I don't use other people's recordings when making my videos but create my own music. Yes, it is not always original music because I'm teaching songs on my channel. Shouldn't the copyright owner be able to only take 5% of my revenue if I'm only putting their material into 5% of my video? That is NOT what is happening. They are revenue sharing the whole video cutting my revenue WAY DOWN or cutting my ability to monetize completely. That's not fair.

I will always get 5 on 5 because I am master arguer. 😂 I think #1 and #3 are so borderline, both opinions are justifiable. #1 could be argued to be sufficiently transformed because there is no audio, and it is a piece of the background wallpaper, and not a featured standalone visual. #3 could be argued to be educational in the sense that it is just relating a segment of actual news, and if anything, would drive more traffic to that news airing. Great video.

You're so sweet! Yeah, you have the big problem. You're doing so well on YT, that a "shared revenue" video really hurts your bottom line. For a lot of us, we'll put up with demonitized videos cuz we don't lose much. Well, ultimately, YT is a private company and so they march to their own drum when it comes to copyright. So, if you went to them and said, "This video is totally legal Fair Use!" They could just say, "So what? We don't technically follow the law." However, YT is a good company and can be swayed by persuasive legal arguments. So, that is a long-winded way of saying, "Yes" you should try. What's the worst that could happen? They could say, "No."
I recently posted a video taken at a Wreath Laying Ceremony at the Tomb of the Unknown Soldier. "Taps" was played for appx. 64 seconds. I received a Copyright Claim for "A Hero's Return". Normally, when there is a content claim, I swap out the music from RUclips's Audio Library. But, in this case, the "free" version was longer than the one in the video. So, I disputed the claim. I argued (in good faith) on two fronts: Public Domain, and Incidental Use. Public Domain: because Taps had been written in the 1800's and is now in the Public Domain Incidental Use because the playing of Taps is traditional at Military Funerals and Public Ceremonies honoring the Military Dead. Since this video was taken at a Public Event at the Tomb of the Unknown Soldier, featuring music traditionally played at such events, it was a Fair use under the Public Domain and Incidental Use theories. The Copyright Claim was removed in about 3 days I will be videoing a Memorial Day Ceremony later today. I am crossing my fingers I don't need to repeat this process all over again.

Great series Ian! It will be interesting how this all unfolds in the next few years. I'm sure Casey gets a ton of copyright claims. Big RUclipsr = Big Money. Heck, big companies and even bogus companies are abusing the YT copyright claims across the board (Big and small channels!). I'm not against copyright claims when they are legit. So many aren't.

Even one person who wrote a song and someone else is claiming it as their song and YT is not taking the side of the original artist. As for myself, I've had claims were the song is completely wrong (a completely different song) and on my kids channel I'm getting claimed for my own recordings of traditional/public domain songs. The funny thing is when I look up the publisher's sound recording, they note it as traditional as well. Plus when you dispute the claim, you're disputing with the company placing the claim. Of course, they're gonna reject it. Insanity.

I have a question about using public domain literary work in videos, specifically using excerpts of poetry, novels or reference books. If material is defined as 'public domain', is it allowable to use it freely, without the commentary, critique etc that feature in fair use, across all jurisdictions (US, EU, global)?
But for the soda ban clip with 2 people talking, he did say "there's been a lot of talk about the soda ban", that doesn't qualify as commenting on that clip?
Does the fair use statute relate only to the specific clip used or by the entire work? For example if a clip is used (like the news clip) and then the situation or context provided by the clip is transformative, would that be fair use? I haven’t seen any language in the statute that clarifies this. Thanks Ian you rock!

I always hold my breath a little when I upload a new video hoping that YT doesn't find anything wrong with it. However, there content developers like The Fat Rat are receiving copyright strikes from people claiming to own the material in question. How do you prevent, stop, or revers a strike on material you produced claimed by a Content Pirate?
Ian, you said Casey's use in the last clip was not for advertising but if the video is monetized, it is for a commercial purpose. How about that? If you're using someone's image for a commercial benefit, a re they not entitled to a payment? Seems that's open to interpretation.
Hey Jerry. Really great question! I address this in future videos, but this is where practicality meets the law. Technically, you’re right RUclips videos that are monetized are a commercial use. However, at least in California, the original creator has a larger burden. He or she is got to prove that the image was used for an explicit advertising purpose. In this case, it wasn’t an advertising purpose. However, even if you were subject to different law, and the standard was less , Most of the time it would be hard to prove that your image was tied directly to a sum of money that was made by the borrower creator. There may be some egregious cases out there, where a RUclipsr makes fun of a person, in the video makes the RUclipsr $1 million. But that’s definitely the exception.

