I am the caller in this segment. Thank you to everyone that offered heartfelt advice. I want to point out that the worry is not just that he will get ahold of the settlement money, but if he even finds out about it he will spend every dollar he contributes to their fixed income. This is a precarious situation. Addiction of all sorts touches every inch of a family.
I knew a couple who the wife got $250k inheritance and the man spent It in one year
It was sad beyond words

Before she gets it, she should file for legal separation.
From experience. I had a job injury settlement in CA. When my spouse and I got divorced she learned that she was not entitled to any of the settlement monies. So she had too pay every cent she spent back.
Talk to an estate planning attorney to set up a trust that protects against him destroying this.

I was 16 when I told my parents to PLEASE get divorced. They stayed together "for the children" (such a cliche, they were just scared and cowards). When they divorced, both of their lives became infinitely better, and the lives of my sibling and I, too. Divorce can be a GOOD thing.

I told my dad to cut off my mom's access yo their bank account because she kept putting them in debt. Just spending on random things that she never uses and won't throw away.

Legal separation would also offer her legal protections.
The mom should give the money to the son asap! Better the son than the casinos. By the time they figure out a legal solution, the funds will be co-mingled and the dad will have access to all the money.

A divorce is not exactly the same thing as a legal separation, it is a separate decree the officially terminates the marriage decree but not necessarily the relationship, whereas a legal separation is a contract between the two parties (sometimes mediated or even court ordered) that stipulates certain conditions about the relationship. Typically it's when the relationship is in practice no longer spousal in nature however I wonder if such a legal separation can be written that only stipulates the financial status while both parties are still in a spousal relationship in all other aspects ? A good lawyer may knor, or perhaps there is zero consideration in all of legal history for such a thing.
I have some serious doubts that malpractice settlements are considered communal property until the funds comingle which they wouldnt if she deposits the money on her son's account.
I know for a fact that those are the rules for inheritances.
It all depends on the State!
Pay him off with half and then divorce for half of the family assets.......Then leave the city

that would be good if you could take over and it could be a trust or do a prenup which he probably won't agree to, but that would be nice if she would just give you the money and keep him from getting his hands on any of it
The son sounds like a good guy but he needs to realize his mother is an enabler and will expect him to take care of her when the money's gone.
A true degenerate gambler would own nothing.

Dude needs to walk away from the situation and let the mother handle her business. The son is co-dependent too. He needs to let his mother make the mistakes and when her husband squanders all the money and she is broke and homeless, then maybe she will wake up. Till then, the guy is wasting his time and energy.

Addiction is everybody’s problem in the family. And those people need love as well. To be called degenerates or other names may be founded but it is very hurtful. All people with addictions are not terrible people but need love and help. A gambling addiction is known to be worse than a drug addiction. And Dave is right it does cause people to do things that they would not normally do. With that being said protecting I loved ones money is important. I hear the word divorce from you guys in this situation a whole lot and I think the root of the whole problem is he has a problem and it has become everyone’s problem.
If the father has no way of turning back and they have received all the help they could get, along with love, and still continues to gamble well knowing the consequences, there is nothing wrong with saying they're a degenerate gambler gambler.

That's funny, virtually every addict I ever met has been a degenerate. Stealing from their own family and such. It's only a problem if you chose it to be. I have no problem whatsoever kicking someone completely out of my life family or not if they prove to be a negative influence. Family in no way, shape or form is an excuse to tolerate toxic BS.
This illustrates exactly why marriage is completely out of date. Yet Mr Ramsey continues to encourage couples to pool assets.

@@d_all_in my mom won't leave her estate to either of us but my brothers think I have an in since I financially support her. I don't want her property regardless and have zero intetest doing business with family. Trust me it is complicated.

His mom can save herself, and choosing not to. If the check comes in her name, and her name only, deposit it at a bank with only her name on it. Invest/retire it. When the dad ask for some money, tell him no. How is this difficult?

kerena only: Any divorce lawyer will find those funds (financial aptopsy), claim they are funds from the marrage and poof, the funds are gone! Leagal advice is far beyond my pay grade on this one!
Stay out of it. They both are adults, if she allows him to spend the money it's on her not you.

K Roddy the hosts of the show recommended that the man who called in should get legal advice for their particular state on that matter. I think that was the best advice they could have given him, because that way his mother will know if she has any options or not.

Statistically speaking women's gambling problems are increasing faster than men's equivalent. Why doesn't Ramsey have *(any)* videos where a woman is the one that has an issue of this nature?
It's not like it's his choice, he can only make a video when somebody calls in to the show about something.
You are correct and there are studies that show why. Unfortunately, I understand it too well.
Women killing men they know is increasing but men killing women they know is exponential, statistically speaking, so it is definitely a bigger story.
