  • After both sides rested their cases in the Johnny Depp v. Amber Heard defamation trial, Judge Azcarate defined the order of jury instructions. Depp's lawyer Camille Vasquez requested the use of video depositions in closing arguments and the judge said no.

    No matter what happens later, I bet Johnny is better than before, now he knows that everyone knows he is a victim. Many things changed when this trial started.

      You can tell just by his demeanour from the start of the trial to now. About midway through I noticed a marked difference.

    No matter what the jury decide, Johnny Depp went from being made to feel that his life wasn’t even worth living to being able to take the stand and tell the world that he is a victim of domestic violence.
    That’s the story here. Johnny Depp is a survivor !

    I have watched close to 80% of this trial. Two things are clear to me : Depp constantly tried to get Heard to calm down, and during the end of their marriage encouraged her to put together with him letters that would reduce press and inflammatory accusations towards each other. Secondly, for Heard to come out now and suggest Depp was continuing to “bully” her is absurd since he endeavored so hard to minimize damage. Heard obviously is a pathological liar and has endeavored to escalate damage towards Depp.

I find it hard to believe execs don’t care about what will make them the most money. And he’s gonna get the butts in the seats. What else is there?     Can we give some praise to the Judge too? I think she has been brilliant throughout the trial too. Very rational, giving each party to say their piece, rejecting unnecessary arguments from either side and so many other things.

      Except when she tried forcing the metadata expert to answer a "Yes or "No" question that didn't have a "Yes" or "No" answer. Imagine if an attorney asked "Were you wearing a green shirt when you killed the victim? Yes or no." and the judge forced the defendant to answer. Same thing

    This judge has got to be one of the most patient people I’ve ever seen! She’s done a great job keeping this trial on task and running smoothly.

    I like how in the end the opposing lawyers can joke around with each other, because they know that its only a job and nothing personal and I love it.
    Don't hate the lawyers, hate the person they're defending cause one is lying in this case

      Yeah I'm surprised Camille didn't catch AH during her rebuttal when she tried to explain that what she meant was he's unbelievable because he is a wife beater... by telling AH, well, in that case you would have said "Johnny Depp, I, a wife beater, I'm a victim too of domestic violence".     The judge was very impartial, humble, and fair. This was a very great case to witness. Depps counsel was extraordinarily, Heards…well “she was trying”😂

Cracked me up the Trailer Court owner said he was not a fan of Johnny Depp. The guy was a wonderful witness and what little I have seen of Johnny he is humble, grateful for his prestige and not offended if someone doesn't know his work

      The issue is not her writing the op-Ed. The issue is the op-Ed was about Johnny Depp which she denied. Depp sued her for defamation because the op-Ed was about him

      I don’t think that the fact that she wrote it is the problem. The fact that she was referring to Johnny in it was the problem with the Op-ed. So her admitting that she wrote it doesn’t really help them seal the deal. They needed her to say that she was talking about Johnny in the op-ed to seal the deal.

      I believe she is the smartest person in the room. She is human and has her own thinking of who is lying, who is telling the truth, etc. Obviously as a judge she can't drop her own opinion on the matter but she knows.

    I feel like the judge tends to overrule valid objections by Depp's team... and sometimes so quickly that they haven't even finished. She did it during trial & now as well

      But luckily the law doesn't work based on public support. It's based on the law. And the law says defamation is a very high bar, and few can meet it. Johnny is no different, despite broad public support.

    JDs attorneys should have filed a fraudulent evidence claim against AH immediately. He would have won his case immediately and would be able to sue all of the individuals that provided false evidence to remove one of the plaintiffs witnesses. Totally undermining his right to a fair trial. And he wouldn’t have had to disclose his personal information and be wrongfully persecuted by AH.

    I understand the Judge's ruling here, but, at the same time I would had liked to see the counterclaim dismissed. Amber's team never proved Waldman acted with malice. Also, Waldman statements were in response to Amber's allegations about JD, so I dont understand how that even makes sense. But, I see it's sort of a catch-22. At the end, I see why the judge just let the jury decide, because it's safer, and she is putting her trust on the Juries to make the right decision. The judge probably didnt want to appear biased and risk this case being appealed, by siding with JD's team over everything. So I think she is trying to give AH a chance to prove her case even though she is clearly guilty.

