"You're Making Me Physically Uncomfortable By Filming Me...I Do Not Appreciate It"

  • For this audit I collaborated for the first time with ‪@SeeBS2‬ to document outside this restaurant along the public sidewalk. Soon after I began my documenting , one of the wait staff who was heading out toward the outdoor patio said as he walked by , don't film me. A short time later one of the managers who resembled Jack Black made contact with me , wanting to know the purpose of my recording. When I declined to give any details, he claimed that my recording was making him uncomfortable & the waiter again made an appearance claiming the California is a two part consent state when it comes to recording...not when it comes to recording anything in plain view from a public space. The waiter also stated that my recording was making him physically uncomfortable, so I suggested some 2ply tissue or some preparation H since he seemed butthurt by my cameras. He then stated that my comment could be implied as hate speech regarding hemorrhoids as a medical condition . We were ultimately met by two managers , the Jack Black doppelganger approaching once again to give us a cam back up close. The female manager appeared to get on her phone to place a call to police possible. We didn't see any law enforcement in the vicinity while we were there documenting as we were in the area for almost an hour documenting. A local newscaster was also in the area , doing a story across the street about the rise in incidents with the homeless population in the area.

      i know, right. my city (nyc) just made an ordinance for those sheds to stay up year round. drivers dont like it and residents dont like it either. rats love it. i wonder if i just stand outside without a camera if they would ask me to move along. im going to try it.

    You should pull the property lines and see if they have built that patio on public property if he wans to be a jerk about freedom in public, you can push back too. If you find they built it on city property then you can file a complaint with the city to have it removed.

      That might be true here...

    I love the response of, "I choose not to," to the demand of "I'd like you to tell me what you are doing." A lot of public photographers say, "I can't discuss it," and then prove themselves wrong by discussing "it" by saying they can't discuss "it". If they can talk they 'can' discuss "it" ... but choose not to. By stating you choose not to you cut to the heart of the matter and educate more directly. Nicely done. ❤

    I know this totally isn’t the point of the video, but I don’t think The city should give restaurants approval to build seating on public sidewalks and public roads. All those people walking by have to go through a narrow area with waiters going a crossed, they have to make awkward eye contact with all the people sitting in the open area.

    One-party and two-party consent applies to surreptitious/secret recordings. Thanks to auditors like First Amendment Rights, everyone should know we don't need anyone's permission to record in public.
    Every business owner and manager should be required to know where their property lines begin and end. They should also be trained on how to handle the media. That includes any citizen who is exercising their right to record in public. Never miss an opportunity to present your business in a positive light!

    The number of people that stop and photograph and record buildings, restaurants, etc. is so plentiful that for these clowns to be so offended and uncomfortable is ridiculous. Before audits were a big thing on RUclips, I used to go around and do the same just to share places I've been, seen, want to check out later, share with friends and family, etc. and for those that serve the public---they are in the wrong profession.

    I don't understand how a private establishment can use a public sidewalk for their business. Do a public records request to find out if they are paying the city and, if so, where that money is going. That would be VERY interesting. Here even for the annual city sidewalk sale certain rules must be followed. Outside displays must not impede traffic and cannot be left out overnight. Only benches and flora displays.

    In my City there's no license to use the public sidewalk as a private dinner so this would be unlawful. You see this kind of outside dinners in malls or private businesses but never on a public space 👍👍

    Amazes me -- in a day and age where practically everything and every one is being recorded, plus the fact that just about everyone with a phone has a camera, people walk up to a camera person and ask 'what are you doing' -- it should be obvious -- but to some, it isn't. In a day and age where anyone for any reason, can end up on social media in a matter of minutes, you'd think (knowing this) folks would behave accordingly. ...and of course, the cam-back. Once they remember they have a camera, they record the cameras recording them. 🙂

    When someone says, "You're making me feel uncomfortable," the proper response is, "No. I'm not. I'm not saying you're not uncomfortable, but I'm not the one making you feel that way. You are choosing to feel uncomfortable. I'm responsible for my thoughts, actions, and feelings, and you are responsible for yours, and how you respond to others. Not me."

      That’s why they’re called emotions. You don’t necessarily make the choice to feel a certain way. Something can be sent to you and your reaction may be to feel anger. It’s not like you consciously said OK I’ve been insulted now time to turn on the anger. That’s not how human nature works.

      For everyone else, just remember that one's emotions are not trustworthy, and we should not be led by them.
      For example, suppose some prankster in your office puts a rubber snake in your desk drawer, and when you open it, it pops out at you. Your emotions are going to kick in immediately, and you'll go into some level of flight or fight mode. But quickly, you'll realize there is no danger, because the snake isn't real. But it will take your emotions a while to catch up with what your mind knows to be true.
      That's why we should always lead with the mind, not with the emotions, and learn to govern our feelings so they don't govern us.
      And above all, stop blaming other people for one's own lack of discipline in dealing with emotions.

    That’s a good point “you could look at it as free publicity for your restaurant” just like you told him.
    He could’ve taken a moment to tell you about all the wonderful dishes that they serve, how they love their customers, maybe some history as to when and how they started their restaurant.
    But instead, he kept telling you how he’s a manager and he’s uncomfortable.

      Actually sidewalk seating saved our sm town. The trains arrive two blocks from our downtown and ppl come to dine, enjoy the town center with their kids. One short street was blocked off outside the local ice cream shop & theater. The twn was in bad shape when I moved her with five businesses gone belly up. Today, the seating remains and only one biz left. The plan was put in place at the start of Covid. I appreciate the planning.

    "You're making me physically uncomfortable" is simply not true. "I am physically uncomfortable" is a true statement. You cannot FORCE, or "MAKE" someone uncomfortable. Feelings are what they are, and you have no say in that, but you have 100% ownership of your reactions to feelings - your EMOTIONS. Some people who are low in mental strength have great difficulty in controlling emotions, while the strong minded can deal with situations with ease. The waiter's reactions and statements are typical of many seen on F.A.R videos. The managers, while frustrated, kept their emotions in check. This is a catalog of human behavior.

    The waiter makes me think he is hiding something, other than his face. Maybe he's a wanted man in another state, or maybe an ex wife that he's not paying his alimony. Like the auditor said, "You can get some free publicity for your restaurant." OR you can make yourself and your restaurant employees look like a bunch of a$$holes.

    I want to know how big does one's balls have to be to operate a business RENT FREE on a PUBLIC SIDEWALK and tell a member of the public that they CAN"T film in public?? Also, these people who get butt hurt and pull the CAM BACK always end up looking like absolute fools in the auditor's videos, holding up the cell phones at eye level, arms extended, face in full frame.