I can't remember where I saw/heard/read it now (and it was only earlier today) that fair use may not be considered if you are trying to monetise your video which contains the fair use content. Could this be the case or affect people who do reaction videos? Some of those have thousands of views. Are they NOT monetised? Can they be? I see some who do the "stop and critique" the songs, regularly, others who watch the whole way through, then comment at the end. I understand your 2-5sec clip "rule", but I would think if you wanted to do a true critique of a song, it would be better to stop after a verse or part thereof, but after 5 sec could destroy the 'mood' a song is trying to build. How would these work?
Hey Ian!! Just found your channel and followed IMMEDIATELY. I'm prepping to launch my channel officially after much hesitation due some of the to the subject matter...COMIC BOOKS. I've followed channels such as Comicstorian and Comics Explained for years & I'm curious as to how they're operating in fair use when they're using actual recently published comic books & art or re-telling (paraphrasing ) the actual printed story. I'm looking to do something similar..BUT different as I'm an actual comic book professional artist & lean heavily on the art side but I plan on using others' works in a similar fashion for some reviews & story re-telling. Based on your videos I see SOME alteration (by blotting out the text) but combined with the length of use of the work in the videos sometimes exceeding 20+ seconds, it seems somewhat a gray area to me. Please help before I launch!!

@@iancorzine Thanks Ian. I worry about copyright problems--not so much with RUclips, but with copyright holders. Legal fees can be expensive, even if you do it right. Currently, I have a book of Basic language software programs published (in print--a real publisher) in 1983 that has been copied to a pdf without my permission and given away free. I submitted a DCMA form request, and I'm waiting. It's been 2 weeks. Can I try to sue if they don't respond? The company is in Panama.
IANAL, but I would argue that a mere 24 seconds out of an entire feature-length film, scaled down and in distorted perspective, with absolutely no audio, and not even a particularly visually-striking 24 seconds, is so extremely non-prejudicial to the potential revenue of the original work, and it constitutes such a small portion of the new work, that it very arguably qualifies as fair use. I knew you would say no because the "no" answer said "it's not transformative", which I agree it isn't, but one isn't absolutely required to check that box for it to constitute fair use. Then again, we're using different definitions of "transformative" because commentary and education is also often blatantly non-transformative. It's also true that RUclips would have no problem failing to find Fair Use in this case, and that your emphasis is RUclips policies, not the law, which is arguably appropriate since those policies matter far more than the actual law in most cases.

You're so sweet! Yeah, you have the big problem. You're doing so well on YT, that a "shared revenue" video really hurts your bottom line. For a lot of us, we'll put up with demonitized videos cuz we don't lose much. Well, ultimately, YT is a private company and so they march to their own drum when it comes to copyright. So, if you went to them and said, "This video is totally legal Fair Use!" They could just say, "So what? We don't technically follow the law." However, YT is a good company and can be swayed by persuasive legal arguments. So, that is a long-winded way of saying, "Yes" you should try. What's the worst that could happen? They could say, "No."
I recently posted a video taken at a Wreath Laying Ceremony at the Tomb of the Unknown Soldier. "Taps" was played for appx. 64 seconds. I received a Copyright Claim for "A Hero's Return". Normally, when there is a content claim, I swap out the music from RUclips's Audio Library. But, in this case, the "free" version was longer than the one in the video. So, I disputed the claim.
I argued (in good faith) on two fronts: Public Domain, and Incidental Use.
Public Domain: because Taps had been written in the 1800's and is now in the Public Domain
Incidental Use because the playing of Taps is traditional at Military Funerals and Public Ceremonies honoring the Military Dead.
Since this video was taken at a Public Event at the Tomb of the Unknown Soldier, featuring music traditionally played at such events, it was a Fair use under the Public Domain and Incidental Use theories.
The Copyright Claim was removed in about 3 days
I will be videoing a Memorial Day Ceremony later today. I am crossing my fingers I don't need to repeat this process all over again.

