That failed. And it cost them arounf 85000.
Now,they are NOT entitled to have that compensated. It is their own problem how careful they wanted to be, or if they wanted to fight the subpoenas.
Imagine you having a simple litigation and asking a 3rd party firm to produce a document. And they hire 10 of the top America's lawyers that cost over $5000 an hour all together to fight that request. You should not be asked to compensate that insane expense! This is entirely on that firm.
The only costs that ACLU can ask to be comensated for - are costs that can not be avoided. Like material and time actually spent on producing - not checking or fighting! - but producing the documents you need.

    • @catwomandaphneb5699
      @catwomandaphneb5699 2 года назад

You've discovered where the ACLU's inflated costs come from. Thank you. All they had to do was provide the documents requested but they hired lawyers to suppress what documentation and information they could to absolve their organization of any culpability contributing to Mr Depp's defamation or something like that.
They should have done more research on Mr Depp before backing Ms Heard. They would have found he doesn't have a background of DA. They weren't very smart. I'm so disappointed in the ACLU getting their hands dirty with Heard's quest for fame. And even after Mr Depp wins his defamation case, the ACLU makes themselves look worse by suing a victim of DA for an absurd amount of money when they're only entitled to be compensated for producing legal documents and court testimony.
I'm so disappointed in the ACLU, they're not the organization I once knew and respected.

So now they are attacking him in court over $86K when he has donated hundreds of thousands to them? Talk about biting the hand that feeds you! He's donated more to them than they're asking for. That seems odd for a charity....especially if they could have just sent his lawyer a letter going something like this, "We have incurred some legal costs at the expense of your trial. Instead of asking those costs be repaid we would like to offer you the opportunity to make a contribution to our charity. We also recognize your past donations and would like to extend our thanks for those."

This only happened as a result to AH refusing to turn in documents. Which he then requested them to. Once they said no he had to make a request through the judge. To me that was AH not just lying but withholding information pertaining to the case. She should be held responsible as it deals with her lawyers and her giving writings for op-ed. They didn't come forward with a fee while the case was going on. Requesting payment for the work to collect the information. They waited until after just because AH lost.

From the ACLU COO's testimony, AH wrote the initial draft and the ACLU coordinated with her attorneys in revising the initial and every subsequent draft to make sure it did not encroach on the NDA between JD/AH included in their divorce settlement. The COO produced e-mails and testified that every time AH was sent a revised draft, she returned it with even more DV claims and an insistence to put JD's name in the article (b/c she wasn't malicious. Sure). It wasn't until after several back and forths that AH even mentioned SA. While I believe the ACLU based their input on the claims that AH made, they should not expect payment for the labor required for producing documentation that proved their client's purposeful defamation. AH is the party that convinced the ACLU to get involved. It was their client's false accusations that put them in this situation not JD. There was little, if any due diligence on their part. I 100% doubt that if the verdict favored AH and she needed the ACLU to provide documentation to prove she was in the right, I highly doubt they would be sending her a bill for producing those documents. They are entitled to postage, a ream of paper and a toner cartridge.

I am not familiar with the specifics of American charity law, but in Canada the costs associated with preparing documents, etc for court (I believe that they were called upon to testify, just as the children's hospital was, as to what AH had actually donated) should have been negligible. First, a charity is required to maintain proper books and records, so all they had to do was reference documents that already existed; it was little to no extra work for them (ie, it looks like they're trying to double dip). Second, charities are allowed to spend a reasonable amount of their revenue on "management and administration," which is what their lawyers' fees, staff time, whatever to appear in court would be. Further, given the nature of the ACLU's professed mandate, it seems likely that they have in-house counsel (ie, one or more lawyers on their payroll, working exclusively for them), so, again, this is an attempt to double dip to cover a cost they would have incurred anyway, with or without this trial. Lastly, there is a public interest in maintaining the public trust in charities, and regulators (in the USA, it's the IRS), can intervene when one bad actor is wrecking it for all the genuine do-good organizations. It's a shame that the ACLU is further tarnishing its reputation with these insufferable demands, especially as this breeds more cynicism and decreases generosity and trust in society in general. They are not any random charity; they have long operated as a national watchdog and defender of human rights and civil liberties. Shame on them, stooping this low.

I shifted spending from organizations to humans in front of me. Friends, family, and where I'm guided to step in and give. People don't always ask for help but just see situations and just give. Always keep $60 of kindness money on me just in case.

Or research other charities that might also support your cause and would appreciate your help.

Just be sure not to make any NAACP donations if your intent is to support organizations that actually offer help to minorities. Those people couldn't even give us a list of businesses or any referrals on minority contractors when our house burned down, told us to go see the Urban League 🤨

I agree. I found the representative's testimony shocking regarding the ACLU's aggressive manner they use towards donations. I'm sure there are other charitable organizations, smaller more honest ones, that would be happy to receive your donations. Native American charities come to mind.

Exactly! Me, too. Ive always supported the ACLU, but now Im flabbergasted not knowing what they actually stand for. Maybe it was a regional office, but either way, the entire organization is blemished and under scrutiniy now.

I pulled my monthly donation to the ACLU. Cause of all of this. I cannot believe a “reputable” organization would behave this way.

ACLU should have slunk quietly away hoping Johnny didn't sue THEM in the first place!

Lets not forget. Johnny made the first payment installations directly to the 2 charities she bragged about. Then she was furious and insisted he 'legally' send the $$$ straight to HER, not the charities that she.designated. So that was the end of JOHNNY sending the agreed upon amount of money directly to the charities of her choice. . The rest is history.

ACLU has some nerve! Along with Heard, ACLU defamed Depp. At the least, ACLU owe Depp a public apology for not doing their due diligence properly.