    Great judge, very professional. She showed more than once how fed up she was with the media circus and some of the mannerisms by the lawyers, especially AH's side. But she did so outside of the jury's ears so that's fine. At times I got the feeling she was on AH's side just because of the story she narrated. If it were true, how could you not be? But when Heard was called out on her lies by Camille she was stoic and kept cool and didn't allow her lawyers to stop it. That could have gone different with another judge. Judges can keep out much more actual evidence and I'm glad she didn't.

    At 51:08 Depp's lawyer asks some questions, gets answers from the judge, but then Heard's lawyers interrupts the judge and starts answering the questions as well. Feels very odd, like Heard's lawyers are trying to school Depp's lawyer on how a courtroom works.... Seeing as how Depp's lawyer destroyed them the past many days...just a weird moment there.
    Also, it seems like Heard's lawyers are quick to point out all the stuff they don't want Depp's team to have available for the jury. They don't want video from testimony or written statements from anybody. They are acting like they are afraid of the actual information brought out during the trial.

    I called that AH must've been manipulative from the time I heard they got married. Besides his first marriage at 20, he was engaged multiple times, and had a 13-year-long relationship. All without following through with an actual wedding.
    At 48, he married her? What changed? She manipulated him into it. Even the most intelligent people can be manipulated if the other person is good at it.

      Also, at 33:06, the judge dismissed Depp's team's objection to including punitive language. So Heard's team had a victory there, those kinds of damages could be awarded, at the discretion of the jury (usually subject to a potential reduction by the judge after the trial is concluded).

    Attempting to hang the jury on a technicality would be a low blow. Jury instruction should not be determined by attorneys but by the Judge and the rule of law. Why are terms being negotiated in jury instruction? This opens the door to abuses by council, making it possible to sully the whole works.

      This is a unique case with points that have not been heard before in the court. The judge isn’t allowing the attorneys to create the jury instructions but rather argue that certain instructions should be introduced to this case.

      It’s to clarify any issues on appeal. Arguments and objections on jury instructions are put on the record in case judge errs in law or in fact on issuing the jury their instructions. Also this is all sides and court working as a team to get it done so there’s no confusion.

    I've been watching Bredehoft while the judge and lawyers are discussing these jury instructions, and she's making notes and looking up as though she was a student in a law class and hearing all of this for the first time, and she's fascinated by it all. It's hysterical.

    In the comments section of this video, I have seen that some people are having trouble (or in need of a short version for) understanding this video. I get it, it can be confusing listening to a Judge and two legal teams speak mainly in legal terms.
    Speaking of legal terms, here's some of the legal terms and definitions of those terms that are used in this video, that could be helpful to know going in:
    -Jury Instructions - the set of rules that a jury must follow during deliberation, which can consist of national and state laws relevant to the case, and/or precedents set from Case Law relevant to the case. In Depp v. Heard, Case Law will be used as is mentioned in this video (e.g. when speaking of other cases not related to the Depp v. Heard case)
    -Case Law - laws to be followed in relevant judicial cases based off of details of previous relevant court decisions. In Depp v. Heard, previous relevant Defamation cases are used to help define rules that must be abided by.
    To sum up what is going on here, Judge Azcarate is discussing the terms of the Jury Instructions with the legal teams of Mr. Depp and Ms. Heard, where both teams can provide evidence to either support or oppose the listed Jury Instructions. However, it is ultimately the decision of the Judge to approve or deny any proposal from either legal team.
    That's mainly what this video consists of. The approved Jury Instructions will be presented to the Jury before deliberation begins. I hope this is helpful to anyone who may need it.

      This is actually untrue, numbing is equally as likely to be presented in a DV victim as PTSD. Numbing leads to a person being unable to recall or articulate, both verbally and emotionally and can lead to many victims being seen as not credible.
      However, it's so obvious from Heard's abysmal acting and displays of tearless sobbing, recovery from upset and displays of agitation when things aren't going her way, that she's spinning us all a line and as far as I can make out, about 98% of us aren't buying a word of it!