Great series Ian! It will be interesting how this all unfolds in the next few years. I'm sure Casey gets a ton of copyright claims. Big RUclipsr = Big Money. Heck, big companies and even bogus companies are abusing the YT copyright claims across the board (Big and small channels!). I'm not against copyright claims when they are legit. So many aren't.
You know it Edie!! Soooooooo many subscribers are telling me stories of claims against their original work. Even one person who wrote a song and someone else is claiming it as their song and YT is not taking the side of the original artist. It is so frustrating!! 😢😢 I feel so sorry for the legitimate people.
@@iancorzine exactly!! I've seen some YT musicians with that very problem. As for myself, I've had claims were the song is completely wrong (a completely different song) and on my kids channel I'm getting claimed for my own recordings of traditional/public domain songs. The funny thing is when I look up the publisher's sound recording, they note it as traditional as well. Plus when you dispute the claim, you're disputing with the company placing the claim. Of course, they're gonna reject it. Insanity.

Hey Ian - love the tie! This series is really (I mean REALLY) useful. I have a question about using public domain literary work in videos, specifically using excerpts of poetry, novels or reference books. If material is defined as 'public domain', is it allowable to use it freely, without the commentary, critique etc that feature in fair use, across all jurisdictions (US, EU, global)?
But for the soda ban clip with 2 people talking, he did say "there's been a lot of talk about the soda ban", that doesn't qualify as commenting on that clip?

Does the fair use statute relate only to the specific clip used or by the entire work? For example if a clip is used (like the news clip) and then the situation or context provided by the clip is transformative, would that be fair use? Hey Lolaa! Thanks for watching -- was it the right thing? Well, it really is a balancing test. For stuff that is really important to you, you may want to file a dispute but for passing concert footage, I don't know that it is worth it. BUT, it is a lesson to be aware of where you are filming!

Hi ReSmart!! Good catch there. Yes, while I am using Casey's video, I am "transforming" it so it is considered Fair Use and "hopefully" won't get flagged by YT's content ID. I always hold my breath a little when I upload a new video hoping that YT doesn't find anything wrong with it. Ian, you said Casey's use in the last clip was not for advertising but if the video is monetized, it is for a commercial purpose. How about that? If you're using someone's image for a commercial benefit, a re they not entitled to a payment? Seems that's open to interpretation.
Hey Jerry. Really great question! I address this in future videos, but this is where practicality meets the law. Technically, you’re right RUclips videos that are monetized are a commercial use. However, at least in California, the original creator has a larger burden. He or she is got to prove that the image was used for an explicit advertising purpose. In this case, it wasn’t an advertising purpose. However, even if you were subject to different law, and the standard was less , Most of the time it would be hard to prove that your image was tied directly to a sum of money that was made by the borrower creator. There may be some egregious cases out there, where a RUclipsr makes fun of a person, in the video makes the RUclipsr $1 million. But that’s definitely the exception.
Thanks Ian, that's valuable information to know, that intent trumps the eventual result and incidental benefit (monetization) isn't the benchmark. You're providing a tremendous service to RUclipsrs with this channel.

I can't remember where I saw/heard/read it now (and it was only earlier today) that fair use may not be considered if you are trying to monetise your video which contains the fair use content.
Could this be the case or affect people who do reaction videos? Some of those have thousands of views. Are they NOT monetised? Can they be? I see some who do the "stop and critique" the songs, regularly, others who watch the whole way through, then comment at the end.
I understand your 2-5sec clip "rule", but I would think if you wanted to do a true critique of a song, it would be better to stop after a verse or part thereof, but after 5 sec could destroy the 'mood' a song is trying to build. How would these work?
Hey Ian!! Just found your channel and followed IMMEDIATELY. I'm prepping to launch my channel officially after much hesitation due some of the to the subject matter...COMIC BOOKS. I've followed channels such as Comicstorian and Comics Explained for years & I'm curious as to how they're operating in fair use when they're using actual recently published comic books & art or re-telling (paraphrasing ) the actual printed story. I'm looking to do something similar..BUT different as I'm an actual comic book professional artist & lean heavily on the art side but I plan on using others' works in a similar fashion for some reviews & story re-telling. Based on your videos I see SOME alteration (by blotting out the text) but combined with the length of use of the work in the videos sometimes exceeding 20+ seconds, it seems somewhat a gray area to me. Please help before I launch!!

