I got 4/5 right. I would argue with you about #2 (the one I got wrong) because the attribute was not added (probably automatically) until they got caught by content ID. If the owner wanted to do a takedown then it wouldn't be fair use.
It’s a real hassle dealing with these fair use laws I wouldn’t mind if anyone used my song if I were a famous singer etc. but it is what it is on RUclips.
I am so so tired of a certain company that is nailing my videos for copyright infringement when I literally pay for the music from legitimate royalty free companies. I am at the point I am not going to bother with music at all. Because its a matter of time before there are issues with even youtube library music I figure.

I tried to exchange it with one of there newer songs. The software screwed up doing the swap and I gave up. RUclips has hit me with three CRSs since I've had my account in 2006. I think I won 2 out of 3 CRS. After 4 years working with the Hot For Words RUclips channel, they wore me and Marina down. We both only on rare occasions make a video.

Ultimately, you are not violating copyright law if the music is incidentally in the background. You just have to be aware of RUclips content I.D.

I just got a video taken down today. I used a 10 to 20 second clip of a lady missing a train while I explain how Amtrak will leave you if you don't get to the train on time. It is a 13 to 15 minutes video and I used 20 seconds or less. I disputed it and RUclips said I didn't give them enough information.

Before this I made sure I followed youtube policy and that video I made was comic dub and I voice over it. And credit the original author owner and I made clear at the first opening of the video that is non-profit Eng dub. When I upload it 5-6 days ago and there was no restrictions problem until a unknown user issued a turndown video without explanation. And when I research on this "comeso GmbH" have many victims on RUclips mostly targeted small youtubers.
