To be fair, that supervisor is probably one of the best. He probably shovels shit for a living, and many people hate him for being a cop, when he is most likely one of the intelligent and caring officers we all keep demanding to be policed by.
Most probably that only happened because he had see the auditor's video/s and immediately knew what was going on. That is the big difference between him and those other two officers. This demonstrates how incomplete and inadequately officially "properly" trained officers
Nah, he's been on patrol for quite a while, he knows laws and codes and he knew the dude and about his videos. He handled it just fine and with a lesson to the rookie for good. Of course that rookie is screwed as far as promotions go. Cities don't forget when someone costs them money lol
Mr. Supervisor should have trained his officers a little better BEFORE being placed into such a situation in the wild. It would have saved the city a lot of money. The supervisor is as much at fault here as the officer/perpetrator.

From the cop's viewpoint, it was a little creepy when that man starts taking pictures of the police parking lot. So yeah I'd say he was waiting for the cops to confront him so he'd have a case. Not every day people are fascinated by a bunch of cop cars in a parking lot. Most people would be getting the hell out of there.

Your rights end where mine start and you are not automatically entitled to my time regardless of your profession.
Additionally, in an encounter with a cop, they are trying to gather any evidence of any violation of any law. Anything you say can and will be used against you. The 5th amendment is mainly there to protect the innocent, not the guilty. Why should or would you want to help the police in their investigation against yourself by possibly making incriminating or suspicious statements? Outside of select situations where there is officer discretion (traffic stops), the only thing you can gain from talking to the police is jail time.

in some videos the police says its some trained "sign" thing they have that silent or uncooperatetive people are hiding something. Many of these cops that act worse are either rookies, or old angry assholes who have been used to that they are law and no complaints in past have surfaced so they use the power and think that 90s brutality is still ok.
The information that you as a citizen offer law enforcement has so many unspoken implications, even when it's something as innocent as you telling them where you're coming from (perhaps a crime had just taken place there soon after you left), that there really IS no incentive to answer any of their questions beyond the ones you're legally required to.
I tell them with every interaction: "Why would I knowingly engage with folks who the supreme court has ruled can lie to me, and who'll openly admit anything I say can and will be used against me in a court of law? Feel free to investigate and earn that paycheck, but I've done nothing illegal so you won't find anything on me, and in the meantime I'll be here using my right to remain silent."

It seems so frequent that supervisors are MUCH more levelheaded than their deputies. This serves as evidence that training is inadequate and definitely no substitute for experience.

Theres no reason why the supervisor shouldnt get the A+ here. He did everything right, no drama. He got the basic rundown, immediately ordered that the auditor be uncuffed, listened to the auditor and literally invited him in to make a complaint about the matter. It was perfect on the supervisors behalf.

@@Nabsolute_ I do believe lawsuits come out of the city's budget, not the PD. This effectively means less money for repairs and other obligations the city has, which ultimately hurts the taxpayer. City's don't really cut into the PDs budget so they usually pay lawsuits separate from their regular budget.

I have seen it where I work, were an officer/officers/Lt, could not articulate a specific crime/violation of the law and still tried to justify an illegal stop. The sad part was the Chief was on board with the stop and even demoted a Sgt. because the Sgt refused to go along with the illegal stop/detention. I wish I could disclose the details and have Audit the Audit do a video of the incident, but I worry it could cost me my job. There is body cam footage to.

Rosendo Gerrero oh hell to yeah, I agree, this cop was paid while completing a police academy and in most cases is additional to a personally obtained college degree in criminal justice. In other words, he should’ve known better because he was educated in the matter well before that moment.
So why should tax payer have to pay for this? The officers having to pay would serve as further motivation for officers to stay educated and make only legally necessary contact with the community they serve.

Cops often say you have the right to remain silent but don't like it when you remain silent apparently.
They have to read them their rights but it would make their job easier if you gave them information. So cops don't tell you to be quiet they are saying you could if you want to.

He realized that every second longer the man was in cuffs was one more second used against them in the coming lawsuit.

After watching many of these videos I'm starting to realize that there is financial gain to be had doing these videos if you can deal with the discomfort of being detained and possible arrested. I've seen a lot of settlements, all justifiable.

@@greglapointe1311 it is not about the money it's about exposing officer misconduct and making sure they know not to do it to anyone one else regardless of them fully¹ understanding the law of not. *¹ fully: knowing or completly (in this case) know what laws protect you or the officer in question. Doing this for money is sad. These settlements are a result of police departments not charging their respective policy's for the people but rather against the people who theg swore to serve.

Auditors largely do this for money, be it lawsuits (not super common anymore but were once very common) or simply viewers/subs/donations on their videos. They make a good chunk of money if their channel takes off, their channels take off when situations like this happen.

It’s amazing to see the amount of change that this is creating. People assume standing with a sign in a crowd creates police reform but THIS has created much more reform without saying a word. I commend these front-line auditors who create actual change.

I believe the actual grabbing of the arm and spinning him around to face the officer was the big money grabber and not the illegal detainment. The grab could be grounds for an arrest on simple assault charges.

Great police supervisor here. Who trained this officer Romero? Those trainers need to be retrained by this excellent police supervisor. It's great not citizen was injured or killed. Bravely done by the auditor! I love these audits where the police supervisor and the auditor both perform their duties at the highest standard.

officers are insured. It comes from a bond, that is purchased with public funds. Like car insurance when you are liable.

i've seen a guy proposing that they should pay their own insurance and hence would have bigger or smaller ones for their actions. if no insurance want to pay for you (or ask too much) then you can't be a cop, good cops would get bonnus like your car insurance. and i think it's one pretty good solution, i wish my country did that

Yea he knew exactly what was going on, responded immediately with releasing him from cuffs, and told his officers why it was incorrect. Took all of 10 seconds to get it sorted out.

@@winterfell9990 the cops were able to do this. It's simple as a leader those under are in your command. Something as basic as culinary, if a salad goes out wrong, it starts with the chefs to properly train our subordinates. If they make a mistake I look bad, I am held to the standard of how effectively I lead it's simple. 1 person can not be everywhere buy it's his job to ensure those under are an extension of his leadership, knowledge and training. If this dude was just a hustler, the cops under him should have known this was a grift. Cops have know the law and they have to know the streets, how else would they survive. If the captain knew this individual or of similar gifts that cost the city money, his subordinates should have known..he gets a C. The team under him is lacking and that's unacceptable. If they are to have access to military level equipment and gear, these people need the highest training. I expect Navy seal level, my safety is on the line, we need to police who cant handle these situations without bias, just based on the laws. Why is our bar so low. I expect my doctors to also hopefully be the best on the planet as well.
I would think as a supervisor that knows about these kind of activities, would have educated his staff ahead of time, thus the A instead of A+ That's how I interpreted this.

@J Merchan Nearly everything you said here is incorrect. The Officer instigated this illegal detainment and that amount of settlement is considered a nuisance. An auditor can never know how PD will react but present them with a legal dillemna to see how they react. Depending on how badly they react they SHOULD be sued for damages because their mistakes have real life consequences.
@J Merchan Damages in the case you describe would be lucrative. This one is not and is in line with settlements from multiple cases around the country. What do you think should be the resolution for cases like this?

agreed, but unfortunately if you request a supervisor you're not likely to get a captain(usually better informed) but a field sergeant. Often times the sergeants are just as ignorant as their subordinates.
Also in this case he was fortunate enough that the supervisor recognized him and that made things easy,if it was anybody else I don't think it would have been that smooth.