@@iancorzine Thanks Ian. I worry about copyright problems--not so much with RUclips, but with copyright holders. Legal fees can be expensive, even if you do it right. Currently, I have a book of Basic language software programs published (in print--a real publisher) in 1983 that has been copied to a pdf without my permission and given away free. I submitted a DCMA form request, and I'm waiting. It's been 2 weeks. Can I try to sue if they don't respond? The company is in Panama.

IANAL, but I would argue that a mere 24 seconds out of an entire feature-length film, scaled down and in distorted perspective, with absolutely no audio, and not even a particularly visually-striking 24 seconds, is so extremely non-prejudicial to the potential revenue of the original work, and it constitutes such a small portion of the new work, that it very arguably qualifies as fair use. I knew you would say no because the "no" answer said "it's not transformative", which I agree it isn't, but one isn't absolutely required to check that box for it to constitute fair use.
Then again, we're using different definitions of "transformative" because commentary and education is also often blatantly non-transformative. It's also true that RUclips would have no problem failing to find Fair Use in this case, and that your emphasis is RUclips policies, not the law, which is arguably appropriate since those policies matter far more than the actual law in most cases.
Fair use very complicated I better don't use it recently RUclips post a video RUclips said there is no such a thing call fair use we can't and not allowed to use even 1 second other RUclips content that's the truth there no fair use use your own content then its gonna be fair use

1- yes you do he is using film/book to teach/educate/explain as methaphor of things in chapters/scene and the point of things in life change closing chapters and change in life death one person runing things to another- yet did not give vuppola/puzo/towne credit in his sighting or paramonts 1972 distribution or who ever owns the B today- it was educational and omg- 24 seconds out of a 178 minute (3 hour film) it was teaching so I totally do not see it as using to sell godfather or take profit from the film-(he a had to throw the mob thing in and tell the damn story for that- it made you want to go get to cinge watch for those who knew the film and go look up to find out more if you didn't so did the owner a favor to deen one to purchase (or remind me to get it in dvd cause only have it in VHS and (omg changing /transforming the godfather sad thought) so cuppala/distributo whoever highly doubtful would strike it- when considering this guys base at least a quarter of them went to either purchase or rewatched the art in film- just saying the point of vopyright is not to make something off of the use of someone elses stuff (steal and sell, plagiarizer-pass it off as your own- this guy was not doing that at all- not being a pirate -2- if bose or beets did not want there logos seen in public they would not put logos on their merch- looks like he may be changing one to look like the other-so transforming, educational as teaching other to do same -maybe a commentary on cost boise/beets good but one better quality one looks cool or something but again once we buy their stuff we should be able to make it look however based on our maybe not wanting to be bullied/not wanted to be stolen in are area which might consider on cooler than the other- what ever- he wasn''t trying to sell them (yet he as the current owner certainly could -cause they already got their money and taxes already paid ) 3. not cause of Matt but never said what clip was from nbc, not a use for learning about the ban cause stopped to soon to get info or comment on bloomburgs ban so I would say no 4. for exactly for why you said- if out in the world for the world- same with if you in a public place like a mall or plane- well I gues I only disagree with 1

I get this message a lot! "This video was found to contain copyrighted material. It is being monetized but revenue is being shared with the
copyright owner." I don't use other people's recordings when making my videos but create my own music. Yes, it is not always original music
because I'm teaching songs on my channel. Shouldn't the copyright owner be able to only take 5% of my revenue if I'm only putting their material
into 5% of my video? That is NOT what is happening. They are revenue sharing the whole video cutting my revenue WAY DOWN or cutting my
ability to monetize completely. That's not fair.
