  • The plaintiff purchased a lawn mower from the defendant, but when he got it home, it didn’t work. The plaintiff says the defendant refuses to give him a refund, so he’s suing. The defendant insists the plaintiff had already used the lawn mower for a month before he tried returning it. The defendant believes the plaintiff broke the lawn mower, so he doesn’t owe him anything.

      we all know damn well he had the phone number but didnt want to call because he was angry and he wanted to try and bully the defendant into giving back the money and he even got the police to try to charge the defendant with assault as part of his nasty plan .

      good point , and i learned that if a person is selling an item from their home then its usually in good condition because they know that u know where they live , but i would not trust buying an item from a person that wants to meet me in some public place because that person is not taking any risks by knowingly selling me a bad item .

    I hate the weirdness they’re trying to create about him saying he had a gun. AND? He’s on his property, going into his garage UNINVITED. I would have said I had a damn gun too, tf. You don’t get to do what you want on everyone’s property and expect a pat on the back.

    You can’t confront someone like that at their own home in Florida. That is exactly why we have the Stand your ground Law. The plaintiff shouldn’t have abandoned his mower.

    It worked when he left with it. During transporting it or removing it from his vehicle he could have broken it. It was an easy fix if the plaintiff wouldn't have been a dick. Judge made the right call.

    It's probably the belt. They oxidize with age, get slick and spin on the pulley. He should either dress-up the belt, replace it or bring it to a mower repair place.

    This is one of those cases , seller be very aware... You place an add on a free site to sell an item, invitation for all the weirdos to come right to your residence. When I was living on an acerage I really hated giving out my location to people contacting me to buy what I had listed. You just never know who your directing to your home.

      Yup. I had to call the police on a guy who picked up something for free off my curb. (Never met him) Three weeks later he started emailing me through the site how much he loves a certain distinguishing thing about me (wont say here bc I dont want any more weirdos). Well, I had zero photos of me and never met him, so it was obvious he had to somehow be stalking me. The police chick was awesome and bc I get home late at night, she said she or another officer would continue to monitor my area around that time. I deleted my account and now have to take everything to goodwill. It's a pain but at least Im safe.

      @@pamelahaze3211 totally. I did exactly that when the items are small ,.but its a bit more difficult when your selling large quantities or large stuff..and ive had times when i did load up my van with plans to meet several people,and then some ghosted me.

    I agree with the verdict, but I am also surprised. After the defendant said he resold the mower for essentially the same amount he got from the plaintiff, I thought the judge would return the plaintiff's $120.
    In similar cases, the money was returned because you are not allowed to sell an item twice.
    If the defendant still had the mower, she could just tell the plaintiff to go pick it up (with police escort, of course).
    What made this case different?

      Who agreed with you? Plaintiff abandoned the mower. Defendant can do anything with it.

      He abandoned the property, how long was the defendant supposed to hold on to it. Plus the defendant had it repaired to get rid of it for the second time when it worked fine when it was sold the first time.

      In most cases, the item in question has never been picked up or the buyer is returning it to the purchaser. This is not that.

    I don’t know understand why JM and Doug said that they were *both* hotheads, because the defendant didn’t come across that way at all. The plaintiff had some nerve following the defendant into his garage, and then he wants to complain that the guy “put his hands on him”. 🙄

    Before they even get started, I want to say how pleasant it is to finally see an actual gentleman. The defendant just opened the gate up for the lady with him. I have seen men go through the gate 1st, maybe holding it open after himself for others. Or just letting it flip back towards the other people. Or even letting the lady open the gate for herself, & possibly for him also. Chivalry has nearly vanished nowadays! How sad.

    People are so dumb. I’d never buy anything like that from Craigslist, Facebook marketplace, etc. Maybe clothing or home decor but nothing mechanical or electronics.

    The defendant shouldn't leave his garage door open for any length of time unless it's empty. Even then I wouldn't leave it open.

      Our garage doors are always open when we are outside and frequently when we are inside. Heck, we have accidentally gone to work with them open and sometimes they have stayed open all night (again on accident). Thankfully, we live in a state with open carry and we have great neighbors-both deterrents to theft. The dogs probably help too.

    Devil's advocate here... Did he engage the self-propelled control bar while "test mowing"??? He should have to make sure that it worked, but if he didn't, it WAS advertised as self-propelled... Regardless, buyer beware...

      @tchevrier I use a regular mower to trim up with and have no issues. But some people might have a huge incline or something where a self propelled works much better. I mean they sell them so apparently people buy them.

      I’ve seen so many cases involving people of different races/color, or from other countries. She is OFTEN all smiles and laughs, especially if one of the people is a character. I don’t know why you are sooooo desperate to portray JM as a racist. No one else is buying it.
